Abstract

Dengan melihat dari sudut pandang auditor keuangan negara dan kontraktor, penelitian ini membahas perbedaan interpretasi tentang kuantitas kontrak lump sum pada proyek konstruksi pemerintah , dengan menelaah pandangan dari dua perspektif utama—auditor keuangan negara dan kontraktor. Studi ini menemukan kesenjangan penting dalam pemahaman kedua belah pihak tentang konsep kuantitas dengan menggunakan pendekatan yuridis normatif. Auditor keuangan negara cenderung berfokus pada kepatuhan ketat untuk menjamin akuntabilitas dan mencegah kerugian negara. Mereka cenderung menginterpretasikan kontrak dan regulasi secara literal. Profil Risiko, dll. Sebaliknya, kontraktor menghadapi risiko finansial yang terkait dengan kontrak lump sum, sehingga mereka sering mengajukan klaim atau perintah perubahan untuk mengatasi situasi tak terduga. Perbedaan interpretasi menyebabkan konflik, inefisiensi proyek, dan kemungkinan peningkatan biaya. Ini juga berdampak pada akuntabilitas keuangan negara. Kompleksitas ini diperparah oleh kesulitan untuk menyelaraskan undang-undang di Indonesia; tumpang tindih antara peraturan negara dan standar FIDIC. Studi ini menunjukkan bahwa upaya besar diperlukan untuk mengatasi perbedaan interpretasi dengan mengembangkan kontrak yang lebih rinci, mengstandardisasi prosedur penanganan variasi, dan mengharmonisasikan regulasi yang berkelanjutan. Tujuannya adalah untuk meningkatkan transparansi hukum, efektivitas, dan akuntabilitas manajemen proyek konstruksi.

Abstract

This study investigates the comparative efficiency of conventional cast-in-situ and steel deck methods for bridge deck slab construction in the Kapuk–Teluknaga–Rajeg Toll Road Project Phase I, Banten Province, Indonesia. The research applies a field-based empirical case study design with a quantitative approach, using primary data from site observations and structured interviews, and secondary data from shop drawings, project specifications, and cost documents. Cost estimation was conducted using unit price-based analysis following AHSP standards regulated by Permen PUPR No. 28/PRT/M/2016, while construction duration was calculated based on actual productivity and activity sequencing. The results indicate that the conventional method required 17 working days with a total cost of Rp 592,003,970, whereas the steel deck method required only 8 working days with a total cost of Rp 553,984,460. These findings demonstrate that steel deck provides a 52.94% reduction in construction time and a 6.42% cost saving. The study further shows that steel deck shifts project cost structure from labor-intensive operations to controlled material-based execution, improving schedule reliability and construction productivity.

Abstract

This study investigates dominant risks affecting time and cost performance in the Prabumulih–Muara Enim Toll Road Project (Zone 5) within the Trans Sumatra Toll Road corridor. The research adopts an empirical quantitative approach using a two-stage questionnaire and semi-structured interviews involving 24 key project stakeholders selected through purposive sampling. Risk variables were initially compiled from literature, project documents, and preliminary site observations, then validated through a Guttman-scale screening process to ensure contextual relevance. The validated risks were subsequently assessed using the Severity Index (SI) to quantify perceived probability and impact levels, and further mapped into a Probability–Impact Matrix to classify risk criticality and prioritize mitigation. The findings demonstrate that dominant risks emerge not only from technical construction factors but also from managerial coordination, procurement delays, logistical constraints, and safety and quality compliance, which collectively intensify schedule slippage and cost escalation. Methodologically, the integrated SI–PIM framework strengthens risk prioritization by combining structured screening, quantitative severity measurement, and decision-oriented mapping, offering a replicable model for toll road risk governance in large-scale infrastructure projects.

Abstract

The application of FIDIC-based construction contracts in Indonesian toll road projects raises significant normative questions regarding their compatibility with the national legal framework. This study employs a normative legal approach, combining statutory, conceptual, and comparative analyses to examine the alignment between FIDIC contractual structures and Indonesian Construction Services Law, the Civil Code, and the Arbitration Act. The findings indicate that while FIDIC reflects common law traditions emphasizing party autonomy, detailed risk allocation, and multi-tier dispute resolution mechanisms, Indonesian law imposes mandatory norms that limit contractual freedom in the interest of public order and legal certainty. Normative tensions primarily arise in clauses concerning risk distribution, variations, claims management, and the finality of dispute board and arbitral decisions. Nevertheless, these tensions do not render FIDIC inapplicable. Instead, adaptive drafting and systematic interpretation enable its integration within the Indonesian civil law system. Proper harmonization ensures that FIDIC contracts remain legally valid while supporting efficiency, certainty, and accountability in the delivery of strategic toll road infrastructure projects.

Abstract

This study examines the governance of construction procurement for a raw water project through Lawrence M. Friedman’s legal system framework, using the District Court for Corruption Crimes in Kupang Decision No. 26/Pid.Sus-TPK/2025/PN.Kpg as the core legal material. Employing doctrinal legal research with statute, conceptual, and case approaches, the analysis treats the court decision not merely as an adjudicative outcome but as an institutional artifact reflecting systemic interactions among legal substance, legal structure, and legal culture. The findings demonstrate that procurement corruption emerges from a cumulative process in which regulatory discretion and fragmented norms enable procedural deviations to escalate into criminal liability. Structural weaknesses are reflected in disrupted accountability chains, limited early detection mechanisms, and ineffective supervisory coordination across procurement actors. Cultural dynamics further intensify risk through the normalization of informal practices, compliance understood as administrative formality, and integrity deficits in bureaucratic decision-making. The study contributes theoretically by refining Friedman’s framework for procurement governance analysis and methodologically by triangulating statutory norms, judicial reasoning, and governance literature to generate prescriptive reforms targeting normative coherence, institutional strengthening, and cultural transformation.

Abstract

The construction of the Probolinggo–Banyuwangi Toll Road (Probowangi) as part of Indonesia’s National Strategic Projects (Proyek Strategis Nasional/PSN) reflects a complex interaction between spatial planning law, agricultural land protection, land acquisition regimes, and the doctrine of public interest. This study aims to analyze the implementation of spatial planning law in the Probowangi Toll Road project, examine the legal implications of agricultural land conversion, and assess the juridical justification of public interest within the PSN framework. This research employs normative legal research using statutory, conceptual, and case approaches. The findings reveal a normative tension between Law No. 26 of 2007 on Spatial Planning, Law No. 41 of 2009 on Sustainable Agricultural Land Protection (LP2B), and Law No. 2 of 2012 on Land Acquisition for Public Interest, particularly concerning the conversion of productive agricultural land. The administrative reinforcement of PSN acceleration through Ministerial Regulation No. 16 of 2025 strengthens central government intervention but potentially reduces regional authority in spatial control. This study argues that regulatory harmonization is essential to ensure that infrastructure development aligns with principles of spatial justice, food security, and protection of land rights.
