Abstract

ABSTRAK Dalam penelitian ini permasalahan yang akan dibahas yaitu peranan Notaris dalam pembuatan Akta Penegasan Keterangan Waris, kendala-kendala yang dihadapi Notaris dalam pembuatan Akta Penegasan Keterangan Waris dan tata cara dan proses balik nama waris dengan menggunakan Akta Penegasan Keterangan Waris sebagai pengganti Surat Keterangan Waris di Kantor Pertanahan Kota Semarang. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis empiris. Adapaun sumber dan jenis data dalam penelitian ini adalah data primer yang diperoleh dari studi lapangan. Dan data sekunder diperoleh dari studi kepustakaan. Simpulan dari penelitian ini adalah bahwa dari setiap peristiwa alam yang berhubungan dengan kematian akan timbul/lahir peristiwa hukum secara perdata baik berhubungan dengan almarhum/alamrhumah (si pewaris) maupun dengan orang-orang yang ditinggalkannya (para ahli waris), yang mau tidak mau harus segera diselesaikan oleh para ahli waris. Selain digunakan dalam pengurusan proses balik nama waris, Akta Penegasan Keterangan Waris dapat pula digunakan sebagai pengganti Surat Keterangan Waris (KHW) dalam pengurusan penutupan dan/atau untuk mengambil harta warisan dalam bentuk deposito, tabungan di bank-bank maupun di tempat-tempat/instansi dimana si pewaris menyimpan kekayaannya dalam bentuk benda bergerak. Dengan berlaku dan dapat digunakannya Akta Penegasan Keterangan Waris sebagai pengganti Surat Keterangan Waris dalam pengurusan proses balik nama sertifikat tanah ke atas nama para ahli waris, di Kantor Pertanahan Kota Semarang, secara tidak langsung hal ini merupakan suatu penemuan hukum baru dalam pengurusan proses balik nama waris, khusunya di Kantor Pertanahan Kota Semarang.Kata Kunci : Akta, Surat Keterangan Waris, Balik NamaABSTRACTIn this research, the issues that will be discussed are the role of Notary in making the Deed of Confirmation of Inheritance Statement, the constraints faced by the Notary in making the Deed of Confirmation of Inheritance Statement and the procedure and the process of returning the name of the inheritance by using Deed of Confirmation of Inheritance Statement in lieu of Certificate of Inheritance at the Office Land of Semarang City. This research was conducted using empirical juridical approach method. Adapaun source and type of data in this research is primary data obtained from field study. And secondary data obtained from literature study. The conclusion of this study is that from any natural event related to death there will arise a civil event both related to the deceased / the heir (the heir) and the persons he left behind (the heirs), which inevitably have to immediately completed by the heirs. In addition to being used in the process of handling the process of inheritance, the Deed of Confirmation of Inheritance Statement may also be used as a substitute for Certificate of Inheritance (KHW) in the management of closure and / or to take inheritance in the form of deposits, savings in banks or in places / institutions where the heir keeps his wealth in the form of moving objects. With the validity and applicability of the Deed of Confirmation of Inheritance Statement as a substitute for the Certificate of Inheritance in processing the process of returning the name of the land certificate on behalf of the heirs, in the Land Office of Semarang City, indirectly this is a new legal discovery in the process of handling the process of inheritance , especially in the Land Office of Semarang City.Keywords: Deed, Inheritance Certificate, Reverse Name

Abstract

ABSTRAKPenelitian ini bertujuan mengkaji dan menganalisa: (1) penggunaan audio populer dalam pembuatan video menggunakan aplikasi dubsmash melanggar hak cipta ditinjau dari UUHC. (2) peran dari Notaris dalam perlindungan hukum terhadap pencipta dalam hal adany penggunaan audio populer yang membuat video menggunakan aplikasi dubsmash tanpa izin (3) kendala dan solusi dalam perlindungan hukum terhadap pencipta.Hasil penelitian ini adalah: (1) Pelanggaran atas penggunaan audio populer dalam pembuatan video menggunakan aplikasi dubsmash ditinjau dari UUHC dapat dikategorikan sebagai perbuatan yang termasuk pelanggaran hak ekonomi dimana Pencipta atau pemegang hak ekonominya terenggut. (2) Peran dari Notaris dalam perlindungan hukum terhadap pencipta dalam hal adanya penggunaan audio populer yang pembuatan video menggunakan aplikasi Dubsmash tanpa izin ditinjau dari UUHC adalah sebagai konsultan yang terdaftar pada Direktorat Jendral. Perlindungan hukum hak cipta terhadap pencipta lagu yang diunduh melalui internet dapat dilakukan dengan cara yaitu secara hukum administrasi negara, hukum pidana dan hukum perdata. (3) Kendalanya adalah terikatannya pencipta aplikasi Dubsmash ketika mengupload dengan ketentuan dari Mobile Motion dan dalam hal penyidikan dilakukan oleh PPNS berdasarkan surat perintah penyidikan yang dikeluarkan oleh pejabat yang memiliki kompetensi terhadap hak cipta. Solusinya adalah dengan upaya preventif dan represif. Upaya preventif dilakukan dengan melakukan pencatatan hak cipta pencipta aplikasi Dubsmash atas karya ciptanya dan peran pihak pemerintah melalui Kementerian Informasi dan Teknologi untuk berperan lebih aktif dan upaya represif dilakukan dengan cara penegakan hukum berdasarkan Pasal 113 Ayat (3) UUHC.Saran dari penelitian ini adalah bagi para editor aplikasi dubsmash hendaknya harus lebih memperhatikan ketentuan hukum dalam bidang Hak Cipta di indonesia sebagaimana diatur dalam UUHC, bagi para masyarakat hendaknya mengindahkan UUHC sehingga hak pencipta dapat dilindungi.Kata kunci : Hak Cipta, Audio Populer, Dubsmash ABSTRACTThe purpose of this study is to examine and analyze: (1) the use of popular audio in video creation using copyright infringing dubsmash apps reviewed from UUHC. (2) the role of a Notary in the legal protection of the creator in terms of the use of popular audio which makes the video use unauthorized dubsmash applications (3) constraints and solutions in the legal protection of the creator.The results of this study are: (1) Violation of the use of popular audio in the making of video using dubsmash application viewed from UUHC can be categorized as an act which includes violation of economic rights where the Creator or his economic rights holder is taken away. (2) The role of the Notary in the legal protection of the creator in the case of the use of the popular audio-making video using the unlicensed Dubsmash app reviewed from UUHC is as a consultant registered with the Directorate General. Such provisions have privileges, as they comply with the principles of the establishment of good legislation. The protection of copyright law against songwriters downloaded through the internet may be done in a manner that is legally state administration, criminal law and civil law. (3) Constraints and solutions in the legal protection of the creator in the form of weakness of the application of compensation sanction to the offender in accordance with the value of the loss of exclusive rights in the form of moral rights and economic rights of the creator and the copyright holder. And the solution is through copyright registration through Notary to obtain legal certainty over the copyrights.Suggestion from this research is for editor of dubsmash application should have to pay more attention to legal provisions in the field of Copyright in Indonesia as regulated in UUHC, for the society should heed UUHC so that the rights of creator can be protected for the sake of nation development.Keywords: Copyright, Popular Audio, Dubsmash

Abstract

Izin Peruntukan Penggunaan Tanah adalah izin yang wajib dimiliki oleh setiap warga masyarakat yang akan mengubah tanah pertanian menjadi non pertanian. Fungsi dari izingperuntukan penggunaan tanah adalah untuk menekan serta pengendalian alih fungsi lahan yang terjadi. Tanah sawah (tanah pertanian) yang akan diubah ke non pertaniangtentunyagharuslahgsesuai dengan rencana tata ruang dan’wilayahgKabupatengDemak5 agar terjadigkesimbangan dimasa mendatang. Muncul masalah yaitu tentang pelaksanaan izin alih fungsi lahan di Kabupaten Demak dan antisipasi Pemerintah Kabupaten Demak dalam mengurangi alih fungsi lahan. ’Penelitian ’ini ’bertujuan untuk’mengetahui’pelaksanaan’izin’perubahan penggunaan tanah terhadap alih penggunaan tanah pertanian ke rumah tinggal. Untuk mengetahui’hambatan-hambatan’ dan’ solusi’ dalam’pelaksanaan izin’perubahan penggunaan tanah terhadap alih penggunaan tanah pertanian ke rumah tinggalPendekatan’penelitian’menggunakan metode’pendekatan secara yuridis empiris dan Spesifikasi penelitian ini menggunakan metode deskriptif analisis. Dalam penelitian ini menggunakan metode analisis data secara kualitatif.Berdasarkan hasilg penelitian gyang gdilakukan, dapat gdiketahui bahwa pelaksanaan izin perubahan penggunaan tanah terhadap alih penggunaan tanah pertanian ke rumah tinggal Di Kantor Badan Pertanahan Nasional/Agraria Dan Tata Ruang Kabupaten Demak telah sesuai antara regulasi. Hambatan-hambatan dalam pelaksanaan izin perubahan penggunaan tanah terhadap alih penggunaan tanah pertanian ke rumah tinggal di Kabupaten Demak yaitu 1) Kendala Koordinasi Kebijakan, 2) Kendala Pelaksanaan Kebijakan dan 3) gKendala gKonsistensi Perencanaan. Abstract

ABSTRAKDalam rangka penanggulangan kemiskinan dan penciptaan lapangan / usaha dipedesaan, departemen pertanian pada tahun 2008 samapi dengan tahun 2015 telah melaksanakan Program Pengembangan Usaha Agribisnis ( PUAP ) yang merupakan bagian dari Program Nasional Pemberdayaan Masyarakat Mandiri ( PNPM-MD ) dan telah menyalurkan Bantuan Langsung Masyarakat (BLM) kepada GOPAKTAN. Gopaktan membentuk Lembaga Keuangan Mikro Agribisnis.( LKM-A ) sebagai pengelola PUAP dengan nominal perdesa adalah Rp. 100.000.000,- (seratus Juta rupiah ) dalam menjalankan LKM-A ini telah mengelola dengan menerapkan ketentuan seperti yang tercantum dalam Anggaran dasar dan Rumah tangga LKM-A dan setiap Akhir tahun diadakan Rapat Akhir Tahun (RAT) untuk mempertanggung jawabkan pengurus kepada semua anggota. Dana yang ada di LKM-A ini diharapkan setiap tahun akan selalu bertambah. Namun pertambahan dana ini belum signifikan dengan kebutuhan para petani. LKM-A ini kedepan dapat ditingkatkan kapasitasnya menjadi bebadan hukum.Dalam mewujudkan badan hukum koperasi diperlukan beberapa persyaratan prosedur / mekanisme yang baku salah satu peran yang sangat penting adalah adanya Notaris dalam hal ini adalah Notaris Pembuat Akta Koperasi yang akan menuangkan kehendak para pihak dalam suatu akta pendirian koperasi. Dalam mewujudkan badan hokum koperasi diperlukan beberapa persyaratan prosedur / mekanisme yang baku salah satu peran yang sangat penting adalah adanya Notaris dalam hal ini adalah Notaris Pembuat Akta Koperasi yang akan menuangkan kehendak para pihak dalam suatu akta pendirian koperasi.Kata Kunci : Notaris,Koperasi, Lembaga Keuangan Mikro Agribisnis ABSTRACTIn the context of poverty alleviation and the creation of field / business in rural areas, the agriculture department in 2008 until 2015 has implemented the Agribusiness Development Program (PUAP) which is part of the National Community Empowerment Program (PNPM-MD) and has channeled the Direct Community Assistance BLM) to GOPAKTAN. Abstract

The research entitled The Application of Pacta Sunt Servanda Principle In Testament Made Before Notary in Perspective of Justice has problem formulation: 1) How is the application of pacta sunt servanda principle on testaments made before the present notary ?, 2) What legal effect arises when The testamen made before the notary does not apply the principle of pacta sunt servanda in the perspective of justice? And 3) How is the application of pacta sunt servanda principle to testament made before Notary in the perspective of justice ?.The results of this research are 1) The application of pacta sunt servanda principle on testaments made before the present notary can be described that the implementation of pacta sunt servanda principle is required at all stages, either before, during or after the process of making the testament deed. 2) Any legal effect that arises when a testament made before a notary public does not apply the principle of pacta sunt servanda in the perspective of justice is that the testament is essentially a statement made unilaterally by the testamenter set forth in a deed that must be executed by the will . 3) The application of the principle of pacta sunt servanda to the testament made before the Notary in the perspective of justice is that in the making of this testament it must be adhered to two principles namely, firstly, giving equal rights and opportunities to the widest freedom of the broadest extent of equal freedom for each person. Abstract

Franchising is essentially a marketing concept in order to expand a business network quickly. Franchising is not an alternative, but one way that is as strong and strategic as the conventional way of developing a business. In a franchise agreement, the role of a notary is required even though the franchise agreement itself is a standard agreement without a notary. However, in order to make the deed of the agreement is more authentic, the role of a notary is necessary to ensure the legal protection. The research method used was normative juridical. Normative legal research is a legal research conducted by reviewing materials derived from various laws and other materials from various literatures. Based on the results of research and discussion, it can be concluded that the role of Notary is important in making the deed of the franchise agreement in addition to preventing the occurrence of misappropriation (negligence or default) of one party. The notary also ensures the legal protection of the deed of the agreement because it is made under the legal protection. The franchise is an engagement or agreement between two parties in which all provisions refer to Article 1313 of the Civil Code of the treaty, article 1320 of the Civil Code of the validity of the agreement and Article 1338 paragraph (1) of the Civil Code on the principle of freedom of contract.Keywords: Notary; Franchise; Legal Protection.

Abstract

In the sale and purchase of land rights of course there are various parties, including Sellers and Buyers. In this case, Seller (RJ) and Purchaser (IS) 1 purchased land on September 26, 2007 with 10 certificates and total purchase value of land object amounting to Rp 2.232.650.000, - (two billion two hundred thirty two million Six hundred fifty thousand rupiah), due on July 31, 2008, which is until the due date the Purchaser (IS) has not been able to repay it. On the other hand, the Notary of MJ who made the Deed of Sale and Purchase Agreement committed a Law Against Act (PMH) by issuing a Sale and Purchase Deed which should not be issued in case of non-payment. With the formulation of the problem studied are: 1. What are the legal consequences that occur on a Notary who commits an unlawful act against the Deed of Sale and Purchase Land made? 2. How to solve a case against a Notary who committed a Legal Actions (PMH) on the Deed of Sale and Purchase of Land?Approach method used in this research is normative juridical research supported by empirical juridical, research specification is analytical descriptive, writer use primary data and secondary data to get data related to this research.Based on the results of this study, based on the Case Court's Decision Number 05 / Pdt.G / 2009 / PN.Rbg, the case investigation between the Seller (RJ) and the Buyer (IS) on the first issue of the formulation of Notary MJ because it was proven to Act Against Law Falsify the information contained in the Deed of Sale and Purchase which is different from the Deed of Sale and Purchase Bond that has been agreed by both parties, then he must finish the Deed of Sale and Purchase Agreement between the RJ and the IS, and automatically does not Occur And in the formulation of the problem Second, the Buyer (IS) who has made a default booking by not automatically paying the purchase price with the binding agreement between himself and the Seller (RJ), he is charged with a 13th Stipikat to Seller (RJ) discount, With the payment already given To Seller (RJ) by Buyer (IS) is irrevocable and automatically becomes the property of Seller (RJ). As well as Buyer (IS) are charged the court fees that have arisen in advance of the trial.The author's suggestion in this research is for the seller, should be more careful in choosing and revoking the prospective buyer, thus minimizing the undesirable things that will be done by the Buyers so as to disadvantage the Seller, for the buyer, he must have good faith It should always be upheld that there will be no future Seller, for Notary Public, Notary as a public official should have a Neutral attitude toward both parties in the agreement, can be mediator, law-abiding and not doing the Fight Against Act (PMH), by reason No party harmed. Keywords: Sale and Purchase Agreement, Unlawful Actions, Wanprestatie.

Abstract

The debt burden is given to the heirs who are willing to accept the inheritance in full. The amount of the debt itself will be adjusted to the size of the inheritance received, outside of his own personal property. Of course, this debt shift will be a heavy burden. Especially if your own needs are already heavy. If indeed you are experiencing these problems, the methods below can help to pay off debts from deceased debtors. This research aim to: 1) To identify and analyze the implementation of the settlement of non-performing credits are collateralized with mortgage collateral while the owner died. 2) To identify and analyze the role of the Notary of the Installation Encumbrance with Certificate Name Properties that have made the process dies down to the Expert Heir based Justice. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by descriptive analysis method. Abstract

ABSTRAKProfesi Notaris merupakan salah satu profesi yang ikut andil dalam proses penegakan hukum di Indonesia dengan memberikan kepastian, ketertiban dan perlindungan hukum ditengah-tengah masyarakat, khususnya dalam hal kebutuhan akan suatu alat bukti yang mengikat selain alat bukti saksi, yaitu berupa pembuatan Akta Otentik. Dalam Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Jabatan Notaris telah dijelaskan mengenai segala aturan tentang profesi Notaris yang salah satunya adalah mengenai Notaris Penggati. Keberadaan Notaris Pengganti sangat penting dalam rangka mengisi kekosongan pejabat Notaris yang sedang cuti, sakit, atau untuk sementara berhalangan menjalankan jabatannya sebagai Notaris, agar tetap menjamin kepastian hukum bagi masyarakat. Pengaturan tentang syarat, tanggung jawab, larangan, serta wewenang Notaris Pengganti telah diatur dalam Undang-Undang Republik Indonesia Tahun 2014 Tentang Jabatan Notaris.Tujuan Penelitian ini untuk mengetahui bagaimana Peran serta fungsi Notaris pengganti, dan Tanggung Jawab serta Akibat Hukum dari Akta Notariil yang dibuat oleh Notaris Pengganti setelah masa jabatannya selesai. Teori Hukum yang digunakan dalam penelitian ini adalah Teori Manfaat dan Teori Kepastian hukum. Metode Penelitian yang dipakai dalam penelitian ini adalah normatif-empiris, yaitu Penelitian tidak hanya dilakukan berdasarkan kepustakaan tetapi juga dalam pada setiap peristiwa hukum yang terjadi di masyarakat.Hasil Penelitian ini menunjukan bahwa Notaris Pengganti mempunyai bentuk Tanggung Jawab serta Akibat Hukum yang sama dengan Notaris yang digantikan, ini telah tertuang dalam Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Jabatan Notaris. Notaris Pengganti juga dapat dimintai pertanggung jawaban atas segala akta yang dibuatnya semasa menjalankan jabatannya.Kata Kunci: Tanggung Jawab, Akibat Hukum, Notaris Pengganti ABSTRACTNotary Profession is one of the professions that contribute in the process of law enforcement in Indonesia by providing certainty, order and legal protection in the midst of society, especially in the case of the need for a binding evidence in addition to witness evidence, which is in the form of making Authentic Act. In the Law of the Republic of Indonesia Number 2 Year 2014 About Position Notary has been explained about all the rules about the Notary profession, one of which is about Notary Penggati. The existence of a Notary Substitute is very important in order to fill the vacancy of a Notary official who is on leave, sick, or temporarily unable to perform his / her position as a Notary, in order to ensure legal certainty for the community. The regulation of the terms, responsibilities, restrictions and authority of the Notary Substitute has been regulated in the Law of the Republic of Indonesia Year 2014 on the Notary's Office.The purpose of this study is to find out how the role and function of the notary replacement, and the responsibility and the legal consequences of the Notarial Deed made by the Notary Substitute after the end of his / her term of office. Legal Theory used in this research is Benefit Theory and Theory of Legal certainty. The research method used in this research is normative-empirical, that is research is not only done based on bibliography but also in every law event that happened in society.The results of this study indicate that the Notary Substitute has the same form of Responsibility and Legal Effect with the notary being replaced, it has been contained in the Law of the Republic of Indonesia Number 2 Year 2014 About Notary Position. Abstract

This study aims to determine the implementation of Credit Agreement with the guarantee of Mortgage Right made by Notary of Land Deed Officials at PT. Bank Jateng Branch Slawi, Tegal Regency, to know the role of Notary Land Deed Officials, to know the constraints faced by Notary and what the solutions can be considered to solve the problem. This legal investigation included a descriptive type of empirical legal research. Research location was at PT. Bank Jateng Branch Slawi, Tegal Regency and the Notary office of Dewi Milasari, S. Sos., S.H., M.Kn as Notary PPAT partner. Based on this research, it found that credit granting mechanism in PT. Bank Jateng Branch Slawi, Tegal Regency is done through 5 stages: stage of loan application, credit analysis, credit decision, credit agreement and credit binding stage. Before credit agreement is executed, Notary as a partner is obliged to check the validity of guarantee of Mortgage Rights, Notary PPAT in credit agreement with guarantee of Mortgage right provides legal certainty for parties holding credit agreement. The constraint faced by Notary in making credit with Mortgage Right is the credit agreement draft which has been prepared by bank (creditor). However, the contents are unfair or more disadvantageous to the customer (the debtor), and the banking party often (creditor) absent in the signing of the deed.Keywords: Role of Land Deed Officials; Credit Agreement; Mortgage Rights
