Abstract

The universalism of Islamic teachings, which are based on the text of the Koran and Hadith and are always in line with contemporary developments, must be supported by contextual understanding as well as textual understanding. This includes the application of a hermeneutic perspective, which aims to interpret, comprehend, and translate the true reality concealed within the text. This study intends to investigate the applicability of hermeneutics to Yusuf Al-Qaradhâwî's understanding of formulating Islamic law from the Prophet ﷺ's hadiths, in addition to conducting a comparative and thematic analysis of other scholars' hermeneutic interpretations. The study employs a qualitative research methodology, theme analysis, and literature review techniques to examine Al-Qaradhâwî's writings on the hadith of the Prophet ﷺ. The contextual and historical factors that shaped his comprehension of the hadith are emphasized. The analysis's findings demonstrate that Yusuf Al-Qaradhâwî's comprehension is essentially similar to that of traditional hadith scholars. Nonetheless, he provides thoughtful and practical approaches and ideas for comprehending the Prophet's sunnah in a contextual and all-encompassing manner. It is intended that the findings of this study will make a significant contribution to raising scholarly awareness of the applicability of hermeneutics in this situation. In addition, it can be a valuable source of information for future research aimed at understanding Islamic law originating from the hadith of the Prophet ﷺ.

Abstract

This abstract aims to elucidate the phenomenon of Friday sermon uniformity in Malaysia, revealing its intricate relationship with religion and power. Employing a qualitative approach, this study utilizes interviews and document analysis to uncover the mechanisms behind sermon uniformity. It is found that this practice, rooted in the Malaysian Islamization Program, has evolved into a national discourse, serving as a conduit for government messaging and propaganda. Furthermore, the study illuminates the role of religious authorities, particularly within the monarchy, in shaping and enforcing sermon uniformity. It underscores how the convergence of religious and political agendas is reflected through standardized sermon content, emphasizing the influence wielded by these authorities in upholding religious and cultural norms. Through its findings, this research provides valuable insights into the complex power dynamics within Malaysia's religious landscape, prompting further reflection on the implications of such uniformity in a diverse and democratic society.

Abstract

The history of fiscal policy in Islam during the Fatimid and Mamaalik periods in Egypt, the Syafawiyah in Persia, and the Mughals in India, can be divided into two main phases: the glory phase and the decline phase. In the glory phase, historical records show that fiscal management under the governments of these caliphates generated revenue surpluses. This situation contributes to the country's economic stability and security. The Fatimids, Mamaaliks, Syafawiyahs, and Mughols in India implemented fiscal policies that encouraged increasing state income from diverse sectors such as agriculture, trade, and industry. The state's largest sources of income come from taxes, tīmār, muḳāṭa'a, waqf and ghanimah. High income is used to support the country's progress through financing territorial expansion, infrastructure development, education and health. However, during the decline phase, the Fathimiyah, Mamaalik, Syafawiyah and Mughol experienced budget deficits. Decreasing state income, failure to westernize the economy, high war costs, and high state debt are factors causing deficits in their fiscal policy.

Abstract

Medical personnel (Healthcare Providers, HCPs) have the moral and ethical obligations of fulfilling the health needs of the patients and must be attentive to the patients’ cultural and religious needs. In Hong Kong, we have a small but significant Muslim population but very few Muslim HCPs. More often than not, we simply neglect or forget about the needs for our Muslim patients. The main cause is our lack of knowledge about Islamic Bioethics (IBE) especially on what treatments and procedures are permitted or prohibited. This article provides a detailed analysis to enable HCPs to understand and make decisions on permitted treatments for Muslim patients. This is extremely important for non-Muslim HCPs who have only mediocre or no knowledge in Islam. This study is a comprehensive review on the application of IBE, from their development since the contemporary period to Modern Times, the contributions of Islamic laws and the frames of belief in Sickness and Treatment. A special emphasis is provided for the mechanisms of relieves in reversing Prohibition. Pork is prohibited in Islam. The authors choose Porcine Therapeutics and Porcine Xenotransplantation (PXT) as the model to illustrate how Prohibition is determined in medical therapeutics and how the Prohibition can be reversed such that appropriate treatments can be offered and accepted. This model has the potential of application to all forms of therapeutics and may facilitate the interactions and decision making among HCPs and Muslim Patients. The principles of Shari’ah and maqāṣid shari‘ah, the basis of IBE in relation to sickness and treatment, and their applications to general biomedical issues, Porcine Therapeutics and PXT are explained in details. The prohibitions on the latter two areas can be reversed by invoking Transformation (istihalah), Dire Necessity (ḍarūrah), or Public Interest (maṣlahāh). The current permissibility in Xenotransplantation (XT) is considered to be premature and Dire Necessity (ḍarūrah) cannot be invoked because benefits from XT and PXT have not been established.  Public Interest (maṣlahāh) can be invoked to allow for Experimental Research and Clinical Studies in PXT.

Abstract

This paper examines Asy Syatibi's legal reasoning of istiqra al-ma'nawy (thematic induction) and its impact on Indonesia's indigenization and contextualization of Islamic law. The reasoning model of Istiqra al-Ma'nawy Asy Syatibi was the study's first focus. Hazairin and Hasbi Ash Shiddiqiey are efforts to indigenize and contextualize Islam through the use of Istiqra al-Ma'nawy's method in Islamic legal reasoning. Doctrinal or normative legal research with a philosophical viewpoint A documentation model is used to collect data. This study's analytical method uses interpretive, idealistic, and holistic meta-logic. The notion of "natural law" from Islamic and customary law was applied to assess the facts. This study found that istiqra al-ma'nawy Asy Syatibi's reasoning formulation is based on a maslahah approach-based interpretation model, its idealization model is oriented toward text and context integration (tahqiq al-manath), and its holistic model is operationalized hierarchically from the top down (min al-a'la ila al-adna) and from the bottom up (min al-adna ila al-a'la). The integration and connectivity between anthropological studies of the bilateral kinship system of most Indonesian races and Asy Syatibi's legal reasoning influenced Hazairin's indigenization and contextualization of Islam. Hazairin abstracts the universal ideals in the Islamic system of inheritance via istiqra al-ma'nawy. Istiqra al-ma'nawy was used by Hasbi ash Shiddiqiey to reconcile puritanism and contextualism. The Istiqra al-Ma'nawi method strikes a balance between how law is defined (hukm taklify) and how law is made.
