Abstract

Law Number 1 of 1974 concerning Marriage and Islamic Law allows a husband to be polygamous as long as he fulfills the specified requirements, including being fair to his wives. However, the law does not provide an explanation and regulation of the meaning and form of justice. Therefore, this study aims to determine the legal ratio of polygamous marriages and fair forms in polygamous marriages. This research uses normative legal research, namely research on secondary data in the form of primary, secondary and tertiary legal materials. The legal materials were collected through literature study. The legal materials that have been collected are then processed and analyzed qualitatively. The results of the study indicate that based on the opinion of legal experts, the legal ratio of polygamous marriages is for the benefit of mankind and preventing immoral acts committed by men. Then according to the opinion of legal experts that the fair form in polygamous marriage is in the form of external justice, and not spiritual justice.

Abstract

Following the background, the problems in this study are, first, the mechanism for implementing procedural law in E-Court for criminal cases in Indonesia, secondly how E-Court accommodates the process of proof in criminal cases in Indonesia. The method used in this research is pure legal research, which refers to and bases on legal norms and principles, applicable laws and regulations, legal theories and doctrines, jurisprudence, and other literature that are relevant to the topic. The results of this study are, firstly, the mechanism for implementing E-Court procedural law is regulated in the Supreme Court Regulation 4/2020 on the Administration and Trial of Criminal Cases in Electronic Courts provides 2 (two) alternatives for conducting trials in criminal cases, namely Normal Courts and Electronic Courts. Such matters are not previously regulated in the Criminal Procedure Code or other procedural regulations. Second, concerning the process of proofing evidence in criminal cases in E-Court still follows the provisions of the normal criminal procedure law and has the same value or power of evidence as normal trials.

Abstract

Port management occupies a strategic position in supporting transportation systems, trade, and regional development, particularly in an archipelagic state such as Indonesia. Nevertheless, the legal regulation of port management still demonstrates the dominance of Central Government authority, which has the potential to weaken the principle of regional autonomy. This article aims to critically analyze the normative disharmony between lex sectoralis in the port sector and lex generalis in regional government law, as well as its implications for the effectiveness of regional autonomy. This study employs a normative legal research method using statutory, conceptual, and comparative approaches. The findings indicate that the legal construction of port management in Indonesia is not yet fully aligned with the principles of decentralization and the development of international practices that position port authorities as relatively autonomous entities. This article recommends the harmonization of regulations and the reformulation of the division of authority in port management in order to strengthen the role of regional governments without neglecting national interests.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk hubungan hukum antara pengemudi ojek online dengan platform digital dalam konteks ekonomi digital berbasis platform serta bagaimana perlindungan hukum bagi pengemudi ojek online terkait keselamatan dan kesehatan kerja (K3). Metode penelitian yang digunakan adalah metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Pendekatan ini digunakan untuk menganalisis peraturan perundang-undangan dan konsep hukum yang berkaitan dengan hubungan kerja serta perlindungan K3. Hasil penelitian menunjukkan hubungan hukum antara pengemudi ojek online dan perusahaan Hasil penelitian menunjukkan bahwa hubungan hukum antara pengemudi ojek online dan perusahaan platform digital diklasifikasikan sebagai hubungan kemitraan, bukan hubungan kerja, namun secara faktual mencerminkan ketimpangan dan dominasi salah satu pihak, misalnya dalam penetapan tarif sepihak, sanksi atas penolakan pesanan, dan pengaturan algoritma yang memengaruhi frekuensi pesanan. Di sisi lain, perlindungan keselamatan dan kesehatan kerja bagi pengemudi ojek online belum diatur secara komprehensif, sehingga menempatkan mereka dalam posisi rentan. Hal ini terjadi karena status kemitraan menyebabkan pengemudi tidak termasuk dalam cakupan perlindungan ketenagakerjaan formal. Oleh karena itu, perlu adanya regulasi yang mengatur perlindungan pencegahan terhadap risiko kecelakaan lalu lintas akibat kelelahan dan kurangnya konsentrasi yang timbul dari fleksibilitas jam kerja yang tidak terkontrol, guna mewujudkan prinsip keadilan dan hak atas pekerjaan yang layak bagi seluruh pekerja digital.
