Abstract

Article 21 paragraph 2 of law number 5 of 1990 concerning living natural resources and their ecosystems. Violation of the provisions of article 21 paragraph 2 is regulated in article 40 of law number 5 of 1990. However, the reality that occurred in the Pulau Banyak sub-district was resolved through customary law that grew within the community and the community still violates the provisions of customary law that exist in society. The type of research method is empirical juridical using primary data through interview data, literature study of written materials such as books and documents. The results of this study say that in the Pulau Banyak District area there are still violations of customary law provisions that live in the community, so that people still violate customary law regarding turtle protection. Based on the case of turtle meat hunting, customary law cannot provide a definite resolution, so it is contrary to the law, therefore it must be resolved through positive law.

Abstract

In line with the Government's efforts to increase efficiency in the performance of State-Owned Enterprises (BUMN) in each sector, one of the strategies used is to create BUMN Holding, Further, Government Regulation was stipulated concerning Amendments to Government Regulation Number 44 of 2005 concerning Procedures for Participation and Administration of State Capital in State-Owned Enterprises and Limited Liability Companies Number 72 of 2016. One of the implementation of BUMN Holding was carried out in the Mineral and Coal Mining sector resulting in a change in the status of PT Timah Tbk which was originally a state-owned enterprise (BUMN) based on Government Regulation concerning the Transfer of Forms of a State-owned Tin Mining Company to a Limited Liability Company (Persero) Number 3 of 1976 Changed to become a BUMN Subsidiary with the stipulation of Government Regulation Concerning the Addition of the Republic of Indonesia State Equity Participation into the Share Capital of PT Indonesia Asahan Aluminium Company Number 47 of 2017 where PT Indonesia Asahan Aluminium Tbk (Persero) is BUMN Holding. With the change in status from previously a State-Owned Enterprise (BUMN) to a Subsidiary of a State-Owned Enterprise (AP BUMN), it has an impact on the change in the financial status of PT Timah Tbk, which no longer has state shares/capital in it. Whereas based on the changing status of PT Timah Tbk to a BUMN Subsidiary of PT Indonesia Asahan Aluminium (Persero), there is legal dualism related to the authority of the Supreme Audit Agency (BPK) to audit PT Timah Tbk

Abstract

On March 2, 2023, the Central Jakarta District Court decided to accept the PRIMA party's lawsuit, declared the PRIMA party the party that was harmed, ordered the defendant to pay a fine of five hundred billion, punished the defendant in this case, the KPU not carrying out the remaining stages of the KPU, and so on. On the one hand, this decision is considered to be in the wrong room, and the JAKPUS District Court judges exceeded their authority, especially regarding the election postponement clause. However, on the other hand, this decision was aimed at justice for the PRIMA party due to the KPU's negligence. Based on this, the research seeks to analyze more deeply and comprehensively whether the JAKPUS District Court decision was in the wrong chamber and the judge exceeded his authority or whether this decision was indeed in his room. This research is normative research with a normative juridical approach. The legal material used in this study is secondary legal material, namely in the form of a JAKPUS District Court decision number 757/Pdt.G/2022/PN.Jkt.Pst, laws and regulations, doctrine, expert opinions, and so on related to the theme of this research. In addition, no research specifically examines this decision. The results of this study indicate that the unlawful act referred to in this case is a legal act committed by a government agency/institution, which is the authority of the Administrative Court as outlined in PERMA Number 2 of 2019. In addition, the judge's actions in handling this case fall into the category of abuse of power for exceeding their authority and not implementing the written rules, in this case, PERMA Number 2 of 2019

Abstract

Due to the rise in cases of film piracy in Indonesia, this has motivated the writer to conduct research on this case. By using a qualitative descriptive writing method, the data is obtained from observations and also from literature studies. The concludes from the author's research, someone who uploads a film without any permission from relevant party can be declared as film piracy, but unfortunately there are still many people who even support this. Because if you watch through illegal websites it is free, but they arn’t aware that this act is a violation of the ITE Law. The main factor is that the perpetrators of piracy get a lot of profit from the audience, and also get a good response from the public who prefer to use illegal websites rather than using illegal websites. with a legal film player application. Stopping film piracy carried out by the LK 21 website has been terminated by blocking the lk 21 website by the Ministry of Communication and Informatics, for viewers to be wiser by watching films through the official site or application so that piracy does not occur.

Abstract

Penelitian ini memiliki tujuan guna (1) mencari tahu hubungan hukum pihak penyelenggara dengan debt collector sebagai pihak alih daya pada diadakannya Layanan Pendanaan Bersama Berbasis Teknologi Informasi (2) guna mencari tahu kepastian hukum sistem pertanggungjawaban pihak penyelenggara dengan debt collector sebagai pihak alih daya pada diadakannya Layanan Pendanaan Bersama Berbasis Teknologi Informasi berdasaran ius constitutum. Metodoe pada penelitian penulis ialah memakai metode penelitian hukum normatif serta berkarakteristik deskriptif kualitatif. Teknik kepustakaan digunakan untuk mengumpulkan data, yang selanjutnya diperiksa secara deskriptif dan kualitatif untuk menunjukkan hasil yang diantisipasi dan menarik kesimpulan tentang masalah tersebut. Temuan penelitian ini menunjukkan bahwa ada hubungan hukum antara pihak penyelenggara dengan debt collector yang berperan sebagai pihak alih daya dalam penyelenggaraan LPBBTI terjadi dikarenakan sebuah perikatan yang terjadi antara pihak penyelenggara dengan debt collector dalam menjalankan layanan pendanaan. Dalam mempertanggungjawabkan seluruh kegiatannya, pihak penyelenggara dengan debt collector diikat dengan hukum yang tertera di Peraturan OJK 10/2022 mengenai Layanan Pendanaan Bersama Berbasis Teknologi Informasi.

Abstract

The study aimed to discover an understanding of the handling of government officials who do not carry out the decisions of the State Administrative Court. In the mechanism for implementing decisions, the State Administrative Court has no implementing agency, and hence, the State Administrative Officers often disobey and do not implement the decisions of the State Administrative Court. Therefore, citizens' constitutional rights to justice decided by the State Administrative Court can be threatened. This study aimed to compare the state administrative justice systems in Indonesia and Thailand. This research uses doctrinal research with a statutory approach. The results of this study are that there is no institution for implementing the decisions of the State Administrative Court in Indonesia. Meanwhile, in Thailand, there is already an implementing agency, and functionally the executive body executes litigants. Therefore, regulation and implementation of State Administrative Officers who do not implement State Administrative Court Decisions is an urgency to increase the effectiveness of implementing State Administrative Court decisions in Indonesia.

Abstract

Along with the national development program carried out by the government, a work copyright law was enacted which is expected to provide ease of doing business, inflow of investment, so as to create jobs and improve people's welfare. This study aims to examine the impact of Article 88C paragraphs 1 and 2 of the work copyright law number 11 of 2020 on district minimum wages in Indonesia. Because there were many controversies, demonstrations by workers and students emerged who understood that this article is more detrimental to workers because it lowers the district or city minimum wage. The research method used is descriptive and normative methods in the form of literature studies. In the perspective of Indonesian law, this article provides protection for workers and companies in order to create economic stability. However, there are still challenges and problems in determining efforts to determine the District/City Minimum Wage, such as if it only follows the Provincial Minimum Wage then the District/City Minimum Wage may be lower and vice versa. Therefore, discussions and in-depth studies are needed to consider the interests of all parties, including workers, employers, and the general public.

Abstract

The purpose of this research is to find out the implementation of the electronic General Meeting of Shareholders (e-RUPS) using the e-proxy method at PT Telkom and to find out how the Notary's authority is in holding the General Meeting of Shareholders electronically. The research method that researchers use is Empirical Juridical law (sociolegal research). The data that has been collected will then be analyzed using a qualitative approach, namely research procedures that produce descriptive data. The research results of PT Telkom as one of the users of the easy.KSEI applications have carried out e-RUPS since the Covid-19 pandemic hit Indonesia in 2020 until the last e-RUPS in 2022.

Abstract

In the case of premeditated murder committed by Former Head of Propam Polri Ferdy Sambo division which was carried out at Ferdy Sambo's official house on Jalan Duren Tiga, No. 46, South Jakarta on Friday (8/7/2022) at around 17.00 WIB against Brigadier Joshua Hutabarat. In the premeditated murder case, Bharada Richard Eliezer, who acted as a justice collaborator, made it easier for law enforcement officials to uncover the case, in which a justice collaborator was given a very light sentence compared to the sentence previously given by the Public Prosecutor, namely imprisonment for 12 years. however, when the verdict was passed against Bharada Richard Eliezer, the Panel of Judges at the South Jakarta District Court only gave a sentence in the form of imprisonment for 1 (one) year and 6 (six) months against Bharada Richard Eliezer, who was the perpetrator of the premeditated murder. The court judges gave Bharada Richard Eliezer a light sentence because he was a justice collaborator who uncovered the premeditated murder case of Brigadier Joshua Hutabarat, in SEMA No. 4 of 2011, namely a justice collaborator, was given a lighter sentence than the perpetrators of other crimes involved. on the crime of premeditated murder.

Abstract

Criminal Sexual Violences or Sexual Violences, in fact, do not only occur in the midst of ordinary society, but also within active institutions of the Indonesian National Armed Forces (TNI). In this case it is clear that the TNI members involved have violated the soldier's oath and 8 (eight) TNI conscripts. In this case, every member who of course commits immoral crimes must be held responsible for their actions by receiving sanctions in the form of dismissal and appropriate punishment because they have damaged the good name of the TNI institution. The type of research method used in this writing is the normative legal research method. The method of normative legal research is carried out by studying documents and referring to studies of court decisions, principles, legal principles, legal theories, doctrines, and opinions of experts. The writing specification used is descriptive. It is used to explain various regulations and legal theories that can be correlated and examined in events or cases that occur in related problems by using secondary research data types and statutory approaches (statute approach). Therefore, it is hoped that the implementation of additional punishment in the form of dismissal can be given with the aim of providing a deterrent effect in order to maintain the image and reputation of the TNI.
