Abstract

Abstrak: Konstitusi sebagai dasar negara memberikan petunjuk bahwa bangsa Indonesia seluruhnya memiliki hak yang sama, lihat pada pasal 27 (1) UUD 1945, termasuk posisi perempuan dan laki-laki. Namun dominasi budaya partiarki memposisikan perempuan sebagai subaltern dari laki-laki. Bagi paradigma Feminisme Legal Theory hukum merupakan produk laki-laki, sehingga menjadi barometer produk hukum adalah laki-laki, seperti penentuan upah dalam UU ketenagakerjaan,  UU terkait Lingkungan dan UU tentang perkawinan. Belakangan ada peristiwa menarik yaitu ketika Mahkamah Konstitusi mengabulkan permohonan Judicial Review terkait batas minimal usia perkawinan, dimana di UU perkawinan sebelum revisi ada perbedaan usia anak yang relatif cukup jauh, 16 tahun perempuan dan 19 laki-laki. Setelah adanya Putusan MK No. 22/Puu-Xv/2017, kemudian Pemerintah merevisi UU Nomor 1 Tahun 1974 tentang perkawinan menjadi UU No. 16 Tahun 2019 Tentang Perubahan Atas UU 1 Tahun 1974 ini mengatur batas usia untuk melakukan pekawinan, khususnya usia perempuan minimal 19 tahun bisa melakukan perkawinan, sama dengan laki. Apakah ini menandakan politik hukum Indonesia mengarah pada paradigma teori hukum feminisme atau Feminist Legal Theory (FLT). Sebenarnya masih banyak norma dalam undang undang yang bias gender, termasuk dalam UU No. 16 Tahun 2019. Adapun pendekatan dalam penelitian ini menggunakan statute approach dan conseptual approach.Kata Kunci: Paradigma Feminisme Hukum; Hukum Perkawinan; Perempuan Abstract: The constitution as the basis of the state indicates that all Indonesians have the same rights, see Article 27 (1) of the 1945 Constitution, including the position of women and men. However, the domination of patriarchal culture places women as a subaltern of men. For the paradigm of Feminist Legal Theory, the law is a product of men, so that it becomes a barometer that legal products are men, such as determining wages in labor laws, laws related to the environment, and laws on marriage. Recently, there was an interesting incident when the Constitutional Court granted the Judicial Review request related to the minimum age of marriage, wherein the Marriage Law before the revision there was a relatively different minimum age for marriage between the couples, 16 years old for girls and 19 for boys. After the Constitutional Court Decision No. 22 / Puu-Xv / 2017, then the Government revised Law No. 1 of 1974 on marriage to become Law No. 16 of 2019 concerning Amendments to Law 1 of 1974 regulates the age limit for marriage, especially women who are at least 19 years old can marry, same as men. It may indicate that Indonesian legal politics leads to the paradigm of feminist legal theory or Feminist Legal Theory (FLT). Many legal norms are gender-biased, including in Law no. 16 of 2019. Abstract

Abstrak: Tujuan dari penelitian ini adalah untuk menganalisa status hukum dari ada nya disruptive innovation terhadap penerapan hukum persaingan usaha dan untuk menentukan arah kebijakan hukum persaingan usaha di Indonesia pada masa yang akan datang. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan konsep dan pendekatan Undang-Undang serta memanfaatkan data sekunder. Dewasa ini, permasalahan terkait penerapan hukum persaingan usaha mulai memuncak dikarenakan hadirnya disruptive innovation, inovasi yang merusak ini mampu merubah paradigma produsen dan konsumen terhadap aktivitas bisnis, yang mana terbiasa melakukan transaksi secara langsung atau tradisonal. Muncul nya teknologi modern akibat ada nya revolusi industri 4.0, mampu mengkombinasikan automisasi dan komputerisasi produk dengan internet, berdampak pada hadirnya inovasi-inovasi yang merusak produk pendahulu. Disruptive innovation memberikan kesempatan bagi produsen untuk menawarkan produk nya secara efisien dan tepat sasaran melalui online-based offerings untuk memfasilitasi konsumen dengan berbagai pilihan produk. Hasil penelitian ini menunjukan bahwa ada nya konsep disruptive innovation justru mampu merangsang sikap berkompetisi para produsen menjadi lebih intensif, dan bagi konsumen dapat memberikan kemudahan dalam menentukan pilihan produk berdasarkan kebutuhan dan kesanggupan secara ekonomi. Dalam hubungan nya dengan politik hukum Undang-Undang persaingan usaha, perlu diperhatikan bahwa hukum persaingan usaha seharusnya dirujuk sebagai social control dan social engineering untuk menciptakan pasar yang efisien dan efektif dengan menggunakan Pasal 33 UUD 1945 sebagai dasar menentukan arah kebijakan pasar.Kata Kunci: Hukum Persaingan Usaha; Inovasi yang Merusak; Politik Hukum Abstract: This research aims to analyze the legal status of disruptive innovation concerning the competition act and outline the policy direction of business competition regulations. In conducting this research, the author uses normative research methods by utilizing secondary data. In recent years, legal issues related to business competition have culminated in the presence of innovations that can change the paradigm of producers and consumers towards market activity habits, which are accustomed to conducting direct transactions. The emergence of modern technology has created a new, fourth industrial revolution that combines automation and computing with the internet of things. Disruptive innovation enables producers to offer their products and services efficiently and effectively through online-based offerings to provide consumers with various product choices to determine their needs efficiently and according to economic capacity. This paradigm shift must be balanced with regulations that can limit the legal corridors that have been adjusted to create prosperity for consumers and producers. It can be concluded that disruptive innovation has made the competition very intensive for consumers, making it easier for them to make choices according to economic capacity. In connection with the legal politics of business competition regulation, the law must be directed as a means of social control and social engineering to make business competition effective and efficient by still paying attention to Article 33 of the 1945 Constitution as the basis for market policy direction. Abstract

The purpose of this study is first, to know about the basic concept of land management rights in Batam City in terms of improving people's welfare. Second, knowing about improving the quality of land management rights in Batam City.The method used by this study is an empirical legal research. The type of data used is primary data, namely those obtained from interviews with the public community, government officers of Batam City, BP Batam and the District office and also Sub-district office. As well as conducting observations in the old village of Tanjung Uma and the old village of Nongsa. Both also use secondary data consisting of primary legal materials, namely the 1945 Constitution and Law Number 5 of 1960 concerning Agrarian Principles.Based on the results of the study, first, it was found that the Implementation of Land Management Rights in Batam became problematic after Indonesia entered the Reform phase with the enactment of Law No. 22 of 1999 on Local Government or Regional Autonomy Law, Law No. 53 of 1999 on The Establishment of Batam city and the Batam Mayor Decree No. 105 of 2004 on The Establishment of 37 Old Village Points. Second, through the socio-legal research, the researcher suggests that the Central Government and the Regional Government of the Riau Islands Province as well as the Batam City Government and BP Batam to immediately restructure the land policy regulations in Batam and synchronize land policies so that Batam people can obtain certainty of land rights as guarantees for their welfare in the future. .

Abstract

Abstrak: Maraknya penangkapan yang dilakukan oleh KPK, yang dikenal dengan Operation Catch Hand atau OTT, telah menimbulkan polemik legal. Wacana ini mengemuka diawal intensitas anggota DPR seperti Fahri Hamzah. Tujuan dari penelitian ini adalah untuk menganalisis operasi tangkap tangan (OTT) dalam pemberantasan korupsi, apakah mencerminkan nilai keadilan dan untuk menemukan konsep pemberantasan korupsi terkait pengumpulan barang bukti permulaan dengan Hand Catching Operation (OTT) yaitu sesuai dengan nilai keadilan. Metode penelitian yang digunakan adalah penelitian normatif. Hasil penelitian menunjukkan bahwa pelaksanaan Operasi Tangkap Tangan yang dilakukan oleh Komisi Pemberantasan Korupsi dipidana dalam arti nilai keadilan yang pada hakikatnya merupakan upaya paksa, memperoleh hak warga negara, tetapi karena untuk kepentingan bukti bahwa sudah diatur dalam undang-undang, tindakan ini bisa dibenarkan.Kata Kunci: Kejahatan Korupsi; Penangkapan Tangan; Nilai Keadilan; Operasi Abstrack: The rise of arrests made by the KPK, known as Operation Catch Hand or OTT, has led to a polemic of whether it is legal or not. This discourse arose at the beginning of the intensity of DPR member Fahri Hamzah. The aim of the research is to analyze hand-catching operations (OTT) in the eradication of corruption, whether it reflects the value of justice and to find the concept of eradicating corruption related to preliminary evidence collection with Hand Catching Operation (OTT) that is in accordance with the value of justice. The research method used is normative research. The result of the research is that the implementation of the Catching Hand Operation conducted by the Corruption Eradication Commission is punished in terms of the value of justice which is essentially a forced attempt, accruing the right of citizens, but because it is for the sake of proof that it is regulated in law, this action can be justified.Kata Kunci: Corruption Crime; Hand-Catching; Justice Value; Operation

Abstract

This legal research aims to determine the consequences of criminal law and civil law consequences for buyers who purchase motorized vehicles without complete and valid documents. This legal research is a normative juridical research. The nature of this legal research is an analytical description to describe an ongoing situation or situation as data for the object of research so that it can explore ideal things which can then be analyzed based on legal theory or applicable laws and regulations. Based on the results of research and discussion, the consequences of criminal law against buyers who purchase motorized vehicles without complete and valid documents are that Article 480 paragraph (1) of the Criminal Code on criminal acts of detention must be fulfilled with subjective and objective elements  Furthermore, the effect of civil law on buyers who purchase motorized vehicles without complete and valid documents is that it is possible for the owner of the motor vehicle to file a lawsuit against the law based on Article 1365 of the Civil Code.

Abstract

Abstrak: Secara yuridis sudah ada pengaturan dalam Undang-undang Perkawianan Nomor. 1 tahun 1974 Pasal 41 tentang pemeliharaan hak anak akibat perceraian. Namun dalam prakteknya sering terjadi perebutan atas hak pemeliharaan anak. Perebutan atas hak pemeliharaan anak ini kerap terjadi dikarenakan masing-masing pihak (orang tua) merasa memiliki hak untuk dapat merawat anak-anaknya. Dengan adanya PERMA Nomor 1 tahun 2016 tentang Presedur Mediasi di Pengadilan maka diharapkan penyelesaian sengketa perkawinan melalui forum mediasi dapat memberikan perlindungan hukum terhadap hak dan kepentingan anak. Tujuan penelitian ini untuk dapat mengkaji upaya dalam dalam mewujudkkan perlindungan hukum terhadap hak dan kepentingan anak pascapercaian melalui forum mediasi. Hasil kajian menunjukkan bahwa pola penyelesaian sengeketa perceraian melalui forum mediasi dapat memberikan perlindungan terhadap hak dan kepentingan anak dengan kesepakatan yang dibuat oleh para pihak (orang tuanya) yang tertulis dalam akta perdamaian. Metode dalam penelitian ini adalah penelitian hukum normative, setelah mengkaji sumber data yang didapatkan melalui kepustakaan juga menelaah hasil  mediasi di Pengadilan Agama yang terdapat dalam Akta Perdamaian.Kata Kunci: mediasi, peradilan, Akta Perdamaian Abstract: Legally, there is already a regulation focusing on Marriage Law, namely Law 1 of 1974 article 41concerning child care due to divorce. However, in practice there are struggles to take care of children’s right. This struggle over the children right occurs because each parents feels that they have the right to be able to take care of their children. With the PERMA Number 1 of 2016 concerning court mediation procedures, it is hoped that resolving marital disputes through mediation forums can provide legal protection for children's rights. The purpose of this study is to examine efforts in realizing legal protection for the rights and interests of post-divorce children through mediation forums. The results of the study show that the pattern of resolving divorce disputes through mediation forums can provide protection for the rights and interests of children with an agreement made by the parents written in the peace deed. The method in this research is normative legal research after reviewing the sources of data obtained through the literature, it also examines the results of mediation in the Religious Courts contained in the Peace Deed.Keywords: Mediation, Judicial, Settlement Agreement

Abstract

Abstract: An agreement to transfer title to land based on absolute power is prohibited by law. The prohibition of absolute power is regulated in Instruction of the Minister of Home Affairs number 14 of 1982 concerning the Prohibition of Using Absolute Power for Transfer of Rights to Land, and Government Regulation No. 24 of 1997 Article 39 paragraph (1) letter d concerning land registration. However, the reality is that there is still a land sale and purchase agreement using an absolute power of attorney, causing losses to other parties. The problem is how is the legal responsibility of the seller and the notary against the loss of a third party due to the use of absolute power of attorney in the agreement to transfer title to land. This study aims to determine the legal liability of the seller and the notary against the losses of third parties due to the use of absolute power of attorney in the agreement to transfer ownership of land rights. The method used in this study is a normative juridical method using a statuate approach and case approach. The Study found that the seller's responsibility was based on Article 1365 of the Civil Code, namely by providing compensation for the value of the sale value of the land minus the owner's debt without involving a third party with good faith. And the accountability of the notary is contained in Law Number 30 of 2014 Article 84 concerning the Position of Notary Public and Government Regulation Number 24 of 1997 Article 62 concerning Land Registration which explains the sanctions for notaries. In this case it relates to the loss of a third party in good faith.Keywords: Absolute Power, CompensationAbstrak: Perjanjian pengalihan hak milik atas tanah yang didasarkan pada kuasa mutlak merupakan sesuatu yang dilarang oleh hukum. Pelarangan kuasa mutlak diatur dalam Instruksi Menteri Dalam Negeri nomor 14 Tahun 1982 tentang Larangan Penggunaan Kuasa Mutlak Sebagai Pemindahan Hak Atas Tanah, dan Peraturan Pemerintah No. 24 Tahun 1997 Pasal 39 ayat (1) huruf d tentang pendaftaran tanah. Namun realitas yang terjadi masih terdapatnya suatu perjanjian jual beli tanah menggunakan surat kuasa mutlak sehingga menyebabkan kerugian bagi pihak lain. Permasalahannya adalah bagaimanakah pertanggungjawaban hukum pihak penjual dan notaris terhadap kerugian pihak ketiga akibat penggunaan surat kuasa mutlak dalam perjanjian pengalihan hak milik atas tanah. Penelitian ini bertujuan untuk mengetahui pertanggungjawaban hukum pihak penjual dan notaris terhadap kerugian pihak ketiga akibat penggunaan surat kuasa mutlak dalam perjanjian pengalihan hak milik atas tanah. Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian ditemukan bahwa pertanggungjawaban pihak penjual yakni berdasarkan Pasal 1365 KUHPerdata yaitu  dengan memberikan ganti kerugian seharga nilai penjualan tanah dikurangi hutang pemilik tanpa melibatkan pihak ketiga yang beritikad baik. dan pertanggungjawaban pihak notaris yaitu terdapat dalam UU Nomor 30 Tahun 2014 Pasal 84 tentang Jabatan Notaris dan Peraturan Pemerintah Nomor 24 Tahun 1997 Pasal 62 tentang Pendaftaran Tanah yang menjelaskan sanksi bagi notaris. Dalam hal ini berhubungan dengan kerugian pihak ketiga yang beritikad baik.Kata Kunci: Kuasa Mutlak, Ganti Kerugian

Abstract

Abstrak:Tujuan dari penelitan ini yaitu untuk mengetahui bagaimana mekanisme pengisian posisi kepala daerah secara demokrasi menurut prinsip demokrasi pancasila setelah amandemen UUD 1945. Metode penelitian yang digunakan dalam penelitian ini yaitu menggunakan metode normative dengan Pendekatan normatif meliputi asas hukum, sistem hukum, sinkronisasi hukum, dan sejarah hukum. Hasil dari penelitian menunjukkan bahwa adanya perbedaan dengan Sistem Pilkada Langsung yang berlangsung pada tahun 2005 dengan metode pemilihan umum yang demokratis berdasarkan prinsip langsung, umum, bebas, rahasia, jujur dan adil, namun ditemukan bahwa sistem ini dapat melemahkan posisi DPRD dan menyebabkan politik yang lebih besar. Dapat dipahami bahwa mekanisme pengisian jabatan Kepala Daerah mengikuti kondisi kebutuhan masyarakat di suatu daerah dan perlu diperhatikan bahwa konstitusi yang diterapkan pada setiap periode mempengaruhi karakter undang-undang yang melaksanakan dan mengatur pemerintahan daerah yang berlandaskan Pancasila. Kerangka dari gagasan Demokrasi Pancasila, berarti bahwa demokrasi bukanlah tiruan dari demokrasi liberal atau lainnya, tetapi lahir secara alami dari nilai-nilai luhur budaya dan suku bangsa Indonesia itu sendiri, dan ditandai dengan sistem organisasi negara yang dijalankan. Baik sistem Pilkada secara langsung maupun tidak langsung tetap sesuai dengan nilai-nilai Demokrasi Pancasila, karena Pancasila sendiri merupakan ideologi terbuka yang artinya hanya mengatur hal-hal yang pokok saja sedangkan pelaksanaannya disesuaikan dengan kondisi sosial politik yang ada.Kata Kunci: Kepala Daerah, Demokrasi Pancasila, Amandemen   Abstract: The purpose of this study is to find out how the mechanism for filling the position of regional head in a democratic manner according to the principles of Pancasila democracy after the amendment of the 1945 Constitution. The research method used in this research is using a normative method with a normative approach covering legal principles, legal systems, legal synchronization, and history. law. The results of the study indicate that there is a difference with the Direct Pilkada System which took place in 2005 with a democratic general election method based on the principles of direct, general, free, secret, honest and fair, but it was found that this system can determine the position of the DPRD and cause political the greater one. It can be understood that filling the position of Regional Head follows the conditions of the needs of the community in an area and it should be noted that the constitution applied in each period has the character of the law that implements and regulates regional government based on Pancasila. From the idea of Pancasila Democracy, it means that democracy originates from liberal democracy or others, but is born naturally from the noble values of Indonesian culture and ethnicity itself, and is characterized by the state system that is run. Both the direct and indirect Pilkada system remain in accordance with the values of Pancasila Democracy, because Pancasila itself is an open ideology which means that it only regulates basic matters while its implementation is adjusted to the existing socio-political conditions.Keywords: Regional Head, Pancasila Democracy, Amendment
