Abstract

Kegiatan investasi saat ini sangat dibutuhkan oleh setiap negara untuk meningkatkan perekonomian suatu negara. Seiring dengan berjalannya waktu, kegiatan investasi di Indonesia cenderung meningkat, dan pada akhirnya undang-undang yang berlaku dan menjadi payung hukum bagi investasi di Indonesia tidak dapat lagi mengakomodir perkembangan tersebut. Oleh karena itu, lahirnya Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal disahkan pada tanggal 26 April 2007. Pasal 6 (1) Undang-Undang tersebut dengan jelas menyatakan bahwa Indonesia menganut asas MFN dan NT dalam rezim hukum penanaman modal Indonesia. Namun dalam Pasal 6 (2) terdapat klausul yang menyatakan bahwa prinsip MFN dan NT tidak berlaku bagi penanam modal yang memperoleh “keistimewaan” berdasarkan perjanjian yang dibuat dengan Pemerintah Indonesia. Kedua klausul tersebut tampaknya saling bertentangan. Pasal 6 ayat (2) Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal menimbulkan ambiguitas dalam pelaksanaannya. Tampaknya ada masalah hukum terkait prinsip MFN dan NT dalam investasi. Penting untuk diulas bagaimana penerapan prinsip Most Favoured Nation (MFN) dan prinsip National Treatment (NT) berlaku di Indonesia. Serta bagaimana akibat hukum bagi penanam modal yang diperlakukan tidak adil atau tidak memiliki hak khusus setelah diundangkannya Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang terkait dengan Pasal 6 Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal? Hasil dari penelitian ini adalah selama perjanjian bilateral tersebut tidak mengganggu investor negara lain, maka penjelasan “keistimewaan” bagi negara investor yang telah membuat kontrak tidak serta merta melanggar ketentuan prinsip MFN dan NT dalam aturan WTO.

Abstract

Auction is a method of offering goods by verbally mentioning the price from the highest to the lowest. This writing aims to find out the material law that should be stipulated in this case and to find out the basis for the judge's considerations in deciding case Number 2893 K/Pdt/2021. This research approach is a normative juridical approach by discussing the doctrine or legal principles contained in statutory regulations. The results of this study are that the court can cancel the cancellation of auction for the execution of the Mortgage. Cancellations can only be canceled before the auction is held, this is by the provisions in Article 24 of the Minister of Finance Regulation No.106/PMK.06/2013 which states that the auction can be canceled by a court decision before the auction is held. Cancellations of auctions submitted after the auction has occurred cannot be carried out, this is in accordance with the provisions in Article 3 of Minister of Finance Regulation No.106/PMK.06/2013 which reads that auctions that have been carried out in accordance with applicable regulations cannot be cancelled.

Abstract

Implementasi pemberdayaan ekonomi keluarga melalui program Usaha Peningkatan Pendapatan Keluarga Sejahtera (UPPKS) di Kecamatan Padang Laweh, Kabupaten Dharmasraya adalah upaya strategis untuk meningkatkan kesejahteraan keluarga di wilayah tersebut. Program ini bertujuan untuk memberikan dukungan dan pelatihan kepada keluarga dalam mengembangkan usaha mikro dan kecil guna meningkatkan pendapatan khususnya pada kelompok-kelompok rentan dalam masyarakat, termasuk perempuan, pemuda, dan keluarga miskin. Prinsip inklusifitas, kesetaraan gender, dan pengentasan kemiskinan menjadi landasan dalam pemberdayaan ekonomi keluarga melalui program ini. Metode yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dengan pendekatan deskriptif yang pengumpulan datanya dilakukan dengan teknik wawancara, observasi, dokumentasi, dan kepustakaan. Populasi dalam penelitian ini adalah seluruh aparatur Balai KB, kelompok UPPKS, dan masyarakat yang ada di kecamatan padang laweh dengan jumlah sampel 11 orang yang memenuhi kriteria dalam menjawab rumusan masalah. Lokasi penelitian berada di Balai KB Kecamatan Padang Laweh Kabupaten Dharmasraya. Melalui implementasi pemberdayaan ekonomi keluarga melalui program UPPKS di Kecamatan Padang Laweh, diharapkan terjadi peningkatan pendapatan keluarga, peningkatan kesejahteraan, dan pengurangan tingkat kemiskinan di wilayah tersebut. Selain itu, program ini juga diharapkan dapat berkontribusi pada pengembangan ekonomi lokal, peningkatan kemandirian keluarga, dan pemberdayaan masyarakat di tingkat lokal.

Abstract

In practice, land sale and purchase agreements are sometimes faced with various problems, including defaults on the part of the buyer or seller where the parties are negligent or deliberately do not fulfill their achievements, thus causing the end of the sale and purchase agreement. For the purpose of this research, namely to find out and examine the down payment status due to the cancellation of land sale and purchase transactions linked to Law Number 8 of 1999 concern on Consumer Protection and to find the alternative dispute resolution that can be taken related to down payments related to land sale and purchase transactions . This study applies normative juridical research methods and is carried out descriptively. From the results of the research, the status of down payments in buying and selling land is associated with Law no. 8 of 1999, namely that one party cannot cancel a purchase because there is already a down payment. However, in some agreements it is possible to agree on the return of the down payment. If the cancellation is caused by the seller's default, thus he is obliged to return the down payment to the buyer, but if it is caused by the buyer's default, then the seller is not obliged to return the down payment. Dispute resolution that can be carried out by the buyer can be carried out amicably. If it doesn't work, then you can take the non-litigation route. To minimize this incident, the buyer should be more careful when carrying out the sale and purchase of land also need to make a binding sale and purchase deed in front of a notary as a perfect and valid witness and evidence.

Abstract

One country that is often a transit country for people seeking asylum elsewhere is Indonesia. Due to its location, Indonesia can become an illicit trade corridor and a stopover for people seeking asylum in Australia. As the influx of these refugees is deemed to pose a danger to national security and resilience, these illegal arrivals are certainly bad for Indonesia. Every person entering or leaving Indonesia is required by law to have a valid travel document. Indonesian laws and regulations governing the treatment of international refugees are inadequate. The purpose of this study is to analyse the role of IOM in fulfilling the basic needs of refugees in Kupang City in terms of Presidential Regulation Number 125 of 2016 concerning the handling of refugees from abroad". Normative-Empirical (applied) legal research. Researchers apply qualitative data analysis methods. The approaches used in this legal research are statutory approach, historical approach and conceptual approach. The result of this research is that IOM in Indonesia has supported the Indonesian government in its efforts to overcome migration problems, both domestic and international. In Indonesia, IOM fulfils its policies regarding protection and a rights-based approach, by assisting migrants and refugees directly in accordance with the references or referrals given by the Indonesian Government to IOM. As a country that did not ratify the 1951 Refugee Convention, Indonesia still respects the rights of refugees including the right to fulfil basic needs for refugees in Kupang City. As referred to in Presidential Regulation No. 125 of 2016 concerning the handling of refugees from abroad.

Abstract

Buying and selling online is an option that is in great demand by the public because it has many conveniences and advantages. With the increasing sophistication of online buying and selling transactions, there are also many choices of payment methods for these transactions, one of which is Cash On Delivery or what is commonly referred to as (COD). However, along with its development, many sellers have suffered losses from the Cash On Delivery payment method. This paper aims to find out how legal protection is for sellers in online buying and selling transactions with the Cash On Delivery payment method and also what legal remedies can be used by sellers. This paper uses a normative juridical research method by applying a statutory approach, namely by means of an analysis of statutory regulations and provisions in accordance with the problems being handled. The results of this paper explain that legal protection for sellers in carrying out online buying and selling transactions with the Cash on Delivery payment method is contained in Article 6 of Law Number 9 of 1999 concerning Consumer Protection. In addition, to protect the rights of the seller, there are also legal remedies that can be taken, namely by way of settlement out of court through Alternative Dispute Resolution. In this case the settlement of disputes through the courts is expected to be the final effort that will be taken by the seller and the buyer after other methods do not result in an agreement.

Abstract

Negara Kesatuan Republik Indonesia, sesuai dengan amanat konstitusi, menganut sistem pemerintahan presidensial. Dalam penerapannya, presiden memiliki kewenangan yang signifikan. Namun, di negara-negara lain yang menganut sistem presidensial, hanya menerapkan sistem dwi partai. Sebagai negara yang terdiri dari beragam suku dan budaya, Indonesia berharap agar sistem ketatanegaraannya sesuai dengan sistem presidensial pada umumnya. Harapan tersebut sedikit demi sedikit terwujud melalui penerapan presidensial threshold yang diharapkan dapat menyederhanakan sistem multi partai yang berlaku di Indonesia. Namun, penerapan presidensial threshold dalam pemilihan presiden di Indonesia sebenarnya memiliki sejarah yang menakutkan terhadap dinamika politik di Indonesia. Pada pemilihan presiden tahun 2014 dan 2019, terjadi perpecahan di antara pendukung calon presiden dan wakil presiden. Pemilihan presiden di tahun-tahun tersebut hanya menghadirkan dua calon yang kontestasinya sangat ketat. Oleh karena itu, para akademisi menganggap bahwa presidensial threshold dengan angka 20% di kursi parlemen atau 25% dari suara sah nasional terlalu tinggi dan khawatir akan memunculkan perpecahan dalam kontestasi pemilihan presiden di tahun 2024.

Abstract

Normativisasi nilai-nilai Pancasila dalam pembentukan peraturan daerah untuk mewujudkan pembangunan hukum yang berkelanjutan menjadi langkah yang mendesak untuk dilakukan. Saat ini, banyak peraturan perundang-undangan yang ada di Indonesia dibentuk dengan jalan yang menyimpang dan mengabaikan nilai-nilai Pancasila. Banyak peraturan yang baru saja ditetapkan namun langsung mendapatkan penolakan dari masyarakat dan tidak sedikit masyarakat mengajukan judicial review atas suatu produk hukum yang baru ditetapkan. Penelitian ini bertujuan menganalisis bagaimana kedudukan nilai-nilai Pancasila dalam pembentukan peraturan daerah, dan bagaimana normativisasi nilai-nilai Pancasila menjadi validitas peraturan daerah sehingga dapat menjamin kepastian hukum. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan filosofis. Hasil penelitian ini mengungkapkan bahwa nilai-nilai Pancasila berkedudukan sebagai sistem norma (system of norms) sekaligus sebagai bintang pemandu (leitstern) dalam pembentukan peraturan daerah, yaitu nilai Pancasila memberikan patokan dan standar dalam pembentukan peraturan daerah. Selain itu, nilai-nilai Pancasila juga berfungsi sebagai sistem perilaku (system of behavior) dalam pembentukan peraturan daerah, yaitu meliputi perencanaan, penyusunan, pembahasan, pengesahan, dan pengundangan. Sementara itu, nilai-nilai Pancasila juga berlaku sebagai sistem validitas (system of validity) yang menentukan apakah norma suatu peraturan daerah valid atau tidak valid.

Abstract

Infrastructure development by the government, namely the Surabaya People's Housing and Settlement Area and Land Affairs Office, is carried out by holding project tenders to cooperate with private parties engaged in construction services to expedite the development process. This study aims to determine the implementation of construction work contracts between the parties, especially when there is default and the type of research used is empirical juridical. The results of the study show that it is the competence side of human resources from the private sector that is the factor causing defaults in the implementation of construction work contracts. Handling from the agency is carried out by holding an addendum which simultaneously gives a warning, imposes fines, and blacklists private companies. Obstacles that occur in the handling process come from the internal side, namely the private sector that is not cooperative. In addition, it also came from the external side, namely from the private sector engaged in construction services. Solutions to dealing with these obstacles require upholding legal certainty as well as revamping the system in its implementation to make it more stringent and prevent things that end up causing harm to many parties in the development process.

Abstract

Restorative justice has emerged as an alternative approach to the traditional criminal justice system, focusing on the restoration of relationships and addressing the needs of victims, offenders, and communities. This paper explores the concept of restorative justice and its role in achieving substantial justice in the resolution of criminal offenses. By emphasizing dialogue, accountability, and repair, restorative justice seeks to transform the traditional punitive model into a more inclusive and participatory process. The paper examines the key principles and practices of restorative justice, highlighting its potential benefits for both victims and offenders. It explores how restorative justice processes provide opportunities for victims to express their feelings, receive apologies, and actively participate in the decision-making process. For offenders, restorative justice offers a chance to take responsibility for their actions, make amends, and reintegrate into the community. Furthermore, the paper discusses the challenges and limitations of implementing restorative justice within the existing criminal justice system. It acknowledges the need for comprehensive legislative frameworks, trained facilitators, and community support to ensure the successful integration of restorative justice practices. The findings suggest that restorative justice holds promise in fostering healing, rehabilitation, and social reintegration. By prioritizing the needs and voices of victims and offenders, restorative justice promotes a more balanced and humanized approach to justice. Its emphasis on repairing harm and building stronger communities contributes to the overall effectiveness and fairness of the criminal justice system.
