Abstract

The essential problem of human rights violation is a matter of human life. The issue raises many new problems, including the trauma suffered by victims and guilty feelings experienced by perpetrators. Some cases of human rights violation, can often be resolved by the constitutional court. Other cases cannot be solved by laws and regulations that have been established. In such cases, it requires an accomplishment by using another point of view, for example, by understanding the basic structure of human person, based on Hannah Arendt's philosophy of action. This research is a qualitative research with emphasises library research in obtaining data. Methods used in this study are hermeneutics, and heuristics. The formal object is human person that is part of philosophy of human. Theory of human person which is categorized into three parts, namely: the personality of human, self identity of human, and the uniqueness in the sociality of human. The result of this research is an exposure of the philosophy of human action, as an ultimate activity in the vita activa. Human beings as individuals, are body and soul; soul and mind. Self identity is understood not only as the present, but also the past and the projections of the future. Human beings develop continuously in the historicity of the time, so that each individual is unique from the others. This uniqueness colors the difference in plurality of life which is expected to keep the friendship in a community. Arendt's philosophy has been successfully answered the problem for human rights violation during the under Nazi rule. Arendt's analysis of the problem for the emphasis on the human personality-conscious thinking in a situation that tends to be authoritarian. Another analysis is the human ability to forgive, promise and build friendship. It is inspire to answer the problem for human rights violation at Indonesia upon 1965-1966. Understanding based on consciousness thinking, forgiveness, promise and friendship will break the cycle of revenge, restore social memory, and ensure the creation of rights of every citizen.

Abstract

The simultaneous process of social-culture transformation emerges a complex problematic in the sector of law; especially it is related with the law certainty. The clash of values occurred intensively and extensively fixes a polemic whether the law must be stable or is always in changing. The law that is always in changing will leave a certainty as an essential character of law. On the contrary, the law that stable in its nature will turn up a problem, it will not accommodate the internal dynamic. The sect of Sociological Jurisprudence, in its effort tries to formulate a harmonious synthesis by positing the significant meaning of customary law and the written constitution as a tool of social live arrangement in order to manage it better. The certainty of law will be achieved throughout continuous dialog process between rationality and experience, between fact that happen in the social life and the ideal normative of juridical values those are formulated in constitution. The certainty of law can be approached properly if it is supported by professional lawyer apparatus that has high moral integrity. The task of judge is not only to be speaker of constitution but also to enforce the justice. Therefore, the law enforcer should has sensitive feeling in understanding the phenomena of social justice that is desired by society, formulating the social justice in the constitution, and implementing the constitution wisely.

Abstract

Behaviorism as a mainstream in psychology occupies a very significant position in decades. Behaviorism developed a method that is able to overcome the shortcomings of introspection in psychology studies. There are three basic assumptions in behaviorist psychology : (1) The method of behaviorist is out-inside (from outside to inside) so that the focus of the study on psychology is behavior and not on the internal mental state. The method of behaviorist psychology is the opposition of the Cartesian model of thinking that is inside-out. (2) The purpose of psychology was the prediction of behavior. (3) The human body is mechanically qualitatively not much different with animals, just to be more complex, so that there is no qualitative difference between the behavior of humans and non-humans. Based on the above assumptions, the fundamental problem that then arises are follows: (1) Ignored or even rejection of consciousness as a part that should be considered in human behavior. (2) Explanation of a very mechanical style behaviorist only able to explain human behavior in terms of a materialist causa, formalist, and efficient, regardless of cause of finalists who put more emphasis on the intentions of the action. (3) Behaviorism too dogmatic in its aim to predict behavior. Regardless of the problems that exist in the assumptions behaviorist psychology, the flow is still able to contribute in explaining people's behavior, given the influence of the environment (both physical and social environment, cultural and economic) as a source of effective stimulus for the behavior of individuals. Keywords: psychological behaviorism, behavior, mechanical, behavioral prediction.

Abstract

Since Auguste Comte period, natural science dominated the development of scientific methodes and even used in social, humanities, and cultural sciences. In the end of 19th century, any consciousness of unsuffcient method of natural science was begun. Wihelm Dilthey (1833-1911) started using new way. He was a person who attempted to differ geisteswissenschaft and naturalwissenschaft to make different method. He introduced hermeneutics as an alternative method for humanities.

Abstract

This study focus on the concept of material world according to Muhammad Iqbal, which can strengther the faith of Allah.This research was conducted by studying literature through interpretation method and logical thinking.The result of the research shows that the material world is not a final and static product. The material world is the reality in the progressive movement which is always flowing and changing. It is an action, a flowing from chaos to cosmos, a life and consciousness as an impact of evolution process, which is unlimited. In this perspective, the material world factually is a self, like the self of man.

Abstract

In response to the Colonial discriminative and exclusive concept of humanism, Frantz Fanon, an Algerian postcolonial thinker, proposes that the idea of humanism needs to be inclusive. To avoid the trap of the essentialist concept of humanism, Fanon argues that our understanding of human beings needs always to be connected with the existing social structure. By utilizing a postcolonial theory as a lens of analysis, this study will explore Frantz Fanon’s existential concept of human existence and investigate his philosophical-political thoughts. This exploration is driven by these critical questions: how is Fanon’s new understanding of the existential concept of human existence, which he proposes as a more inclusive concept? How does Fanon draw the correlation between human existence and social structure? What is the significance of his thoughts to critically investigate the socio-political structure in the postcolonial Indonesia? Our critical research will focus mainly on several of Fanon’s works: The Wretched of the Earth, Toward the African Revolution, and Black Skin White Masks. His other works will certainly be considered. We will utilize a litterer critical analysis method in approaching these works of Fanon. This new concept of Fanonian humanism, we argue, gives a theoretical frame and direction to develop existentially our understanding of an inclusive Indonesian humanism.

Abstract

Posisi metafisik Edmund Husserl seringkali diperdebatkan di antara para komentatornya: apakah Husserl itu realis, idealis, atau netral secara metafisik. Alih-alih berambisi untuk membuat klaim yang terlalu umum tentang pemikiran Husserl, penelitian ini hanya fokus pada teori intensionalitas untuk mengetahui bagaimana komitmen metafisik Husserl di dalam teori tersebut. Penelitian ini, oleh karena itu, bertujuan untuk melakukan rekonstruksi metafisik terhadap teori intensionalitas Edmund Husserl dan kemudian membuktikan bahwa intensionalitas Husserlian lebih bercorak realis daripada idealis ataupun netral secara metafisik. Dengan menggunakan metode analisis tekstual terhadap karya-karya Husserl, penelitian ini setidaknya menghasilkan empat temuan. Pertama, intensionalitas kesadaran terhadap objeknya, dalam kerangka Husserlian, selalu dimediasi oleh makna. Kedua, objek intensi di dalam intensionalitas Husserlian itu bersifat transenden dan independen dari kesadaran. Ketiga, objek yang sama dapat diintensikan dengan mediasi makna yang berbeda-beda sesuai dengan perspektif yang menyituasikan intensi. Oleh karena itu, keempat, teori intensionalitas Husserl dapat dikategorikan sebagai salah satu versi dari realisme perspektival.
