Abstract

‘Urf in ushul fiqh is categorized as a source of Islamic law or a valid (disputed) Islamic legal proposition, but in the various products of Islamic jurisprudence that exist, it turns out that all schools use ‘urf as a source of law. The categorization seems to contradict the facts of the existing fiqh. Based on this, the focus of the study of this article is to unravel the ulama’ debate about the status of ‘urf in legal terms in each school. By using the library data analyzed in content (content analysis) in depth, it can be concluded that all schools use ‘Urf as a legal proposition or legal source even though the ushul fiqh is classified as a valid (disputed) legal proposition.

Abstract

This hadith through two chain lines; Anas and Mughaffal. For the history of Anas, there is no diversity in his lafadz, except in muwaththa’ having the difference of lafadz because of the other likelihood and the possibility of tanawwu’ in this hadith. While the history of Mughaffal is the diversity of lafadz. This history of Muslim is of shahih and muttashil. There are three versions of basmalah reading model on jahriyah prayer; Shafi’iyyah argues basmalah sunnah read aloud (jahr). With the basis of the argument stating basmalah is the part of al-fatihah that must be read jahr; Some scholars believe basmalah sunnah is read softly (sirr). This is the opinion of al-Bukhari, Muslim, al-Zaila’i, Ibnul Qayyim, Hanafiyyah, and Hanabilah with the basis of absence of the shahih and sharih that the Prophet hardened basmalah reading; and Malikiyyah argues that reading is jahr. Ibn Taymiyah explains that none of the hadith expressly basmalah reading jahr, but there is a history that the Prophet had hardened basmalah readings, so the right is the Prophet sometimes basmalah and sometimes breaks it, but most often it is toss it down so that’s more important. Basmalah is read by jahr because of the existence of a great ally to achieve.

Abstract

The Qur’an describes the heirs only three verses that govern in detail, detail, and clear. Article 179 KHI husband gets half the part on the condition that the corpse does not leave the child or grandchildren and gets a quarter of the portion on the condition that the corpse leaves the child or grandchild. The widow or widow (wives) in section 180 KHI gets a fourth part on the condition that the corpse leaves no children or grandchildren and gets an eighth part on the condition that the corpse leaves the child or grandchild. Partial, quarter, and eighth part of section 179 and section 180 KHI are from inheritance or inheritance. Surely the property is not a property that is still a treasure of gono gini or mutual property. So if the property is still belonging together then it should be divided into two parts if each husband is working together, the husband works outside the house while the wife works in the house or divided three two parts for the husband and one part for the wife or vice versa.

Abstract

In the concept of procedural law in Indonesia, when the verdict has been handed down and divorce has been dropped, the husband is obliged to fulfill his ex-wife's livelihood rights, but in reality the problem arises namely the assumption that after the divorce occurs there is no more thing that needs to be done by the husband, including giving a living to his ex-wife and child after the divorce. The law has arranged a solution for that, namely by the process of execution, but because the execution costs are too expensive compared to the amount of income that is not much, then the community fails to make the request for execution. This is the reason for the policy carried out by the Religious Court

Abstract

Pernikahan sirri, atau yang biasa juga disebut pernikahan bawah tangan, adalah pernikahan yang dilakukan secara diam-diam atau tersembunyi (secret marriage) tanpa diketahui atau tercatat di lembaga negara. Sedangkan pernikahan dengan menggunakan akad Madzhab Hanafi, ialah pernikahan dengan ketentuan syarat dan rukun yang ditentukan oleh Madzhab Hanafi. Perbedaan paling mencolok dibanding dengan madzhab lain adalah tentang kebolehan bagi perempuan untuk menikahkan dirinya sendiri tanpa adanya wali. Pernikahan jenis ini yang kemudian banyak terjadi di kalangan mahasiswa. Pernikahan sirri dengan menggunakan madzhab Hanafi telah banyak dilakukan oleh mahasiswa kota Malang dengan dalih untuk menghindari zina dan seks bebas. Pernikahan jenis ini terjadi tanpa sepengetahuan wali dan orangttua masing-masing mempelai. Setelah menikah, pola hubungan suami-istri ini nambah biasa dan berjalan sama seperti sebelum terjadi pernikahan, kecuali masalah hubungan intim yang dilakukan secara rutin dan tersembunyi di rumah kost. Nafkah juga tidak menjadi tuntutan bagi suami, namun istri harus siap jika dipanggil untuk melakukan kewajiban ‘badaniyah’. Sayangnya, beberapa informan justru menggunakan pernikahan ini sebagai legitimasi hukum Islam atas petualangan seksual dan rasa penasaran jiwa remaja mereka. Salah satu contoh adalah adanya poligami dan perceraian yang terjadi dengan alasan yang sebenarnya tidak mendesak untuk dipenuhi. Sejujurnya, menurut peneliti, pernikahan ini terjadi justru dengan mengesampingkan makna agung dari pernikahan itu sendiri dan hanya berfungsi sebagai legalitas dalam menghindari dosa akibat zina Kata Kunci: Pernikahan Sirri, Madzhab Hanafi, Seks Pranikah

Abstract

The draft of Law on the Religious Courts Material Law is a draft law that is still in the stage of discourse and declaration by the authorities. This draft law has one article that is quite interesting to study, namely the law of punishment for sirri marriage. As an eastern country that still follows eastern wisdom; and Indonesian people who are Muslim, there are still many practitioners who practice sirri marriage among the people. This is due to many factors including lack of marriage registration material, less socialized marriage regulations and others. Many approaches are carried out by researchers from socialist circles, academics and historians who produce different assumptions about the problem of "reluctance to marriage records". This law is in accordance with the spirit of Islam in order to benefit. The maqashid syariah approach is an effective approach in combining positive law and shari'ah law.

Abstract

This study analyzes how the concept of punishment is in the learning process. Given how much controversy caused by the application of penalties that are considered not ideal and as acts of violence. Therefore, the concept of punishment is needed to improve the application of penalties that are not in accordance with the provisions of the Law and Islamic Shari'a. This literature study examines the concept of applying the perspective penalty of Ibnu Sahnun, which places more emphasis on the state of child psychology. With the hope that the concept of educational punishment becomes a reference in the process of applying punishment in the learning process. The main source of this study is a book by Ibnu Sahnun which deals with punishment, namely the book Adab al muallimin, also a book written by other writers who support the application of punishment in education. This study concludes that there are three types of educative punishment by Ibnu Sahnun, namely bi nadri (see with a cynical view), bi oral (advise), bi darban (punch). The three types of punishment are very relevant when applied in the learning process
