Abstract

Premarital agreements on joint property made before or during the marriage took place, the parties may determine the contents of the agreement, especially respect the innate property of each party in a premarital agreement. In Act No. 1 of 1974 About the Marriage of Article 29 paragraph (1) confirms that at the time or before the marriage took place two parties by mutual consent may submit a written agreement authorized by the employee registrar of marriage, after which it shall also apply to third parties lodged. Having made premarital agreement then the next must be registered in the district court clerk's office in legal marriages were held, the purpose of such registration in order to satisfy the principle of publicity. Background of the problem, authors conducted a study entitled "Juridical Study Of Premarital On Joint Property Which Made By Notary And Legal Consequences In The District Of Kudus". This study raises the issue of implementation of joint property on premarital agreement made by the notary in Kudus and the legal consequences of the implementation of a premarital agreement. The purpose of this study is to investigate the implementation of the agreement For Premarital of joint property made by a notary in Kudus and to know the legal consequences of a premarital agreement made by the notary. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by descriptive analysis method. Based on the results of data analysis concluded that Premarital agreements about the estate property that is made before a notary in the Kudus District by husband and wife time before or after the course of the marriage as provided for in Article 29 of Act No. 1 of 1974 About Marriage asserts that the agreement must not violate limits of the law, religion and morality. Agreement it means the contents can be related to any of any one of them the separation of joint property during the agreement was detrimental to the parties and does not conflict with the nature and purpose of marriage. The legal consequences premarital agreement made by a notary it is binding and valid as the Law for the parties. Abstract

ABSTRAKHasil penelitian ini menunjukkan bahwa Pelaksanaan tugas pengawasan jabatan notaris oleh Majelis Pengawas Daerah Kabupaten Sleman mengacu pada Pasal 1 ayat 5 Permen nomor M.02.PR.08.10 tahun 2004 bahwa pengawasan sebagai kegiatan yang bersifat preventif dan kuratif. Kegiatan preventif meliputi kewenangan yang bersifat administratif, sedangkan yang bersifat kuratif adalah kegiatan tentang pengambilan tindakan terhadap dugaan pelanggaran yang dilakukan oleh notaris terhadap UUJN dan kode etik. Hambatan-hambatan dan solusi pelaksanaan tugas pengawasan jabatan notaris oleh Majelis Pengawas Daerah Kabupaten Sleman yang bersifat intern meliputi: anggaran yang minim,sarana penunjang yang terbatas dan kesibukan masing-masing pengurus. lalu yang bersifat ekstern adalah jumlah notaris yang banyak sejumlah 180 notaris, protokol notaris yang tidak tertata rapi, paradigma yang keliru oleh Notaris tentang jabatan notaris sebagai pengusaha akta. Solusi dengan menambah anggaran melengkapi sarana prasarana, sosialisasi, seminar dan rapatSaran kepada MPD untuk meningkatkan pengawasan terhadap Notaris dengan melakukan pemeriksaan rutin secara teratur dan disiplin. Pemberian sanksi terhadap notaris harus diterapkan dan dijalankan dengan benar dan tegas.Kata Kunci : Majelis Pengawas Daerah, Notaris, PengawasanABSTRACTThe results of this study indicate that The implementation of supervisory duties of a notary by the Regional Supervisory Board of Sleman Regency refers to Article 1 paragraph 5 of Candidate number M.02.PR.08.10 in 2004 that supervision as activities that are preventive and curative. Preventive activities include administrative authority, while curative is an activity of taking action against alleged violations committed by notary to UUJN and code of ethics. 2. Obstacles and solutions for the implementation of supervisory duties of notary public by the Regional Supervisory Board of Sleman Regency that are internal include: minimal budget, limited supporting facilities and busyness of each board. then the extern is the number of notaries that many a number of 180 notaries, notary protocols that are not neatly arranged, a paradigm that is not mistaken by notaries about the notary's position as a businessman deed. Abstract

Hak Tanggungan adalah Hak Jaminan yang dibebankan pada hak atas tanah sebagaimana dimaksud dalam Undang-undang Nomor 5 Tahun 1960 Tentang Peraturan dasar Pokok-Pokok Agraria, berikut atas benda-benda lain yang merupakan satu kesatuan dengan tanah itu, untuk pelunasan utang tertentu, yang memberikan kedudukan yang diutamakan kepada kreditor tertentu terhadap kreditor-kreditor lainnya.Terhadap Pemasangan Hak Tanggungan masih ada yang menggunakan Nama Sertifikat Hak Milik yang telah Meninggal Dunia. Disinilah Peran Pejabat Pembuat Akta Tanah berlaku.Tujuan dilaksanakannya Penelitian ini karena untuk mengetahui Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, Problematika Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, dan Cara mengatasi Problematika Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan.Penelitian ini menggunakan metode pendekatan yuridis normative, dalam pengumpulan data lebih ditekankan pada penguraian dan penafsiran data-data yang dikaitkan dengan kaidah-kaidah hukum, yakni berupa peraturan perundang-undangan, menelaah kaidah-kaidah hukum maupun teori ilmu hukum serta di tambah dengan wawancara kepada para pihak yang terkait dengan masalah yang di teliti.Berdasarkan hasil penelitian yang penulis lakukan, maka diperoleh hasil sebagai berikut : Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis Keadilan, Problematika dan Cara Mengatasi Problematikan Peran Pejabat Pembuat Akta Tanah terhadap Pemasangan Hak Tanggungan dengan Nama Sertifikat Hak Milik yang telah Meninggal Dunia yang dilakukan proses Turun Waris kepada Ahli Waris Berbasis.Kata  kunci :  Pejabat Pembuat Akta Tanah, Hak Tanggungan, Sertifikat hak Milik, Turun Waris

Abstract

The purpose of this study was to: 1) analyze the position adopted child's inheritance rights in Islamic Law Compilation (KHI). 2) to analyze the implementation of the division of property as inheritance to an adopted child Compilation of Islamic Law (KHI). 3) Analyze the legal consequences of the implementation of the division of property as inheritance to an adopted child Compilation of Islamic Law (KHI).This study was prepared using the type of normative juridical research, the research focused on reviewing the application of the rules or norms of positive law. This study uses the approach of legislation (statute approach) And the approach of the case (case approach). The data collection was obtained by interview and literature. Analysis of data using qualitative descriptive.The research results are: 1) Position Adopted in the Compilation of Islamic Law that adopted children may not be recognized to be the basis and cause of inherited, because the basic principle in Islamic inheritance law is their blood relations / nasab / descent. So as the solution according to Islamic law compilation is by jalam Award "was borrowed" on condition should not be more than 1/3 (one third). 2) The division of property as inheritance to an adopted child Compilation of Islamic Law (KHI) must meet two requirements that are required to accept the will not the beneficiary, the person who died both the grandfather and the grandmother has not provided to the child that must be made a will, the amount with other roads, such as grants for example, and if he has less than the sum was borrowed, then it should enhanced the will. 3) The role of the Notary in deed was borrowed for a foster child is doing what desired heir and explain all that heir to all the heirs, it is intended to provide clarity and legal certainty for all heirs of things execution of wills which heir to all his heirs.Keywords: Inheritance, Adopted, Compilation of Islamic Law.

Abstract

Notaries have the legal authority for the preparation of an authentic deed. To improve the quality and quantity of a Public Notary, apply to the Notary, namely Regulation No. M.02.PR08.10 Menkumham of 2004 on the Supervisory Council of Notaries. The purpose of this study was to determine the technical supervision of Notary conducted by MPD Surakarta, Role and Functions of MPD Surakarta and to determine the effectiveness of supervision MPD Surakarta in implementing the Notary supervision in the region. In this study the authors use empirical juridical approach, whereas the method of data collection using interviews and literature. The results showed that the supervision of a Notary by MPD Surakarta include: examination Notary protocols, guidance and counseling, giving approval / consent with respect to the interests of the criminal justice process to call and check Notary deed relating to the making. Notary performance Surakarta, among others: Notary of Surakarta less orderly in the making and reporting Notaries protocols, Notary unknown where the position / office address, and notaries who are rarely in the office so it was hard to see him. Barriers experienced by MPD Surakarta, among others: lack of equipment and adequate infrastructure, the limited time the members of the MPD Surakarta busy with the duties of each, a limited budget, MPD does not have the authority to impose sanctions against notaries who violate of Notary.Keywords: MPD Authority; Oversight of Notary; Notary Development.

Abstract

ABSTRAKTujuan Penelitian ini 1.) Untuk mengkaji prosedur pengecekan sertipikat terhadap pencegahan sengketa tanah dalam peralihan hak atas tanah 2.) Untuk mengkaji efektivitas pengecekan sertipikat terhadap pencegahan sengketa tanah dalam peralihan hak atas tanah. Penelitian ini menggunakan metode pendekatan yuridis empiris dengan menggunakan jenis sumber data seperti data sekunder,data primer,dan data tersier. Berdasarkan hasil analisis data disimpulkan bahwa: 1.) Prosedur pengecekan sertipikat hak atas tanah yaitu dengan menyerahkan sertipikat asli disertai data pendukung berupa identitas pemegang hak atas tanah, dan apabila dikuasakan kepada pihak lain, harus dilengkapi dengan surat kuasa yang dilegalisir oleh pejabat berwenang (Lurah / Camat / Notaris / PPAT). 2.) Pengecekan dilakukan untuk mencocokkan data fisik dan data yuridis yang tersimpan dalam peta pendaftaran, daftar tanah, surat ukur dan buku tanah dan mutlak dilakukan dalam mencegah sengketa pertanahan. Secara umum pengecekan sertipikat telah efektif dalam mencegah sengketa pertanahan pada Kantor Pertanahan Kota Makassar dan menjadi suatu hal yang mutlak sebelum dilakukan peralihan hak atas tanah. Adapun masih terdapat celah dimana pengecekan tidak sempurna memberikan jaminan kepastian hukum terhadap data yuridis maupun data fisik sertipikat,akan tetapi melihat rasio perbandingan kasus yang ditimbulkan karena kesalahan administrasi pada pencatatan sita jaminan pada buku tanah yang sangat jarang terjadi dibandingkan keseluruhan proses peralihan hak yang diproses di Kantor Pertanahan Kota Makassar.KATA KUNCI : Pengecekan Sertipikat , Sertipikat , Peralihan Hak Atas Tanah. ABSTRACTObjectives of this study 1.) To examine the procedure of checking the certificate on the prevention of land disputes in the transfer of land rights 2.) To examine the effectiveness of certification checks on the prevention of land disputes in the transfer of land rights. This research uses empirical juridical approach method by using data source type such as secondary data, primary data, and tertiary data. Based on the result of data analysis, it is concluded that: 1.) Procedure of checking of certificate of land right that is by submitting original certificate accompanied by supporting data in the form of identity of holder of land rights and, if authorized to other party, must be completed with power of attorney legalized by authorized officer / Sub-district / Notary / PPAT). 2.) Checks are made to match physical data and juridical data stored in registration maps, land lists, measuring letters and land books and are absolutely essential in preventing land disputes. In general, certification checks have been effective in preventing land disputes at the Makassar Land Affairs Office and becoming an absolute matter prior to the transfer of land rights. There is still a gap where imperfect checks provide legal certainty for juridical data and physical data of the certificate, but see the ratio of cases caused by administrative error in the confiscation of confiscation records on the land book that is very rare compared to the whole process of transfer of rights processed in Land Office of Makassar City.KEYWORDS: Checking the Certificate, Certificate, Transfer of Land Rights.

Abstract

This study aims to determine and analyze the role of notary in the process of making pawn bonding deeds in PT. Pegadaian (Persero); knowing and analyzing the consequences of legal wanprestasi against pawn bonding deed in PT. Pegadaian (Persero) in the perspective of law objectives, as well as to describe the solution in overcoming the debtor's default.The method used in this study is the method of normative juridical approach that emphasizes the decomposition and interpretation of data associated with the rules of law or doctrines namely the Book of Civil Law, Government Regulation No. 103 of 2000 on the Public Corporation Pawnshops.The result of this research is that 1) The role of notary in binding process of guarantee of pawn with fidusia notary system does not come into play directly but the product produced by a notary is indispensable, so that later can be used as document to anticipate things unwanted by the parties, by first entering into the mortgage agreement as the principal agreement while the bond agreement binding agreement with the fiduciary system in PT. Pegadaian (Perero) is merely an accesoir agreement of the principal agreement of credit agreement. After the signing of the credit agreement, it is followed by the signing of the guarantee bailing and the delivery of collateral from the debtor to the creditor. However, in the pawn bond agreement with the fiduciary system, the guarantee goods remain controlled by the debtor to be treated, stored and used as well as possible while PT. Pegadaian (Persero) as the creditor only keeps Proof of Ownership of Motor Vehicle owned by debtor, 2) Effect of law of wanprestasi in agreement of pawn binding through fiduciary system in perspective of law objective at PT. Pegadaian (Persero) is that the juridical object of mortgage guarantees is in the power of creditors but because it uses fiduciary system then PT. Pegadaian (Persero) allows the debtor to control the guarantee items to be treated, stored and used, but if the debtor wanpretasi then the PT. Pegadaian (Persero) may confiscate collateral goods from the debtor party but by first sending a warning or a reprimand letter with the criteria approved in the previous credit agreement and 3) Solution to overcome the debtor wanprestasi in pawn bond agreement in fiduciary system at PT. Pegadaian (Persero) then it can be done by checking and visiting the debtor's home to know the condition of the collateral whether it is still in place of the debtor or has been transferred to another party also to know the condition of the last assurance whether it is still as usual or there has been a physical change, which resulting in the selling price down and so forth.Keywords: Notary Role, Default, Deed of Pawn License

Abstract

In its development in terms of making the Deed of Granting Mortgage or APHT the debtor can not be present which is then represented by his representative, the consequences of the debtor's representative then the APHT must be made with SKMHT or Power of Attorney Imposing Mortgage Rights. The SKMHT is made by a notary public. But in its development based on Article 96 PMNA / Per.Kaban No. 3 of 1997 as amended by Regulation No. 8 of 2012 requires that the deed is made in accordance with the form or form made by the BPN or the Land Agency, even though it is clear that it has contradicted the provisions related to the deed according to Article 15 paragraph (1) of Law Number 2 of 2014 is not quite right, this is because The notary is authorized to make an authentic deed, not to make a letter, or fill in blanks, such as SKMHT where the manuscript is made by BPN. So it is clear that the current SKMHT has contradicted the provisions referred to in Article 15 paragraph (1) of Law Number 2 of 2014. The type of research in this writing is sociological juridical. Abstract

The purpose of this study is to 1. To know and analyze the prospects for a notary protocol archiving in electronic form, 2. To identify and analyze the force of law on notary protocol archiving in electronic form. The data used in this research is secondary data is data obtained through library research. Secondary data in this study is divided into two (2) in the form of primary legal materials and secondary law to support the study, then analyzed with descriptive analysis method.Based on the results of data analysis concluded that: 1) the prospect of a notary protocol archiving in electronic form can be judged from the aspect of economic and legal aspects. Economically, the electronic storage notary protocols aimed at more practical, efficient, cheap and safe. While the legal aspects, can assist and facilitate the legal proceedings related to the rules of evidence that electronic evidence. 2) The legal force of proof protocol notary electronically stored in evidence in the field of civil law can only serve as a backup and not as a copy of which has no binding force, due to the restrictions given by the ITE Law in Article 5 (4 ) that the electronic document that does not qualify the authenticity of the documents as stipulated in Article 1 point 1 UUJN Amendment and Article 1868 of the Civil Code, with the idea or discourse on the transfer protocol notary of conventional (paper based) into an electronic (digital based) then the notary profession in carrying out the authority and obligation to keep archives and documents in a notary's protocol will become more effective and efficient.Keywords: Normative Juridical Studies, Protocols Notary, Electronics.

Abstract

Notary is a public official authorized to make an authentic deed to the extent that the making of such a certain authentic deed is not reserved for other general officials. The making of an authentic deed is required by law and regulation in order to create certainty, order and legal protection. In addition, the authentic deeds made by or before the notary are not only required by legislation, but also because it is desired by the parties concerned to ensure the rights and obligations of the parties. Notary became one of the general officials who provide services in the form of archiving files that have been done by the parties. What is meant by filing is to bind any legal acts committed by the parties in the notary's office. To achieve the objectives used legal juridical Normative research is the study of the law that focuses on the study of documents or bibliography, but to complement the data obtained from the study of documents or library then conducted field research, ie from the sources. Data analysis used is qualitative data analysis. Notary pursuant to Article 1 paragraph 1 of Law number 2 of 2014 concerning Position, Notary is a public official authorized to make authentic deeds and other authorities as referred to in this law. And still in Article 1 paragraph 13 UUJN (Position Notice Act) Protocol is a collection of documents that are archives of the state that should be kept and maintained by a notary. From the result of research and discussion it is concluded that rejecting protocol from other notary is not justified, because every notary must accept protocol from other notary it is stated in Notary Appointment Letter. Notary holder of the protocol shall only be responsible for securing state documents, submitting minas deed if necessary, in case of responsible criminal acts shall remain the notary making. It is stipulated in the Notary Office Law Article 65 that a notary, a substitute notary, a notary public official is responsible for every deed he has made even though the notary protocol has been transferred or transferred to the notary notary of the notary protocol.
