Abstract

AbstractThe main problem in this study is the first, how the legal liability by a Notary in making acte party, and secondly, how the legal protection for Notaries in making party acte. This research is a normative juridical research approach to law (statute approach). The data used is secondary data in the form of primary legal materials, secondary and tertiary. The results showed that there are 3 (three) forms of Notary legal responsibility in making acte party, namely the administrative responsibility, civil liability and criminal liability. Notary doing his duty in a responsible manner and in accordance with UUJN and other legislation, the right to protection of the law. Notary legal protection for agency basis given by the Honorary Council of Notaries and Notary Act laws and legal protection through the obligation / right of refusal Notary.Keywords: Responsibility, Protection, Notary and Party Acte.

Abstract

AbstractThis study discusses the misuse of land in the District Rural village treasury Banguntapan Bantul Yogyakarta. This type of research used in this research is the empirical jurisdiction. The study concluded that the abuse of cash land Banguntapan village in the district of Bantul Regency involve various stakeholders ranging from the government, the communities, and also the local notary. Cash Land Village is one of the village valuable asset because it serves as the village's largest revenue source then sebaikanya existence should be safeguarded. The village government must act decisively against the survival of the village treasury land and provide sanctions against infringing on the case. So that the wealth of the village could be felt by all people, especially villagers do not violate regulations.Keywords: Soil village treasury, Notary, Bantul.

Abstract

AbstractThe focus of this study is to explain the implications of their subrogation by granting power of attorney involved in the transition lastgeving land rights and outlining efforts to settle the implications of  the implementation of the application of subrogation by giving power of attorney lastgeving in the turnover of land rights. This research is a normative approach doctrinal and non-doctrinal. Results showed positive implications, namely the debt of the debtor be paid, the creditor will obtain repayment of debt and the third party will acquire the land and building. The implication negative is about the costs, expenses and Roya who from the beginning was not discussed so that a dispute exists between the seller and the buyer, not made a deed of power of a debt by a notary during the process of debt repayment in the bank, bad credit by the purchaser which replaced debtors, banks that do not receive transition without notice to the bank first. For his efforts in general notary prepare and notify to the parties to the costs of the burden of transition, the cost Roya, on payment of taxes, as well as supplies of administration, and the notary from the beginning to tell and gives advice on the consequences that ensue for the switchover without the knowledge of the bank so that no losses of the parties in the future.Keywords: Subrogation, Authorization Deed Lastgeving, Transfer of Rights to Land

Abstract

AbstractThis research focuses on two issues: first, the authority of Ombudsman of Indonesia Republic (locally abbreviated as ORI) in monitoring any verdicts of civil service arbitration tribunal and second, the procedure of monitoring of Ombudsman of Indonesia Republic in encouraging the implementation of the verdict of civil service arbitration tribunal. This is a normative research in which its results conclude that: first, the law about the civil service arbitration tribunal explicitly does not mandate the Ombudsman of Indonesia Republic to do a monitoring to the implementation of the verdict of civil service arbitration tribunal but, if seen from the valid law Number 5 of 1986, Law Number 23 of 2014, Law Number 25 of 2009 and Law Number No. 37 of 2008, the Ombudsman of Indonesia Republic has an authority to do the monitoring with three reasons:  i) apparatus is the target of Ombusman monitoring; ii) the action of apparatus in contradict with the legal court verdict seen as arbitrary action as a part of maladministration becomes the authority of Ombudsman of Indonesia Republic; and  iii) the report to the legislative institutions and publication as the external procedures in the implementation of the verdict of civil service arbitration tribunal need to be supported with the participation of society through the complaints reported to Ombudsman of Indonesia Republic that acts as the controller of public service. Second, the monitoring procedure towards the implementation of the verdict of civil service arbitration tribunal is implemented through any demands of clarification, investigation, mediation and recommendation.  Keywords: Monitoring, Ombudsman of Indonesia Republic, verdict of civil service arbitration tribunal

Abstract

AbstractNon-cash transactions in Mudharabah contract is one of several types of contract in Islamic banking. Mudaraba is a contract based on revenue sharing, in which Islamic banks bear the full needs of venture capital / investment. This study focused on the problem of how the application of non-cash transactions in mudharabah in Islamic banking and whether the scheme of non-cash transactions in Islamic banking mudharabah in accordance with Shari'a principles truth. This study is a juridical-empirical research using primary data, secondary and tertiary. The results showed the first application of non-cash transactions in Islamic banking in Indonesia, many of which deviated from the terms of the principle, tend to be mere labeling (labeling). Due Both mudaraba product does not comply with the principle of mudaraba beginning itself so judged only in the form of labeling (labeling) only from the bank and the necessity to not give a guarantee that is incompatible with God's word QS. Abstract

AbstractProblems in this study, the first: whether the use SKMF under the hand as the basis for loading / fiduciary deed can be done, if the terms of the legal guarantee? Second, how is the legal effect of the fiduciary certificates have been obtained creditor, if at the time of loading / deed fidusianya, fueled by SKMF under the hand? The research is a normative juridical. The study concluded that, first, the use of SKMF under the hand as the basis for loading / fiduciary deed can not be justified under the national security law. Although UUJF not set, this does not mean the use of SKMF under the hand can be justified. Second, with the use of a power in the loading / fiduciary deed, then the validity of the result obtained from the loading / fiduciary deed, will depend (dependent) on the validity of proxies. So if creditors overburden / a deed of fiduciary through SKMF under the hand, it will bring consequences can not be obtained privileges as promised by law to creditors fiduciary certificate holder.Keywords: power of attorney, deeds, fiduciary guarantees.

Abstract

AbstractThe main problem in this study is the first, how the existence of a notarial deed in strengthening the legality of the implementation of the Early Childhood Education institutions (ECD) in Sukabumi? And secondly, what form of certificate of incorporation institutions Early Childhood Education (ECD) in Sukabumi ?. This research is empirical or sociological law by using an empirical approach / sociological approach to law (statute approach). The results showed the existence of a notarial deed is very important for the implementation of ECD in Sukabumi, because the activities of early childhood institutions is closely linked to the public. So it is not enough just to their form of recognition (justification) in the form of early childhood Operating License issued by the Department of Education alone, but requires that the (legality) in the form of a notarial deed. Based on the research results are to some ECD Institutions authors found no notarial deed in the form of legal entities association deed, and the deed of the institution, but as with all forms of legal entity foundation deed.Keywords: Deed, foundations, associations, ECD

Abstract

ABSTRAKPenelitian ini mengkaji permasalahan mengenai:  pertama, penerbitan Izin Peruntukan Penggunaan Tanah sebagai kendali tata ruang untuk pembangunan apartemen di Kabupaten Sleman sudah sesuai dengan Peraturan Daerah Nomor 12 Tahun 2012? Kedua, penegakan hukum terhadap pembangunan apartemen yang tidak sesuai dengan Peraturan Daerah Nomor 12 Tahun 2012 di bidang Tata Ruang?Apakah Peraturan Daerah Nomor 12 Tahun 2012 dan peraturan pelaksanaanya di bidang Tata Ruang sudah efektif mengatur tentang pembangunan apartemen dan permasalahannya di Kabupaten Sleman? Penelitian ini termasuk penelitian hukum normatif. Hasil dari penelitian ini,  pertama: penerbitan izin peruntukan Penggunaan Tanah berdasarkan Peraturan Daerah Nomor 12  Tahun 2012 sebenarnya sudah sesuai dengan rencana tata ruang tetapi jika pembangunan apartemen dikaitkan dengan faktor lain seperti cara pengalihan hak dengan pengikatan jual beli sebenarnya belum sesuai.  Kedua,  penegakan hukum dalam Peraturan Daerah Nomor 12 Tahun 2012 lebih banyak menjabarkan tentang sanksi administrasi dimana dalam pelaksanaan maupun regulasinya tetap mengacu pada Undang-Undang Nomor 26 Tahun 2007, Peraturan Daerah Nomor 12 Tahun 2012 dalam pelaksanaannya belum efektif mengatur tentang  permasalahn pembangunan apartemen di KabupatenSleman, dimana Peraturan Daerah Nomor 12 Tahun 2012 hanyamengaturtentangrencanatataruangwilayah yang didalamnya  terdapat  zona  tata  ruang yang tidak secara detail memberikan kepastian suatu wilayah merupakan wilayah pemukiman, peresapan air atau wilayah peruntukan  lainnya. Sedangakan peraturan lain yang berkaiatan dengan pembangunan apartemen juga belum memadai seperti baru adanya atura nmengenai pertelaan  dan  akta  pemisahan  atas  hak  satuan  rumah susun sedangkan  aturan mengenai sertipikat Hak Milik Atas Satuan Rumah susun sendiri belum ada payung hukumnya di Kabupaten Sleman.

Abstract

AbstractThis study intend to find out about how the application of UUK as seen from Implementation of UUK in registration rights of PAG's Land and next step about that in Kulon Progo regency. The results of this study is have been done a lot of improvement of policies related to privilege of DIY from colonial times until the enactment of UUK, That the registration and next step about registration rights of PAG's Land in Kulon Progo Regency still used the same procedure such as PP 24/1997. So it will be better to design a new system that is more efficient in handling PAG as soon as possible and provide education to people about the importance of having evidence right of land.Keywords: Pakualaman Ground, Land, Law - Law Feature DIY

Abstract

The issue of Regulation No. 32 of 2002 about the Broadcasting has altered the process of broadcasting system in Indonesia. The most fundamental change in regulation is about limited transfer of authority to the KPI (Indonesia Broadcasting Committee). This research is to identify some issues: first, the role of KPID (local Indonesia broadcasting committee) in the Province of Central Sulawesi in terms of the broadcasting regulations to public. Second the status and the authority of the KPID in this province in monitoring and evaluating any programs broadcasted in accordance with the Regulation No. 32 of 2002 about Broadcasting.  This is a normative-descriptive research. The result of the research showed that first the KPID in the Province of Central Sulawesi has an important role in monitoring the program. In the context of democracy and community empowerment as the citizen, the existence of the strong regulation and pro-public interest are highly needed.  The fact reveals that the broadcasting institution is still marginal. In terms of legal perspective, there is an inconsistent interpretation towards the texts of law as there is no detail of sufficient regulation. Second, the status and the authority of KPID in the Province of Central Sulawesi is not the authority of the Constitution 1945 but the authority given by the Law no. 32 of 2002 on the Broadcasting. The KPID in the Province of Central Sulawesi in running its tasks refers to regulation.  Internally, KPID also has a drawback in running the monitoring of broadcasting system.  Keywords: KPID of central Sulawesi, broadcasting, authority of KPID
