Abstract

This study aims to analyze Law No. 16 of 2017 concerning Social Organizations in accordance with the Rule of Law Principles and find forms of formulative policies to revoke the status of Legal Entities of Community Organizations Association in the future (Ius Constituendum). This research is a normative legal research using 3 types of approaches: Statute Approach, Conceptual Approach, Case Approach related to the laws and regulations on Social Organizations. The results of this study indicate that Law No. 16 of 2017, which criminalizes freedom of assembly is not following the principles of the state law and even against the principles of the state law, and has the potential to lead to repressive actions to create a dictatorial ruler. Future formulative policies in realizing freedom of association and assembly, the Law on Community Organizations must continue to guarantee a fair judicial process (due process of law) as regulated in Law Number 17 of 2013 concerning Social Organizations, and the sanctions given are sufficient sanctions. Abstract

Cultural elements, such as proverbs, hold deeply rooted educational values that have been integral to shaping societal norms and practices. These values can be utilized to educate children and build their character from an early age, whether through formal or nonformal education, guided by parents or teachers. In Islamic education, the integration of cultural values has been extensively studied and discussed. This study aims to explore how the values embedded in Sundanese culture can serve as a foundation for educating children from an Islamic perspective. Through a qualitative approach, the research examines Sundanese proverbs and their alignment with Islamic educational principles, focusing on the roles of parents, teachers, and educational institutions in characterbuilding. The study finds that educating children based on Sundanese values within an Islamic framework requires a comprehensive understanding of both cultural and religious teachings. A key element is the pivotal role of mothers as primary role models, supported by teachers and schools, to nurture children who are devoted to Allah and possess noble character. This research highlights the importance of integrating Sundanese cultural values with Islamic educational principles to create a holistic approach to character education. It underscores the collaborative roles of family, educators, and society in fostering a generation rooted in cultural wisdom and Islamic ethics.

Abstract

The pre-modern political frameworks of Muslim institutions, rooted in classifications like Dār al-Islam (Abode of Islam) and Dār al-Harb (Abode of War), are no longer fully compatible with the modern nation-state system. Contemporary terms such as Dār alShahādah (Abode of Testimony), Dār al-Ahd (Abode of Truce), and Dār al-Amān (Abode of Peace) have emerged as additions to the classical framework to address evolving sociopolitical contexts. This study aims to analyze the contributions of modern Muslim scholars and reformist thinkers to the development and reinterpretation of these classifications and their relevance to contemporary citizenship (Muwātana). Through a historical and analytical approach, the paper traces the evolution of the concept of citizenship within Islamic political thought, examining its transition from the Caliphate era (632–661 C.E) to the Ottoman Empire (1299–1924 C.E) and beyond. Special emphasis is placed on the reinterpretation of these concepts in light of Darūrah (necessity). The study reveals that the modern reinterpretations of classical frameworks offer a more inclusive and cohesive understanding of citizenship, treating all individuals equally within the nation-state paradigm. These developments reflect the adaptability of Islamic legal and political thought in addressing contemporary challenges. By exploring the evolution of citizenship within Islamic political history, this research underscores the necessity of reimagining classical frameworks to align with current socio-political realities, fostering greater inclusivity and harmony within diverse nation-state systems.

Abstract

Islam is a comprehensive religion and ideology that encompasses all aspects of human life. However, many Muslims today misunderstand or misinterpret its holistic concept. This issue arises from intellectual limitations within the Muslim community and the pervasive influence of secularism and liberalism in the Islamic world. This article aims to clarify Islam’s perspective on domestic and foreign politics, focusing on its principles, objectives, and practices to provide a more accurate understanding of Islamic foreign policy. Using a qualitative approach, this study collects data from Islamic sources and other relevant literature to explore the foundational concepts of Islamic foreign policy, including both theoretical and practical frameworks. The study argues that Islam forms the basis of Islamic foreign policy, primarily aimed at spreading its message (da'wah). This can be achieved through two main approaches: forceful means (warfare) and peaceful strategies (diplomacy). The paper highlights the importance of consulting expert analyses to optimize foreign policy interests in line with Islamic principles. This research provides foundational insights into Islamic foreign policy and underscores the need for further detailed studies on practical and specific issues in this area. Future research should focus on actionable strategies to implement Islamic foreign policy in a modern global context.
