El-Faqih, Jurnal Pemikiran dan Hukum Islam, ISSN, 2503-314X ( Online) and 2443-3950 (Print) is a peer-reviewed journal published by the Faculty of Sharia, IAI Faqih Asyari Kediri. This scholarly periodical specializes in the study of Islamic law and seeks to present the various results of the latest research, both conceptual-doctrinal and empirical, in the field. The editors welcome contributions in the form of articles to be published after undergoing a manuscript selection mechanism, peer-review, and editing process. The journal is published twice a year in April and October. It is now a fully online journal, and it only accepts manuscript submissions written in Indonesia, English, and Arabic.

Abstract

This study discusses polygamy in the perspective of Hamka. Polygamy is a man who has a wife more than one up to four people. In Islamic view, polygamy can be done if it meets the requirements that are clearly mentioned in the Qur'an, that is, being able to be fair. The fair referred includes several parts, namely: fair in the shared time, fair in living, fair in the place of residence and fair in the cost of the child. Rasulullah's polygamy is different from the polygamy phenomena that we face today. The practice of the Prophet's polygamy is not based on biological needs, but there are several considerations including wanting to honor the widow, raising the degree of widows and women who offer herself to be married. In the present, polygamy is based solely on biological needs, and lose the element of justice in it.

Abstract

The current radicalism and extremism became the background for the initiation of the theory of religious moderation. In the Indonesian context, religious moderation is highly emphasized and has even become a program apart from the Ministry of Religion of the Republic of Indonesia. Along with these developments, the author is interested in studying religious moderation in interpreting the Koran using thematic methods. The results of the research concluded that the Koran aims to do good to each other among fellow believers and act fairly towards them, build friendships, respect other people's religions, not incite other religions, and carry out the teachings of their respective religions and religions and not disturb them. These things can be used as principles that must be applied in building religious moderation in Indonesia.

Abstract

The term 'religious freedom' is controversial among religious communities, particularly among Muslims. Both supporters and opponents within the Muslim community present arguments based on scriptural (Qur'an and Hadith) and rational reasoning. Those supporting religious freedom often cite verses like "There is no compulsion in religion," while opponents refer to war-related verses. It is generally agreed among Muslims that Qur'anic verses do not contradict each other. Based on this fact, the author is interested in examining Abdullah al-Harari's views on the verses related to the absence of compulsion in religion. Al-Harari, being a contemporary scholar staunch in adhering to the creed of Ahlussunnah Wal Jama'ah, has a strong focus on creed studies. Using the library research method, the researcher addresses two main problem formulations: (1) How does al-Harari understand the verses indicating the absence of compulsion in religion? (2) How does al-Harari reconcile these verses with the war-related verses? To answer these questions, the researcher examines al-Harari's interpretations in his works and those of his students, comparing them with the interpretations of other scholars in their exegesis works. This study concludes that al-Harari, following the interpretations of previous scholars, asserts that the belief in religious freedom is incorrect. The verses indicating the absence of compulsion in religion are understood as abrogated or that there is no compulsion against dhimmi (non-Muslim subjects) or against the hearts of unbelievers to enter Islam.

Abstract

Zakat is a maliyah worship that must be carried out by a rich Muslim who fulfils the conditions and is given to those who are entitled to receive zakat, especially for the poor and needy. Law No 23 of 2011 on zakat management authorises BAZNAS, Provincial, Regency or City BAZNAS to establish UPZ (Zakat Collection Unit) in government agencies, state-owned enterprises, private companies, regionally-owned enterprises, and can also establish UPZ at the sub-district, village or kelurahan level. One of the UPZ that has been formed and running is UPZ under BAZNAS Kota Kediri. The researcher used field research (fieldresearch) in this study. it is a qualitative approach. The analysis used is descriptive. Descriptive data presupposes that the data is in the form of text. Descriptive qualitative research is a study that describes the situation in the form of transip in interviews, written documentation. The result of this study are: BAZNAS Kediri City in conducting fundraising using several strategies, namely: a. Direct Fundraising, it is a method that uses a way or technique that directly involves the participation of muzakki. b. Indirect Fundraising, it is a method that does not directly involve the participation of muzakki, such as promotions that lead to the formation of an image or image of zakat institutions, without direct direction to donate Keyword: Strategy, Fundraising, Community

Abstract

The research aims to analyze the causes of operational risks in Islamic banking, as well as ways to overcome them. Using qualitative research and Maslow's motivation theory, this study concluded that human resources in Islamic banking come from various educational backgrounds. On the other hand, Islamic banking must also be able to manage its human resources so that it does not cause operational risks. So that these operational risks do not arise, it is necessary to reconstruct human resources by increasing the motivation of human resources.

Abstract

The aim of this research is to find out the marketing strategy for fund raising products at the Kediri branch of KSPPS BMT PETA and to find out the obstacles that KSPPS BMT PETA Kediri branch often experiences in marketing fund raising products. The type of research used is field research using a qualitative descriptive approach, collecting data through observation, interviews and documentation. The results of this research are that the marketing strategy for fund raising products at KSPPS BMT PETA Kediri branch has three strategies, namely: product strategy including determining the brand and creating a motto for each savings or savings product, location strategy includes choosing an office location that feels like it is in the right place. strategic, for its promotional strategy it uses two types of promotional tools, namely advertising and publicity. However, in marketing fund-raising products there are several obstacles that are often experienced by the Kediri branch of KSPPS BMT PETA, namely: competition between BMTs in adjacent locations, lack of supplies at the Kediri branch of the KSPPS BMT PETA office, lack of human resources at the Kediri branch of the KSPPS BMT PETA office.
