Abstract

The use of maslahah mursalah as the source for the establishment of Islamic economic practices that previously did not exist is a necessity. This is because maslahah is at the core of all these economic developments. All forms and practices of Islamic financial innovation meant to realize maslahah. The establishment of Islamic banking, the rise of Islamic credit card to facilitate a variety of transactions, their renewal in mudaraba transactions ie collateral obligations, revenue sharing method, and others show how maslahah mursalah has role in the economic development of sharia.

Abstract

Contract Bay al-Wafa’ is one form of sale and purchase agreement that emerged in the mid-fifth century AH in Central Asia (Bukhara and Balk). Contract bay al-wafa' is a conditional sale and purchase, where goods that have been sold can be bought back by the seller at the same price. This study used a qualitative approach with in-depth interviews as the main instrument for data collection. This study took place in three districts, namely North Labuhan Batu district, Madina and Serdang Berdagai district. The cause of the emergence of the practice of contract bay al-Wafa’ among the people of North Sumatra due to: the needs of society to meet the needs of families and their survival and continuation of education, transactions carried out by the public by using of bay al-wafa' is a perceived risk of business activities lighter., very helpful and useful and the process is very simple, easy and quick to be realized, and the practice of contract bay al-wafa' in North Sumatra have a different names they use, but the form of what they do and goals to be achieved are the same, there are three terms that are found in the life of society, namely: Taxation, Pagang Pawn and Sell Pawn. The form of practice is likened to someone who needs money / funds for the needs of children's school fees or other needs in the family, they sell / pawn their farms, rice fields or their yards to get costs / funds, with the agreement if the funds obtained had been able to be restored, the farms, rice fields or the yards that serve as the object of transaction returned to the proprietor owner of farms, rice fields or yards. During the time the money can not be returned by the owner of the farms, rice fields or yards as long as it also the buyer or recipient had been able to take benefit from the land. What do these people seemed okay by them due to the lack of gharar factor or deception among them, instead they have been helped and easier their problem, by that the walfare is creted and refuse the badness in their lives, this is what required by Islamic law. Can not be denied that 'urf or culture instrumental fills a legal vacuum that never exist in al-Quran and the Sunnah of the Prophet, especially related to muamalah, contract bay al-wafa' is a form of transaction that is anchored in the istihsan 'urfy.

Abstract

Risk management is an important effort that must be done by each company, including Islamic banking, as an effort to minimize losses due to the risk. Bank Muamalat of Panyabungan manage the risk by applying the process of Financing Risk Assessment (FRA) on some aspects and then continued with intensive billing, give warning, applying revitalization process by rescheduling, reconditioning, and restructuring, completion with guarantee, as well as take the path of litigation and at the same time monitoring and controlling. Strategic SWOT that can apply is by Strengthen Regulation of internal bank, Recruiting competent employees, , revitalizing maximumly and rigorously, developing a reliable risk management system, specializing MSME financing, Doing emotional service improving the ability of FRM, implementing office chanelling, strengthen the treaty clause. In the application of risk management at Bank Muamalat Branch Panyabungan, fairness and the principle of legal certainty has been applied and walk in unison and not against each other.

Abstract

This study aims to determine how much influence the Education, Culture of organizations, Wages, Work Motivation on Employee Performance of Sharia Mandiri Bank Syariah Mandiri Branch Aksara Medan. The sample in this study are employees of Sharia Mandiri Bank. Forms of this research are form of quantitative study using multiple linear regression analysis supported by models test and statistical tests using SPSS 17 and Eviews 8. From the results of research that conducted at alpha 5%, the authors concluded that the results of multiple linear regression analysis showed that the variables education, organizational culture, wages, work motivation affects the performance of employees simultaneously and together influence employee performance amounted to 71.3%. Variation factors that influence employee performance is jointly explained by education, organizational culture, wages, work motivation, with value effect is 71.3%, meanwhile the residual effect of 28.7% explained by other variables not examined.

Abstract

West Sumatra is famous for its local ethnic religious wisdom as Adat Basandi Syarak, Syarak Basandi Kitabullah. In addition, in the realm of ethnic leadership Minagkabau also have a cultural concept Tungku Tigo Sajarangan, which is functionally role in shaping patterns and behavior society. In assumptive, local wisdom as well as the religious character of Minangkabau society committed to abide by the teachings of indigenous and indigenous leaders, will give strength to the economic development of sharia. however, there are strong indicators that show that the Islamic Microfinance Institutions in West Sumatra has not developed as ideal as assumed. Synergy between components “Tungku Tigo Sajarangan” on the one hand, and with the Islamic Micro Finance Institutions on the other hand, can be used as capital and models of economic development of sharia and will contribute positively to the development of Indonesia, particularly in West Sumatra.

Abstract

This thesis discusses about the Comparation of Performance and Risk between Islamic Mutual Funds with Conventional Mutual Funds where Islamic mutual funds differ fundamentally from conventional mutual funds. The period of this research is from January 1st , 2013 until December 31th, 2015 and this research uses Sharpe, Treynor and Jensen model for data processing. The result of data processing and analyzing from this research, overall the performance of the entire mutual funds are still not optimal. However, when compared in terms of performance and risk among Islamic mutual funds with conventional mutual funds, conventional mutual funds have better performance compared to Islamic mutual funds. For the risk, with Sharpe method, conventional mutual funds have a lower total risk than Islamic mutual funds. For the treynor, conventional mutual funds have a lower total risk than islamic mutual funds. For the Jensen islamic mutual funds have a lower total risk than conventional mutual funds. The third method of Sharpe, Treynor and Jensen performance superior to conventional mutual funds .

Abstract

This study aims to determine and understand the transformation of the role of the mosque as well as offer the revitalization of the role of the mosque at this time. This study used a qualitative approach. The results of the analysis of the study showed that the role and function of the mosque has been a change and a shift from time to time. in modern times, the mosque still felt his presence by the Muslim community. This is because the implementation of the function and role of the mosque is not maximized. Thus, this study also offers the concept of revitalizing the function and role of the mosque intact, such as the role and functions of worship, education, propaganda, economic, social, political, health and technology.

Abstract

To reach a wider audience, the mass media with the sporadic nature, heterogenic, and anonymous, is an effective tool to be used as a communication channel. Islamic political parties in legislative elections in 2014 have the benefit of disseminating information widely on political campaigns through the mass media. This study investigated the interaction of Islamic political parties in North Sumatra with the mass media by using content analysis (content analysis) news media (Daily Alert and Analysis) of the Islamic political party (PKS and PPP) in the 2014 legislative election campaign in North Sumatra. The results show that the interaction of Islamic political parties in the media is not maximized. MCC looks more aggressive otherwise PPP tend not to take any action in the design of political communication through the mass media.

Abstract

This article aims to determine how much influence the direct and indirect variable among quality of the participants, instructors, materials, facilities on the performance and quality of service at PT. Bank Muamalat Indonesia, Tbk Branch Medan. The research method used is quantitative approach using path analysis with multiple linear regression model is supported by test models and statistical test using SPSS version 16. From the research conducted, the author conclude that this study on a structural 1 that is equal to 45,6% which the variable quality of the participants, instructors, materials and facilities affect service quality, while 54.4% is explained by other variables. On a structural model 2 is equal to 62.3%  which the variable quality of the participants, instructors, materials and facilities affect the performance. The results of the analysis of indirect influence significance test showed indirect effect of the quality of the participants, instructors, materials and facilities to the quality of services through the variable performance significantly.
