Abstract

This research reconstructs the concept of iḥtikār based on three āthār (narrations) in Imam Mālik's Bāb al-Ḥukrah from al-Muwaṭṭaʾ and applies it as an analytical framework to assess predatory pricing practices in the digital economy. Departing from the limitations of fiqh literature that narrowly defines iḥtikār as the hoarding of physical commodities, this normative, library-based legal study employs taḥlīl al-naṣṣ (textual analysis), maqāṣid al-sharīʿah (objectives of Islamic law), and commentaries by Mālikī scholars. The findings reveal that the normative construction of iḥtikār in al-Muwaṭṭaʾ has a broader scope, encompassing three dimensions: (1) market access monopolization by holders of surplus capital; (2) destruction of competition through pricing that undermines market structure; and (3) the necessity of systematic and sustainable state intervention to maintain market justice. Based on this reconstruction, predatory pricing practices on digital platforms—which leverage capital power to eliminate competitors, create market concentration, and reduce economic accessibility—are understood as a contemporary manifestation of iḥtikār. The novelty of this research lies in its reconstruction of the concept grounded directly in authoritative āthār, thereby producing a new normative framework capable of bridging the prophetic tradition with competition law challenges in the digital economy
