History of plantation is the history of peasants’ land grabbing in Nusantara. The peasants have responded thissituation with resistance in many ways. The theme of the research is peasant resistance during the transition of democracyorganized by peasant movement of Deli Serdang confronts PTPN II. This research reveals that the peasants consider thatreformation era has opened political chance for them to struggle in legal ways. But when the resistance in legal way is deadlocked, the peasants took another way to rebel, in the extra legal way, with its consequences such as open war with nationalmilitary or civilian militia recruited by PTPN II. The birth of extra legal movement is the consequence of nation failure and it isalso the consequence of the contradictions of the formal law in handling agrarian conflict.Keywords: PTPN II, peasant social movement, reclaiming, rebellion transformation.

The land policy in Yogyakarta Special Province, especially the one related to land ownership by the Indonesian-Chinese blood, is different from that of another region. It is stated on the Governor’s Instruction No. K. 898/I/A/1975 aboutThe Uniformity of Giving the Right on Land Policy to Non Indonesian citizens, Indonesian-Chinese blood which states that theyare not allowed to own the land. The policy is called the affirmative action that is the positive discrimination having theideological purpose of reaching the justice and similarity for The Indonesian origins in Yogyakarta. Abstract: The article offers an framework to identify causes, effects, perpetuating conditions, and structural roots of agrarianconflicts. Systemic agrarian conflicts were defined as everlasting contradictory claims on who had the rights over access to lands,natural resources, and territories between rural community and concession holders in the business of plantation, forestry,mining, infrastructure, etc. The conflicting claims are perpetuated by significant efforts to delegitimize the existence of others’claims. Being different from various mainstream analysis promoting global market as opportunity, I prefer to use what Ellen M.Wood notion of “market-as-imperative”. Using the illustration of the expansion of oil palm plantation in Indonesia, the articleshows the consequence of global capitalist markets to the emergence of the agrarian conflicts.Keywords: agrarian conflicts, market, agrarian capitalism.

The article was saimed at describing the conflicts between the community, peasants at Pulau Padang, Meranti Islands Regency, and PT Riau Andalan Pulp and Paper (RAPP). The conflict started from the policy of The Minister of Forestry which allowed concession of HTI to RAPP at Pulau Padang. The problem was the permission itself as it took not only the area of farming lands but also the areas of settlement. The other problem was the environment itself. This was a result of RAPP. Various researches showed that Pulau Padang had thick peat. However, the permission for RAPP was to build industries and canals needing a lot of water. This would damage the environment whereas the peat ought to be protected. If tis is done, the serious damage of ecosystem at Pulau Padang will take place.

The management of natural/agrarian resources in the reformation era influence the governance of the governmentafter Amendment of the 1945 Constitution. The article is aimed at analyzing the crusial problems related to the right of thecentral government on managing (the land, forestry, mining, and taxation) problems. Yet, at present, those duties are implementedby the provincial and regional governments. The result of the analysis showed that the implementation caused thedecrease of the environmental quality, overlapping of services and so forth. Therefore, to make the regulations accord with theconstitution, the break law by the judges of the constitutional court was badly required.Keywords: dilemma, implementation, management natural/agrarian resources.

This paper seeks to explore the case of conflict within palm oil plantation-local people partnership involving SADBatin 9 group with palm oil company. Bungku village was the site chosen to take this issue comprehensively.The expansionofpalm oil plantationshave led totheloss ofliving territoryto developtheir social system. Conflictsarisenot onlyverticalbutalsohorizontal. Amongst the Inner SAD 9 itself, each fighting for its sovereignty emerged. SAD groups which were impoverishedby imbalanced control structure eventually have to deal with a part of their own group which slowly became part of the newruling capital group. The palm oil skipper that came from a group of local residents as well as newcomers were the form of theemerging plantation power. In the context of adverse incorporation, they were part of the group that get benefit from thepresence of palm oil plantation. Involvement or integration of this group in the oil business scheme has allowed them toaccumulate new capital sources. This group could accumulate greater profits from palm-oil they collect from small farmers.Key words: Suku Anak Dalam, palm oil, conflict, partnership

This article is a conceptual idea of the comparison between a research finding and reality in the community relatedto the agrarian conflict resolution. The study is entitled Resolution Policy on Contemporary Agrarian Conflict, which is one of thesystematic studies carried out by STPN in 2012; while the aforementioned reality in the society is gathered from records of thedynamics of agrarian conflict and struggle in several areas collected by Forum Komunikasi Masyarakat Agraris (FKMA), which arepublished by FKMA and other official media. One of current agrarian struggles in Central Java is between peasants against plantation estates. This paperexplicates four land conflict cases, and discusses varied responses of the state institutions to deal with land conflicts. This paperstart by showing the ways in which, after the fall of the authoritarian regime of Suharto in 1998, rural poor took the land back,which previously controlled by plantations. They believed the reclaimed lands belong to them as heirs. The Reformasi providedpolitical opportunity for rural poor in various regions to do Aksi Reklaiming, and got legitimacy for their actions. However, theplantation companies fought back, including by using legal and non-legal strategies. The paper shows in detail the trajectory ofeach conflict and efforts to handle it, and put them in comparison one to another.Keywords: agrarian conflicts, reclaiming action, Central Java.
