Abstract

An important aspect that cannot be separated from the evidentiary process is related to how to obtain and present evidence to the judge before the trial. Wiretapping as electronic evidence obtained secretly often gives rise to debate from the perspective of bewijsvoering, and the evidentiary value of electronic evidence obtained through wiretapping. This article will discuss the use of wiretapping results as electronic evidence in relation to its evidentiary value in court. The results of this research show that there is a dualism in bewijsvoering the results of wiretapping as electronic evidence, some are of the opinion that bewijsvoering the results of wiretapping as electronic evidence must be obtained legally, and other opinions state that bewijsvoering is a separate matter from proof, as long as the evidence is submitted to the front. the trial is in accordance with the facts and other evidence, then the evidence is considered valid.

Abstract

The problem with law enforcement for environmental crimes is that in prosecuting perpetrators of environmental crimes, the emphasis is still on the element of error. The implication of this problem is that it is difficult to prove environmental crimes, considering that the perpetrators of environmental crimes are not only people (natuurlijk person) but also include corporations (recht person). Legislation regarding the environment, especially Law Number 32 of 2009, has determined responsibility for perpetrators of environmental crimes using the strict liability theory. This article will discuss the implementation of strict liability theory to find the ideal concept for dealing with environmental crime. The method used in writing this article is normative legal research with a statutory approach. The results of this research are the ideal concept of corporate responsibility for the occurrence of environmental crimes in the form of payment of compensation (civil) and punishment of perpetrators (criminal sanction).

Abstract

Seiring majunya waktu, muncul berbagai inovasi, termasuk Rokok Elektrik. Rokok jenis ini mengandalkan daya listrik dari baterai dan menggunakan Liquid sebagai substansi untuk menghasilkan uap. Pada dasarnya, Rokok Elektrik dirancang sebagai alternatif untuk mengurangi konsumsi Rokok konvensional yang tinggi kandungan nikotinnya. Namun, banyak Liquid Rokok Elektrik yang masuk ke Indonesia tidak mengikuti prosedur yang sesuai, dan jika dikonsumsi, dapat menjadi lebih berbahaya daripada rokok konvensional. Penelitian ini menggunakan pendekatan filosofi yuridis normatif, yang menyimpulkan bahwa perlindungan hukum bagi konsumen yang terkait dengan Rokok Elektrik dapat dievaluasi dengan merujuk pada Undang-Undang Nomor 8 Tahun 1999 tentang Proteksi Pelanggan dan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Terdapat juga tanggung jawab terhadap konsumen yang mengalami kerugian akibat konsumsi Liquid Vape. Pihak distributor atau industri yang memproduksi dapat dikenakan sanksi hukum dalam bentuk ganjaran administratif. Jenis ganjaran ini mungkin melibatkan peringatan lisan, peringatan tertulis, pencabutan produk dari peredaran, saran untuk menghentikan produksi, atau pun saran untuk menaikkan standar keamanan sesuai dengan ketentuan dalam Peraturan Perundang-undangan.

Abstract

The protection of a just and civilized humanity can be planned with rational protection through non-penal policies in crime prevention efforts. Criminal policy aims to provide protection to society in order to realize people's happiness in living a healthy and refreshing cultural life. The purpose of this study is to describe and analyze efforts to overcome physical violence against women in Labuhanabatu Regency at the office of women's empowerment and child protection. The method used in this research is empirical research located in Labuhanbatu Regency, namely at the Labuhanbatu Regency (P2TP2A) unit. The results of this study are that it was found that the data on physical violence against women in Labuhanbatu Regency. Labuhanbatu is that in 2021 there were 3 cases and in 2022 it increased to 9 cases. The forms of violence that occur are in the form of beatings, slaps, kicks, jambakan, strangulation which result in bodily damage such as bruises, facial injuries. Activities to Prevent Physical Violence Against Women carried out by the P2TP2A Office of Labuhanbatu Regency are Socialization and counseling on "Protection of Women and Children" to the community, Skills training, Labor market and employment opportunities, Start-up capital assistance program, Women's cooperatives, Small micro businesses, Opening a culinary business, Tailoring services. The Recovery Activities for Victims of Violence Against Women carried out by P2TP2A Labuhanbatu Regency are: Rehabilitation, Services, Assistance, Education.

Abstract

The main focus of Pilkada's implementation in this pandemic is that the protection of basic rights in the form of the fulfillment of political rights and the right to health must be placed on an equal footing rather than contradictory to each other. That is. This study aims to identify and analyze the urgent reasons for the fulfillment of basic rights in the 2020 regional leader elections in the Covid-19 pandemic. The problem approach in this study uses normative law. This approach explores theories, concepts, legal principles, and laws related to this study, with a focus on examining the application of rules or norms in positive law. The urgency of fulfilling political and health rights may have been addressed appropriately, but violations of health protocols should be monitored during the preparation and implementation of Pilkada. From the perspective of three basic legal values, only the value of legal certainty regarding the enforcement or imposition of sanctions in the event of a breach of a health protocol is not finely and clearly regulated by PKPU.

Abstract

Development in Indonesia emphasizes the need for funds for productive projects, including foreign investments. However, limitations on share ownership have led to the practice of nominees in limited liability companies. This research analyzes the validity of nominee agreements and the synchronization of relevant regulations in Indonesia. The research method employed is descriptive analytics with a normative juridical approach. The findings indicate that the nominee practice, despite its common use, may violate regulations, particularly prohibitions on agreements declaring share ownership on behalf of others. In conclusion, this research highlights the complexity and challenges of regulating nominee practices within the existing regulatory framework in Indonesia.

Abstract

The purpose of writing this article is to be able to know and analyse how the notary's liability for forgery of authentic deeds. This article uses normative research type with statutory research approach and conceptual approach, and uses descriptive qualitative data analysis with deductive thinking method. Criminal offences by notaries for the act of forgery of authentic deeds can be subject to sanctions contained in the Criminal Code with applicable provisions, in this case, namely the criminal act of forgery. Notaries who commit criminal offences must be punished, and the Criminal Code in general can be applied to the Notary in accordance with the principle of lex specialis derogate legi generali which is interpreted a contrario, namely as long as there is no regulation regarding criminal sanctions in the UUJN specifically, the provisions of general criminal sanctions (Criminal Code) will apply. Criminal responsibility carried out by the Notary, namely for the criminal act of forgery of authentic deeds, namely by going through the process in the Criminal Justice System related to the submission of allegations of forgery of authentic deeds starting from the investigation process to the trial. Falsification of an authentic deed made by a notary has implications for the authentic deed to be null and void.

Abstract

Malpractice, a criminal act in the healthcare field, creates legal problems when patients realize the impact. Medical negligence can harm patients, triggering risks that could have been avoided with medical prudence. Normative and sociological research supports the criminal law assessment of malpractice, focusing on maltreatment and negligence causing death. Sanctions are imposed by the medical professional organization and the immediate supervisor in charge, taking into account the ethical values and values of the profession. Punishment is only imposed if the act violates the law, and the form of malpractice needs to be adjusted to the development of science and the times.

Abstract

Trademark becomes a valuable asset owned by a company, especially if the brand has become a well-known mark. The well-known of a trademark creates a greater opportunity for deviations in the use of the brand which will eventually lead to the trademark disputes. Trademark disputes are still common in Indonesia with various problems, especially imitation of famous trademarks. The purpose of this study was to determine the decision process of the judiciary regarding the "STRONG" trademark dispute from the first level and an appeal and to see its conformity with the applicable laws and regulations and justice for the disputing parties.The approach method used in this thesis is normative juridical, namely research that uses existing legal norms and the application of these legal norms with research specifications is descriptive-analytical. The results showed that the Supreme Court in Decision Number 332 K/Pdt.Sus-HKI/2021 which stated that the considerations at the Central Jakarta Commercial Court were wrong in applying the law, had given correct considerations and decisions in accordance with applicable laws and regulations. The Defendant/Applicant for Cassation has not violated the rights to the “STRONG” trademark belonging to the Plaintiff/Respondent of Cassation. In order to be able to use a trademark in the form of a general descriptive word, it must build a secondary meaning on the trademark so that it can become a stand-alone trademark and has a strong distinguishing power. The need for additional criteria and use of trademark in the form of descriptive general words in the laws and regulations concerning trademarks in Indonesia.

Abstract

Nowadays there is unclear norm (Vague of norms) in some domains of rules in marriage agreements in the Marriage Law, where a marriage legal unit in Indonesia should be drawn up which is related to the marriage agreement referring to Article 29. The provisions in Article 29 of the Marriage Law do not have clear reasons related the entire marriage agreement, for example it requires aspects and there are no things contained in the marriage agreement, the legalization of the marriage agreement and related to the mechanism of change so that there can be a guarantee that the change will not harm the other party. Regarding the type of normative juridical research, it leads to the object of research, including legal issues which relate to the responsibility of a Notary in the preparation of an Authentic Deed in a Marriage Agreement. So that the results of this research are authentic deeds which include the strongest written evidence and the full meaning where the Judge does not have to explore other aspects of truth unless it is contained in the notary deed. In addition, marriage agreements can be drawn up through the wishes of the prospective bride and groom where there is no contradiction in the Constitution of the Republic of Indonesia, there are no violations of religious law or aspects of morality. This situation is in harmony with the principle of freedom of contract.
