Abstract

The main purpose of this study is to identify and analyze the implementation of activities financed by the Special Autonomy Fund whether it is in accordance with existing rules/guidelines, whether it is seen from the routine activities, the funds used in each activity, the leverage of the implementation of activity towards the achievement the vision and mission of the regional head, the involvement of the Papuans in the activities, and the influence of the implementation of the activities towards solving the problems of the Local people. Methods used include: Quantitative descriptive statistics in the form of concentration measures, and crosstab analysis. Based on the results of this study it can be concluded that: 1) During the period of 2008-2014 the implementation of programs/activities classified routinely carried out all almost been implemented with reference to the rules / guidelines of the implementation of Special Autonomy in Papua Province; 2) Development Programs /Activities implemented through the use of Special Autonomy funds, indicating the amount of activities that use substantial amount of funds and the implementation is in accordance with the rules/guidelines of the implementation of Special Autonomy in Papua Province; 3) Implementation of development activities using Special Autonomy funds in Jayapura City has been able to play a role in improving the achievement of vision and mission of regional head, whose implementation has been in accordance with existing rules/guidelines; 4) The results of this study indicate that many programs/activities involving the implementation of many Orang Asli Papua, whose implementation has been in accordance with existing rules/guidelines; 5) Implementation of Special Autonomy policy in Papua Province is expected to solve the problems faced by Orang Asli Papua. The results of this study indicate that most of the activities undertaken by the Jayapura City Government using Special Autonomy funds have had an impact/change in alleviating the problems/problems faced by Local People, whose implementation has been in accordance with existing rules/guidelines.

Abstract

Sesuai dengan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup menyebutkan bahwa dalam rangka melestarikan fungsi lingkungan hidup, maka setiap orang wajib untuk melindungi lingkungan. Undang-Undang Nomor 4 tahun 2009 tentang Mineral dan Batubara, mengatur mengenai izin usaha pertambangan. Perusahaan diwajibkan menyetor deposito untuk menjamin reklamasi dan pascatambang. Objek tulisan ini terkait dengan kewajiban deposito sebagai jaminan reklamasi dan pascatambang, dengan menggunakan metode yuridis normatif. Hasil penelitian menunjukkan bahwa setiap perusahaan diwajibkan melakukan kegiatan pertambangan agar dapat melestarikan fungsi lingkungan hidup dan mencegah terjadinya pencemaran dan/ atau kerusakan lingkungan.

Abstract

Penelitian ini bertujuan mengetahui sejauhmanakah konsep lelang jabatan struktural dapat mewujudkan reformasi birokrasi di Indonesia.Penelitian ini bersifat yuridis normatif.Pengumpulan data dilakukan melalui observasi, dokumentasi, dan kajian pustaka.Data dianalisis dengan menggunakan analisis deskriftif kualitatif.Hasil penelitian menunjukkan bahwa konsep lelang jabatan strukturalmerupakan bentuk dari promosi jabatan yang dilakukan secara transparan dan selektif.Sehingga melalui penerapan konsep lelang jabatan struktural diharapkan mampu menghasilkan pejabat eselon yang berkompeten dimasing-masing bidangnya serta dapat mewujudkan reformasi birokrasi di Indonesia.

Abstract

The direct election of Regional Head and Deputy Regional Head directly and democratically by the people is a political process of the Indonesian nation towards a more democratic, transparent, accountable and responsible political life and administration. Therefore, in order to ensure the implementation of election of Regional Heads and Regional Representatives at a time of quality and meet the degree of healthy competition, the requirements and procedures for election of Regional Head shall be stipulated in separate laws and regulations. In general it is said that the direct election of the regional head is more democratic. There are at least two reasons why the idea of direct election is considered necessary: First; to open the door for the appearance of the head of the region in accordance with the will of the majority of the people themselves. Second; to maintain government stability so as not to be easily dropped in the middle of the road. Practice during the regime of Law Number 22 Year 1999 regarding Regional Government, indicates that the election through DPRD mechanism is often opposed even not in accordance with the will of the majority of people in the region. In this connection, there are several reasons why the direct Election of Regional Head (Local Election) is important for the development of democracy in Indonesia are: First; direct regional head elections allow for the strengthening of democracy at the local level, in particular the development of political legitimacy. This is based on the assumption that the elected Head of Region has a strong mandate and legitimacy, because it has the support of the peoples voice directly reflecting the configuration of political forces and the interests of the constituents of voters. This legitimacy is very important for the governing government. Second; Direct Regional Head Election is expected to be able to build and realize local accountability and strengthening of democratic values in Indonesian state administration system.

Abstract

The authority of governance in Papua Province through Act No. 21 of 2001 is very large, as stipulated in Article 4 paragraph (1), which covering all fields of government, except with regard to foreign affairs, defense and security, monetary and fiscal, religion, and justice, and except with regard to a particular field. In addition to the authority, the authority of Papua Province added with partial authority of the Government called a special authority as provided in paragraph (2) is the authority in the field of foreign policy, defense and security, monetary and fiscal, justice and religion. This authority, causing some people argues that leads to form a federal state and also may lead to the disintegration of nation. The assessment object with regard to the substance of Act No. 21 of 2001 that opposed to the concept of a unitary state, and designing a special autonomy of Papua in accordance with the principles of the Republic of Indonesia, by using juridical-normative. The result indicates that the special autonomy through Act No. 21 of 2001 does not conflict with the concept of a unitary state; it strengthens Papuan into the Unitary State of the Republic of Indonesia. Design of special autonomy in accordance with the principles of the Unitary State of the Republic of Indonesia that gives special powers to the province of Papua in the form of delegation of authority is clear and explicit to the Province of Papua through the implementation of devolution theory and delegation of authority from the provincial to the district/cities through the implementation of real household teachings.

Abstract

The aims of the study were to investigate to what extent the essence of waiver of costumary land in Merauke Regency and to investigate to what extent the release of customary land can provide legal certainty for investors. The research was conducted in Merauke, West Papua Privince. The techniques of obtaining the data were interview and field observations. The data consisted of primary and secondary data. They were  analyzed using qualitative analysis.The results of the research indicate that the waiver of customary land is the claim of the existence of indigenous people as a condition of the transfer of land rights in Papua Province especially in Merauke Regancy. The release of customary land for investors benefit in Merauke Regency does not provide legal certainty for investors, so it causes the conflict of land affair. The conflict occurs due to the overlapping of tenure or claim by some tribes over the land rights and land boundaries which are not clear because they are natural boundaries.

Abstract

Laboratorium Klinik dan Bantuan Hukum (LKBH)  mempunyai peran yang penting dalam mengemban Tri Dharma Perguruan Tinggi, karena ketiga dharma tersebut, yaitu dharma pendidikan, dharma penelitian dan dharma pengabdian kepada masyarakat dilaksanakan oleh LKBH yang ada pada Fakultas Hukum. Objek tulisan ini terkait dengan kedudukan laboratorium klinik dan bantuan hukum dalam mengemban Tri Dharma Perguruan Tinggi, dengan menggunakan metode yuridis normative. Hasil penelitian menunjukkan bahwa sejak Undang-Undang Nomor 18 Tahun 2003 tentang Advokat diundangkan, kedudukan LKBH perguruan tinggi nyaris hilang, karena dalam Pasal 31 ada larangan dan sanksi pemidanaan bagi orang yang menjalankan bantuan hukum atau jasa hukum dan bertindak seolah-olah advokat dengan ancaman pidana penjara maksimal 5 (lima) tahun dan denda lima puluh juta rupiah, namun sejak dilakukan judicial review ke Mahkamah Konstitusi atas UU Nomor 18 Tahun 2003 pada Pasal 31, kedudukan LKBH perguruan tinggi semakin jelas yaitu diperkenankan memberikan bantuan hukum. Kedudukan LKBH perguruan tinggi semakin rinci diatur di dalam UU Nomor 16 Tahun 2011 tentang Bantuan Hukum. Dalam undang-undang tersebut, LKBH perguruan tinggi dikelompokkan sebagai organisasi atau lembaga pemberi bantuan hukum.

Abstract

Penyelesaian suatu tindak pidana melalui peradilan formal (Pengadilan Negeri) umumnya masih dirasakan kurang memberikan rasa keadilan bagi korban. Bahkan seringkali masih menyimpan ketidakpuasan (dendam) dari korban (keluarga korban) atas hukuman atau sanksi pidana yang telah dijatuhkan kepada pelaku oleh pengadilan. Keadilan restoratif merupakan suatu solusi yang diharapkan dapat diterapkan dalam menyelesaikan delik adat, yang umumnya penyelesaiannya digagas oleh pelaku untuk menyelesaikan kasusnya secara damai bersama korban (keluarganya). Metode peneltian yang digunakan berupa penelitian hukum empiris (socio legal research). Hasil penelitian menunjukan bahwa penyelesaian delik adat di Papua pada dasarnya dilakukan dengan menerapkan konsep keadilan restoratif, yaitu ide penyelesaiannya dilakukan oleh pelaku kepada korban atau keluarga korban. Apabila tidak berhasil, akan diselesaikan melalui keluarga pelaku dan keluarga korban, atau melalui kepala suku/Ondoafi, atau melalui peradilan adat. Konsep keadilan restoratif ini diterapkan dalam penyelesaian delik adat semata-mata sebagai upaya untuk memulihkan penderitaan yang dialami korban dan untuk memperbaiki keseimbangan kosmis yang terganggu dalam masyarakat.

Abstract

This study aims to determine the status of dual citizenship law (bipatride) for overseas Indonesian overseas (Diaspora). This research is prescriptive legal research with normative juridical approach method in the form of research on the principle of citizenship law with data collection technique through literature study in the form of primary, secondary and tertiary law material with qualitative legal material analysis. The results of the study show that Law No. 12 of 2006 on Citizenship recognizes only limited dual citizenship that the status of the Diaspora citizenship is limited. However, there is a need for further regulation regarding the limitation of the use of this limited dual citizenship because in the Act does not regulate the consequences of circumstances that allow a person to not choose one of his nationalities in the event that the person has limited dual citizenship status.

Abstract

The excellence of customary court for indigenous peoples of Papua as a peace justice institution which is one of the specific rights of Special Autonomy of Papua and it regulated in Article 50 paragraph (2) juncto Article 51 paragraph (1), and Article 43 paragraph (1) of Act No. 21 of 2001 in the field of executive. The recognition of customary court of Papua referred to as “traditional rights” in accordance with Article 18B paragraph (2) juncto Article 24 paragraph (3) and Article 28I paragraph (3) of the 1945 Constitution, its relevance to Article 35 paragraph (3) letter d and Article 58 No. 48 of 2009 and in Article 1 No. (5) of Act No. 49 of 2009 is not synchronized for indigenous peoples of Papuan that perform the function of customary court in the Judicial Power system in the field of judicative informally. The object of this study is related to the primacy of the recognition of customary justice: perspective of judicial power and special autonomy of Papua by using normative juridical method. The results indicate the weakness of the recognition of customary court of Papua against: 1) the institutional of customary court, 2) authority and 3) the decision of customary court over the case or the customary dispute and the principle of ne bis in idem in the function of Judicial Power. Its implementation raises the conflict of norms on the Acts of Judicial Power and the Special Autonomy of Papua. For future, the customary court of Papua needs to be a synchronization of the legal basis of the relationship of authority recognition in the Act of Judicial Power and the Special Autonomy of Papua, in order to fulfill a sense of legal certainty and justice for indigenous people of Papua as multicultural and customary law as the living law.
