Abstract

Tindak pidana Perdagangan Orang merupakan bentuk perlakuan buruk dari pelanggaran harkat dan juga martabat manusia. Tindak pidana ini dapat mengakibatkan korban mengalami gangguan psikis, mental, fisik, seksual, ekonomi, dan social. Dalam tindak pidana ada perlindungan terhadap saksi dan korban yang diatur dalam Undang-Undang Nomor 31 Tahun 2014 atas perubahan atas Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban. Yang kemudian, dalam tindak pidana perdagangan orang korban dapat mengajukan restitusi sebagai ganti kerugian yang diberikan oleh pelaku tindak pidana kepada korban atau keluarganya akibat tindakan yang merugikan korban. Tujuan dari penelitian ini adalah untuk mengetahui apakah yang menjadi faktor dari minimnya pengajuan restitusi untuk korban tindak pidana perdagangan orang dalam putusan hakim yang dimana hal ini jelas sudah diatur dalam undang-undang. di Indonesia prosedur pengajuan restitusi untuk tindak pidana perdagangan orang sudah diatur dan dijelaskan dalam Pasal 48 Undang-Undang No. 21 Tahun 2007, pemberian restitusi dilakukan dalam 14 hari terhitung sejak diberitahukannya putusan yang telah memperoleh kekuatan hokum tetap. Kemudian, dalam hal pelaku diputus bebas oleh pengadilan tingkat banding atau kasasi, maka hakim memerintahkan dalam purusannya agar uang restitusi dapat dititipkan dikembalikan kepada yang bersangkutan. Akan tetapi untuk hal tersebut di Indonesia masih minim diajukan karena adanya kendala terkait impelementasi hak atas restitusi bagi korban tindak pidana yang tidak mudah untuk diajukan.

Abstract

This study aims to analyze the implementation of increased sentencing for recidivists in child sexual abuse crimes in Indonesia and examine the construction of judges' considerations in court decisions. The problem arises because, although laws and regulations regulate increased sentencing for recidivists, inconsistencies in sentencing practice persist. This study uses a normative juridical method with a statutory and conceptual approach. The primary legal materials consist of laws and court decisions, while secondary legal materials are obtained from legal literature and journals. The results indicate that while the regulation of increased sentencing for recidivists is normatively regulated in the Criminal Code and the Child Protection Law, its implementation is not entirely consistent. Judges' considerations are often influenced by subjective factors such as the perpetrator's remorse and social background, resulting in disparities in sentencing. Therefore, stricter sentencing guidelines are needed to ensure legal certainty, justice, and maximum protection for child victims.

Abstract

The sale of babies by biological mothers is a form of human trafficking that violates the law, humanitarian values, and children's rights. This phenomenon demonstrates a shift in the family's role from protector to exploiter of children. This study aims to analyze the legal regulations regarding baby selling from the perspective of human trafficking and the forms of criminal liability imposed on biological mothers as perpetrators. The research method used is normative legal research with a statutory and case-based approach. Primary and secondary legal materials were analyzed qualitatively and normatively. The results indicate that the act of baby selling fulfills the elements of a crime as stipulated in Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking and Law Number 35 of 2014 concerning Child Protection. In Decision Number 328/Pid.Sus/2023/PN Pal, the judge applied the idealist concursus theory because a single act violates more than one criminal provision. The biological mother, as the perpetrator, can be held criminally responsible if she meets the elements of capacity to take responsibility and culpability. Strict law enforcement and preventive measures are needed to prevent the recurrence of similar crimes.

Abstract

This study aims to analyze the application of concursus realis in cases of premeditated murder accompanied by child rape, as well as to examine the sentencing in such circumstances. The research employs a normative juridical method with statutory and conceptual approaches. The results indicate that in judicial practice, concursus realis is applied when multiple independent criminal acts are committed by the same perpetrator within a single series of events. Normatively, Article 65 of the Indonesian Criminal Code stipulates that the sentence shall be based on the most severe punishment increased by one-third. However, in practice, judges do not always apply this mathematical calculation and may impose life imprisonment or even the death penalty by considering the severity of the crime, its impact, and aggravating circumstances. This discrepancy between normative provisions and judicial practice may lead to legal uncertainty. Therefore, stronger juridical reasoning is required in judicial considerations to ensure consistency and transparency in sentencing within the framework of concursus realis.
