Abstract

AbstractThis study aims to determine the implications of the Constitutional Court Decision No. 69 / PUU-XII / 2015 and the legal consequences for making the marriage contract after the Constitutional Court ruling on the status of property and third parties who feel aggrieved over the agreement. This study is a normative by using approaches Act (statuteapproach) and the conceptual approach (conseptualapproach).The data used is secondary data in the form of primary legal materials, secondary and tertiary. The results showed that the implications of the Constitutional Court Decision No. 69 / PUU-XIII / 2015 against the deed covenant marriage after the wedding before a Notary change the legal mechanism of making the marriage contract that can now be created during the marriage bond takes place by the Notary without preceded by court decision authorized. While the legal consequences of the marriage covenant deed after mating before the Constitutional Court ruling that the changes to the property status of husband and wife and binding upon both parties and against third parties. Later than it was after the Constitutional Court the legal consequences of making the marriage contract after the wedding on the status of joint property inherent (closely related) to the time of entry into force of  the agreement and binding on third parties.Keywords: Marital agreement, the notary, the constitutional court's decision

Abstract

The problems in this research include, first, what is the role of the Regional Notary Supervisory Council in imposing sanctions on notaries who do not read deeds? Second, what is the legal consequence for a notary who does not read the deed based on the Decision of Yogyakarta Regional Supervisory Council Number 03/Pt/Mj.PWN DDIY/VI/2016? and third, what is the legal consideration of Yogyakarta Regional Supervisory Council in imposing sanctions on the notary? This study is normative-empirical legal research with a field research type. The results indicate that, first, the role of Notary Supervisory Council is to protect the interests of the community or parties who suffer losses due to legal actions by irresponsible notaries who conduct their duties without referring to the stipulated provisions in both the law and decisions of the notary professional association/organization. Second, the legal consequence for the notary based on the Decision of Yogyakarta Regional Supervisory Council Number 03/Pts/Mj.PWN DIY/VI/2016 is in the form of written notice in which the decision can be used as a reason for a case reporter to sue the concerned notary for a civil compensation. Third, the legal basis for imposing sanctions on the notary, which is the result of investigation stating that the notary has been found guilty, is not a violated formal requirement.Keywords: Notary; deed; notary supervisory council

Abstract

Abstract One form of the implementation of good corporate governance in Islamic Banking is the actualization of sharia compliance. Sharia compliance lies not only on the products but also on the operational aspect of business activities, including contracts. In short, effective GCG means clarity in the contracts. In conducting business activities, contracts become the basis for the realization of business activities, one of which is financing activities. A written agreement on financing made by and before a Notary becomes an authentic deed with perfect proof of evidence. Therefore, a Notary can play a role in supporting the enforcement of GCG in a sharia bank. This study was normative legal research, aimed to provide legal arguments over a legal case and to assess it as well as to answer how it should be according to law. The results showed that in banking business activities, especially financing, a Notary plays a role in enforcing GCG in sharia banks, and that it is a good important role to support the actualization of GCG in banking. However, the role of Notary must be in accordance with Law No. 2 of 2014 on Amendment to Law No. 30 of 2004 on Notary.KeywordS : Good corporate governance; sharia banking; contract; notary AbstrakSalah satu wujud dari penerapan good corporate governance (GCG) pada Perbankan Syariah adalah terwujudnya kepatuhan syariah. Kepatuhan Syariah bukan hanya terletak pada hal produk, tetapi juga pada aspek operasional kegiatan usaha, termasuk di dalamnya adalah kontrak. Singkatnya, GCG yang efektif adalah adanya suatu kejelasan dalam kontrak. Dalam melakukakan kegiatan usaha, kontrak adalah dasar terlaksananya realisasi kegiatan usaha,salah satunya adalah kegiatan pembiayaan. Kesepakatan tertulis mengenai pembiayaan yang dibuat oleh dan di hadapan Notaris menjadi akta otentik yang memiliki kekuatan pembuktian sempurna, maka dari itu Notaris dapat berperan dalam mendukung penegakkan GCG di Bank Syariah. Penelitian hukum ini adalah penelitian hukum normatif, dilakukan dengan maksud untuk memberikan argumentasi hukum mengenai suatu peristiwa hukum dan menilainya serta menjawab bagaimana sebaiknya peristiwa itu menurut hukum. Hasil dari penelitian menyimpulkan bahwa, didalam kegiatan usaha bank khususnya pembiayaan, ada peran Notaris dalam menegakkan GCG di Bank Syariah, dan peran tersebut menjadi peran yang baik dan penting dalam mendukung terwujudnya Bank melaksanakan GCG, tetapi peran Notaris yang dilaksanakan tersebut harus sesuai dengan Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris.Kata-kata Kunci: Good corporate governance; perbankan syariah; kontrak; notaris

Abstract

This study aims to determine the objective conditions regarding the legal politics of managing the performance accountability of regional heads after the reform. The formulations of the problem include, first, how is the legal politics of the regulation for performance accountability of regional heads after the reform, and second, what is the ideal model of regional head accountability to the regional representative council (DPRD). This research is normative juridical research in which the data used is secondary data in the form of legal materials. In addition, this study uses theories as an analysis tool. The results show that the legal politics of regional head accountability has shifted from DPRD to the central government. The shift is caused by an empirical practice during the enactment of Law No. 22 of 1999 and the domination of DPRD, but the accountability is then shifted to the central government. Domination is also shown by the central government in supervising regional governments, thus minimizing the role of DPRD as a regional representative body with supervisory function. The performance accountability of regional head should be initially presented to DPRD to create equal partnership relations between the two institutions and to place DPRD outside the regional administration element, enabling DPRD to carry out the supervisory function optimally towards directly elected regional heads.Keywords: Legal politics; accountability; regional heads

Abstract

AbstractThis study examined the relevance of norms in Article 29 of the 1945 Constitution of the Republic of Indonesia to the principle of Belief in the One and Only God in Pancasila as the state philosophy and an answer to faith crisis. The research aimed to identify the relevance of Article 29 of the 1945 Constitution of the Republic of Indonesia to the principle of Belief in the One and Only God in Pancasila and its feasibility as the highest constitution of the state to overcome the current social problem (crisis of faith). This was normative research with a philosophical approach and a descriptive qualitative analysis model. The study concluded that, first, Article 29 of the 1945 Constitution of the Republic of Indonesia is no longer relevant to the principle of Belief in the One and Only God in Pancasila. Abstract

The signing of Memorandum of Understanding in Helsinki between the Free Aceh Movement (GAM) and the Republic of Indonesia (RI) is a sign of peace for the conflict in Aceh. Among the points of agreement is the establishment of the Truth and Reconciliation Commission (KKR) in Aceh. This study aims to investigate and explain the basis for KKR establishment as well as the concept of Aceh KKR. To answer this, the author uses a juridical-normative approach with the library research method. We find that the formation of KKR in Aceh is based on Article 229 of Law No. 11 of 2006 concerning Aceh Government. However, based on the a quo Law, Aceh KKR is referred to as part of National KKR, while National KKR has yet to be established until today. In addition, the institutional concept of Aceh KKR is independent and non-structural with the aim of strengthening peace, helping to achieve reconciliation between perpetrators of human rights violations and victims, and recommending comprehensive reparation for victims of human rights violations. Aceh KKR is based on Islam, Acehnese, independence, impartiality, non-discrimination, democratization, justice and equality, as well as legal certainty.Keywords: Commission; truth; reconciliation; Aceh; human rights

Abstract

In 2010, Purworejo District held the Regional Head Election (Pilkada) directly. The author conducted a study of the political coalition agreement in the Purworejo District Election in 2010 by formulating the problem of how to implement the political coalition agreement and how its juridical implications. The chosen research is qualitative research that produces descriptive data. The approach chosen in this legal research is nominative-empirical, that is, regarding the implementation of normative legal provisions in action on any particular legal action during the implementation of the Purworejo District Election in 2010. From the research, the author found the role of a Notary in making political coalition agreements in District Election Purworejo. In its implementation, there are two categories of parties to the agreement. First, the agreement between the prospective regent candidates and the regent candidates who are stated in an authentic deed and made before a Notary. Second, the agreement is underhanded between the candidates for the regent and the leaders of the political party who carry it. The political coalition agreement does not have direct juridical implications for the validity of the Purworejo district election process. The agreement also cannot be used as a strong evidence for filing a lawsuit / dispute to court even though the party has found a default.Keywords: Political coalition; agreement; notary

Abstract

AbstractIdeally, the constitution of a state must conform to the values of constitutionalism. However, the Indonesian constitution (1945 Constitution of the Republic of Indonesia) is currently inconsistent with the values of constitutionalism. This can be seen from the bias of presidentialism and the vagueness of the legislative chamber system applied in Indonesia as to whether it relies on a three-chamber or two-chamber parliamentary system. This article examined the ideal design of presidential government and parliamentary systems in Indonesia. Using the juridical-normative research method, this study recommended five ideas that should be employed as the materials for changes in the 1945 Constitution of the Republic of Indonesia to actualize a more authentic presidential system. Additionally, in an effort to reinforce the two-chamber parliamentary system in Indonesia, the first step taken should be to shift the People’s Consultative Assembly (MPR) paradigm from previously being known as an institution with its exclusive membership to being acknowledged as a joint meeting forum between the House of Representatives (DPR) and Regional Representative Council (DPD). Furthermore, to achieve an ideal two-chamber parliamentary system, DPR and DPD must be positioned in the same level in terms of their functions and authorities.Keywords:  The Fifth Amendment to the 1945 Constitution of the Republic of Indonesia; presidential; two-chamber parliament AbstrakDalam tatanan ideal, konstitusi suatu negara haruslah sejalan dengan nilai-nilai konstitusionalisme. Namun realitanya saat ini, konstitusi negara Indonesia (UUD NRI 1945) masih belum sejalan dengan nilai-nilai konstitusionalisme itu sendiri. Hal ini dapat dilihat dari biasnya bangunan presidensialisme di Indonesia serta tidak jelasnya sistem kamar parlemen yang diterapkan di Indonesia, apakah berkayuh pada sistem parlemen tiga kamar ataukah pada sistem parlemen dua kamar. Artikel ini mengkaji bagaimana desain ideal sistem pemerintahan presidensil dan kamar parlemen di Indonesia. Dengan metode penelitian yuridis-normatif, penelitian ini menyimpulkan bahwa, terdapat 5 gagasan yang perlu menjadi materi perubahan dalam UUD NRI 1945 dalam rangka mewujudkan sistem presidensil yang lebih murni. Selain itu, dalam upaya mempertegas parlemen dua kamar di Indonesia, langkah pertama yang harus dilakukan adalah merubah paradigma MPR yang semula dianggap sebagai sebuah lembaga yang memiliki keanggotaan tersendiri, menjadi MPR yang merupakan forum sidang gabungan antara DPR dan DPD. Selanjutnya, agar sistem parlemen dua kamar yang digagas menjadi lebih ideal, DPR dan DPD haruslah diposisikan dalam strata yang sama dalam hal fungsi dan kewenangannya.Kata-kata Kunci:   Perubahan kelima UUD NRI 1945; presidensil; parlemen dua kamar

Abstract

This study examines the authority of KPPU (Indonesian Business Competition Supervisory Commission) in the case of late notification of the acquisition of Woongjin shares by Toray Materials. The acquisition is carried out by a foreign company that is not domiciled in Indonesia, so the act is outside the jurisdiction of the Republic of Indonesia. This study also examines the legal liability of Toray Materials for the late notice of Woongjin share acquisition. Toray Materials reasoned that the delay is due to their having insufficient information about the laws and regulations in Indonesia. This study is normative legal research using a legislative approach and a case-study approach. Based on the results, we find that KPPU has the authority over the corporate action by Toray Materials in performing their acquisition of Woongjin shares. Based on the principle of legal duty by mistake element, Toray Materials has the legal responsibility for their action. Their mistake is a form of negligence.Keywords: Business competition; share acquisition

Abstract

AbstractThe increasing number of political parties after the reform era as the consequence of the protection of the right to freedom of association in the constitution has become a crucial issue considering that the objective of reform and constitutional amendment is to strengthen the presidential system. This is because the presidential system is considered incompatible with the multi-party system. This study aimed to analyze, first, the history of the policies to simplify the party system in Indonesia and, second, the legal politics in determining the parliamentary threshold in Law No. 7 of 2017 as an effort to simplify the party system in Indonesia. Using the normative legal research method and legislative as well as conceptual approaches, this research concluded that, first, after the reform era, several policies have been taken as an effort to simplify the political party system, including by challenging the establishment of political parties, aggravating the requirements for political parties to obtain a legal entity status, imposing more difficult terms through verification for political parties to take part in elections, implementing electoral threshold, and applying the parliamentary threshold. Second, the implementation of parliamentary threshold is deemed effective to simplify the party system in the parliament, thus making the presidential system effective. Therefore, in Law No. 7 of 2017 on General Elections, the new parliamentary threshold is set at 4% because 3.5 % in the 2014 election had yet to be able to simplify the party system in Indonesia.Keywords: Legal politics; party system; parliamentary threshold AbstrakMenjamurnya partai politik pasca reformasi sebagai konsekuensi dari perlindungan hak kebebasan berserikat di dalam konstitusi menjadi isu krusial mengingat cita-cita reformasi dan amandemen konstitusi adalah memperkuat sistem presidensial. Hal ini karena sistem presidensial dianggap tidak kompatibel dengan sistem multi partai. Penelitian ini bertujuan untuk menganalisis pertama, sejarah kebijakan penyederhanaan sistem kepartaian di Indonesia; Kedua, politik hukum penentuan parliamentary threshold dalam Undang-Undang Nomor 7 Tahun 2017 sebagai upaya penyederhanaan sistem kepartaian di Indonesia. Menggunakan metode penelitian hukum normatif, serta pendekatan perundang-undangan dan pendekatan konseptual, penelitian ini menyimpulkan pertama, pasca reformasi, telah ditempuh beberapa kebijakan sebagai upaya penyederhanaan partai politik, di antaranya adalah menerapkan pemberatan pendirian partai politik; memperberat syarat bagi partai politik dalam memperoleh status badan hukum, memperberat partai politik yang akan mengikuti pemilu melalui verifikasi, menerapkan electoral threshold, dan menerapkan ambang batas parlemen (parliamentary threshold). Kedua, penerapan parliamentary threshold dianggap efektif untuk menyederhanakan sistem kepartaian di parlemen, guna mengefektifkan sistem presidensial, karena itu, melalui Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, ketentuan parliamentary threshold ditentukan angka baru sebesar 4%, karena dinilai angka 3,5% pada pemilu tahun 2014 belum mampu menyederhanakan sistem kepartaian di Indonesia.Kata-kata Kunci: Politik hukum; sistem kepartaian; parliamentary threshold
