Abstract

Marriage is an inner and outer bond between a man and a woman with the aim of forming a household that is sakinah mawadah and rahmah. To be able to realize this goal of course requires a harmonious and compatible partner. Islam offers kafa'ah as a medium so that the goals of marriage can be realized. Kafa'ah is equality or equality between a prospective husband and a prospective wife. In Islam, the most important equality that must be seen is in religious matters. Parents or married couples have different kafa'ah standards ranging from a social or religious perspective. For this reason, the research conducted by researchers aims to determine the application of kafa'ah in weddings in Gintangan village. This type of research is field research (field research) which is descriptive analysis in nature. The primary source in this research is the Gintangan village community using a proportional sampling technique, where the data sampling technique takes certain considerations into account, namely people who are married and parents who have married off their children. Data collection techniques use unstructured interview methods and documentation, qualitative data analysis techniques use inductive thinking methods, namely drawing conclusions starting from questions or specific facts leading to general conclusions.

Abstract

The indiscriminate disposal of waste in villages, particularly in Banyuwangi Regency, has become a crucial phenomenon. In addition to the increasing daily waste, the lack of sanitation facilities and the low literacy of the community regarding waste raise concerns. The impacts involve unpleasant odors, environmental pollution, unsightly views, and the potential spread of diseases. Numerous illegal dumping points along riverbanks pose a threat to rice field irrigation. Previous studies primarily focused on factors such as attitudes and education levels, neglecting the anthropological aspects of Islamic law. This research addresses this gap by examining the behavior of rural communities towards waste in Banyuwangi from the perspective of Islamic law anthropology. The study is significant as the indiscriminate disposal of waste persists among rural Islamic communities, despite existing Islamic laws requiring environmental protection. The qualitative research method, specifically explanatory case studies, was conducted in Sarimulyo Village in December 2023. The results indicate a lack of knowledge among the community regarding waste and Islamic law, along with a tendency for non-compliance with regulations.

Abstract

Unlicensed polygamy remains a legal issue in Indonesia as it has implications for legal certainty, the protection of wives’ and children’s rights, and the orderly implementation of marriage. This study aims to analyze the regulation and implementation of Article 402 of Law Number 1 of 2023 concerning the Indonesian Criminal Code (KUHP) in relation to unlicensed polygamy, the relationship between this provision and the mechanism for obtaining polygamy permission under Indonesian marriage law, as well as its compatibility with Islamic legal principles. This study employs a normative legal research method using a statutory approach and a conceptual approach. The data were obtained through library research involving primary and secondary legal materials, which were analyzed using qualitative juridical analysis. The results indicate that Article 402 of the KUHP does not aim to prohibit polygamy, but rather to establish legal limitations on polygamous practices conducted without fulfilling state-mandated procedures. This provision is consistent with the polygamy permission mechanism under the Marriage Law and Islamic legal principles, particularly the principles of justice, responsibility, and maqāṣid al-sharī‘ah in maintaining family welfare.

Abstract

The limited availability of female religious funeral attendants (mudin perempuan) at the village level constitutes a significant concern, particularly because it affects the extent to which the funeral rites of deceased women are conducted in accordance with Islamic legal requirements. This study aims to identify the underlying factors contributing to the shortage of female mudin in Sumbersari Village and to develop an educational and training model grounded in Islamic principles. The study employs a qualitative approach based on participatory field observation. The findings indicate that the funeral rites of deceased women in Sumbersari Village have traditionally been handled exclusively by male mudin, a practice that raises concerns from the perspective of Islamic jurisprudence because it does not adequately uphold the principles of preserving the awrah and dignity of deceased women. These findings are consistent with evidence from community engagement programs showing that limited knowledge and practical skills among women in performing funeral rites remain significant obstacles to the effective fulfillment of fardhu kifayah. This study argues that the shortage of female mudin can be addressed by cultivating collective awareness through systematic education and structured practical training. It therefore proposes a women’s empowerment program at the village level that integrates practical capacity building with Islamic legal and ethical principles. Such an approach not only strengthens women’s capacity to participate in the fulfillment of fardhu kifayah but also contributes to ensuring that the funeral rites of deceased women are conducted with greater attention to religious norms, dignity, and gender-sensitive practice
