Abstract

AbstrakLembaga Kenotariatan adalah salah satu lembaga kemasyarakatan yang ada di Indonesia, lembaga ini timbul dari kebutuhan dalam pergaulan sesama manusia yang menghendaki adanya suatu alat bukti mengenai hubungan hukum keperdataan yang ada dan atau terjadi diantara mereka.Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis empiris, spesifikasi yang digunakan dalam penelitian ini bersifat deskriptif analitis, teknik pengumpulan data ini menggunakan penelitian lapangan dan studi kepustakaan.Notaris sebagai pejabat umum dalam menjalankan jabatannya perlu diberikan perlindungan hukum, antara lain pertama untuk tetap menjaga keluhuran harkat dan martabat jabatannya termasuk ketika memberikan kesaksian dan berproses dalam pemeriksaan dan persidangan. Kedua, merahasiakan akta keterangan yang diperoleh guna pembuatan akta dan ketiga, menjaga minuta atau surat-surat yang dilekatkan pada minuta akta atau protokol Notaris dalam penyimpanan Notaris. Ketiga hal inilah yang menjadi dasar dalam Pasal 66 UUJN dalam hal pemanggilan Notaris untuk proses peradilan, penyidikan, penuntut umum atau hakim dengan persetujuan Majelis Pengawas.Kata Kunci: Majelis Pengawas Daerah, Pengawasan,Jabatan Notaris AbstractsThe Notary Institution is one of the existing social institutions in Indonesia, this institution arises from the needs in the association of fellow human who wants a proof of the relationship of civil law existing and / or occur between them.The approach method used in this research is empirical juridical, the specification used in this research is analytical descriptive, this data collection technique using field research and literature study.Notary as a general official in carrying out his / her position needs to be given legal protection, among others, first to maintain the nobility of dignity and dignity of office including when giving testimony and proceeding in examination and trial. Second, to keep secret deeds obtained for making the deed and third, to keep the minuta or letters attached to the Minutes of Notary or Notary's protocol in the Notary's depository. Abstract

Permasalahan dalam penelitian ini adalah bagaimana prosedur perolehan hak atas tanah bagi perempuan WNI  yang   terikat perkawinan campuran, kendala-kendala dan solusi yang timbul dalam memperoleh Hak Atas Tanah bagi Perempuan WNI yang terikat Perkawinan Campuran  (Studi Kasus Putusan MK Nomor. 69/PUU XIII/2015) Adapun penelitian ini bersifat sosiologis, dimana penulis melakukan penelitian  yang diteliti pada awalnya adalah data sekunder, kemudian dilanjutkan penelitian terhadap data primer di lapangan, atau terhadap masyarakat, wawancara dengan Badan Pertanahan Nasional, Notaris, dan dua perempuan WNI yang menikah dengan WNA.  Dan meneliti peraturan yang berhubungan dengan perkawinan campuran,  yang berlaku di Indonesia. Hasil penelitian menunjukkan kesimpulan bahwa Notaris mempunyai peranan yang penting dalam membantu klien tentang : prosedur memperoleh hak atas tanah bagi WNI yang menikah dengan WNA yaitu dengan penurunan hak, misal dari Hak Milik menjadi HakPakai, dimana penurunan haknya oleh pemilik tanah.  Kendala-kendalanya  adalah masalah domisili bagi laki-laki  WNA yang menikah dengan WNI, dan pasangan perkawinan campuran antara WNI dan WNA tidak membuat perjanjian perkawinan selama perkawinan mereka, solusinya sebelum menikah sebaiknya mereka membuat perjanjian perkawinan. Kata Kunci : Perkawinan Campuran, perempuan WNI, Hak Akses Tanah

Abstract

Notary is competent public authority or his duty is to make the deeds authentic. Notaries have the right to take leave in accordance with Law Notary. Leave notaries are leaving the work of notaries in some time officially to rest, take a vacation or to become public officials. The purpose of this study to analyze how the legal consequences leave notary on the implementation of office in accordance with Act No. 2 of 2014 concerning Notary, the legal position of notaries replacement which replaces the notary in the period of leave, challenges and solutions faced by a substitute notary in implementing the office notary supplants the leave period. Legal Theory used in this research is the theory of Responsibility and Theory of Rule of Law.The effects of this study indicate that there are no legal consequences for the notary who take leave, when he took a leave of absence he has appointed a substitute notary, if in the future in which no party feels aggrieved as a effect of his actions then Substitute Notary to be held responsible, even though they had quit his respective duties as Notary Public; Substitute notary legal position that replaces the notary in the period of leave is a substitute notary has authority as a notary as by UUJN; Challenges and solutions faced by a substitute notary in implementing the replaced notary office within the period of leave such as a lack of knowledge or ignorance, inexperience and lack of understanding. The solution is to appoint a substitute notary notaries, notary substitute must have the precautionary principle, accuracy and precision in implementing the notary office of his predecessor in the leave to avoid the occurrence of negligence in carrying out his post.Keywords: Effects; Leave Notary; Notary Substitute.

Abstract

ABSTRAKPerkembangan dinamika masyarakat telah memberikan dampak pada semakin bervariasinya kebutuhan masyarakat, khususnya masyarakat pengguna jasa Notaris (klien). Notaris adalah pejabat umum yang berwenang membuat akta otentik dan kewenangan lainnya yang dalam menjalankan tugas jabatannya Notaris harus berpedoman pada kaidah hukum dan kaidah moral. Kaidah hukum yang berlaku bagi Notaris adalah Undang-undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, sedangkan kaidah moral yang secara khusus mengatur tentang Profesi Notaris adalah Kode Etik Notaris yang ditetapkan oleh Organisasi Profesi Notaris yaitu Ikatan Notaris Indonesia. Namun pada kenyataannya dalam menjalankan tugas jabatannya banyak Notaris yang telah masuk keranah hukum dengan berbagai kasus yang terjadi. Bahkan banyak terbukti di Pengadilan dengan status sebagai terpidana.Penelitian ini akan dikaji mengenai perlindungan hukum terhadap kriminalisasi terhadap Notaris, beserta penerapan sanksi terhadap Notaris apabila Notaris terbukti bersalah di PengadilanMetode penelitian yang dipakai dalam penelitian ini meliputi : penelitian yang bersifat normatif, jenis pendekatan adalah dekriptif analistis, dengan pendekatan yuridis normative, yaitu dengan pendekatan perundang-undangan (statute approach), pendekatan konsep (conseptual approach), pendekatan kasus (case apporah), dengan cara melakukan telaah terhadap kasus-kasus yang berkaitan dengan isu yang dihadapi.Hasil dari penelitian ini adalah bagaimana penerapan perlindungan hukum terhadap notaris yang dikriminalisasi dalam pembuatan akta otentik, sebagaimana terdapat pada Pasal 66 UUJN. Dengan demikian, maka Notaris tidak dapat seenaknya dipanggil dalam proses pidana atau peradilan oleh penyidik, penuntut umum atau hakim. Pemanggilan yang dilakukan tersebut harus melalui persetujuan MPD terlebih dahulu. Akan tetapi apabila MPD memberikan persetujuan untuk diperiksanya Notaris, maka sebagai bentuk perlindungan terhadap dirinya, Notaris dapat menggunakan hak ingkarnya. Sanksi yang diberikan Notaris apabila kriminalisasi terbukti yaitu mulai dari Teguran, Peringatan, Schorsing (pemecatan sementara) dari keanggotaan perkumpulan, Pemberhentian dengan tidak hormat dari perkumpulan. Penjatuhan sanksi-sanksi sebagaimana terurai di atas terhadap anggota yang melanggar Kode Etik disesuaikan dengan kwantitas dan kwalitas pelanggaran yang dilakukan anggota tersebut. Dan Notaris baru dapat diberhentikan dengan tidak hormat dari jabatannya oleh menteri atas usul Majelis Pengawas Pusat apabila keputusan atas hukuman pidana yang diterimanya 5 (lima) tahun atau lebih termasuk telah memperoleh kekuatan hukum tetap. Dengan demikian status hukum dari Notaris tersebut berubah dari terdakwa menjadi terpidana.Kata kunci : Perlindungan Hukum, Kriminalisasi Notaris, Pejabat UmumABSTRACTThe development of community dynamics has had an impact on the increasingly varied needs of the community, especially the community of Notary service users (clients). Notary is a general official who is authorized to make authentic deeds and other authorities in carrying out their duties. Notaries shall be guided by the rule of law and moral rules. The rule of law applicable to Notary Public is Law Number 2 Year 2014 about Notary's position, whereas moral rule which specifically regulate Profession Notary is Notary's Code of Ethics specified by Notary Profession Organization that is Notary Association of Indonesia. But in reality in carrying out his duties of office many notaries who have entered the legal ground with various cases that occurred. In fact many are proven in the Court with the status of a convicted person.This research will be studied about legal protection against criminalization of Notary, along with the application of sanction to Notary if Notary is found guilty in CourtThe research methods used in this research include: normative research, the type of approach is descriptive analytical, with normative juridical approach, that is by statute approach, concept approach, case apporah, by way of a review of cases relating to the issues at hand.The result of this research is how the application of legal protection to notary which is criminalized in making authentic deed, as contained in Article 66 UUJN. Thus, a Notary can not be casually summoned in a criminal or judicial process by an investigator, public prosecutor or judge. Such invocations shall be subject to prior MPD approval. However, if the MPD gives approval for the examination of a Notary, then as a form of protection against him, a Notary may use his right of repudiation. Sanctions granted by a Notary if criminalization is evident from the Warning, Warning, Schorsing (temporary dismissal) of the membership of the association, Disobedience with disrespect from the association. The imposition of sanctions as described above against a member in violation of the Code of Ethics shall be in accordance with the quantity and quality of the offenses committed by that member. And the new notary may be dismissed with disrespect from his position by the minister upon the recommendation of the Central Supervisory Council if the decision on criminal penalty he receives 5 (five) years or more including having obtained permanent legal force. Abstract

Making of license process of roya mortgage right need the role of notary. The research Notary's role in the making of license deed of roya mortgage right because the debt elimination in perspective of legal certainty. The problem in this research  are 1) how did  the process of making Permit Roya Deed Rights due to debt removal, 2) notary role in making deed of Permit Roya Mortgage Rights due to the elimination of Debt in perspective of legal certainty and 3) what are  the Constraints and solutions in the role of notary in making the deed of Roya mortgage right due to the elimination of Debt in the perspective of legal certainty.Approach method used is juridical empirical method, juridical research with the object in the form of law, empirical research is the existence or results of research on the pouring of the applicable laws in the community.The result of this research is that the process of making Deed of Roya mortgage right due to debt removal is based on requests from interested parties and deletion based on the decision of the District Court. The role of a notary in the making of the deed of Roya mortgage right because of the elimination of Debt in the perspective of legal certainty is that roya can be processed if all the requirements are complete. One of them is Roya Letter. The problem is if the roya letter is lost or the certificate of mortgage is lost then the roya process can not be executed by the National Land Agency, then in this case the notary can help with the record in accordance with the rules of notary can issue or make Roya Permit or can be called as a roya concentrate in the form Notarial deed prior to the preparation of a loss report from the police to be issued a certificate of loss. The constraints of the notary's role in the making of the deed of Roya Hak Liability due to the elimination of Debt in the perspective of legal certainty are Roya period exceeds seven days from the date of application, Roya costs exceeds the provisions, Roya Partial Objects of Mortgage Rights which are Not Consist of Multiple Rights to Land and Completeness Roya Requirements Not Fulfilled. Abstract

The purpose of this study was to: 1) To understand how the role of the Notary in determining acceptance or cancellation will set out in articles 194 to 209 Compilation of Islamic Law. 2) In order to understand what are the reasons that make a person could fail to get a will, and how the notary in dividing section will treasure for the recipient. 3) To understand what are the barriers and solutions notary role in determining the acceptance and cancellation will. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by descriptive analytical method.Based on the results of data analysis concluded that: 1) the role of the notary in determining the acceptance and cancellation will have to go through the will of the testator in which it was agreed between the parties involved, and should be included / dionlinekan in the Minister of Law and Human Rights No. 60 of 2016 on Procedures for Reporting Wills and Testament Application Issuance of Electronic. Because if not then the deed will be listed online does not have a strong legal force. 2) the reasons that make a person could be canceled in the will because a person or institution authorized a treasure will be, but he refused, unable to take advantage of the treasure will as possible, or other things that make him blame and convicted criminal who belong in Article 197 compilation of Islamic Law. 3) barriers and solutions in the division will was that the heirs who assumed that he did not get the part of the will so many of them impede the course of a will, and the solutions that are required in the making of a will should be through consensus among family testator with parties associated therein, which aims to avoid things that sustainable in the future.Keywords: Wills; Cancellation; Reception.

Abstract

Inheritance issues are particularly vulnerable because they are related to total assets to be distributed to the heirs. This issue often occurs and ends up in court, especially concerning the issue of inheritance for non-Muslim heirs. Based on the Compilation of Islamic Laws, non-Muslim heirs are not entitled to the inheritance of the Muslims family. For non-Muslim heirs, this is very unfair, so it can cause disunity within the family. Islam prioritizes justice and prosperity, so that cases of non-Islamic heirs can be given alternative solutions by giving inheritance through a mandatory will (Wasiat Wajibah).Keywords: Inheritance; Non-Moslem Heir; Compilation of Islamic Law.

Abstract

This research aims (1) To know and analyze how the process of registration of customary land (2) To know and analyze the position of customary law and the role of Notary-PPAT in the process of land registration in Sorong City West Papua reviewed: According to the Principal Agrarian Law. This research uses a juridical-empirical approach. Yudiris is used to analyze rules relating to customary law and land, while empirical is used to analyze laws based on the behavior of people who always interact in daily life. The result of this research are (1) Government of Indonesia recognition of the existence of land and customary law is set forth in UUPA and PP. 24 of 1997 on Land Registration, so that in the process of registration of customary land in Sorong city is not much different from the registration of land in general. Only the registration of customary land in Sorong must be proven by several conditions that specify in local customary law and has been arranged also in the PP. No. 24 of 1997 (2) UUPA itself is a national agrarian law whose presence is based on indigenous laws of Indonesia known as customary law, so to conduct registration of land in Sorong City must use letters of customary release from the local customary chief, in this process the role of Notary-PPAT is needed in making the declaration of customary release and the role of PPAT in helping people who do not understand the rules of local custom in the process of registration of customary land as long as it does not violate the rules related to PPAT authority set by PerKaBPN No. 8 Year 2013.Keywords: Land, Customary Law, Notary-PPAT

Abstract

The employment agreement is an agreement made by business owners with employees. Trace Article 1 point 14 of Act No. 13 of 2003 on Labor, employment agreement is an agreement between the workers / laborers with employers which contains the terms of employment, the rights and obligations of the parties. The agreement may be written and unwritten. Unwritten agreement has the disadvantage not have the force of law when the future of a dispute between workers and employers. In this case related to the employment relationship between employers and employees in UD. Endah Pratama Pati regency, Central Java.This study aims to find out how conduciveness workers in a company that does not implement a written agreement for workers. And how treatment can be done if the aggrieved party both employers and workers.UD leaders of Endah Pratama with workers can be said to be communicative in terms of implementation of the work. Abstract

This researchaims to determine how the execution Encumbrance through an auction to be determined by the District Court of Pekalongan and what weaknesses and execution Mortgage solution through an auction to be determined by the District Court of Pekalongan. Mortgage execution through an auction based on the determination District Court of Pekalongan held upon the request of the winning bidder. Request execution Mortgage by auction by the auction winner made after terlelang not willing to vacate voluntarily execution object. Mortgage weakness execution through an auction based on the determination that the District Court Pekalongan there are two opinions on the application process execution Encumbrance through an auction to be determined by the District Court if there is a lawsuit against the object of the auction following the application execution. The first opinion the petition can still be processed until the issuance of the determination of the District Court. The second opinion request for execution should be delayed pending completion of a lawsuit against the auction object. This is due to the absence of explicit provision governing the execution Mortgage application process through the auction in case there is a lawsuit in the execution object, especially if there is a lawsuit against the object of execution in case the application execution has been carried out. Similarly, in the case of the emergence of a lawsuit before the application for execution is done. Whether the execution can be carried out or not. This gives rise to a variety of opinions that may be detrimental to the winning bidder.
