GLOBALISASIDAN GENEALOGI STABILITAS DOMESTIK: TANTANGAN DAN KEBIJAKAN TERHADAP PENGUNGSI DAN PENCARI SUAKA Elviandri, Elviandri

Abstract

Factors that cause Indonesia to be selected as a transit country for refugees and asylum seekers, among them are first, Indonesia has a vast marine territory of long coastline, but is not supported by strict rule of law. Secondly, Indonesia's position is very weak in addressing the problem  of asylum seekers and refugees from other countries because it has no national regulations that specifically address the issue. Third, the lack of facilities and infrastructure in handling refugees and asylum seekers. Fourth, the presence of  UNHCR  in  Jakarta  became  a  refugee  attraction.  Fifth,  the  culture  or culture of Indonesia, known for its hospitality, gives the impression that Indonesians can easily accept the arrival and whereabouts of refugees. The setting up of asylum seekers and refugees should be  placed in immigration legislation because the issue of asylum seekers and refugees is a foreigner's (immigration status) problem, which touches on international aspects. The handling of refugees, immigrants and asylum seekers faces several obstacles in the process of handling them: First, Internal Constraints; A) the absence of standard standards in legislation regarding the handling of illegal immigrants. b) The legal vacuum that comprehensively regulates asylum seekers and refugees in Indonesian positive law, weakens coordination among agencies in the field. c) Lack of immigration quarantine facilities to accommodate asylum seekers and refugees, d) Limited regular funds. Second, External Constraints. a) Local Government objected to the additional burden of the arrival of troubled foreigners. b) The often sharp distinction between regional culture and the culture of displaced potential foreigners brings about social conflict. c) Arise of social jealousy of the refugees received free humanitarian assistance in the form of shelter and living expenses, while local residents live in a state of deprivation. Residents do not realize that the aid is not from the government, but from UNHCR and or IOM. D) Often the assimilation between asylum-seeker men and refugees with local women, precisely leaves the child's burden. -the children who turn up when repatriation or resettlement are not brought along.

Abstract

Enforcement of forest fires carried out by formal institutions, such as courts and the government shows a formalist, deterministic attitude, the law is understood narrowly and involutively even uprooted from the ideological / philosophical roots of the Pancasila. The attitude of law enforcers who often ignore the sense of justice of the community with controversial and discriminatory decisions adds to a series of law enforcement problems. This legal paper refers to the object of study, namely the Pancasila Ideology as a paradigm in the Enforcement of Forest Fire Law to Strengthen the Authenticity of Indonesian Wisdom Based on Local Wisdom in Indonesia. In this legal paper uses a philosophical approach to examine in depth the Pancasila Ideology in enforcing forest fires. Sources of material in this paper were obtained from observations, research and literature studies. The laws, especially those related to the Environment, failed to transform the ideological / philosophical foundation of the Pancasila, which had become a value and spirit for the long journey of the Indonesian nation. This happens because there is no or less attention to local wisdom and national interests. The theory put forward by Robert B. Seidman, "The Law of Non-Transferability of Law", concludes that the law of a nation cannot be taken for granted, without having to take over the surrounding aspects (socio-cultural aspects) where the law rests. Borrowing the term Satjipto Rahardjo, law is not in a vacuum, but it is with other social sub-systems, in a wider social system.

Abstract

Al-Ta‘āruḍ wa al-tarjīḥ is a methodology offered by al-Syāṭibī to overcome problems that often arise in fiqh issues faced by the people. This study is a descriptive literature study (library research) aims to determine how the concept of al-Ta‘āruḍ wa al-tarjīḥ offered, with fahm al-naṣṣ methods that exist in its al-Muwāfaqāt. To al-Syāṭibī, no at-ta‘āruḍ (contradiction) in texts but there is a contradiction among mujtahids (Muslim jurists) in understanding the texts. Then, the mujtahids (jurists) should not be in a hurry to do istinbāṭ al-ḥukm (taking out the law) which originated from the ẓāhir contradictory arguments. A depth and universal study toward contradictive postulates seems needed by mujtahid both using their precision and intelligence. Because of the precision and intelligence mujtahids are varying, it causes the appearance of a conflict between mujtahids in looking at the arguments. To find a solution to the problem, the offer is the use of tarjīḥ method, looking for the most powerful arguments, and then serving them as the basis to take a single istinbāṭ al-ḥukm.

Abstract

Abstract

Data on accidents and traffic violations collected by the Riau Regional Police Directorate and from our daily observations illustrates that the level of traffic safety and the level of community compliance with traffic laws / legislation is very alarming, if no strategic steps are taken. in order to increase the level of safety and increase the legal compliance of the community it will cause harm not only to the loss of life and property and psychological but also will cause losses in the economic field. The strategy or effort to increase legal awareness of the community as road users is basically part of orderly traffic. Strategies in increasing community legal awareness include: First, socialization or campaigns to comply with traffic regulations through the installation of banners and socialization. Second, Building the character of discipline. This character building can be started through the teacher's example. Therefore awareness of the instructional teachers is undoubtedly necessary. Security, order, safety and smooth traffic are shared responsibilities. Through this counseling, the character of discipline can be transmitted to all students of Muhammadiyah 3 Vocational School Pekanbaru.

Abstract

Bullying behaviour in a school environment can create a less supportive environment for students self-development, bullying behavior can hurt students, so they feel unwanted and rejected by their environment. This will certainly bring effect to the various activities of the students in the school. Causes of bullying due to family factors, environmental factor, school factors and social environmental factors. Bullying is a student who has a physical or social strength that is more appealing to another friend, has a high temperament, and a sense of empathy is low. Victims of bullying often fight against the perpetrators but some of them are subject to the command of the perpetrator and do not dare to fear. To cope with the well-programed bullying, the current countermeasures only include individual approaches by Walikelas, teacher of study field, as well as BK teachers. Abstract

Tulisan ini bertujuan untuk melihat bagaimana pembacaan kaum feminis terhadap hadis misoginis dalam sahih bukhari. Banyak Hadis yang dinilai misoginis oleh kalangan feminis terutama hadis yang berkaitan dengan kehidupan dan posisi perempuan yang terdapat dalam hadis sahih bukhari. Dalam kesempatan kali ini hadis yang diangkat adalah tentang mayoritas penghuni neraka adalah perempuan. Menurut kaum feminis, melihat lahirnya teks, hadis di atas berhasil memposisikan perempuan sebagai mayoritas penghuni neraka hanya karena melaknat dan mengingkari kebaikan laki-lakinya. Padahal fakta sekarang secara kuantitas penduduk bumi lebih didominasi oleh perempuan dari pada laki-laki. Dengan demikian, secara tidak langsung mengatakan bahwa mayoritas penduduk bumi adalah calon penghuni neraka. Mereka menambahkan, jika benar demikian, tentu perintah Allah untuk berlomba-lomba dalam kebaikan tidak lagi berfungsi karena sudah dikecam sebagai ahli neraka. Faktanya, perempuan sekarang lebih banyak yang shalihah dari pada laki-laki. Apabila ada perempuan yang berlaku immoral tentu salah satu faktornya adalah laki-laki. Kasus PSK bisa diminimalisir bahkan dihilangkan apabila tidak ada laki-laki hidung belang. Kasus KDRT pun bisa dihindari apabila dari pihak laki-laki bisa menyadari peranannya. Dengan demikian, perempuan tidak bisa dipersalahkan sepihak, bahkan secara teologis diancam dengan neraka.

Abstract

Hampir setiap tahun kebakaran lahan dan hutan terjadi di beberapa wilayah Indonesia. Selama penegakan hukum kebakaran hutan masih menggunakan pendekatan postivistik, maka keadilan yang didambakan akan semakin absurt dirasakan oleh masyarakat. Pendekatan paradigma profetik menurut penulis dapat memecahkan kebuntuan itu. Paradigma profetik dalam penegakan hukum dimulai dengan pembinaan penegak hukum melalui kecerdasan spiritual yang ditawarkan oleh Danah Zohar dan Ian Marshall. Pendekatan yang mereka gunakan adalah dengan mengenalkan berpikir spiritual (spiritual tinking). Melalui kecerdasan spiritual (spiritual quition), akan diperoleh kecerdasan yang paling sempurna (ultime intelegent) sehingga dapat menerabas garis-garis formalisme (existing rule) menuju trasedental yang mendekati kebenaran yang hakiki (the ultimate truth). Pembinaan hakim dengan pendekatan SQ sesuai dengan amanat tugas seorang hakim yang menjatuhkan keputusan berdasarkan “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”. Tugas yang dijalankan seorang hakim adalah tugas spiritual dengan mengatasnamakan Tuhan dan Keadilan

Abstract

Undang-undang Partai Politik mengamanatkan perlunya pendidikan politik dengan memperhatikan keadilan dan kesetaraan gender dalam partai politik yang ditujukan untuk meningkatkan kesadaran akan hak dan kewajiban, meningkatkan kemandirian dan kedewasaan dalam kehidupan berbangsa dan bernegara. Kenyataanya partai-partai politik belum dikelola secara demokratis dan belum terinstitusionalisasi sehingga menjadi beban bagi sistem demokrasi dan tata kelola pemerintahan yang baik. Oleh sebab itu perlu dihidupkan lagi peran organisasi sayap partai. Dengan dilakukannya penataan pengaturan organisasi sayap partai sebagai upaya penguatan kaderisasi dan fungsi rekrutmen serta pelembagaan partai politik yang muaranya menjadikan demokrasi di negara ini berjalan sebagaimana mestinya.
