Abstract

Abstract. Demographic bonuses are a hot issue, although they are still limited to population and economic experts, even among other academics the term bonus demography is still not well known. The study has not reached a legal perspective. Some aspects related to the demographic bonus are the implementation of the Sustainable Development Goals (SDGs) until 2030. While the prediction of achieving demographic bonuses by Indonesia in 2020-2030. The series of periods of achieving the demographic bonus, in the analysis of population experts including economists, still "shyly" mentions where the Republic of Indonesia and the Unitary State achieve their welfare. constitutional namely the welfare of society.  Keywords: Demographic Bonus, Sustainable Development, Legal Perspective, Unitary State of the Republic of Indonesia.  Abstrak. Bonus demografi menjadi isu hangat, meskipun masih sebatas di kalangan pakar kependudukan dan ekonomi, bahkan di kalangan akademisi lain istilah bonus demografi masih kurang akrab dikenal. Kajiannya pun belum sampai menyentuh perspektif hukum.  Beberapa aspek berkaitan dengan bonus demografi ialah implementasi tujuan Pembangunan Berkelanjutan (Sustainable Development Goals/SDGs) hingga tahun 2030. Sementara prediksi pencapaian bonus demografi oleh Indonesia di tahun 2020-2030. Rangkaian periodesasi pencapaian bonus demografi tersebut, pada analisis para pakar kependudukan termasuk para ekonom, masih “malu-malu” menyebutkannya di mana bangsa dan Negara Kesatuan Republik Indonesia mencapai kesejahteraannya, dalam arti kata melalui pencapaian bonus demografi, diharapkan bangsa dan Negara Indonesia dapat mewujudkan amanat konstitusional yakni mensejahterakan masyarakat.   Kata Kunci: Bonus Demografi, Pembangunan Berkelanjutan, Perspektif Hukum, Negara Kesatuan Republik Indonesia.

Abstract

Penelitian ini bertujuan untuk memberikan analisis terhadap pengakuan sistem noken sebagai bentuk penghormatan terhadap masyarakat adat yang bertentangan dengan konsepsi Pemilihan Umum sesuai dengan Peraturan Perundang-Undangan. Tipe penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normative yang memposisikan hukum sebagai kumpulan beberapa norma yang tersistematis dan dijadikan sebagai tolak ukur tingkah laku masyarakat (fundamental norm). Teknik pengumpulan data didasarkan pada bahan hukum sekunder dengan menerapkan penelitian kepustakaan untuk mencari, mengumpulkan, dan memahami berbagai literatur hukum, Peraturan Perundang-Undangan, dan asas-asas hukum yang sesuai dengan pembahasan. Data yang diperoleh selanjutnya dikaji berdasarkan cara berfikir deduktif untuk menguraikan dan menghubungkan data akurat dengan permasalahan. Hasil penelitian ini menghasilkan bahwa penyelenggaraan pemilihan umum dengan sistem noken tidak diatur secara tertulis melainkan penghormatan terhadap kesatuan masyarakat hukum adat. Sistem noken telah bertentangan dengan asas-asas pemilihan umum yakni asas langsung, bebas, dan rahasia.

Abstract

Kekerasan seksual terhadap anak-anak, merupakan salah satu kejahatan yang sering terjadi di sekitar kita dan memengaruhi anak-anak dari segala usia. Kekerasan seksual terdiri dari berbagai tindakan seksual terhadap anak, seperti inses, pemerkosaan, kekerasan seksual dalam konteks pacarana, hubungan intim, eksploitasi seksual, pelecehan seksual online, dan pelecehan seksual non-kontak. Penelitian ini akan menganalisa bagaimana kejahatan seksual terjadi di Sulawesi Utara serta alternatif model kebijakan dalam pengendalian kekerasan terhadap anak di Sulawesi Utara. Penelitian ini merupakan penelitian lapangan dengan menggunakan metode campuran (mixed method) dengan model The Explanatory Sequential Design yang dilakukan dalam 2 tahap. Pendekatan yang digunakan dalam penelitian ini adalah model pendekatan dengan teori Kriminologi spasial, yang akan melihat bagaimana faktor-faktor eksternal (lingkungan dan desain tata ruang) berkontribusi bagi terjadinya kejahatan kekerasan seksual terhadap anak. Jenis data yang digunakan dalam penelitian ini adalah data sekunder yang berasal dari data kasus kekerasan seksual terhadap anak yang terjadi di Sulawesi Utara antara tahun 2016-2021. Selain itu, penelitian ini juga menggunakan data primer berupa hasil wawancara mendalam dengan korban atau keluarga korban kekerasan seksual terhadap anak. Data-data tersebut akan disajikan dalam bentuk tabel dan dijelaskan secara deskriptif. Analisis kriminologi spasial dapat digunakan baik secara eksplorasi maupun konfirmasi dengan tujuan utama untuk mengidentifikasi bagaimana faktor geografis memengaruhi pola spasial kejahatan.

Abstract

This study aims to analyze the effectiveness of penal mediation efforts in achieving restorative justice and to analyze penal mediation efforts in stopping the investigation and prosecution of criminal cases. The type of research used is normative legal research, relying on and using library data, namely secondary data in the field of law. The technique of obtaining legal materials is by means of library research by collecting legal materials by reading, quoting, recording and understanding various legal literature and laws. The results of the study show that 1) the function and role of the state through penal mediation will reduce the burden on the state in punishing and imprisoning criminals because amicable and compromise solutions can be reached for the creation of restorative justice. 2) Termination of Prosecution because there has been a settlement of cases outside the court as stipulated in PERJA No. 15 of 2020 Article 3 paragraph (2) is the scope of settlement of criminal cases by mediation as an effort to realize restorative justice which is pursued with material and formal requirements.

Abstract

Child sexual abuse (CSA) is a grave criminal offense that profoundly impacts the victims' psychological, physical, and social well-being. While conventional criminological approaches have focused on sociological and psychological determinants, neurocriminology offers a new dimension by exploring neurological and biological correlates of deviant behavior. This paper aims to analyze CSA through the lens of neurocriminology, particularly the neural dysfunctions and brain abnormalities frequently observed in perpetrators. Using a qualitative literature review, this study synthesizes findings from neuroimaging and neuroscientific research. Evidence suggests that abnormalities in the prefrontal cortex, amygdala, and limbic system are significantly correlated with impaired impulse control, emotional regulation, and deviant sexual behavior. These findings emphasize the need for interdisciplinary frameworks in addressing CSA—combining legal, neurological, and psychological strategies to enhance both prevention and rehabilitation. The paper concludes with recommendations for justice systems to consider neuroscientific insights when handling CSA cases.

Abstract

The title of this paper is “The Role of Marine and Fishery Resources Supervision of Ternate in Handling Illegal Fishing”. The object of this research is the action to settle illegal fishing by Technical Implementation Unit for Marine and Fisheries Resources Supervision of Ternate. This paper aims to analyze the how this Technical Implementation Unit settles the illegal fishing crimes in Ternate as well as the factors that influence their actions in handling illegal fishing crimes in Ternate. This paper employed the sociological legal research method which studies and analyzes the legal behavior of individuals or communities, in relation to the law and the data sources used come from primary data. It employed the the conceptual approach, the statute approach, and the case approach. Results showed that the Technical Implementation Unit for Marine and Fisheries Resources Supervision of Ternate resolves illegal fishing crimes namely by carrying out supervision, outreach to fishermen, carrying out routine patrols, verification and validation and carrying out investigations. The factors that influence their actions include the lack of human resources infrastructure facilities and the failure to achieve targets
