Abstract

This study examines the perspective of the juridical status of the implementation of the payment system and its legality dimension in social practice using the statute approach and conceptual approach methodology. To examine the problem of this research method, it uses normative juridical by using a conceptual approach to review and study the research topics raised. The findings indicate that the increasing adoption of payout immediately raises new complexities in users' understanding of rights and obligations in digital contracts. Regulatory uncertainty makes consumers vulnerable to debt traps due to the consequences of late payments, and the risk of personal data leakage increases as the use of pay later services is not equipped with adequate data protection. It is time for Bank Indonesia and the Financial Services Authority to be clearer in identifying concrete steps to improve financial literacy and consumer supervision in line with the development of increasingly developing and innovative pay laters. Based on a comprehensive analysis, it can be concluded that the legal position of the payout mechanism is equivalent to traditional credit agreements in general.

Abstract

As a country with a constitution as the highest fundamental law, Indonesia regulates and distributes state functions to state power organs, which are then referred to as State Institutions. One of the state institutions regulated in the constitution is the State Ministry Institution, which is governed by Article 17 paragraph (1) of the 1945 Constitution of the Republic of Indonesia, stating that the President is assisted by State Ministers. Article 17 paragraph (4) regulates that the establishment, amendment, and dissolution of state ministries are governed by law. This then became a polemic, because the People's Consultative Assembly (MPR) of the Republic of Indonesia had agreed to the Revision of Law Number 39 of 2008 on State Ministries, with one of the important points of change being the absence of a limit on the number of ministries, so that the number of ministries formed and established by the President is in accordance with the needs of state administration. The issues raised in this scientific article are: First, How to Critically Review and Analyze the Revision of Law Number 39 of 2008 on State Ministries from the Perspective or Doctrine of the Indonesian Rule of Law and the Principles of Pancasila Democracy, and Second, Whether the Revision of Law Number 39 of 2008 on State Ministries is in accordance with the Perspective or Doctrine of the Indonesian Rule of Law and the Principles of Pancasila Democracy. The research method used to address the issues in this scientific article is the normative legal research method with a conceptual approach. The conclusion drawn from the problem-solving answers is: First, that the Perspective or Doctrine of the Indonesian Rule of Law and the Principles of Pancasila were not used as guidelines and were ignored by the State in the process of Revising Law Number 39 of 2008 on State Ministries, and Second, that the Revision of Law Number 39 of 2008 on State Ministries does not yet align with the Perspective or Doctrine of the Indonesian Rule of Law and the Principles of Pancasila Democracy.

Abstract

Kajian ini membahas dengan mendalam fenomena alih fungsi mobil pribadi dan angkutan umum menjadi usaha bergerak di Kota Pontianak, yang muncul sebagai respons adaptif masyarakat terhadap keterbatasan angkutan umum dan tekanan kebutuhan ekonomi. Penelitian ini mengungkapkan dampak hukum yang signifikan dari praktik tersebut terhadap pelaksanaan hukum transportasi, terutama terkait pengawasan, penegakan aturan serta ketertiban lalu lintas. Ketidaksesuaian fungsi kendaraan dengan dokumen resmi dan proses perizinan yang kompleks menimbulkan tantangan pengelolaan yang memerlukan sinergi kuat antara Pemerintah Daerah, Dinas Perhubungan, Kepolisian dan Organisasi Angkutan Darat. Kajian ini turut menegaskan pentingnya penguatan aspek hukum dan administratif serta edukasi masyarakat agar alih fungsi kendaraan dapat berjalan secara legal dan terkontrol, demi menjaga integritas sistem transportasi yang aman, tertib dan berkelanjutan. Metode yuridis empiris menujukkan bahwa keberhasilan pengelolaan alih fungsi kendaraan bergantung pada konsistensi penegakan hukum dan kolaborasi lintas lembaga yang efektif. Dalam konteks pembangunan transportasi Kota Pontianak, regulasi yang adaptif dan pengawasan intensif menjadi kunci untuk memberikan kepastian hukum bagi masyarakat sekaligus mendukung kelancaran pelayanan angkutan umum. Dengan demikian kajian ini memberikan kontribusi penting dalam memperjelas cakupan regulasi dan implkasi huku yang harus diperhatikan dalam sistem transportasi perkotaan yang dinamis sekaligus menjadi landasan bagi pengambilan kebijakan yang lebih responsif terhadap kebutuhan aktual masyarakat.
