Abstract

Indonesia is currently one of the largest coffee exporters country in the world. Coffee from Indonesia often scores highest in various international coffee auctions. Along with the development of the Indonesian coffee industry, it is expected to improve the lives of farmers as well. But in the end there were still many coffee farmers whose lives were less prosperous. There are problems experienced by farmers and countries that help provide protection. On this basis the Republic Indonesia Government made Law Number 19 of 2013 concerning Protection and Empowerment of Farmers who are expected to overcome various problems experienced by farmers. This study aims to find and discuss fair trade conditions in laws in Jawa Barat (Indonesia), especially for coffee farmers so that they can improve the welfare of farmers. The study also found findings and discussions about laws related to improving the welfare of coffee farmers in Indonesia. This research is expected to provide practical and practical uses, namely those that can be used in the development of agricultural law and provide criticism and suggestions for making laws on agriculture that specifically achieve the independence and welfare of coffee farmers. This research is also expected to inform a public about fair trade, both the owners of coffee outlets, coffee roaster and coffee farmers as the main producers.

Abstract

Pembangunan ekonomi sangat mempengaruhi tingkat kemakmuran suatu negara. Namun pembangunan ekonomi yang sepenuhnya diserahkan pada mekanisme pasar, tidak akan secara otomatis membawa kesejahteraan kepada seluruh lapisan masyarakat, sehingga akan menimbulkan kesenjangan diantara masyarakat yang satu dengan lainnya.Untuk mengurangi kesenjangan tersebut maka Negara-negara maju termasuk Indonesia menerapkan sistem Negara Kesejahteraan (Welfare State) yaitu suatu sistem yang memberi peran lebih besar kepada Negara atau pemerintah dalam hal mengatur pembangunan ekonomi yang terencana, melembaga, dan berkesinambungan. Dengan memperhatikan letak geografis Indonesia sebagai Negara Bahari dan kepulauan terbesar di dunia, lembaga hipotik sangat menunjang perekonomian di bidang ekonomi kelautan, khususnya di bidang transportasi dan pengangkutan laut. Untuk memenuhi kebutuhan akan transportasi atau pengangkutan laut nasional maka peranan perbankan atau lembaga keuangan sangatlah diperlukan. Lembaga keuangan maupun bank masih kurang tertarik menyalurkan kreditnya kepada perorangan maupun badan usaha yang menjaminkan kapal laut sebagai objek jaminan, dikarenakan aturan mengenai Hipotik kapal laut masih tersebar secara partial di berbagai peraturan dan sampai dengan saat ini belum ada peraturan perundang-undangan yang khusus mengatur tentang hipotik kapal laut sehingga menyebabkan rendahnya pembiayaan kapal laut dari lembaga keuangan atau bank. Kata Kunci : Hipotik; Negara Kesejahteraan; Kapal laut.

Abstract

Abstrak Pada dasarnya peraturan perundang-undangan di Indonesia bersifat hierarkis, oleh sebab itu ketentuan dalam Peraturan Walikota Bandung No.543 Tahun 2018, khususnya yang mengatur tentang pengesahan Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun (P3SRS) tidak boleh bertentangan dengan peraturan yang ada di atasnya. Penelitian ini bertujuan untuk mengetahui konsistensi antara Peraturan Walikota Bandung No.543 Tahun 2018 dengan peraturan di atasnya dan juga mengetahui bagaimana keberlakuannya bila terjadi inkonsistensi, serta mengetahui tindakan hukum bila terjadi inkonsistensi. Hasil penelitian ini menunjukan bahwa ketentuan mengenai pengesahan P3SRS dalam Peraturan Walikota Bandung No.543 tidak konsisten dengan peraturan perundang-undangan yang ada di atasnya, sehingga ketentuan tersebut tidak dapat diberlakukan berdasarkan asas lex superior derogate legi inferiori, dan oleh karena itu tindakan yang dapat dilakukan sebagai upaya penyelesaiannya guna mencapai kepastian hukum adalah dengan melakukan judicial review atau executive review. Abstract

Access to justice is a mechanism for every person, whose rights are violated, including consumers who are in dispute, to find effective solutions provided by the justice system. The mechanism shouldt be accessible, affordable and easy to understand. This mechanism must be able to provide justice fairly, speedy and without discrimination, and must also provide an alternative dispute resolution. In the case of consumer alternative dispute resolution outside the court, it should provide a great benefit to the community, because the avaibility of the choice to access justice in a way that can be adapted to their needs and abilities. But what is the meaning of the alternative or choice if in the end it cannot be implemented or cannot be executed to what has become decision or agreement of the alternative institution. This is related to the contradiction of the strength of BPSK decisions, in order there are still legal remedies against the BPSK decision, and the execution of the BPSK verdict still relies on the existence of 'fiat' executions from the court. Therefore to ensure access to justice for the consumers, harmonization between courts and consumer alternative disputes resolution system is unavoidable.

Abstract

Abstrak Dewasa ini pelaku usaha berlomba-lomba membangun sebuah brand. Alasannya adalah semakin positif citra sebuah brand di masyarakat maka brand tersebut akan mempengaruhi tingkat pembelian masyarakat terhadap brand tersebut. Brand menjadi salah satu faktor pertimbangan masyarakat untuk membeli suatu produk barang atau jasa. Umumnya masyarakat cenderung membeli produk yang masuk ke dalam tingkatan teratas dalam suatu survey brand. Membangun sebuah brand bukanlah usaha yang mudah, diperlukan usaha maupun modal yang tidak sedikit demi membangun citra yang kuat dalam masyarakat. Akan menjadi sangat tidak adil bila brand yang telah dibangun dengan susah payah ditiru oleh pelaku usaha yang tidak bertanggung jawab. Pelaku usaha membutuhkan sebuah perlindungan hukum atas brand yang telah dibangunnya agar terhindar dari perbuatan curang yang mengarah ke persaingan usaha curang. Pranata hukum merek dibuat untuk memberikan perlindungan atas suatu brand yang ditempelkan pada suatu barang atau jasa yang diperdagangkan. Pranata tersebut memberikan hak eksklusif bagi pemegang merek dalam menggunakan brand tersebut. Kata Kunci : Brand, Hukum, Merek, Perlindungan, dan Usaha.

Abstract

Advertising is a medium of communication directly with producers (business actors) to the audience / prospective consumers and consumers, of course here is expected by producers, one of which introduces products (both goods and services) to consumers and hopes consumers, through persuasion, are willing to consume them. Through advertisements, business actors refer to something related to their products to consumers. Because business people take various ways that are considered to be able to convey their messages effectively and efficiently. Business actors also choose media that are considered more appropriate for that. Reflecting on the educational background, social status, culture, ethnicity, religion, and others from the target consumers also influences the strategies of business people to advertise their products. Considering the loss caused by the broadcasting of advertisements has a massive impact and is felt by many consumers, which of course is not small, and has the same importance due to the losses suffered, consumers are more right to restore their rights to file a group representation as adopted in the Indonesian legal system Perma Nomor 1 Tahun 2002 Tentang Acara Gugatan Perwakilan Kelompok Keywords : Advertising; Businessmen; And Consumer.

Abstract

The Indonesian Constitution states that Indonesia is a state of law, but what happens today is that the law is not respected. The law will be closely linked with justice, authority, revelation, which in turn creates peace, and rules in the sense of rules that contain the norm. The law has a function to provide protection to human interests (all human beings without exception). Therefore, the law must be implemented so that human interest can be protected. In practice, the law can run normally and peacefully, but there can also be legal violations in practice. In the case of law enforcement that we have done so many people say that law enforcers in Indonesia are still weak and do not understand the law, and law enforcement in Indonesia is still relatively weak. And there are those who say our law enforcement, many fail. In this case law enforcement is a central issue in the rule of law, where law enforcement is a reflection of a country. A good legal state will bring about good law enforcement, so that people feel comfortable within a country of law. This paper explains how law enforcement, carried out in accordance with the rules, and is responsive, thus realizing Indonesia as a state law.

Abstract

The internet is a new world where humans interact, without limitation of distance and time. In the real world, as legal subjects, everyone must have a clear identity, proof of identification, so that the state can recognize it and the law can be upheld against it, as well as the law can protect their rights. Social media which is currently developing, allows everyone to appear and interact in cyberspace either by showing their true identity, or by using fake identities, or even interacting without identity (annonymous). Easily each person can create more than one e-mail account, which can be used to create more than one social media account. Although the creation of e-mail and social media accounts is through the cell phone number verification stage, this does not solve the problem because anyone can easily have multiple cellphone numbers. A person in cyber world can be an anonymous subject and take various actions that harm others, including stalking others. Stalking, done by the person behind an anonymous account is an annoying action, has not been regulated clearly in Indonesian. This paper is the result of a normative juridical study. Result of this research is: criminal law regulation system in Indonesia regulated cyberstalking as long as the action consist of delivery of illegal contents such as threats, obscene content and insults. Further regulation is still needed, especially regarding law enforcement mechanisms for perpetrators that are difficult to reach due to the use of the anonymous account.

Abstract

"The United Nations Committee on the Peaceful Uses of Outer Space" (UNCOPUOS) is a general international organization under the United Nations (UN) system. This committee is the main focal point committee under the United Nations General Assembly (MU) to deal internationally with space issues and issues. UNCOPUOS effectively carried out its duties and mandates in 1961 and has produced several international space law products. The formation of international space law by UNCOPUOS is based on the authority given to it as an international organization. The methodology used in this paper is descriptive juridical-analysis. The type of data used in this study is secondary data (in legal research is called primary legal material), so this study is intended to see the validity of the authority seen from the law of international organizations and the products produced as an international space law. Based on the results of the study, both in terms of the law of international organizations and the content of the results of its legal formation, UNCOPUOS has the authority and the results are legally valid.

Abstract

This article aims to analysis state of emergency rules in Indonesia. it contains practical power during state of emergency. A state of emergency is a situation that threaten the life and nation and caused political instability. A state of emergency regulated within article 12 constitution of the republic of Indonesia gives extraordinary power to the President to act against the emergency situation. Besides constitution, state of emergency also regulated by several acts (Perppu 23/1959 UU 24/2007 and UU 7/2012) and each act has different concept of state of emergency. Based on Perppu 23/1959, there are five kinds of situation called state of emergency (rebellion, riot, civil war, disaster and war). Furthermore, UU 24/2007 and UU 7/2012 regulate disaster, riot and civil war separetely and give special authority to the local government (Governor, Bupati and Mayor) proclaiming state of emergency. Besides special authority, these acts ( UU 24/2007 and (UU 7/2012) regulate different concept of how long state of emergency applicable. The result, these different concepts affect several acts such as UU 31/1999 that regulates the death pinalty for those person who doing corruption during state of emergency and local government has no right to proclaim state of emergency based on UU 23/2014 that separates authority between central and local government. State of emergency related to security and defence issues and according to UU 23/2014 security and defence issues are the part of central government authority.
