Abstract

The purpose of this study was to: 1) To determine responsibility regarding installation PPAT Encumbrance on credit guarantees in the process APHT on Bank BPR Karya Remaja Indramayu district. 2) To know the problems and solutions do just about anything regarding installation PPAT Encumbrance on credit guarantees in the process APHT in Bank BPR Karya Remaja Indramayu district. The data used in this study are primary data and analyzed with descriptive analytical method.Based on the results of data analysis concluded that: 1) PPAT responsible for making Deed Granting Mortgage in accordance with the provisions set forth in the legislation in force, in this case the Deed Granting Mortgage shall be in accordance with the occurrence, status, and data are correct, and supported by documents in accordance with the legislation. PPAT deed made by it must be made correctly in order to create a sense of security to the parties so that all can go smoothly and there are no losers. 2) Constraints in the installation APHT Mortgage in the process is that it lacks the completeness of the file, not a guarantee in the form of certificates, as well as the difference between self-identity in the name of National Identity Card with the name on the certificate. Therefore, the bank and PPAT should actively cooperate in completing the file completeness of the debtor and if the warranty is still in the process of making the certificate, then as a substitute for bank guarantees issued PPAT as partners covernote.Keywords: Responsibility PPAT; Credit agreement; Installation Mortgage.

Abstract

Land registration is held to ensure legal certainty. The absence of legal certainty in land ownership rights will lead to the deed of sale of land that is unlawful, because it is made without going through the procedures of land deed that has been determined. The purpose of this study was to analyze the causes of the Deed of Sale and Purchase of Land that is not in accordance with the procedures of the Land Deed-making event and to analyze the legal consequences Deed of Sale and Purchase of Land that is not in accordance with the procedure of making the show. This study using sociological juridical approach with analytic descriptive data analysis techniques. Data collection was done by using the study of literature. The results showed that the factors causing the deed of sale of land that does not follow the procedure of deed of land caused by the confidence that is too high between the parties with PPAT, too many employment PPAT so the time to investigate is limited, lack of understanding PPAT to the provisions of the law, the value of the transaction so that PPAT follow the will of the parties, relationships and friendship factor. Based on data analysis concluded the legal consequences of land purchase deed which is not in accordance with the procedures of a deed is PPAT be dishonorably discharged, the deed of sale published degraded proof strength be deed under the hand and third parties can use this for their own interests.Keywords: Deed of Sale and Purchase of Land; Procedure for the Deed; Effects.

Abstract

Blora Regency is one of regencies in east end of Central Java province of the run National Agricultural Operations Program or commonly referred to PRONA. In fiscal year 2017 this amount PRONA in Blora Regency is one of the largest in Central Java province that is the number 25000 certification of land. Implementation of the National Agricultural Operations Program also involves various parties including the Government of Blora, Blora Regency Land Office and Regency Head / Head of Village related to the implementation of the National Agricultural Program's operation. Research methods which I use in this research is empirical juridical. Moreover, I also use this type of field research where the author falls directly to secure the data is valid in the field. From the results of this study concluded that the juridical implementation of the National Agricultural Program Operation in Blora with fiscal year 2017 is superbly accomplished in accordance with applicable regulations is Government Regulation No. 24 of 1997 on Land Registration and Technical Guidelines Prona.Keywords: National Operations Program; Registration of Land Mass.

Abstract

The purpose of this study: 1) to analyze the Notary role / PPAT in raising legal awareness in the registration of land rights in Pati Regency, according to Government Regulation No. 24 of 1997 on Land Registration. 2) to analyze the obstacles and solutions role of the Notary / PPAT in increasing of public awareness for the registration of land rights in Pati regency. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by descriptive analytical method.Based on the results of data analysis concluded that: the role of the Notary / PPAT in increasing of public awareness for the registration of land rights in Pati Regency, according to Regulation No. 24 of 1997 on Land Registration can be said to have not been successful, due to the lack of socialization of Notary / PPAT up to the suburbs Pati city where people still common law. Barriers Notary / PPAT in increasing of public awareness for the registration of land rights in Pati regency namely external and internal factors. The solution Notaries should cooperate with other parties for the success of socialization, such as cooperation with the press.Keywords: Notary Role; Socialization; Legal Understanding.

Abstract

The purpose of this study is to identify and analyze: 1) The importance of the notary's obligation to safeguard the confidentiality of the contents of any particular act as referred to in Article 16 paragraph 1 of the letter (f) of Act No. 2 of 2014 Regarding Change of Law of 30 of 2004 About the Notary Department. 2). It is the responsibility of the Notary department for the abuse of confidentiality by millions of employees.This study is a type of normative juridical research, using a legislative and conceptual approach to Data collection derived from primary and secondary data, using interview methods and library studies. Data analysis techniques using qualitative data analysis.The result of the research is 1).The importance of the Notary's obligation to safeguard the confidentiality of the contents of the deed, particularly in the matter of Article 16 paragraph 1 letter (f) of Act No. 2 of 2014 About the Amendment of Act No. 30 of 2004 About the Notary Department is to keep everything confidential. and any evidence obtained for the making of the deed in accordance with the oath / appointment of the department. 2). The responsibility of the notary office is due to the misuse of confidentiality by the employees although in this case the notary does not commit a direct offense, because in one of the principles of civil liability there is a principle of absolute responsibility, whereby the person commits an error indirectly (due to negligence or negligence) heart) can be held responsible for the loss suffered by someone.Keywords: Notaries; Responsibilities; Minutes Deed.

Abstract

The purpose of this study to determine: 1) The registration process Swap Bolster Indigenous Land Rights Reserved by Bondo Deso Sedadi Village-Penawangan Subdistrict-Grobogan. 2) Obstacles and How to Overcome It. The approach in this study is a socio legal sourced from primary data and secondary data, qualitative analysis method. Data collection techniques with interviews, and literature. Data were analyzed using qualitative data analysis.Based on the analysis concluded: the alienation of land property rights of indigenous with Bondo Deso form of swaps is based on the public interest to be taken through the initial stages, namely the approval of the Head of Village and BPD (Village Consultation), approval to the Head of the Regional (Regent / Mayor, Governor), the approval of the Minister of Internal Affairs (as related to exchange) and the last is the stage registration right to use the land in the village treasury land Office. The obstacle is that when enrollment in the District Land Office Grobogan occurred facts are different between physical and juridical document, the data from the soil was not a complete history, chronology deed broken or lost and their land disputes and the absence of a line in the measurement of the ground by officers. Abstract

The purpose of this study was to: 1) Knowing and To study Role in Making of Notary Deed of Limited Liability Company in order to boost the economy in Indonesia. 2) Knowing and To study Roles and Responsibilities of the Notary in order to boost the economy in Indonesia 3) Know and To study barriers of Notaries in Deed Limited Liability Company in order to boost the economy in Indonesia. Abstract

This article provides an analysis Descriptive just about any Rights Land Stewardship (HPL) and the state of the legal regulation of HPL on community land. Research findings is that it turns out the existence of Land Management Rights, by society in general considered to be problematic from a legal setting. In view of the general public (the men in the street) there is no clear basis in the legal arrangements of the Basic Agrarian Law regarding the HAT. Problems HPL also appear as the result of legal research normative author, with mainly navigated by Justice Theory Dignity (the dignified Justice Theory) was found that the provision HAT to the Government almost be violate or conflict with the rights to other land that had previously existed. As for the other HAT referred to are the property of land under customary law. The ownership of the land under customary law was legally recognized. In this study also found that in fact the birth of HPL owned by the Government of Sorong regency which has now become the City of Sorong on the one hand is based on the claim the Government of Sorong, proposed by the elements of the local Land Office that the origin of the HPL is a conversion from HAT in West Law (Right Erfpacht). With this fact it can be said that the Government HPL Sorong seek refuge or shelter behind Erfpact Verponding. In fact, in a Court decision expressly states that the right Erfpach judges and Erfpacht Verponding it is not there anymore. The legal consequence is Erfpacht not be used as legal basis that justifies or justification for HPL. According to the Judge, HPL Sorong government owns comes from the State Land. In short it can be said that this article contains an overview of the issues HPL law above the government-owned land parcels at the same time also be claimmerupakan land belonging to indigenous peoples. Keywords: Because of law Rights Land Stewardship; Indigenous Lands; Justice.

Abstract

Penelitian ini berangkat dari banyaknya kasus yang menimpa beberapa Notaris, informasi tersebut telah saya peroleh dari beberapa dosen pada saat masa pekuliahan di Program Pasca Sarjana Magister Kenotariatan Unissula. Kasus-kasus yang menimpa beberapa Notaris saat ini adalah penyangkalan yang dilakukan para pihak terhadap isi Akta yang dibuat oleh Notaris, para pihak yang sedang bersengketa tidak sedikit mengikutsertakan Notaris ke dalam permasalahannya. Hal tersebut dikarenakan para pihak berasumsi bahwa Notaris terlibat didalam pembuatan Akta tersebut, padahal Notaris bukanlah pihak didalam Akta tersebut, karena para pihak dalam membuat akta atas keinginannya sendiri dan Notaris hanya mengkonstantir apa yang dikehendaki oleh para pihak untuk dimasukan kedalam Akta.Tujuan dari penelitian ini adalah (1) Untuk menganalisis Bagaimana Standar Prosedur Pelayanan Operasional (SPPOP) Notaris dalam pembuatan Akta notariil untuk memproteksi diri Notaris, dan (2) Untuk menganalisis Apakah klausul proteksi diri dalam akta tentang identitas, sengketa dan keterangan penghadap mempunyai pengaruh, jika ada penghadap yang menyangkal.Penelitian ini menggunakan Metode pendekatan Yuridis Normatif, karena berdasarkan studi kepustakaan terhadap peraturan yang satu dengan peraturan yang lain. Penelitian ini dilakukan di beberapa Kantor Notaris dan PPAT di Kabupaten Tegal dan Kabupaten Brebes.Hasil penelitian Standar Prosedur Pelayanan Operasional (SPPOP) Notaris dalam menjalankan tugas dan jabatannya sebagai seorang Notaris tentunya dengan memintakan data-data atau Identitas dari para penghadap yang hendak membuat Akta Notariil dan Akta Notaris sebagai bukti Autentik harus dilihat sebagaimana yang tercantum atau tertulis didalamnya, sepanjang sudah sesuai dengan aturan-aturan yang terkandung dalam UUJN dan Kode Etik maka Akta tersebut telah benar dan mempunyai kekuatan pembuktian yang sah dan/atau sempurna. Adanya Klausul Proteksi diri bagi para Notaris sangat berpengaruh, mengingat dalam menjalankan tugas jabatannya perlu adanya perlindungan bagi dirinya.Kata Kunci : Klausul Proteksi, Akta Autentik.

Abstract

Notary acts as a medium for the birth of a deed of authentic. Responsibility of notaries in the sale and purchase agreement to the party is limited to deed that made accordance with the authority of his post by UUJN. The purpose of this study are: 1. to know the roles and responsibilities in the making notary deed of sale and purchase agreement in the event of disputes for the parties. 2. To determine the notary solution in preparation of deed sale and purchase agreement in order to avoid disputes of the parties.Based on the results of data analysis concluded that: 1. The responsibility of the notary deed merely on early part deed / deed chief, section final / concluding notarial deed and have full accountability of the contents either formal and material. 2. In the duty of notary shall apply precautionary principle and do legal education in order to avoid disputes in the future.Keywords: Notary; Agreements; Sale and Purchase Agreement; Deed.
