Abstract

Guru sebagai ujung tombak pendidikan memiliki peran strategis dalam membentuk generasi bangsa. Namun, dalam praktik penyelenggaraan pendidikan, tidak jarang guru menghadapi permasalahan hukum sebagai akibat dari tindakan profesional yang dilakukannya, seperti tindakan disipliner terhadap siswa. Penelitian ini bertujuan untuk mengkaji bentuk dan implementasi bantuan hukum terhadap guru berdasarkan ketentuan undang-undang tersebut, dengan studi kasus guru SDN Tiuhbalak Baradatu di Way Kanan, Lampung, yang dilaporkan ke polisi karena mencubit siswa. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kualitatif, didukung oleh studi literatur kasus. Meskipun terdapat landasan hukum yang menjamin bantuan hukum bagi guru, pelaksanaannya di lapangan masih lemah akibat kurangnya sosialisasi, tidak adanya mekanisme pendampingan hukum yang jelas, serta minimnya peran lembaga pendidikan dan organisasi profesi dalam memberikan perlindungan hukum secara konkret. Studi ini merekomendasikan perlunya regulasi turunan yang mengatur mekanisme bantuan hukum bagi guru serta peningkatan peran dinas pendidikan dan organisasi profesi dalam menjamin hak-hak hukum guru.

Abstract

The ethical crisis in modern education has become a significant phenomenon in Muslim societies facing the pressures of globalization, digitalization, and materialistic orientation. In the context of Islamic education in Indonesia, particularly in Muhammadiyah institutions, there is a challenge to maintain the spiritual and material balance of the concept of tawazun, which has long been the foundation of classical educational values. This study aims to examine the forms of ethical crises that have emerged, their causes, and the urgency of reintegrating tawazun values ​​into the modern Islamic education system. The research method used a literature review of journals and articles published between 2020 and 2024, as well as an analysis of curriculum documents and educational policies in modern Islamic institutions. The results of the study indicate that the dominance of academic and material orientations (achievement, accreditation, facilities) has shifted the focus away from spiritual character formation; this has led to a decline in students' moral quality, an increase in pragmatic behavior, and a weakening of their sense of social and religious responsibility. The discussion suggests that reintegrating tawazun through curriculum reconstruction, strengthening character and moral education, and implementing a holistic approach to Imtaq Iptek is crucial. This article emphasizes that modern Islamic education must return to the essence of spiritual-material balance in order to be able to produce progressive people who are not only intelligent but also have noble morals.
