Abstract

Current technology has significantly impacted several sectors, including the financial sector. Cryptocurrency is one of the financial technology phenomena currently being widely discussed. Cryptocurrency is a digital currency that holds value and can become a promising asset for its holders. This study focuses on cryptocurrency as collateral from Indonesian and Islamic legal perspectives. This research method emphasizes a rules-based approach, namely, through laws and other legal sources. The findings indicate that Indonesian legal support for cryptocurrency as collateral is valid because it is a movable asset. However, from an Islamic legal perspective, collateral is known as al-Rahn. The use of cryptocurrency as an object in an al-rahn contract is considered invalid. This is because, from an Islamic perspective, cryptocurrency does not fulfill Shariah principles. This asset contains elements of gharar (uncertainty), dharar (potential harm), and maysir or qimar (elements of speculation or gambling), so it is considered unfit to be used as goods (sil'ah) in transactions that comply with sharia.

Abstract

In rem security institutions are fundamentally established as mechanisms to safeguard investments by providing an Executorial Title to ensure the certainty of debt recovery. However, this landscape has undergone a paradigm shift following the Constitutional Court Decision Number 18/PUU-XVII/2019, which degrades creditors' rights and generates legal dualism between Fiduciary Guarantees and Mortgage Rights. Utilizing a normative legal research method with statutory and conceptual approaches, this article demonstrates that the Constitutional Court decision explicitly weakens fiduciary creditors tied to the doctrine of constitutum possessorium by transforming an independent parate execution process that once represented summary justice into a conditional execution mechanism that requires a written consensus on default and the voluntary surrender of the asset by the debtor. This alteration creates a strategic loophole for bad faith debtors, downgrades the status of the fiduciary certificate to a mere piece of ordinary civil evidence, and forces creditors into a prolonged and costly district court bureaucracy while exposing them to heightened moral hazards, such as the concealment or transfer of movable collateral. Furthermore, the comparative normative analysis identifies a sharp disparity that violates the principle of equality before the law and Aristotelian distributive justice, as fiduciary execution is paralyzed by procedural barriers while the Mortgage Law maintains its absolute and direct executorial title without judicial intervention. This imbalance completely disregards the economic characteristics of the collateral, in which movable fiduciary assets undergo rapid annual value depreciation compared to stable or appreciating mortgage objects, such as land and buildings. This means that execution delays caused by litigation cycles risk rendering the creditor's legal protection financially hollow.

Abstract

Maraknya pinjaman online ilegal di Indonesia menuntut peningkatan literasi finansial digital, khususnya pada mahasiswa yang rentan terhadap praktik predatory lending. Kegiatan pengabdian ini bertujuan meningkatkan pemahaman mahasiswa mengenai bahaya pinjaman online ilegal melalui edukasi digital berbasis e-book berjudul panduan praktis menghindari pinjaman online ilegal. Metode pelaksanaan menggunakan pendekatan partisipatif dengan distribusi materi melalui google drive dan evaluasi melalui google form pada mahasiswa. Hasil pra kuesioner menunjukkan 65,8% responden pernah menerima tawaran pinjaman online dengan media sosial sebagai saluran dominan. Kemampuan mengecek legalitas layanan hanya 47,4% sebelum edukasi. Setelah intervensi edukasi, terjadi peningkatan. Responden menyatakan memahami dalam membedakan pinjaman legal atau ilegal, memahami risiko penyalahgunaan data pribadi, dan lebih selektif terhadap tawaran dana cepat. Perubahan perilaku juga terlihat dari penghapusan aplikasi tidak terdaftar OJK. Edukasi berbasis media digital yang sederhana terbukti cukup efektif dalam meningkatkan literasi finansial digital. Namun, pendampingan berkelanjutan diperlukan mengingat masih terdapat responden yang menganggap pinjaman online pada umumnya sebagai solusi praktis. Kegiatan ini berpotensi dikembangkan untuk kelompok masyarakat lain sebagai upaya preventif kejahatan finansial digital.
