Abstract

Penelitian ini menunjukan bahwa CSR mewakili kompromi antara etika dan perilaku-perilaku tertentu. CSR muncul untuk meningkatkan image perusahaan di dalam masyarakat di mana perusahaan itu menjalankan kegiatan usahanya. Ide untuk menjadikan kepedualian sosial perusahaan sebagai unsur pemasaran. Abstract

Abstract: This study explores the needs of female inmates, a vulnerable group within correctional facilities, highlighting the urgency of addressing their specific requirements. Female inmates often face unique challenges, including mental health issues, lack of access to healthcare, and insufficient rehabilitation programs. Utilizing a qualitative research approach, data were collected through interviews and focus group discussions with female inmates and correctional staff. The findings reveal significant gaps in the provision of healthcare services, educational opportunities, and psychological support for female inmates. The study concludes that targeted policies and programs are essential to meet the needs of female inmates, ensuring their rights and facilitating successful reintegration into society.

Abstract

Prisoners in correctional institutions (prisons) are a vulnerable group facing various challenges related to mental and physical health. This study aims to analyze the mental and physical health conditions of vulnerable groups in prisons and their management strategies. The research method used is a literature study by collecting data from various sources such as scientific journals, research reports, and related articles. The results show that prisoners have a higher prevalence of mental disorders and physical illnesses compared to the general population. Contributing factors include overcrowding, exposure to stress, and limited access to health services. Recommended management strategies include increasing the availability and quality of mental and physical health services in prisons, training prison staff on health issues, and coordinating with community health services to ensure continuity of care. Commitment and collaboration from various parties are needed to ensure the fulfillment of prisoners' right to health and promote healthy social reintegration.Keywords: Mental health; physical health; vulnerable groups; correctional institutions; management strategies.

Abstract

Abstract: In today's digital era, the protection of personal data has become a crucial issue for companies operating in the technology and e-commerce sectors. The increasing reliance on information technology correlates with a higher risk of data breaches, which can harm individuals and damage corporate reputations. The data breach cases involving Tokopedia and Gojek highlight the serious consequences of inadequate data security systems, raising public doubts about these companies' ability to protect user information. These incidents underscore the importance of corporate criminal liability and the need for a thorough evaluation of existing regulations to ensure more effective consumer protection. This research employs a normative legal approach to analyze legal principles and the synchronization of laws, providing practical implications for the development of a more sustainable and equitable national legal framework. It is hoped that the findings will aid in formulating solutions to address future data breach challenges and strengthen the legal framework for consumer protection in Indonesia.

Abstract

This study examines the legal protection of inmates with mental health issues in correctional facilities. The urgency of this research arises from the increasing recognition of mental health as a critical aspect of human rights within the penal system. Utilizing a normative legal research method, the study analyzes existing laws and regulations, as well as their implementation in prisons. The findings indicate significant gaps in legal protections and inadequate mental health services for inmates, highlighting the need for comprehensive reforms. The study concludes that enhancing legal frameworks and mental health support systems is essential to safeguard the rights of vulnerable inmates and promote rehabilitation.Keywords: legal protection; mental health; inmates; correctional facilities; human rights.

Abstract

Abstract: Of the total 536 collective agreements related to layoffs in 2019, only 147 agreements, which is equivalent to around 27 percent, provided layoff compensation in accordance with labor regulations. On the other hand, 384 agreements, or around 73 percent, did not meet the provisions of the applicable law in terms of layoff compensation payments. This research aims to identify corporate responsibility in terms of severance pay due to layoffs., This research carried out using a normative and descriptive approach, using secondary data for qualitative analysis. Deductive logic methods are applied to reach conclusions. with the problem formulation, what is the responsibility for corporate crime in the payment of severance pay due to termination of employment? Research results show that Termination of Employment (PHK) is a termination of the employment relationship between a company and employees which can occur for various reasons, including the employer's initiative, the wishes of workers, legal regulations, or decisions of the Industrial Relations Court (PHI). Layoffs require employers to provide compensation in the form of severance pay, gratuity pay, and compensation for rights in accordance with the provisions. Types of layoffs include changes in company status, efficiency, liquidation, force majeure, bankruptcy, violation of provisions, retirement, and death or permanent disability. Corporations that do not fulfill their severance pay obligations can be subject to criminal sanctions according to various theories of corporate responsibility including strict liability, vicarious liability, direct corporate criminal liability, aggregation theory, and corporate culture model.Keywords: Corporations, Employment, Crime

Abstract

Correctional Institutions (Lapas) in Indonesia are still in the public spotlight due to various problems, one of which is related to legal protection for vulnerable inmates. Vulnerable groups in Lapas consist of female inmates, children, the elderly, persons with disabilities, inmates with life sentences and convicts with the death penalty. This study aims to determine the legal arrangements in Indonesia in ensuring the protection of the rights of vulnerable inmate groups, especially in the child category. The research method used is normative research by examining the relevant laws and regulations. The results showed that there are several regulations that form the legal basis for protecting the rights of child inmates, such as Law Number 3 of 1997, Law Number 11 of 2012, and Law Number 22 of 2022. However, these regulations have not been fully able to guarantee legal certainty for the protection of child inmates. Abstract

The urgency of this research arises from the alarming rates of violence reported in prisons, which undermine rehabilitation efforts and violate human rights. Utilizing a qualitative approach, data were collected through interviews with inmates, correctional officers, and legal experts. The findings reveal significant gaps in existing legal frameworks and enforcement mechanisms, suggesting that current protections are inadequate. The study concludes that comprehensive reforms are necessary to enhance legal protections for inmates, ensuring their safety and dignity while promoting a more humane correctional system.Keywords: legal protection; inmates; violence; correctional facilities; human rights.

Abstract

Abstract: Corporate accountability in business competition crimes in Indonesia is one of the important aspects in the effort to create a healthy and fair business competition climate. corporations or business entities can act as legal subjects that engage in anti-competitive actions detrimental to public interests, such as cartel monopoly practices or abuse of dominant positions. In the context of law in Indonesia, this business competition crime is regulated by various regulations, especially in. (Law No. 5 of 1999) This research method is used as a way to examine and analyze research problems, with the type of legal research used being normative legal research. descriptive in nature by adopting a regulatory approach (statute approach). In the Supreme Court Regulation Number 13 of 2016, Article 4, paragraph (1) states that corporations can be held accountable in accordance with corporate criminal provisions in the law governing corporations. If a corporation is proven to have committed an offense, both administrative and criminal sanctions can be imposed, with the aim of preventing anti-competitive behavior and protecting consumers and other business actors.Keywords: corporate accountability in criminal offenses.

Abstract

Vulnerable prisoners, including the elderly, persons with disabilities, pregnant and breastfeeding women, and children, require special attention in healthcare services within correctional facilities (Lapas). This group often faces higher health risks compared to other prisoners, making it essential for the correctional system to ensure that they have adequate access to healthcare services. This study aims to analyze the extent of healthcare services provided to vulnerable prisoners and to identify the obstacles faced in its implementation. The method used in this research is a literature review, where the author examines various relevant literature and regulations to obtain a comprehensive picture of the healthcare conditions in Lapas. The results indicate that healthcare services for vulnerable prisoners are not yet optimal. Several challenges include limited medical facilities and infrastructure, a lack of professional healthcare personnel, and insufficient budgets allocated for healthcare services in Lapas. Additionally, not all prisoners receive health financing guarantees, which are often only available to those classified as poor. This creates a gap in fulfilling the right to health for prisoners, which should be guaranteed by law. Therefore, concrete steps are needed to improve the quality of healthcare services, including the provision of adequate facilities and an increase in the number of medical personnel. To address these issues, systematic efforts to enhance healthcare services in Lapas are necessary. This includes a larger budget allocation, the provision of adequate healthcare facilities, and an increase in the number of trained healthcare personnel. Furthermore, it is important to implement a special housing separation system for vulnerable prisoners to ensure their safety and comfort. With these measures, it is hoped that the rights of vulnerable prisoners can be adequately fulfilled, allowing them to receive healthcare services that are fair and equivalent to those in the general community. This effort will not only improve the quality of life for prisoners but also support their rehabilitation and reintegration goals into society after serving their sentences.KeywordsHealthcare services; vulnerable prisoners; correctional facilities.
