Sexual Harassment During a Pandemic and The Legal Consequences It Causes

Abstract

Sexual harassment is unwanted and unwanted behavior or attention of a sexual nature and results in disturbing the harasser. Sexual harassment includes, but is not limited to: sexual payments for wanting something, coercion of sexual activity, derogatory statements about sexual orientation or sexuality, requests for sexual favors by the perpetrator, speech or behavior that has a sexual connotation; all can be classified as sexual harassment. This action can be conveyed directly or implicitly. The effect is on the victim, who is considered to be causing problems and not the perpetrator. In general, victims will keep their mouths shut, sometimes for a very long time, for these reasons, and there is a fear that they will become targets of abuse. They don't talk about it with friends or family. The healing process will be more difficult when there is denial from the institution, distrust, or blaming the victim. The rampant sexual harassment that is happening in Indonesia is troubling most people. Even during the current covid-19 pandemic, there is an increase in sexual harassment that occurs against women, even worse, it also happens to children who are still underage. Komnas Perempuan identified that during 2001 to 2012, there were at least 35 women who were victims of sexual violence every day. Meanwhile, the data released by Komnas Perempuan during the current covid-19 pandemic is 1,902 cases of sexual harassment that have occurred in Indonesia, as of Saturday, July 3, 2021. In this case, it is clear that there is still a lack of legal protection for cases involving threaten a person's personal personality, especially in cases of sexual harassment to sexual violence.

Abstract

The aim of this research is to see the effect of parenting style on discipline, responbility, and respect in middle childhood. The subjects are children aged 8 and 9. Characters and parenting style of the subjects are measured by instruments that were constructed by a group of character Education Research. Based on the measurement using one-way Anova. The result shows that there are significant diffrences between characters, which are discipline, Responbility, and respect, and parenting styles, which are authoritative, authoritarian, permissive, and neglectful in middle childhood.

Abstract

Sexual harassment is a form of sexual violence and is classified as a serious crime. This is due to the impact of sexual harassment which can threaten and endanger the life of the victim. Seeing the impact that is the result of sexual harassment, it is necessary to protect victims of sexual harassment from several parties such as the government, institutions, families, and communities. In addition, there is a need for legal protection that is binding on victims of sexual harassment. This study aims to conduct a juridical review of legal protection for victims of sexual harassment as a form of state responsibility. The research method used is a normative approach with a normative legal research design. The data used are secondary data derived from important documents and literature related to the research topic. The results of this study are that there is already legal protection for victims of sexual harassment in Indonesia which is a form of state responsibility, namely Articles 5 6 of Law Number 31 of 2014 concerning amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims. , Law Number 35 of 2014 concerning Child Protection, and Law Number 39 of 1999 concerning Human Rights. This is also supported by the activeness of victim protection institutions that assist in the protection of victims of sexual harassment. The urgency of establishing legal protection for victims is to prevent and provide solutions to the impacts felt by victims of sexual harassment.

Abstract

In IPR (Intellectual Property Rights) the protection of copyright holders is very important. Intellectual Property Rights (IPR) guarantees legal creators to obtain an advantage from a work that is created. So in this case someone who without permission plagiarizes a work and takes advantage of it will be considered a violation of the law. This is in line with the culture of today's society, with the rapid development of technology, many people are competing to create a work. But sometimes they forget a rule regarding Intellectual Property Rights by plagiarizing other people's work without permission. This makes it a legal violation of Intellectual Property Rights and harms the Copyright holder. The number of plagiarism of other people's work today shows that there is still a low level of public knowledge and law enforcement on copyright in Indonesia. This article will discuss the Protection of Intellectual Property Rights for Copyright holders, where Copyright holders must get legal protection for their works in the midst of the legal culture of society, in which in this case there are still many violations of Intellectual Property Rights.

Abstract

Online loans are currently increasingly widely circulated in the community. With all the conveniences offered, this has become one of the drivers of increasing online loan users. However, there are still many illegal online loans that are widespread and increasingly difficult to control. The existence of illegal online loans causes huge losses for its users. The existence of online loans cannot be controlled and can cause problems with great impact for the victims. The importance of education and introduction to the types of online loans that are still under the auspices of the Financial Services Authority (OJK) to minimize the increase in the number of victims which has been increasing in recent times.

Abstract

The existence of technological advances provides opportunities for the development of technological applications. The use of technology that is not based on knowledge of the rule of law can lead to violations, and does not rule out the possibility of violations to the detriment of the creator. With the internet network will increase the number of violations because it can be seen by the wider community. Copyright is regulated in Law Number 28 of 2014 (Copyright Law) concerning Copyright. The law explains that copyright is part of the intellectual property rights of protected objects. In fact, even though the Indonesian people have used the new copyright law (UUHC), there are still many copyright violations. Like what Warkopi did to Warkop DKI, Warkopi imitated the clothes and characters of Dono, Kasino, and Indro without permission, all three of whom were considered to have committed plagiarism as well as copyright infringement. Therefore, the state must provide legal protection as a form of appreciation for the creation.

Abstract

In the digital age, there are a lot of people or society who choose  e-commerce rather than the conventional transaction. E-commerce usually done in online marketplace applications such as Tokopedia, Bukalapak, Traveloka, and so on. Based on the data, Indonesia ranks as one of the highest e-commerce growth rate in the world. This is a good sign, because it means that marketplace companies in Indonesia can also compete and have a great opportunity to be more global.  However, as a result of these developments, of course there are also negative impacts that come together. One of the negative impacts is the issue of security/security of the linked accounts in the marketplace application. A lot of data-leak phenomena occur frequently and this is an urgent matter to be prevented and resolved. Marketplace’s account owners must have a legal things that protect them and prevent any various kinds of losses that can arise due to data leakage. And the marketplace platform providers also have to make some policies to protect their app users from the data leakage.

Abstract

As in most modern law countries, the State of Indonesia has a regulation regarding guarantees for religious rights and freedoms. This is implied in the constitution of the State of Indonesia, namely the 1945 Constitution of the Republic of Indonesia, precisely in Article 28 E paragraph (1) which reads "Everyone is free to embrace religion and worship according to his religion, choose education and teaching, choose work, choose citizenship, choose a place to live in the territory of the country and leave it, and have the right to return.” Along with regulations related to religious freedom, the State also has a role in guaranteeing its people to be able to embrace their respective religions which has been stated in Article 29 Paragraph (2), namely "The State guarantees the independence of each resident to embrace their respective religions and to worship. according to his religion and belief." Although the guarantee of the right to freedom of religion has been regulated in the constitution of the Unitary State of the Republic of Indonesia, in its concretization there are still many obstacles and problems. Talking about the right to freedom of religion, there are interesting things to always talk about and it is hoped that there will be a solution in the future, namely related to acts of violence in the name of religion. Recently, the Indonesian people were shocked by the act of destroying the mosque belonging to the Ahmadiyah congregation by intolerance and radicalism, to be precise, on Friday, September 3, 2021, in Balai Harapan Village, Temunak District, Sintang Regency, West Kalimantan. Seeing the barbaric actions carried out by the intolerant, the government needs firmness in enforcing the law and mediating between the minority and the majority.

Abstract

The Industrial Revolution forced a shift in all aspects of culture and economy. When the Revolution took place society turned from human power to mechanical power. The dynamic development of the flow of society has made very significant changes, so that it has come to an era where digital miracles seem very amazing. In this era of disruption, development in the agricultural sector underwent strategic environmental changes. This environmental change urges a new perspective for agricultural sector actors to find a new innovation developed for the welfare of farming families. The development of inclusive and sustainable agribusiness is a solution in the agricultural sector in this era of disruption but still requires basic adaptation and adjustment. This paper aims to explore policies, challenges and changes that occur in the agricultural sector in this era of disruption. This scientific article uses a descriptive type of research by using data collection sourced from secondary data. This data was collected based on a literature study conducted by reading, citing information from books, theses, official internet sites, and documents owned by the institution.

Abstract

In this day and age there are many problems with children. how not at a very early age and need good development and in the content of things that are posistif actually damaged. The rights of the child are usurped by irresponsible people. For example, such as sexual violence that can cause child development so unclear. Sexual violence itself is increasing significantly and the rate of sexual violence in Indonesian children almost every year rises. This is due to lack of attention and less serious attention. So that the most common negative effect felt by the victim is psychological damage. So that the occurrence of psychological damage can cause negative effects of long-term for children.
