Abstract

Kondisi wilayah Provinsi Kepulauan Riau didominasi oleh perairan laut karena sekitar 408.205 kilometer persegi atau sekitar 96% dari luas wilayah Provinsi Kepulauan Riau merupakan bentangan lautan. Penelitian ini membahas tentang pembentukan Badan Usaha Pelabuhan, kendala-kendala yang dihadapi dalam pembentukan Badan Usaha Pelabuhan dan penyelesaian permasalahan terhadap kendala tersebut. Penelitian ini menggunakan metode penelitian hukum sosiologis dengan menganalisis data primer dan data sekunder. Penelitian ini memaparkan bahwa Provinsi Kepulauan Riau telah mempunya Badan Usaha Pelabuhan dengan nama PT. Pelabuhan Kepri. Namun memiliki kendala terkait pembangunan pelabuhan dan lokasi. Penyelesaian terhadap masalah tersebut adalah meminta agar pemerintah pusat menghibahkan asestnya kepada pemerintah daerah (Provinsi Kepulauan Riau). Pemerintah daerah seharusnya membangun pelabuhan tersebut secara bertahap.

Abstract

The Porth Health Office Class I of Batam , a technical unit of the Ministry of  Health is  responsible to the Director General of Disease Control and Environmental Sanitation in carrying out their duties, has an obligation to implement the Government Regulation Number 21 of 2013 concerning The Type and Rate of The Non Tax Revenue that is  applied in  the Ministry of Health. In the application of the Government Regulation, which became effective since June 2013, there was resistance from the international ferry companies in Batam, as the object of the Regulation. This resulted in the failure to pay obligations of non tax revenue by the object state revenues, so that the financial records of the Porth Health Office Class I Batam are categorized as non tax revenue. In this research, the researcher conducted a sosiological research to analyze the effectiveness of the implementation of a rule of law, in particular linking it  to the effectiveness of the theory of law and progressive legal theory. The Researcher found and concluded that the application of the Government Regulation is not effective. It is suggested to revise the Regulation by involving the participation of ferry service users and Porth Health Office Class I Batam as a regulator. === Kantor Kesehatan Pelabuhan Kelas I Batam (KKP Kelas I Batam) sebagai  unit pelaksana teknis di lingkungan Kementerian Kesehatan yang berada di bawah dan bertanggung jawab kepada Direktur Jenderal Pengendalian Penyakit dan Penyehatan Lingkungan, dalam pelaksanaan tugasnya, juga mempunyai kewajiban untuk melaksanakan peraturan pemerintah 21 Tahun 2013 Tentang Jenis Dan Tarif Penerimaan Negara Bukan Pajak Yang berlaku Pada Kementerian Kesehatan. Akan tetapi, dalam penerapan Peraturan Pemerintah Nomor 21 tahun 2013, yang efektif diberlakukan sejak Juni 2013, beberapa penolakan terjadi dari pengguna jasa. Penolakan khususnya terjadi dari   operator ferry  Internasional di Batam, sebagai objek dari Peraturan Pemerintah ini. Hal ini mengakibatkan terjadinya gagal bayar kewajiban PNBP oleh objek PNBP, sehingga dalam catatan pembukuan keuangan KKP Kelas I Batam, terdapat Piutang PNBP. Dalam tulisan ini, peneliti melakukan penelitian hukum sosiologis terhadap efektifitas penerapan sebuah aturan perundang-undangan, khususnya dihubungkan dengan teori Efektifitas Hukum dan Teori Hukum Progressif. Peneliti menemukan dan menyimpulkan bahwa penerapan Peraturan Pemerintah No. 21 tahun 2013 di pelabuhan ferry internasional tidak efektif. Peneliti merekomendasikan dilakukannya revisi atas Peraturan Pemerintah  ini dengan melibatkan peran serta penguna jasa dan KKP sebagai regulator.

Abstract

The main purpose of this research is to understand the role of Syahbandar in the execution of shipping activities in sea freight in territorial waters according to "Act Number 17 of 2008" about shipping in Indonesia. The formulation of the problem consists of: (1) What is the minimum operating standard that must be owned by a ship that is anchored ? ; (2) Who has the highest authority in maintaining the safety and security of anchored ship ? ; (3) Has "Act Number 17 of 2008" been implemented correctly ? The method used in the research is juridical-sociological approach in the form of field survey and direct interviews with Stakeholder. The type of data used in the research is descriptive analysis method to solve the problem at hand.

Abstract

The purpose of this research was to determine the authority of Batam City government in policing street vendors which stand on the land rights of exploitation of Batam Concession Entity. It is also to determine what factors impede the Batam City Government in policing street vendors which stand on the land rights of exploitation of Batam Concession Entity. The results of this research concludes that the Batam City Government has a mandatory authority in policing street vendors which stand on the land rights of the land management exploitation Batam. The factors impede the Batam City Government in policing street vendors arise from the duality of authority on the tenure rights to land. The solutions suggested is that the Batam Government City should take action to streamline the implementation eventually make an act of synergy between the parties government took office with government officials.   Tujuan penelitian ini adalah untuk mengetahui kewenangan Pemko Batam dalam penertiban pedagang kaki lima yang berdiri di atas lahan hak pengelolaan BP Batam, untuk mengetahui Faktor-faktor apa yang menjadi Hambatan Bagi Pemko Batam dalam penertiban pedagang kaki lima  yang berdiri di atas lahan hak pengelolaan Lahan  Badan Pengusahaan Batam Batam dan untuk mengetahui solusi apa yang dapat dilakukan Pemerintah Kota Batam dalam Penertiban Pedagang Kaki Lima yang Berdiri di Atas Lahan Hak Pengelolaan Lahan  Badan Pengusahaan Batam. Hasil dari penelitian ini adalah Kewenangan Pemko Batam dalam Penertiban Pedagang Kaki Lima di Atas Lahan Hak Pengelolaan Badan Pengusahaan Batam menjadi kewenangan wajib yang harus dilakukan.

Abstract

The purpose of this research is to know the law against people in groceries Settings in Batam city is in compliance with the Customs Act, to find out the legal settlement Implementation taking action against smuggling People in Batam city. According to the law ? customs laws, to find out what factors are barriers/constraints to reduce smuggling groceries in Batam city. Data collection is carried out by the procedure and field studies libraries study authors take respondents research has to do with the issues that are discussed. As for the respondents in this study is the Head Office of the Customs and Excise unit area of Batam. The results of research that the Central Government in this case from customs and Excise in Batam city in dealing with the function of supervision. But a variety of conditions, from the geographical condition to the high consumptive society against imported goods so difficult to cooperate plus Batam port area is an area free of FTZ to vices-depravity internal irresponsible persons in the port so the practice of bribe make surveillance capacity has become weak.

Abstract

Penelitian ini membahas tentang Covernote Notaris/PPAT terkait pemasangan Hak Tanggungan Agunan Bank. Penggunaan Covernote Notaris/PPAT khususnya di industri Perbankan merupakan best practice dan berlangsung sejak lama serta sudah menjadi bagian dari Hukum Kebiasaan. Penelitian ini bertujuan untuk mengetahui manfaat dari Covernote Notaris/PPAT, untuk menganalisis mengapa Covernote Notaris/PPAT tidak diatur dalam perundangan serta solusi hukum yang dapat digunakan untuk mengisi kekosongan hukum atas penggunaan Covernote Notaris/PPAT. Penelitian ini menggunakan metode penelitian yuridis normatif. Penelitian hukum ini bertujuan untuk menelaah peraturan perundangan dan regulasi yang bersangkutan dengan isu hukum yang diteliti. Hasil penelitian menunjukkan bahwa ternyata Covernote Notaris/PPAT merupakan bentuk hukum kebiasaan dan tidak diatur dalam perundangan serta bukan merupakan produk hukum Notaris/PPAT sehingga terjadi kekosongan hukum. Akibatnya Covernote Notaris/PPAT tidak mempunyai kepastian hukum sehingga sangat rentan dalam hal penegakan hukum. Penelitian ini menyarankan solusi jangka pendek dan juga solusi jangka panjang sebelum ada kejelasan perundangan yang mengatur secara tegas tentang Covernote Notaris/PPAT ini.

Abstract

Residential Building is a part of the basic need for humans to carry out their activities. The developments in each region are rapidly growing. The problems that arise from construction activities are when they are not in accordance with their functions and spatial plans. Accordingly, the Tanjungpinang city government issued a regulation of the Tanjungpinang City Regional Regulation Number 7 of 2010 concerning Building. The objectives of the study is to evaluate whether the buildings in Tanjungpinang City have met the requirements and they are in accordance with the functions and spatial planning. It also analizes the legal certainty in the implementation of the building permit in this city.

Abstract

The basic concept of Consumer Protection Law is to ensure legal certainty for the protection of consumer rights, as anticipation that business players are not arbitrarily violating the consumer rights. This study examines whether consumers, particularly consumers of electricity service users in Batam city have their rights protected in accordance with what has been stipulated in Law No. 8 of 1999 on Consumer Protection Law. This study aims to determine aspects of the violation of the rights of electricity service consumers in Batam which have been violated by PT PLN Batam as the only supplier of electric power for public consumption in Batam. Blackouts that often occur in Batam certainly have caused discomfort among of the community. Thus, this study further analyzes the consideration of a power outage conducted by PT PLN Batam and whether such measures can be justified legally. With this study, it is expected that the public, especially consumers of electricity service users in Batam, know how to fight for their rights that have been stipulated as consumers in accordance with Law No. 8 of 1999 on Consumer Protection. === Konsep dasar dari Hukum Perlindungan Konsumen adalah menjamin adanya kepastian hukum untuk memberi perlindungan terhadap hak-hak konsumen, memberi harapan agar pelaku usaha tidak sewenang-wenang melanggar hak-hak kosumen. Penelitian ini ingin lebih lanjut mengetahui apakah konsumen, terutama konsumen pemakai jasa listrik di Kota Batam telah terlindungi hak-haknya sesuai dengan yang telah diatur dalam UU No 8 Tahun 1999 tentang perlindungan konsumen. Penelitian ini bertujuan mengetahui aspek-aspek pelanggaran atas hak-hak konsumen pemakai jasa listrik di Kota Batam yang telah dilanggar oleh PT PLN Batam selaku pihak pemasok tenaga listrik untuk kepentingan umum di Kota Batam. Pemadaman yang kerap kali terjadi di Kota Batam tentunya telah menimbulkan keresahan di tengah-tengah masyarakat. Oleh  itu, Penelitian ini juga akan menganalisis pertimbangan dari pemadaman listrik yang dilakukan oleh pihak PT PLN Batam dan apakah tindakan tersebut dapat dibenarkan secara hukum. Dengan Penelitian ini, diharapkan masyarakat, terutama konsumen pemakai jasa listrik di Kota Batam mengetahui haknya sebagai konsumen sesuai dengan UU Nomor 8 Tahun 1999 tentang perlindungan konsumen.

Abstract

Development in Batam is developing very rapidly because Batam is a city located in Riau Islands Province. In reality, there are many regulation that related to the problem of development, so that there is less legal certainty in Building Permit or often short with IMB, There are more hotel building in Batam that violates because it does not have Building Permit or hotel that already has Building Permit but violates the Local Regulation of Batam City number 2 of 20b11 on Building in Batam. The Sociological Juridical Approach is directed to reality by looking at the application of the law (Das Sein), in this case the Local Regulation of Batam number 2 of 2011 on Building. Researchers choose this type of legal research because the researchers see the difference between the desired rule of law (Das Sollen) with the reality that happened (Das Sein) that occurred in Batam, it is not all that violate but there are still violations of hotel buildings regulations in Batam. Results of Research on Implementation that has not been run effectively, especially to the distance between hotel buildings that are not in accordance with the rules that have been applied. Lack of public awareness to follow the regulations has not been effective against the Local Regulation of Batam City number 2 of 2011 on Building.

Abstract

Early 20th century- U.S. courts began to give children some form of legal protection, most notably in custody hearings. From the 1960s, children began to earn participatory rights of their own. The trend for recognizing children's rights reversed in the 1990s amid an increase in juvenile crime. With a rise in juvenile crime in the 1990s, parents felt the need to be more in control of a child's upbringing in order to raise more morally-sound and law-abiding citizens.  This trend in parenting grew from the family values movement of the 1980s. The U.S. has yet to ratify the Convention on the Rights of the Child (CRC) is quite perplexing, particularly in light of the crucial role its UN delegates played in structuring the CRC in the 1980s. The U.S. has, however, signed the CRC in 1995 and ratified the Optional Protocols on the involvement of children in armed conflict and the Optional Protocol on the sale of children. Since the sign of the CRC in 1995, several states recognized the need for such an amendment protecting the rights of parents to raise their child as they see fit. In 1996, Colorado was the first state to propose an amendment to its state constitution. While voters rejected the amendment, socially conservative politicians continued their fight against the CRC. Peter Hoekstra introduced a parental rights amendment for the U.S. Constitution in the summer of 2008. In 2009 Hoekstra again proposed a constitutional amendment supporting the rights of parents with Senate co-sponsor Jim DeMint. The CRC is a human rights treaty, which is classified as ?not self-executing, therefore even if the CRC is ratified, individual states can propose amendments to their state constitution that will grant their desired parental right. === Di awal abad ke 20, Pengadilan Amerika Serikat mulia meberikan beberapa bentuk perlindungan hukum kepada anak-anak. Sejak tahun 1960-an, anak mulai memperoleh hak untuk berpartisipasi. Trend terhadap pengakuan hak anak di tahun 1990-an sebaliknya meningkatkan jumlah kejahatan anak. Dengan peningkatan jumlah kejahatan anak di tahun 1990-an, orang tua merasa perlu untuk lebih mengawasi cara membesarkan anak agar menjadi warga masyarakat yang bermoral dan patuh terhadap hukum. Trend dalam pengasuhan anak bertumbuh dari gerakan nilai-nilai keluarga di tahun 1980-an. Amerika Serikat yang belum meratifikasi Konvensi Hak Anak cukup membingungkan, khususnya dikarenakan peranan penting delegasinya pada Perserikatan Bangsa-Bangsa (PBB) dalam menyusun Konvensi Anak di tahun 1980-an. Namun demikian, AS telah menandatangani Konvensi Anak di tahun 1995 dan meratifikasi Protokol Tambahan tentang Keterlibatan Anaka Dalam Konflik Bersenjata. Sejak penandatanganan Konvensi Hak Anak di tahun 1995, beberapa negara bagian mengakui perlunya perubahan terhadap perlindungan hak orang dalam membesarkan anak mereka. Pada tahun 1996, Colorado merupakan negara bagian pertama yang merubah Undang-Undang Dasar Negara Bagiannya. Pemilih menolak perubahan tersebut, politisi konservatif melanjutkan perlawanan terhadap Konvensi Hak Anak. Peter Hoekstra memperkenalkan perubahan hak orang tua untuk Konstitusi AS pada musim panas tahun 2008. Pada tahun 2009, Hoekstra kembali mengusulkan perubahan konstitusi yang mendukung hak orang tua kepada Penyokong Senat dengan Jim DeMint. Konvensi Anak merupakan penjanjian internasional terkait hak asasi manusia yang digolongkan sebagai ?not self-executing?, oleh karena itu meskipun Konvensi Anak diratifikasi, tiap negara bagian dapat mengusulkan perubahan terhadap konstitusi mereka yang memberikan hak orang tua yang diinginkan.
