Abstract

ABSTRACT The Historical School of Law emerged as a critical response to the dominance of the Natural Law and Legal Positivism schools, which tended to formulate rules abstractly without considering the cultural context of society. This article aims to examine in depth the historical development of the Historical School of Law, its contribution to global legal thought, and its implications for the practice of legal discovery in Indonesia. Using a normative legal research approach with a literature review method, this study analyzes Friedrich Carl von Savigny's thinking on the concept of Volksgeist, or the soul of the nation, as the primary source of legal authority. The results show that the Historical School of Law has made significant epistemological contributions to the emergence of Sociological Jurisprudence, Legal Realism, and the theory of legal pluralism globally. In the Indonesian context, this thinking has real relevance in legal discovery, where judges are encouraged not to focus solely on statutory texts but also to explore the values of living law and substantive justice derived from the nation's culture and history. The recognition of customary law and the importance of local wisdom in the development of national law clearly reflects the continuity of the Historical School of Law's thinking in Indonesia.
