Abstract

This study aimed to identify the legal strength and legal consequences of release and discharge in MSAA and MRNIA as a form of personal responsibility of Bank Indonesia Liquidity Assistance (BLBI) debt shareholders. This qualitative research followed the typology of normative legal research. The study used a conceptual approach by examining the concept of MSAA and MRNIA agreements in which a Release and Discharge clause was found. The research data was collected by means of library research and documents. All the data obtained was then evaluated using the theory of Piercing the Corporate Veil, written descriptively, and analyzed qualitatively. The results showed that formally the Release and Discharge clause in MSAA and MRNIA had the legal strength though not materially. Then the legal consequences of Release and Discharge in MSAA and MRNIA for shareholders towards BLBI debt could be personally accounted for.Keywords: Release and discharge; MSAA and MRNIA; personal responsibility of shareholders; BLBIStudi ini bertujuan untuk mengetahui kekuatan hukum serta akibat hukum release and discharge dalam MSAA dan MRNIA sebagai bentuk tanggung jawab pribadi pemegang saham utang BLBI. Penelitian ini menggunakan pendekatan konseptual, yaitu dengan cara mengkaji konsep perjanjian MSAA dan MRNIA yang di dalamnya terdapat klausula Release and Discharge. Data penelitian dikumpulkan dengan cara studi pustaka dan dokumen. Kemudian seluruh data yang diperoleh dari studi kepustakaan dan studi dokumen tersebut direlevansikan dengan teori Piercing the Corporate Veil serta dituliskan secara deskriptif dan dianalisa secara kualitatif. Hasil studi ini menunjukkan bahwa secara formal klausula Release and Discharge dalam MSAA dan MRNIA memiliki kekuatan hukum, namun secara material tidak. Abstract

This research raises the issues of, first, the legal protection of the interests of GMS participants in Law No. 40 of 2007 concerning Limited Liability Companies, and second, the strength of evidence of GMS minutes of meeting prepared in the form of original deed. This study is library research using a normative juridical approach. Based on the results, we conclude that, first, the legal protection for participants in a General Meeting of Shareholders (GMS) has been arranged in detail in the Law on Limited Liability Companies. The resolution of GMS can be prepared as a notarial deed or minutes of meeting in the form of original deed. Second, the strength of evidence of GMS original deed is deemed perfect as a proof of evidence even though it is based on minutes of meeting or private deed. The minutes are then set forth in the form of a Private Deed Resolution. It is an authentic deed because it fulfills the elements of an authentic deed and does not conflict with the laws and regulations.

Abstract

AbstractThis study aimed to examine the legal protection and accountability of banks towards the security of customers’ personal data and deposit in a card skimming case. The research used the normative-empirical approach to related laws and regulations, which were then correlated with the practical implementation. Through a descriptive analysis, this study explained the existing regulations associated with legal theories in practice. Data collection was conducted through library research and interviews. The results indicated that banks are responsible for losses suffered by customers due to card skimming thefts provided that it is proven with CCTV camera recordings and there is no element of negligence from the customer as a victim. Legal protection for customers relating to the accountability of banks should be based on Law No. 8 of 1999 on Consumer Protection, Bank Indonesia Regulation No. 16/1/PBI/2014 concerning Consumer Protection of Payment System Services, and Regulation of Financial Services Authority No. 1/POJK.07/2013 regarding Consumer Protection of Financial Services Sector.Keywords: Banking; ATM cards; ATM machine; card skimming AbstrakPenulisan ini bertujuan untuk mengetahui perlindungan hukum serta pertanggungjawaban pihak bank terhadap keamanan data pribadi nasabah maupun dana simpanan nasabah yang ada pada bank dalam kasus card skimming. Penelitian ini menggunakan pendekatan normatif-empiris yaitu pendekatan undang-undang dan regulasi yang bersangkut paut lalu dikaitkan dengan penerapannya yang terjadi di lapangan. Penelitian ini bersifat deskriptif analisis yang mana menggambarkan peraturan-peraturan yang berlaku dikaitkan dengan teori-teori hukum dalam praktek pelaksanaannya. Pengumpulan data dilakukan dengan cara library research dan wawancara. Hasil penelitian ini menunjukkan bahwa bank bertanggungjawab terhadap kerugian yang dialami nasabah atas pencurian dengan modus card skimming, dengan catatan harus dibuktikan dengan rekaman kamera cctv dan tidak ada unsur kelalaian dari pihak nasabah yang menjadi korban. Abstract

This study examines, first, what are the benchmarks used by court in determining the misuse of circumstance in loan agreements by loan sharks? Second, what are the legal consequences of loan agreements that contain elements of circumstance misuse? This study is library research with a normative juridical approach to observe the phenomenon of loan sharks from a legal perspective. The results indicate that, first, there are three benchmarks used by court in determining the misuse of circumstance loan agreements, including moral benchmark of fairness and propriety, benchmark of good faith, and benchmark of profit. Secondly, the legal consequences of loan agreements by loan sharks can be void if one of the aggrieved parties requests cancellation before the judge due to misuse of circumstance. This reason is then classified into the fourth defect of will apart from the other three defects of will that have been regulated in the Civil Code.Keywords: Loan agreements, misuse of circumstances

Abstract

 AbstractThis study examined, first, the concept of deliberation in land procurement for the interest of public based on Islamic law and, second, the concept of compensation in land procurement for public development according to Islamic law. The answers were found though a normative juridical approach. The results showed that, first, Islam put forward the concept of deliberation for consensus as an absolute term in land procurement for the interest of the public. The concept of deliberation in land acquisition can accommodate the demand of the two parties, particularly the need to obtain justice and to avoid conflicts. Second, considering that the origin of land ownership is a mandate, the government should settle the compensation through deliberation, which refers to the concept of buying and selling with the bargaining principle. Islamic law justifies the transfer of land use rights as long as it is accompanied by compensation. The principle of compensation used is the sale and purchase law because the fundamental norms in the Qur'an and hadith are more general, especially in mu’amalah matters.Keywords: Concept of deliberation and compensation of land acquisition (perspective of Islamic law) AbstrakPermasalahan yang akan diteliti dalam penelitian ini yaitu, pertama, konsep musyawarah dalam pengadaan tanah untuk kepentingan umum menurut Hukum Islam. Kedua, konsep ganti kerugian dalam pengadaan tanah bagi pembangunan untuk kepentigan umum menurut Hukum Islam. Cara untuk menemukan jawaban atas kedua masalah tersebut, maka dilakukan dengan menggunakan yuridis normatif. Hasil penelitian menyimpulkan, pertama, Islam mengedepankan konsep musyawarah untuk mufakat sebagai syarat mutlak dalam hal pengadaan tanah bagi kepentingan umum. Konsep musyawarah dalam pengadaan tanah dapat mencapai keinginan antara kedua bela pihak, terutama keinginan untuk mendapat keadilan, dan menghindari konflik. Kedua, mengingat bahwa asal kepemilikan tanah adalah amanat maka pemerintah dalam menetap ganti kerugian dengan jalan musyawarah yang merujuk pada konsepsi jual beli dengan prinsip tawar menawar. Hukum Islam membenarkan pengambilan hak-hak atas tanah namun disertai dengan ganti rugi. Prinsip ganti rugi yang dipakai adalah hukum jual beli, oleh karena norma-norma dasar yang terdapat dalam Alquran dan hadis masih bersifat umum terutama dalam bidang mu’amalah.Kata-kata Kunci: Konsep musyawarah; ganti rugi pengadaan tanah (prespektif hukum Islam)

Abstract

This study highlighted the issue of arrangement for mandatory BPJS (Indonesian national health insurance) membership from the perspective of competition law. The research method used in this study was the normative juridical method, and the statute approach was employed. The results of the study indicated that the establishment of BPJS was mandated by the Law on National Social Security System (UU SJSN) and Law on National Health Insurance (UU BPJS); therefore, BPJS arrangement for mandatory membership is a permissible form of monopoly. The government monopoly through BPJS in administering health insurance is an obligation, instead, because the contribution of social security is in fact the same as taxes.Keywords: BPJS mandatory membership; competition law Penelitian ini mengangkat permasalahan mengenai pengaturan kepesertaan wajib BPJS dalam perspektif hukum persaingan usaha. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normati. Pendekatan yang dipergunakan dalam penelitian adalah pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa pembentukan BPJS merupakan amanat UU SJSN dan UU BPJS, sehingga pengaturan BPJS mengenai kepesertaan wajib BPJS merupakan bentuk monopoli yang diperbolehkan. Abstract

This study aims to examine and analyze the role of mediators in resolving sharia economic disputes in Sleman Religious Court. We also aim to determine the obstacles faced by mediators when mediating sharia economic disputes in Sleman Religious Court. This research is a normative legal research using a legislative approach and a case-study approach. Based on the results of the study, we find that the role of mediators in solving sharia economic disputes in Sleman Religious Court is generally unsatisfactory due to several obstacles they face although for some cases of sharia economic disputes the role of mediators has been strong enough to achieve agreement deeds . Though remaining insignificant, the role of mediators has been able to reduce the number of sharia economic cases to be resolved by investigating judges.Keywords: The role of mediators; sharia economic disputes; religious court

Abstract

Notary deed is the perfect, strongest, and most complete proof of evidence, thus not only guaranteeing legal certainty but also avoiding disputes. In practice, however, disputes often arise due to the existence of a notary deed. The notary can be liable for his action in making authentic deeds that are not in accordance with the applied provisions or are carried out against the law. This study has 2 formulations of the problem, first, how is the validity of the deed made before a notary containing fraudulent acts according to the Decision of Supreme Court Number 1003 K/PID/2015, and second, how is the notary's liability for the notarial deed containing fraud. The method in this study is normative legal research. The results show that, first, based on the Decision of Supreme Court Number 1003 K/PID/2015 in conjunction with the decision of Pekanbaru District Court Number 247/Pdt.G/2016/PN.Pbr, the Notary Deed No. 149 dated March 30, 2011 is declared valid and valuable before the law, but in terms of the strength of evidence, it is degraded from authentic deed to private deed for violating Article 48, 49, 50, and 51 of Law on Notary concerning Investigators. Second, the notary's legal duty for the deed containing fraud includes criminal, civil, and administrative liabilities.Keywords: Authentic deed; fraud; notary

Abstract

AbstractThis study aimed to examine the responsibilities and efforts of Land Titles Registrar (PPAT) to provide legal protection for the parties involved in the process of land use right transfer through buying and selling. PPAT as a general official who makes deeds, especially the deed of land use right transfer, must have specific capabilities related to agrarian matters, considering that the deed can be used as proof of evidence that explains the existence of legal acts of right transfer. This research was a normative juridical study that used the qualitative methods while exploring primary legal materials and secondary legal materials to review the legal issue. The results showed that the responsibility and effort of PPAT to provide legal protection for the parties involved in the transfer of buying-selling were carried out from the beginning of the agreement, during the process of buying-selling agreement, and until the transfer of rights was performed in accordance with the regulations about PPAT. The obligations of the seller are protected if the buying-selling object has been fully paid by the buyer, and the rights of the buyer are protected if the process of right transfer up to the inclusion of the name in the certificate and handover of the certificate containing the name of the buyer has been conducted. To be able to provide legal counseling and to give examples of legal consequences if the parties fail to meet the requirements of right transfer, a PPAT has to master and understand all the applicable stipulations relating to the transfer of rights through buying and selling.Keywords: Land Titles Registrar (PPAT); land contracts; land use right transfer AbstrakPenelitian ini bertujuan untuk mengetahui tentang tanggung jawab dan upaya-upaya PPAT dalam memberikan perlindungan hukum bagi para pihak dalam proses peralihan Hak Atas Tanah melalui jual beli. PPAT sebagai pejabat umum pembuat akta tertentu khususnya akta peralihan hak tanah, harus memiliki kemampuan khusus di bidang pertanahan, mengingat akta tersebut bisa digunakan sebagai alat bukti yang menerangkan telah terjadi perbuatan hukum pengalihan hak. Jenis penelitian ini bersifat yuridis normatif, dengan menggunakan metode kualitatif, sedangkan untuk mengkaji permasalahan hukum, digunakan bahan hukum primer, dan bahan hukum sekunder. Hasil penelitian menyimpulkan, bentuk tanggung jawab dan upaya-upaya PPAT dalam memberikan perlindungan hukum terhadap para pihak, dalam peralihan hak jual beli, dilakukan sejak awal perjanjian, proses perjanjian jual beli, hingga peralihan hak dilaksanakan sesuai dengan peraturan yang terkait ke PPATan. Kewajiban penjual terlindungi jika obyek jual beli telah dibayar lunas oleh pembeli, dan hak pembeli terlindungi jika proses peralihan hak sampai dengan namanya tercantum dalam sertifikat, dan menerima sertifikat yang sudah atas nama pembeli. Agar bisa memberikan penyuluhan hukum, serta contoh akibat hukum jika para pihak tidak memenuhi persyaratan peralihan hak sesuai dengan apa yang dijelaskan PPAT harus menguasai dan memahami semua ketentuan yang berlaku terkait dengan peralihan hak melalui jual beli.Kata-kata Kunci : PPAT; akta jual beli tanah; peralihan hak atas tanah

Abstract

AbstractThis study examined the application of ius curia novit principle in the legal interpretation of the verdicts made by a pretrial single judge who examines the validity of suspect status determination, which is obviously observable from the Decision of the District Court as the first and last dispute settler. This research was of doctrinal type with a legal regulation approach. Of the verdicts of the District Court that adjudicated pretrial cases, some verdicts only examined formal matters or prioritize objective elements that were limited to administrative issues settled by investigators. On the other hand, several verdicts were more valiant to examine subjective elements, including considering the quality of the completed examination. This means that disparity remains to exist in the verdicts when judges examine the validity of suspect status determination. In the future, therefore, to actualize the equality of legal opinions and the uniformity of legal framework objectively, it is important to rearrange the pretrial of suspect status determination based on the Criminal Procedure Code.Keywords: Ius curia novit principle; pretrial of suspect status determination; legal interpretation AbstrakPenelitian ini mengkaji penerapan asas ius curia novit dalam penafsiran hukum putusan-putusan hakim tunggal praperadilan yang memeriksa keabsahan penetapan seseorang sebagai tersangka yang sangat kentara terlihat dari Putusan Pengadilan Negeri tingkat pertama sebagai pemutus sengketa pertama dan terakhir. Penelitian ini termasuk ke dalam tipe penelitian doktrinal dengan pendekatan peraturan perundang-undangan. Penelitian ini menyimpulkan, di antara putusan-putusan Pengadilan Negeri yang mengadili perkara praperadilan ada putusan yang hanya menguji hal-hal yang bersifat formal atau yang mengedepankan unsur obyektif yaitu sebatas masalah administrasi yang telah dilakukan oleh penyidik, di sisi lain juga terdapat putusan yang lebih berani masuk ke dalam unsur subjektif yaitu termasuk pula mempertimbangkan mengenai kualitas pemeriksaan yang telah dilakukan. Artinya masih terdapat disparitas putusan hakim dalam menguji sah tidaknya penetapan tersangka. Karena itu, ke depan, untuk mewujudkan terciptanya kesamaan pendapat hukum dan keseragaman kerangka kerja hukum secara objektif, perlu pengaturan kembali terkait praperadilan penetapan tersangka berdasarkan pada Hukum Acara Pidana.Kata-kata Kunci: Asas ius curia novit; praperadilan penetapan tersangka; penafsiran hukum
