Abstract

Dispute resolution does not only have to go through court, it can also resolve by alternative dispute resolution. Alternative dispute resolution regulated in Indonesia through Act Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution that more diverse than alternative dispute resolution provided by the World Intellectual Property Organization (WIPO) through the WIPO Arbitration and Mediation Centre. Alternative dispute resolution in Indonesia can be in consultation, mediation, negotiation, conciliation, arbitration, and expert determination. The WIPO Arbitration and Mediation Centre at least provides four option for the alternative dispute resolution, namely mediation, arbitration, expedited arbitration, and expert determination. This research is to compare the alternative dispute resolution in marks dispute resolution jo. the act of alternative dispute resolution and alternative dispute resolution on WIPO Arbitration and Mediation Centre. Only expedited arbitration that is not explicitly regulated in Act Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, but there is provisions that resemble to expedited arbitration, i.e. a sole arbiter

Abstract

Corruption is an act to against the law and moral because it is considered as an act abusing the power and authority for personal’s benefit, group or other parties to take advantage each other either economically or politically. Due to perpetrators of corruption is a public official, the type of corruption is considered as political corruption. One of many cases of political corruption in regional level is corruption on social assistance fund. The reality of social assistance fund corruption case disclosure in many regionals seems difficult. The sociology aspect takes a part in law enforcement such as stratification, morphology and intervention variables. Stratification which is a formal position of somebody, friendship between law enforcers and the suspect, and intervention of superior to the subordinate in legal institution confirm the legal discrimination in corruption act of social assistance fund. Therefore, to suppress the rate of corrupt behavior in regional level, it needs the legal enforcement reconstruction started from legal enforcer side to the encouragement of legal enforcer reformation in regional level. The legal enforcer reformation should emphasize on the importance of rolling job system at the top management in the legal enforcement institution. This system can enrich experience and perception, and to sharpen the skills. On the other hand, it can minimize the occurrence of morphology aspect between the legal enforcer and local elites. Besides, the involvement of justice collaborator in corruption eradication should be implemented in order to reveal the political corruption case which is complicated and neatly covered.

Abstract

In the era of globalization like today, the ease and speed of getting things are highly sought after, including the ease and speed of getting financial services. Financial Technology (Fintech) is a digital financial service that offers and provides convenience and speed of financial services. The emergence of Fintech certainly provides convenience for people to get financial services. But we need to remember that in our constitution, Indonesia is a rule of law so that everything that is done in this country must be based on law. Including the Fintech business, must be regulated and monitored by existing laws in Indonesia. So it is necessary to know the regulation and supervision of Fintech's business in Indonesia, which will be further explained in this paper. The writing method used is normative juridical, using secondary data by analyzing primary, secondary and tertiary legal materials. Based on the research results it is known that Fintech's business in Indonesia is regulated and supervised by three institutions namely the Ministry of Communication and Information, Bank Indonesia, and the Financial Services Authority.

Abstract

Abstract Banking is categorized as one of the very risky industries. The collapse of the banking industry can cause an economic crisis in a country. To maintain the health of the industry, it is necessary for all parties involved to run banks based on principle known as prudential banking principle in their daily operation. There are several factors that can reduce the soundness of the bank. One of them is the condition of loan portfolio maintained by the bank which is reflected by Non Performing Loan or NPL ratio. The higher the NPL ratio, the worse the loan portfolio of the bank. This could affect to the bank liquidity, Rentability, solvability and finally the overall bank’s ability to survive. To maintain a low NPL ratio, banks must handle NPL in an effective and efficient manner. This paper tries to describe the way banks in Indonesia deal with NPL in practice and concludes that most banks apply the restructuring and litigation methods.

Abstract

UMKM merupakan pelaku ekonomi yang memiliki keunggulan komparatif dan kompetitif serta banyak memberikan kontribusi bagi perekonomian di Indonesia. Salah satu keunggulan tersebut adalah desain industri, yang mana desain industri sebagai salah satu jenis hak kekayaan intelektual yang banyak dimiliki oleh UMKM namun sampai saat ini dari sisi kuantitas relatif masih sedikit jumlahnya yang dilindungi oleh hukum. Dari 56.534.592 UMKM hanya 398 yang telah memperoleh perlindungan HKI. Padahal era persaingan saat ini pasca berlakunya MEA tidak hanya dalam negeri tetapi lintas batas negara yang rentan terjadi konflik/sengketa. Berdasarkan analisis yang penulis temukan ada 2 hal yang melatarbelakangi mengapa pelaku UMKM tidak melindunginya. Pertama, substansi UUDI masih terdapat beberapa kelemahan. Adanya kesenjangan antara aturan yuridis dan kebutuhan praktis di masyarakat. Aspek kebaruan menjadi salah satu faktor yang sulit bagi UMKM untuk memperoleh perlindungan. Padahal ketentuan di dalam TRIPs dan Konvensi Paris adalah baru (new) or orisinil (original). Copyright approach menjadi salah satu gagasan untuk memperoleh perlindungan hak atas desain industri di Indonesia. Kedua, kesadaran dan pemahaman atas pentingnya perlindungan desain industri yang mereka miliki. Sinergi antara pemerintah dengan UMKM menjadi salah satu alternatif gagasan yang layak dipertimbangkan ketika copyright approach melalui identifikasi dan pendataan melalui software berbasis IT.

Abstract

The law No. 1 of 1979 on extradition has been the legal basis for extradition in Indonesia. This law has some issues that should be corrected. Some of these issues consist of: (i) no arrangement regarding the deadline required to complete an extradition process, (ii) the extradition process in Indonesia has failed to reflect the government's desire to optimise Law enforcement activities. To note, optimal law enforcement activities will provide a state of political stability, prevent economic decline and or unstable circumstances, and the main objective is to maximize social welfare.

Abstract

One way to settle bad debts is the execution mortgage rights through a public auction. However, in practice, the execution of mortgage security does not always provide legal protection to the auction buyers of mortgage rights, one of them is that the auction winner cannot enjoy his rights to the auction object because of the lawsuit over the execution of mortgage rights, so that the execution of the mortgage security cannot be carried out. The purpose of this research is to find out the position of the collateral right that has been auctioned in the event that there is a lawsuit from a third party and legal protection that can be given to the auction winner for the loss of not being able to enjoy the object of the mortgage rights auction due to a lawsuit from a third party. The research method used in this study is a normative juridical approach, which uses secondary data in the form of related legislation. Based on the research conducted, the results are: First, the position of the guaranteed mortgage rights object in the auction execution in the event that there is a lawsuit from a third party, legally still the right of auction winner that have a good faith. Second, legal protection for the winner of a bid in good faith over losses cannot enjoy the object of the mortgage right because the lawsuit can be carried out by litigation and non-litigation. Litigation lawsuits are based on unlawful acts against auction sellers.

Abstract

The objectives of this research are to analyze (1) the definition and scope of bank secrecy; (2) the implementation bank secrecy as a form of legal protection to customers; (3) problematic disclosure of bank secrecy between state interests and protection to customers; (4) bank refusal rights to open bank secrecy. The method used is the normative legal research with the statute and conceptual approaches. The research result indicated (1) the definition of bank secrecy is everything related to information about depositors and their deposits. The scope of bank secrecy relates to information about the depositors and their deposits; (2) the implementation bank secrecy as a form of legal protection to customers consists of preventive and repressive legal protection; and (4) bank refusal rights to open bank secrecy indicates that the bank has the right to refuse to open bank secrets based on the contractual relationship between the bank and its customers. According to Article 1338 of the Civil Code the agreement is binding on the parties who make it, but it is not binding on third parties in this case including the state as a third party.

Abstract

One effort to apply the principle of environmentally sustainable development in buildings is to apply the concept of green buildings. One of the building materials that are widely used in the administration of buildings is wood. PUPR Ministerial Regulation No. 02 / PRT / M / 2015 concerning Green Building and LH Ministerial Regulation No. 08 of 2010 concerning Criteria and Certification of Green Buildings require the implementation of buildings to implement environmentally friendly wood materials. However, in reality, there are still buildings that are held and existing buildings that do not meet the green building requirements that have been determined by legislation, especially in the use of environmentally friendly wood materials. The method used in this study is normative juridical. Secondary data collection techniques. As well as the research specifications used are analytical descriptive. It was concluded that the utilization of environmentally friendly wood materials in buildings based on Ministerial Regulation PUPR No. 02 / PRT / M / 2015 concerning Green Building Building jo. Ministerial Regulation LH No. 08 of 2010 concerning Criteria and Certification of Green Buildings is considered ambiguous and cannot accommodate the legal needs of the use of environmentally friendly wood materials. Implementation of the use of friendly wood materials the environtment in office buildings in the city of Bandung has not fully implemented optimally.

Abstract

Halal food products are one part of Islamic Sharia, especially for Muslim consumers. The circulation of food products in Indonesia, one of which comes from the Micro Small Enterprises (MSEs), which also has an important role in improving the economy. Increasing the ownership of halal certificates for MSEs halal food products can be done through the Corporate Social Responsibility (CSR) program provided by the stakeholders. The research method used in this research is normative juridical by emphasizing on literature study and supported by field data. The results of this study indicate that one of the empowerment for the development of MSEs can be through an increase in halal-certified food products given the halal product consumer market in Indonesia is very large. Improvement of halal-certified food products at MSEs can be through CSR programs specifically aimed at empowering and developing MSEs. In addition, through CSR programs, companies and other stakeholders can become MSEs partners in marketing halal-certified food products.
