Abstract

Globalization has had a significant impact on the sustainability of local culture and traditional heritage in Indonesia. The currents of cultural homogenization and the commodification of traditions often threaten values preserved through customary law. This study aims to analyze the mechanisms for protecting culture and heritage through customary law within a sustainability framework, and to formulate a model for integrating customary law with formal law. The study uses a qualitative approach with literature study methods and normative-empirical analysis. Data were obtained from national and international regulations, scientific journal articles, and empirical case studies such as the practice of subak in Bali and sasi in Maluku. The results show that customary law contains effective internal mechanisms for preserving culture and the environment through collective regulation, rituals, and social sanctions. However, its effectiveness is often hampered by conflicting norms, limited legitimacy in the formal legal system, and globalization pressures that encourage cultural commodification. The discussion emphasizes the importance of an adaptive integration model, including hybridization of regional regulations, co-management mechanisms, dual legal forums, cultural impact assessments, and strengthening the capacity of customary institutions. In conclusion, customary law remains relevant as an instrument for protecting culture and heritage in the global era, but it requires formal legal support to function optimally. Adaptive integration between custom and the state is key to maintaining cultural sustainability while strengthening local identity.

Abstract

This study aims to analyze the transformation of digital kitab kuning usage in the implementation of bahtsul masail at Pondok Pesantren Al Luqmaniyyah Yogyakarta and its implications for knowledge transmission and scholarly authority within Islamic boarding schools. This research employed a qualitative approach using observation, interviews, and documentation techniques. The findings reveal that digital Islamic classical texts are utilized to accelerate reference searches, broaden access to classical literature, and improve the efficiency of deliberative forums. However, digital references remain under the epistemological supervision of ustaz through a verification mechanism of legal arguments. The study identifies a dual- authority pattern in which technology functions as a reference-search tool while ustaz maintain authority over interpretative validity. In addition, the research finds a cross-referencing hybrid practice combining digital and printed texts in legal analysis. These findings indicate that digitalization in pesantren represents not a shift away from tradition, but an epistemological adaptation that sustains Islamic scholarly traditions in the digital era.

Abstract

Abstract

This study aims to evaluate the Lajnah Bahtsul Masail (LBM) Program at Pondok Al- Luqmaniyyah Islamic Boarding School Yogyakarta (PPLQ) uses Stufflebeam's CIPP evaluation model (Context, Input, Process, Product). Although PPLQ already possesses the 2026 LBM Technical Guidelines as a written SOP, a comprehensive evaluation of input readiness and procedural implementation consistency in practice has never been conducted. The study employs a qualitative-evaluative approach, with data collected through document analysis, in-depth interviews, and participatory observation. Data validity was verified through source triangulation. Findings indicate: (1) contextually, LBM represents a strategic transformation from informal study into a structured intellectual forum; (2) in terms of input, human resources and facilities are available, yet the capacity of formulators requires strengthening; (3) procedurally, of five evaluated SOP aspects, one was found compliant, three partially compliant, and one non-compliant particularly regarding digital form submission via Google Form; (4) in terms of product, LBM produces documented fiqh decisions and improved student literacy competence in classical texts. These findings imply the urgency of strengthening digital infrastructure and human resource development as prerequisites for modernizing Islamic studies governance in Islamic boarding schools
