Abstract

The development of financial technology (FinTech) has introduced innovations such as Robo-Advisors, digital platforms providing algorithm-based investment management services. In the Sharia capital market, the use of Robo-Advisors presents new challenges concerning compliance with Sharia principles, specifically the prohibition of Gharar (uncertainty) and Maysir (gambling). This research aims to analyze the legal risks of using Robo-Advisors in Sharia stock investment in Indonesia through a normative-juridical approach. The findings indicate that Gharar risk arises from the "black box" nature of the algorithms, where investors do not fully understand the basis of investment decision-making transparently. Meanwhile, Maysir risk can be detected if the algorithm encourages speculative high-frequency trading (churning). From a regulatory perspective, the Financial Services Authority (OJK) and the National Sharia Board-Indonesian Ulema Council (DSN-MUI) need to strengthen algorithm audit standards to ensure that Robo-Advisor operations remain within the valid framework of the wakalah bil ujrah contract without manipulative elements.

Abstract

Perkembangan financial technology (fintech) telah memberikan dampak signifikan terhadap sistem keuangan, termasuk pada sektor keuangan syariah. Fintech syariah hadir sebagai inovasi yang memadukan teknologi dengan prinsip-prinsip muamalah, melalui layanan seperti pembiayaan berbasis teknologi, crowdfunding halal, dan sistem pembayaran digital syariah. Namun, perkembangan tersebut belum diiringi dengan regulasi yang memadai. Penelitian ini bertujuan untuk menganalisis kondisi regulasi fintech syariah di Indonesia, mengidentifikasi kelemahan regulasi konvensional terhadap pengaturan fintech syariah, serta mengkaji urgensi pembentukan regulasi khusus yang bersifat komprehensif. Penelitian ini menggunakan metode yuridis normative dengan pendekatan perundang-undangan dan studi pustaka. Hasil penelitian menunjukkan bahwa pengaturan fintech syariah masih bergantung pada regulasi umum fintech konvensional dan Fatwa DSN-MUI, sehingga menimbulkan ketidakpastian hukum, lemahnya pengawasan kepatuhan syariah, serta rendahnya perlindungan konsumen. Oleh karena itu, diperlukan regulasi khusus fintech syariah yang terpadu, mencakup ketentuan standar akad, tata kelola, pengawasan, perlindungan konsumen, dan mekanisme penyelesaian sengketa berbasis syariah. Regulasi khusus diharapkan mampu memperkuat ekosistem fintech syariah yang inovatif, kompetitif, dan sesuai dengan prinsip hukum ekonomi Islam.

Abstract

This study examines the implementation of sharia business ethics in Nilda Darmin's Shredded Chicken Sambal Processed Food Home Industry. Sharia business ethics, which are instilled are morality, fairness, honesty, and social responsibility, which are considered crucial for the blessings of businesses and MSMEs in Indonesia. The purpose of this study is to find out how the principles of sharia business ethics such as balance, monotheism, free will, obligations, and Iḥsān) are implemented in all aspects of Nilda Darmin's operations, especially in its best-selling product, shredded chicken sambal, since its establishment in 2020 and halal certification in 2024. This study uses a qualitative research design that is field research with case studies. This study shows that Nilda Darmin consistently implements sharia business ethics in the selection of high-quality halal raw materials, clean production processes, transparent promotions, fair pricing, avoiding usury, as well as Iḥsān treatment of employees and social responsibility initiatives. This implementation is not only limited to ensuring halal and product quality, but also building consumer trust to create a positive impact. The implication is that Islamic business ethics need to be continuously improved through the formalization of financial records and the development of more structured social initiatives.
