Pemerintah Daerah Buol menjalankan program Tanah Untuk Rakyat (Taurat) yang membagikan tanah bukan sekedar hak pengelolaan, tapi hak kepemilikan. Kebijakan itu cukup menyentak, sebab menyangkut distribusi tanah di tengah skeptisitas terwujudnya reforma agraria oleh negara saat ini. Secara sosio-politik, tentu bernilai positif, namun muncul problem dari sisi norma hukum terkait peralihan tanah negara menjadi hak milik yang sifat perolehannya turun temurun. Pada kenyataannya Pemda Buol menggunakan Perda No.7 Tahun 2015 sebagai dasar legitimasi kebijakan tersebut. Penelitian ini mengarah pada kajian dasar yuridis Perda dari sisi substansi materil maupun formil menyangkut kesesuaiannya dengan Undang-undang Pokok Agraria No. 5 Tahun 1960 (UUPA) dan Peraturan Perundang-undangan yang mendasarinya. Sekaligus menguji keabsahan Pemda Buol menerapkan kebijakan Taurat. Selanjutnya, penelitian juga mengkaji penerapannya. Metode penelitaian, mendeskripsikan dan menganalisis data melalui studi dokumen dan kepustakaan hukum serta wawancara dan observasi lapangan. Hasil penelitian menunjukkan adanya kesesuaian Perda tersebut dengan asas-asas dan norma UUPA sebagai sumber materil secara substansi serta memiliki landasan yuridis secara formil dari Undang-undang dan Peraturan Perundang-undangan yang berlaku. Sehingganya Pemda Buol memiliki kewenangan atributif menjalankan kebijakan Taurat. Sedangkan penerapannya, terlaksana secara baik. Hanya perlu penyempurnaan melalui aturan teknis lebih lanjut, koordinasi serta komunikasi dan partisipasi masyarakat. The Buol Regional Government runs the Land for the People (Taurat) program which distributes land not just management rights, but ownership rights. This policy is quite surprising, because it concerns the distribution of land amidst skepticism about the implementation of agrarian reform by the state at this time. Socio-politically, of course it has positive value, but problems arise in terms of legal norms regarding the transfer of state land into property rights whose acquisition is hereditary. In reality, the Buol Regional Government uses Regional Regulation No. 7 of 2015 as the basis for the legitimacy of this policy. This research leads to a study of the juridical basis of regional regulations in terms of material and formal substance regarding their conformity with the Basic Agrarian Law no. 5 of 1960 (UUPA) and the underlying Legislation. At the same time testing the validity of the Buol Regional Government implementing the Torah policy. Furthermore, research also examines its application. Research method, describing and analyzing data through document and legal literature studies as well as interviews and field observations. The research results show that the Regional Regulation is in accordance with the principles and norms of the UUPA as a material source in substance and has a formal juridical basis from the applicable Laws and Legislation. So the Buol Regional Government has attributive authority to implement Torah policies. Meanwhile, its implementation was carried out well.
