Abstract

The State of Indonesia is a legal state where this is regulated in the 1945 Constitution of the Republic of Indonesia, especially in Article 1 paragraph (3). The consequence of this rule of law is that all aspects of state life are regulated in existing legal policies. This applicable law has a function as a regulator of all community actions including children. Children need special protection and enforcement within the protection of the law itself. The influence of all existing developments, including the development of science, technology, and culture, is not only felt by adults, but also by children. Along with these developments, it also does not cover the emergence of deviant behavior from minors, and one form of deviation is bullying. In Indonesia itself, cases of bullying are often found by underage children which have even been categorized as violence and bullying. Then often the perpetrator is not punished according to his actions just because he is underage, so this makes it difficult for the victim to heal the trauma because they still see the victim roaming around without proper law enforcement. For this reason, in this paper, the author will analyze how this can happen, and also how to enforce the law for the perpetrators of these minors.

Abstract

Child protection is one of the most important things in life, because basically a child cannot protect himself. Starting from actions or treatments that can result in psychological, physical and social losses, so that one of the steps in overcoming this is to ensure protection. The government's effort in tackling this problem is to create a statutory regulation regarding the protection and needs of children's rights which becomes a reference for the effectiveness of efforts in child protection issues. Because the law discusses how we should treat children so that they are prosperous and protected and their needs and rights are fulfilled. In an effort to understand it further, this journal was created to compare the concept or basis of child protection from Indonesia and Malaysia. The method in making this journal is to collect other research journals and also normative legal comparisons, which can be sourced from the Convention on the Rights of the Child and the Law on Child Protection in Indonesia and Malaysia.

Abstract

In mid-2021, the Indonesian people were shocked by a news report about a case of same-sex sexual harassment carried out by employees of the central Indonesian broadcasting commission or better known as the central KPI. Which is, this case has been going on for a long time but due to the slow handling of the law, the victim also made an open statement to social media so that this case was widely discussed. The form of same-sex sexual harassment according to positive law is basically the same as sexual harassment against the opposite sex, only the difference lies in the perpetrator and the victim, namely the same sex. The elements of same-sex sexual harassment are the existence of an act related to sex, the form of the act is physical and non-physical and there is no voluntary action. The method of writing this article is based on normative law with a statutory approach and a case approach. The results of the research in this article show that there is evidence against perpetrators of same-sex sexual harassment by co-workers at the Central KPI. However, in accordance with the provisions of Article 184 paragraph (1) of the Criminal Procedure Code that evidence is carried out with the testimony of witnesses, expert statements, letters, instructions and statements of the defendant. Proving the crime of same-sex sexual harassment also requires the role of a doctor to provide medical information through visum et repertum so that cases of sexual harassment tend to get a slow legal process and result in changes in the mental pattern of the victim.

Abstract

Drug abuse that occurs is mostly carried out by the younger generation starting from their teens, this is due to the fact that teenagers are a period where humans are very vulnerable and easily influenced by various bad influences from their circle, drug abuse is one of the, and as if it has been addressed by them as a trend in this modern era. Drugs can cause addiction effects for users, and on this basis they will try their best to get and use them again. This problem is supported by students’ access to various resources where they have their own pocket money and very broad association. Meanwhile, narcotics abuse itself is one of the crimes that can cause a lot of damage which is regulated in a special law, namely Law Number 35 of 2009 concerning Narcotics. This law was drafted to eradicate narcotics criminals and regulates criminal sanctions that can be given to them and the parties involved in their distribution, this is necessary considering the massive impact that this dangerous substance can have.

Abstract

Indonesia does not allow the use of narcotics except for medical purposes. Drug use for medical purposes must be under supervision of doctor, regardless of the level of content in it. In contrast to Netherlands, which allows the use of Soft Drugs as regulated in Dutch Opium Act. In Netherlands itself, the use of marijuana and the purchase of marijuana can be done at a coffee shop that already has a permit. The legalization of certain types of drugs and for certain purposes exists because Netherlands wants to provide legal certainty for their people. Netherlands want drug trafficking not to be carried out by crime syndicates that will harm their people. In addition, Netherlands also provides adequate health facilities for drug addicts. Evidently, number of addicts, number of HIV infections due to injection needles, and deaths from drugs has decreased. This is what distinguishes drug policy in Indonesia and Netherlands. Indonesia prioritizes the Penal Policy, it can be seen from the punishment of drug users. While Netherlands prioritizes Non-penal Policy, it can be seen from the incessant drug control. What can Indonesia follow from the drug policy in Netherlands is the prevention of drugs with state control over drug trafficking accompanied by adequate health facilities. Indonesia should reduce the punishment of drug addicts. Criminalizing drug addicts will not solve the problems. In the case of drug abuse, addicts are also victims.

Abstract

The current outbreak of the corona virus is becoming increasingly worrisome. More and more people became infected with the corona virus, with some even succumbing to their illness and dying as a result of the virus's spread. Today, social media is a popular means of communicating outside traditional means. In order to prevent the spread of this new disease, I'd like to share my experiences as someone who has been infected with the corona virus, as well as to warn others to stay at home and take care of themselves in order to avoid contracting the sickness. Descriptive qualitative research is employed in this study. It is the goal of this study to educate community members and millennial youth with information and an overview so that they can pay more attention to social ties in society and avoid societal changes as a result of false news causing undue worry. According to the study's findings, the community's usage of social media and other online tools has increased its members' access to information. A large false news campaign about social isolation preceded this, despite the government's call to heed the recommendations relating to social isolation.

Abstract

Indonesia in its government system uses democracy, which means that it upholds human rights. Especially about the election of their representatives in government. In this election of representatives, the people are given the right to vote to elect their representatives in running the government of the State of Indonesia. However, in practice there are several obstacles and even violations, for example money politics. These violations have undermined the value of the general election. However, there is a group in the general election that has a big role, namely millennials. Because of this, it is necessary to examine the legal polemic regarding money politics and how millennials can come to take part. The method used is normative juridical. The result is that the law in Indonesia has included regulations regarding money politics. However, in terms of implementing sanctions, it is still less than law enforcers, therefore this position can be filled by millennials. And millennials can also carry out fair and honest elections.

Abstract

Juvenile delinquency is a phenomenon that is often studied from a social, psychological, and legal perspective. In principle, children have different handling characteristics. For example, in legal studies, children have unique and distinctive procedures, starting from the Juvenile Criminal Justice System, Child Criminal Law, and Child Protection. However, along with the development of increasingly open technology and information, deviant behaviors in children continue to develop. This study aims to analyze how children's deviant behavior in social media in the study of law and criminology. The method used in this study is a mixed method between empirical and normative studies. This method is used to answer substantially the rules regarding child deviance on social media and the protection provided for children, as well as to see facts and phenomena directly in the field regarding child deviance on social media and some of the factors behind it. This study uses a legal and criminological study approach. The location of this research was specifically carried out in the city of Semarang, and several other cities as supporting material. Supporting data in this study were also obtained from various studies on the internet. This research was submitted through the DIPA Student Research grant scheme, Faculty of Law, Semarang State University in 2022. The outputs in this study consisted of mandatory and additional outputs. The mandatory output in this research is in the form of articles published in the National Journal, while additional outputs are in the form of book designs and/or Copyrights. This research was conducted by a team that has the capacity in their field, in addition, this research is the initiation of increasing publications carried out by the Student Journal Team of the Faculty of Law, Semarang State University.

Abstract

The causes of corruption include weak religious teachings, ethics, knowledge, education, and the imposition of sanctions and a weak government structure. Eradication of corruption can be done through education, because education has a very strategic position in an effort to build an anti-corruption attitude, especially to the younger generation. In this case, students have a role to not be permissive of corruption and together rise up against corruption. The research method in this paper uses qualitative research methods from individual and institutional journalistic sources, and the research uses empirical methods with a discussion technology-based approach, namely the Zoom Meeting application/web to find data from lighters and respondents. The purpose of this paper is to understand the causes of corruption and to find out why students should build the spirit of the anti-corruption movement in the campus environment. With the conclusion that someone commits acts of corruption because of factors both from within and from outside. so that students have a role in encouraging and inviting the public to act to create justice so that corruption does not occur.

Abstract

Anti-corruption education is very important given the increasing number of corruption cases every year. Moreover, the largest number of corruption is in the vortex of government institutions which incidentally are people who have a qualified educational background. Seeing this reality, academics have to start racking their brains to tackle corruption cases from the roots. Thus, this article was compiled using a literature review that refers to the latest articles and journals. This paper is also prepared based on a case study in one of the group assignments, so that it is expected to be able to provide a comprehensive explanation of the importance of Anti-Corruption Education.
