Abstract

The number of acts of terror that have occurred in Indonesia has forced the Indonesian government to always make efforts to prevent and control various acts of terrorism that have occurred. Considering that in carrying out their actions terrorist groups always use weapons and bombs, a strategy is needed to prevent terrorism crimes. The research method used in this study is the Normative Legal Research Method. In this study, 2 (two) approaches were used, namely: Statute approach and conceptual approach. To take a stance on various types of terrorist attack incidents that create fear in the Indonesian people, the government has taken strategic steps in tackling criminal acts of terrorism, including by issuing a Government Regulation in Lieu of Law on the Eradication of Criminal Acts of Terrorism, and a year later a Perpu In 2002 this was confirmed as a regulation regarding the Suppression of Terrorism Delicts. Based on various considerations, it is necessary to regulate the Regulation of the Head of the National Police of the Republic of Indonesia Number 23 of 2011 concerning Procedures for Enforcement of Terrorism Suspects. The stages that must be passed to take action against criminal acts of terrorism are (1) carrying out an agreement (2) carrying out a warning (3) carrying out infiltration (4) thwarting levies (5) carrying out arrests (6) carrying out searches (7) carrying out confiscation of evidence.

Abstract

Berakhirnya kekuasaan orde baru pada tahun 1998, melahirkan harapan yang besar terhadap proses demokrasi termasuk reformasi hukum. Harapan yang begitu besar selama bertahun-tahun semakin berkurang dan nyaris hilang, karena perubahan-perubahan yang dilakukan belum menunjukkan bahwa keadilan hukum telah telah dapat dilaksanakan oleh masyarakat luas. Salah satu masalah dalam masa transisi ialah : bagaimana rejim baru menyikapi kejahatan dari masa lal. Rejim lama telah meninggalkan sejumlah besar kejahatan yang tidak pernah terselesaikan. Kejahatan yang telah menimbulkan penderitaan bagi banyak orang. Persoalan ini coba diatasi dengan menciptakan instrument-instrumen yang bersifat tradisional untuk segera memberi keadilan yang dapat dicicipi oleh masyarakat, sekaligus memelihara proses demokratisasi yang baru berjalan dengan memperkuat rule of law. Praktek demokrasi yang diselenggarakan baik orde lama maupun orde baru melahirkan system pemerintahan yang sentralistik, borokratik bahkan cenderung otoriter. Hasil akhir dari kedua masa pemerintahan ini agalah “kegagalan” akibat ketidakpercayaan masyarakat terhadap pemimpinnya. Hal inilah yang kemudian melahirkan babak baru yaitu “era reformasi” untuk melakukan koreksi dan perubahan terhadap tatanan pemerintahan yang lebih demokratis.

Abstract

The principle of good faith is a fundamental legal principle in the registration and protection of registered trademarks, so it can be a reason for rejecting a lawsuit to cancel a registered trademark in the Commercial Court, if the Plaintiff cannot prove that the registration of the disputed trademark was carried out by the Defendant in bad faith. This article will examine how good faith is regulated in trademark registration based on the 2016 Trademark Law?, and what requirements must be met when filing a lawsuit for canceling a registered mark in the Commercial Court?, as well as how to apply the principle of good faith as a reason for rejecting a lawsuit for canceling a registered mark by the Court. Commerce? This article is the result of normative legal research, using a statutory, case and concept approach, using secondary data, with qualitative data analysis. The research results show that the regulation of good faith is regulated in Article 21 paragraph (3) and Article 77 paragraph (2) of the 2016 Trademark Law, and the requirements that must be fulfilled in filing a lawsuit for cancellation of a registered trademark at the Commercial Court meet the formal and material requirements in Article 76 to Article 79 and Articles 85 to Article 90 Jo. Article 21 of the 2016 Trademark Law, as well as the application of the principle of good faith as a reason for rejecting a claim for cancellation of a registered mark by the Commercial Court, is casuistic and proportional and objective according to the legal facts revealed in the trial.

Abstract

ABSTRACT The development of the regional government system has undergone substantial changes with the birth of Law Number 6 of 2014 concerning Villages. The regulation regarding the election of village heads has changed with a simultaneous election mechanism and the candidate who gets the most votes is entitled to be appointed as village head. The purpose of this study is to examine and analyze the regulation by mechanical election in the district of Maluku Tengah which in the Regional Regulation Number 03 of 2006 concerning Procedures for the Nomination, Election and Inauguration of the Head of the Negeri Government whose substance the article on elections still refers to Law Number 32 of 2014 which is no longer valid. The method used in this research is the socio-legal method whose data are taken from the interview process and study of Regional Regulation documents and by using literacy related to the research title.

Abstract

Penelitian ini merupakan penelitian hukum empiris yang bertujuan menganalisis faktor-faktor yang menyebabkan tindak pidana plagiarisme terhadap desain produk terjadi serta kebijakan preventif dalam menanggulangi tindak pidana plagiarisme terhadap desain produk. Hasil dari penelitian ini ialah bahwa terjadinya suatu tindak pidana plagiarisme terhadap desain produk didasari atas beberapa faktor yang diantaranya; faktor ekonomi, faktor pendidikan, faktor perbandingan harga, faktor perkembangan teknologi, faktor konsumen serta faktor pemahman hukum yang dimiliki oleh desainer. Terkait dengan perlindungan atas desain produk, Indonesia telah memiliki regulasinya yakni pada undang-undang Nomor 31 Tahun 2000 tentang Desain Industri. Akan tetapi, keberadaan undang-undang ini masih belum cukup sehingga bagi penulis perlu beberapa kebijakan yang dapat menanggulangi tindak pidana plagiarisme ini secara preventif, yakni kebijakan preventif dari desainer dan kebijakan preventif dari pemerintah. Kebijakan pecegahan tindakan plagiarisme yang dpaat dilakukan oleh desainer yakni dengan melakukan pembuatan desain yang rumit serta desainer aktif dalam melakukan monitoring atas produknya yang telah beredar di pasaran. Kebijakan selanjutnya dari pemerintah yakni pemeritah dapat melakukan revisi undang-undnag desain industri dan membantu masyarakat UMKM dalam melakukan pendaftaran produk yangdnihasilkan serta membantu pendampingan hukum apabila produk dari UMKM ini diimitasi oleh pihak lain secara ilegal.

Abstract

Legal research on the Libya’s obligations to Indonesia regarding the crude oil spilled that polluted Indonesia’s sea, which is created liability based on international agreements regarding marine pollution because the Libya has ratified the international agreement. Therefore Libya must comply with the provisions of the United Nations Convention on the Law Of the Sea 1982, International Convention on Civil Liability for Oil Pollution Damage 1969, Stockholm Declaration and Rio de Janeiro Declaration 1992. The purpose of this research is to find out the liability carried out by the Libya due to the crude oil spilled that polluted Indonesian’s sea due to an accident with the MV Sinar Kapuas from Singapore. Normative methods used in this study focus on the strict liability principle and sea international treaties, including the United Nations Convention on the Law Of the Sea 1982, International Convention on Civil Liability for Oil Pollution Damage 1969, Stockholm Declaration and Rio de Janeiro Declaration 1992. Marine pollution by crude oil carried out by the MT Alyarmouk from Libya created a liability which is determined as strict liability by the International Convention on Civil Liability for Oil Pollution Damage 1969.

Abstract

Penelitian ini bertujuan untuk mengetahui apakah prisnsip komplementari yang dimiliki oleh Internasional Criminal Court dapat mengambil alih proses hukum terhadap kasus Mayor Mahmoud Mustafa Busayaf Al-Werfali. Penelitian ini merupakan penelitian dengan metode yuridis normatif, yaitu penelitian dengan melakukan studi kepustakaan terhadap bahan-bahan hukum yang telah diperoleh. Hasil penelitian ini menunjukan bahwa meskipun Libya tidak termaksud dalam negara pihak statuta roma 1998 tetapi Mahmoud Mustafa Busayaf Al-Werfali dapat diadili karena Libya telah menjadi anggota PBB.

Abstract

The capacity of the notary in recording the minutes of auction is only limited to the implementation of the auction which is carried out on a non-voluntary basis. Minister of Finance Regulation Number 189/PMK.06/2017 concerning Class II Auction Officers position notaries as class II auction officials only having the authority to carry out voluntary non-execution auctions. This means that other types of auctions are not the work domain of class II auction officials. So that the capacity and capability of the notary cannot touch the bankruptcy auction process. Based on this, problems arise, namely regarding the legality of the position of a Notary in the implementation of a bankruptcy auction after the debtor is declared bankrupt and the legal validity of recording a bankruptcy auction that does not involve a Notary. Based on these problems, notaries actually have legal legality to carry out legal actions for bankruptcy auctions as stipulated in Article 185 paragraph (1) of the KPKPU Law that all objects must be sold in public in accordance with the procedures specified in the legislation. The procedure for traded assets in the management of bankruptcy assets is actually inseparable from the involvement of a notary in the bankruptcy auction process against a debtor who is declared bankrupt because the notary is the only public official who is given the authority to take legal actions to make an authentic deed regarding all acts and or an agreement according to the provisions of the applicable laws and regulations as stipulated in Article 15 paragraph (1) of the UUJN. Based on this, notaries need to have stronger authority to be able to be involved in execution auctions, especially those related to bankruptcy auctions. Strengthening the authority of a notary as a bankruptcy auction official is because a notary is a legal profession that is considered the most capable of forming an authentic deed of legal action on bankruptcy assets. Therefore, if the notary's authority is added to be able to be directly involved in the bankruptcy auction, it will greatly assist the process of completing the implementation of the bankruptcy estate.

Abstract

Proses dismissal merupakan proses penelitian terhadap gugatan yang masuk di Pengadilan Tata Usaha Negara oleh Ketua Pengadilan. Dalam proses penelitian itu, Ketua Pengadilan dalam rapat permusyawaratan memutuskan dengan penetapan yang dilengkapi dengan pertimbangan-pertimbangan bahwa gugatan yang diajukan itu dinyatakan tidak diterima atau tidak berdasar. Tujuan dari penelitian ini adalah untuk mengetahui dan menjelaskan tentang analisis yuridis dismissal proses dalam pengadilan tata usaha negara terkait tujuan hukum tentang keadilan dan menjelaskan proses hukum acara pengadilan tata usaha negara diterapkan dismissal proses.Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan pendekatan yuridis normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan dan literatur-literatur yang berkaitan dengan permasalahan yang diteliti. Berdasarkan analisa hukum yang digunakan maka penulis memberikan kesimpulan bahwa seharusnya dalam Undang-Undang lebih memperjelas dengan terperinci proses dismissal sebagaimana yang dimaksud dalam Pasal 62 Undang-Undang Republik Indonesia Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara. Sehingga dalam proses dismissal terhadap gugatan yang diajukan oleh individu dan atau badan hukum perdata dapat dengan jelas memahami fungsi dari proses dismissal, dan terhadap individu dan atau badan hukum perdata merasa tidak dirugikan nantinya dalam proses pemeriksaan dismissal.

Abstract

The purpose of the text is to examine the issue of homosexual act committed by by TNI member from a human rights perspective. The research used is doctrinal legal research. The results of this study can be concluded that homosexsual act commited by TNI member is contrary to article 281 paragraph (1) of the KUHP. In additiaon especially in TNI internal regulations include the telegram of the TNI commander number ST/398/2009 Jo. ST/1648/2019 as emphasized in the supreme court circular letter number 10 of 2020. Homosexsual act also contarty with the human rights in Indonesian as stated in article 28 J paragraph (2) of the UUD 1945 Jo. Article 70 UU HAM. The limitations on the application of human rights that apply in Indonesia are based on considerations of moralitry, security and public policy in a democratic society, so that homosexsual act coomited by TNI members is a contrary toi the provisions of the law that are upheld so that actions coomited by TNI member must be dealt with firmly.
