Abstract

Fenomena “marriage is scary” yang berkembang di kalangan Generasi Z menunjukkan adanya perubahan cara pandang generasi muda terhadap institusi pernikahan. Ketakutan terhadap pernikahan dipengaruhi oleh faktor ekonomi, trauma relasi, tingginya angka perceraian, paparan media sosial, serta budaya digital yang membentuk persepsi negatif terhadap kehidupan rumah tangga. Kondisi tersebut turut mendorong munculnya praktik living together atau hidup bersama tanpa ikatan pernikahan yang sah sebagai bentuk relasi yang dianggap lebih fleksibel dan minim tanggung jawab. Penelitian ini bertujuan untuk menganalisis fenomena “marriage is scary”, faktor pendorong munculnya praktik living together, serta tinjauan hukum keluarga Islam terhadap fenomena tersebut. Penelitian menggunakan metode hukum normatif dengan pendekatan konseptual dan pendekatan perundang-undangan melalui studi pustaka terhadap berbagai sumber hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa budaya digital dan globalisasi telah memengaruhi konstruksi sosial Generasi Z dalam memandang pernikahan sebagai sesuatu yang penuh risiko dan tekanan psikologis. Selain itu, praktik living together dipengaruhi oleh ketidaksiapan mental, tekanan ekonomi, pengaruh lingkungan sosial, lemahnya kontrol keluarga, serta normalisasi budaya Barat melalui media digital. Dalam perspektif hukum Islam, praktik hidup bersama tanpa akad nikah bertentangan dengan prinsip fiqh munakahat, larangan zina dan khalwat, serta tujuan maqashid al-syariah dalam menjaga keturunan, kehormatan, dan ketertiban sosial. Oleh karena itu, diperlukan penguatan pendidikan keluarga Islam, literasi digital berbasis syariah, serta pembinaan pranikah guna membangun kembali pemahaman generasi muda terhadap nilai sakralitas pernikahan dalam Islam.

Abstract

Choosing a life partner is a fundamental step in building a harmonious and lasting family. In modern society, the increasing number of domestic conflicts and divorces reflects the importance of individual readiness in selecting the right partner. Therefore, being selective and communicative are essential considerations in the partner-selection process. This study aims to examine the role of selective and communicative attitudes as a foundation for forming a harmonious family. The method used is a literature review with a descriptive-analytical approach, drawing on data from books, academic journals, and other relevant scholarly sources on interpersonal and family relationships. The findings reveal that a selective approach enables individuals to evaluate compatibility in terms of values, character, background, and emotional and social readiness, thereby reducing the risk of future conflicts. Meanwhile, a communicative approach characterized by openness, honesty, and mutual understanding plays a vital role in building trust, strengthening emotional connections, and resolving conflicts constructively. Effective communication also helps partners understand each other more deeply, anticipate potential problems, and identify appropriate solutions. Thus, the integration of selective and communicative attitudes becomes a key foundation for achieving a stable, harmonious, and sustainable family life.

Abstract

Alimony constitutes a fundamental institution in Islamic family law that regulates financial responsibilities among family members and promotes welfare, justice, and social protection. This article examines the definition of alimony, its legal foundations, and the obligations arising toward former wives and parents within the framework of Indonesian Islamic family law. Employing a normative juridical approach and library-based research, the study analyzes primary legal sources, including the Qur’an, Hadith, and the Compilation of Islamic Law, alongside relevant scholarly literature and legal regulations. The findings reveal that alimony is not limited to material support but also embodies moral and social responsibilities rooted in Islamic legal principles. Its legal force extends beyond the marital relationship, encompassing post-divorce obligations through iddah maintenance and mut’ah, as well as the duty of financially capable children to support dependent parents. These obligations reflect the broader objectives of Islamic family law in safeguarding dignity, ensuring family welfare, and strengthening social justice through legally recognized mechanisms of support and protection.

Abstract

This study examines the legal status, normative foundations, and legal implications of marriage registration in Indonesia through the perspectives of Islamic law and positive law. The research employs a non empirical legal method based on a normative juridical approach and doctrinal legal analysis. Primary legal materials consist of Law Number 1 of 1974 concerning Marriage, Government Regulation Number 9 of 1975, and Law Number 16 of 2019, supported by scholarly literature on family law, legal pluralism, and sociolegal theory. The analysis explores the historical and regulatory development of marriage registration, the relationship between religious validity and state recognition, and the role of registration in securing legal protection for family members. The findings indicate that marriage registration functions as a legal mechanism that bridges Islamic legal principles and state legal authority within Indonesia’s plural legal system. Although classical Islamic jurisprudence does not generally classify registration as a substantive requirement of marriage validity, contemporary legal developments justify its necessity through the objectives of Islamic law and the demands of legal certainty. Registration strengthens the protection of rights relating to spouses, children, inheritance, maintenance, and access to judicial remedies. The study concludes that marriage registration constitutes an essential instrument for legal recognition, family welfare, and substantive justice in contemporary Indonesia.

Abstract

This study examines the historical formation and juridical positioning of the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) within the Indonesian national legal system through a normative qualitative approach. Employing historical and statutory analyses, the research reconstructs the socio-political context underpinning the codification of Islamic law and evaluates its legal legitimacy as a state-recognized instrument. The findings reveal that KHI emerged as a strategic response to the absence of uniformity in judicial decision-making within Religious Courts, which previously relied on diverse classical fiqh references. Its promulgation through Presidential Instruction No. 1 of 1991 signifies a distinctive model of legal integration, reflecting a hybridization of Islamic jurisprudence and national legal principles. The study further demonstrates that KHI functions not only as a practical legal guideline but also as an evolving normative framework shaped by legal pluralism, judicial interpretation, and socio-cultural dynamics. The research contributes to legal scholarship by offering a critical understanding of codification processes in pluralistic legal systems and highlighting the adaptive capacity of Islamic law within modern state structures.
