Abstract

Ketidakhadiran tergugat dalam persidangan perdata dan implikasinya terhadap putusan verstek. Permasalahan yang dikaji adalah bagaimana hukum acara perdata mengatur putusan verstek, sejauh mana hakim tetap harus menilai gugatan penggugat, serta bagaimana perlindungan hukum terhadap tergugat melalui upaya verzet. Penelitian ini menunjukkan bahwa putusan verstek merupakan instrumen untuk menjaga efektivitas persidangan ketika tergugat tidak hadir meskipun telah dipanggil secara sah dan patut. Namun, putusan tersebut tidak dapat dijatuhkan secara otomatis karena hakim tetap wajib memeriksa keabsahan pemanggilan, dasar gugatan, dan kelayakan alat bukti. Di sisi lain, verzet berfungsi sebagai sarana koreksi yuridis untuk melindungi hak tergugat agar tetap dapat membela diri. Dengan demikian, penerapan putusan verstek harus dilakukan secara hati-hati agar tidak mengorbankan prinsip keadilan, kepastian hukum, dan perlindungan hak para pihak.

Abstract

Surat Kuasa Khusus (SKK) adalah persyaratan administratif esensial yang wajib dilengkapi dalam proses persidangan di pengadilan, khususnya ketika para pihak menunjuk atau menggunakan jasa penasihat hukum untuk mewakili kepentingan mereka. Gugatan dapat dinyatakan tidak dapat diterima (niet ontvankelijke verklaard atau N.O.) apabila terdapat ketidaksesuaian atau cacat formil dalam surat kuasa khusus. Penelitian ini mengkaji berbagai jenis cacat formil yang terdapat dalam surat kuasa khusus serta landasan dasar hukum yang menjadi acuan hakim dalam menetapkan putusan. tidak dapat diterima (N.O.), serta implikasi ketentuan hukum yang mengikat para pihak dalam persidangan. Melalui pendekatan yuridis normatif dengan studi putusan pengadilan, penelitian ini menemukan bahwa cacat formil pada surat kuasa khusus terjadi dalam berbagai bentuk, antara lain surat kuasa yang tidak menunjuk perkara secara spesifik, ditandatangani setelah gugatan didaftarkan, tidak memuat identitas para pihak secara lengkap, atau diberikan oleh pihak yang tidak memiliki kesaktian hukum. Putusan N.O. yang dijatuhkan akibat cacat formil surat kuasa khusus berdampak signifikan terhadap hak para pihak untuk memperoleh keadilan dan kepastian hukum.

Abstract

This study examines the settlement of copyright disputes through civil law mechanisms under Law Number 28 of 2014 on Copyright, employing a normative juridical approach with statutory and doctrinal analysis. The research focuses on the coherence and synchronization of copyright norms with civil procedural frameworks, including the Civil Code, HIR, and RBg, in addressing disputes related to economic and moral rights. The findings reveal that Indonesia adopts a declarative system of copyright protection, granting automatic rights upon fixation, yet evidentiary challenges persist due to the absence of mandatory registration. Furthermore, the study identifies structural limitations in civil litigation, particularly in the assessment of damages, evidentiary standards, and enforcement of court decisions. Through interpretative legal methods, including grammatical, systematic, and teleological approaches, this research highlights the gap between normative expectations and practical implementation. The study concludes that strengthening institutional mechanisms, improving legal coherence, and adapting regulatory frameworks to digital contexts are essential to ensure effective dispute resolution and legal certainty in Indonesia’s copyright regime.

Abstract

This study examines the legal responsibility of marketplace platforms for consumer losses arising from electronic transactions within the framework of Indonesian positive law. Employing a normative juridical method with statutory and conceptual approaches, the analysis focuses on the coherence, adequacy, and adaptability of legal norms governing digital commerce, particularly under consumer protection, trade, and electronic transaction regimes. The findings reveal that existing regulations, including consumer protection law, electronic information and transaction law, and trade law, have not yet fully accommodated the complex, multi-party nature of marketplace ecosystems, resulting in normative gaps and fragmented liability structures. Furthermore, the current liability framework tends to emphasize fault-based principles, which are insufficient in addressing systemic risks and technological asymmetries inherent in digital platforms. This study proposes a reconstructed model of marketplace liability grounded in hybrid principles, integrating strict liability, shared responsibility, and risk-based regulatory mechanisms to ensure more effective consumer protection. The proposed model contributes to the development of a responsive and adaptive legal framework capable of addressing emerging challenges in digital transactions while strengthening legal certainty and fairness in marketplace governance.

Abstract

This study examines the juridical status and evidentiary strength of electronic documents as written evidence in breach of contract disputes within the Indonesian legal system through a normative legal research approach. The analysis employs statute and conceptual approaches to assess the coherence between conventional civil procedural law and contemporary electronic transaction regulations, particularly focusing on the Indonesian Civil Code, HIR/RBg, and the Law on Electronic Information and Transactions along with its implementing regulations. The findings indicate that electronic documents have obtained formal legal recognition as valid evidence; however, their evidentiary weight remains contingent upon authentication, integrity, and reliability standards embedded in electronic systems. The study further identifies normative inconsistencies and interpretative disparities in judicial practice, which create legal uncertainty in evaluating electronic evidence. By applying systematic and teleological interpretation, this research proposes a harmonized legal framework grounded in the principle of functional equivalence to bridge the gap between traditional and digital evidentiary regimes. The study contributes to the development of modern evidentiary law by offering a prescriptive model that integrates legal norms and technological validation mechanisms to ensure legal certainty, fairness, and procedural efficiency

Abstract

This article examines the doctrinal and procedural challenges in the application of exception (eksepsi) and counterclaim (rekonvensi) within Indonesian civil justice practice, emphasizing their normative structure and judicial interpretation. Using a normative juridical method with statutory and conceptual approaches, the study analyzes primary legal instruments including HIR, RBg, Burgerlijk Wetboek, and Rv, supported by jurisprudence and academic doctrine. The findings indicate that ambiguities in classification, procedural requirements, and the relational nexus between principal claims and counterclaims generate inconsistent judicial outcomes and weaken legal certainty. In addition, the lack of harmonization between traditional procedural norms and contemporary developments, such as electronic court systems and procedural justice principles, contributes to inefficiency and fragmentation in dispute resolution. The study proposes a systematic normative reconstruction through interpretative integration and regulatory refinement to enhance coherence and predictability. Strengthening the clarity and alignment of these procedural mechanisms is essential to ensuring an effective, fair, and modern civil procedural system in Indonesia.

Abstract

ANALISIS YURIDIS TERHADAP WANPRESTASI DEBITUR DALAM PERJANJIAN KREDIT DENGAN JAMINAN FIDUSIA (Case Study: Putusan No. 850/PDT. This study examines the juridical dimensions of debtor default in credit agreements secured by fiduciary guarantees, with specific reference to Decision Number 850/Pdt.G/2020/PN Mdn. Employing a normative legal research method grounded in statute and case approaches, the analysis focuses on the interpretation of the Indonesian Civil Code and Law Number 42 of 1999 concerning Fiduciary Guarantees, complemented by doctrinal perspectives and relevant jurisprudence. The findings reveal that debtor default manifests not only in the failure to perform contractual obligations but also in the erosion of good faith, which constitutes a fundamental principle in contract law. The study further identifies that dispute resolution mechanisms reflect a structured legal process, yet their implementation remains contingent upon judicial interpretation. Importantly, the court’s refusal to grant fiduciary seizure demonstrates a progressive shift toward balancing creditor rights with debtor protection, particularly in light of constitutional jurisprudence. The analysis underscores the necessity of harmonizing legal certainty with substantive justice through interpretative methods that integrate statutory norms and judicial reasoning. Abstract

Indonesian contract law, rooted in the Civil Code (Kitab Undang-Undang Hukum Perdata / KUH Perdata) inherited from the Dutch colonial era, has long prioritized freedom of contract and formal legal certainty. However, this paradigm frequently overlooks structural inequalities between contracting parties, rendering contracts susceptible to becoming instruments of legalized injustice. This article aims to examine the reconstruction of Indonesian contract law toward substantial justice through four strategic steps: (1) reinterpretation of the principle of freedom of contract, bounded by propriety, balance, and good faith; (2) strengthening of the principle of balance as a corrective mechanism against the unequal positioning of parties; (3) substantive revitalization of good faith as an animating principle throughout all phases of the contractual relationship; and (4) expansion of the judicial role as an active guardian of justice. This research employs a normative legal method with statutory, conceptual, and comparative approaches. Primary legal materials include the Civil Code, court decisions, and relevant legislation, while secondary legal materials encompass scholarly literature and national as well as international legal journals. The findings indicate that true contractual justice cannot be measured solely by the existence of formal consent, but must be assessed against whether the substance and process of contract formation are genuinely fair, balanced, and respectful of the dignity of all parties. A reconstruction of contract law that integrates substantial justice will transform it from a mere instrument of formal certainty into a genuine means of realizing a more just and dignified society.

Abstract

This study examines the effectiveness of court-annexed mediation in civil cases within Indonesian district courts through a normative juridical analysis of Supreme Court Regulation Number 1 of 2016. Employing doctrinal legal research, the study analyzes statutory provisions, legal doctrines, and scholarly literature to assess the coherence between normative design and its conceptual implementation. The findings indicate that the regulation has introduced significant procedural improvements, including clearer obligations, structured timelines, and strengthened roles for certified mediators. However, effectiveness remains constrained by ambiguities in the operationalization of good faith, inconsistencies in judicial interpretation, and limited institutional capacity. Cultural resistance among disputing parties and legal practitioners further weakens the practical realization of mediation objectives. The study highlights that legal effectiveness is contingent upon the interaction between normative clarity, institutional support, and legal culture. It argues for a holistic reform approach encompassing regulatory refinement, capacity building, and public legal awareness. Strengthening these dimensions is essential to position mediation as a credible and efficient mechanism for civil dispute resolution within the Indonesian judicial system

Abstract

This study aims to analyze the protection of the parties' rights in the implementation of e-Court and e-Litigation in civil justice in Indonesia. The background of this research is based on the transformation of the judicial system towards digitalization as a response to the development of information technology in the era of the Industrial Revolution 4.0. The research method used is normative juridical with statutory and conceptual approaches, supported by literature studies of primary and secondary legal materials. The results show that the implementation of e-Court and e-Litigation provides convenience in access to justice through efficiency in time, cost, and transparency of judicial processes. However, there are still several challenges in protecting the rights of the parties, such as the digital divide, low digital literacy, and potential violations of fair trial principles, including the right to be heard and the right to defense. In addition, there are risks of abuse of process and issues related to the validity and security of electronic documents
