Abstract

The digital transformation of state governance has engendered a novel form of algorithmic authority that exerts a direct influence on human rights. In Indonesia, administrative determinations derived from digital systems, such as the Computer Assisted Test for civil service recruitment, the Integrated Social Welfare Database, digital identity applications, and inter-agency data integration facilitated by the One Data Indonesia initiative, are frequently executed without transparency, correction mechanisms, or accessible legal recourse. This scenario engenders a substantial disparity between the constitutional tenet of due process and the actualities of automated public decision-making. This scholarly inquiry endeavors to articulate the notion of algorithmic due process as a unique constitutional safeguard that transcends procedural fairness, administrative due process, and digital due process. Employing normative legal methodologies in conjunction with a socio-legal perspective, this research scrutinizes the Indonesian legal framework's responsiveness to the challenges engendered by algorithmic authority. The results indicate that Indonesia is deficient in adequate normative foundations to govern algorithmic justice and safeguard fundamental rights. Consequently, the study advocates for a model of algorithmic due process predicated on the rights to explanation, correction, and legal challenge, situated within the overarching theoretical paradigm of Rule of Law 5.0. The study underscores an imperative for constitutional reform to establish definitive standards for algorithmic governance in the realm of public services.

Abstract

The problems of interaction between humans and digital technologies based on artificial intelligence cannot be regarded as resolved. The aim of this study is, through the generalisation of various viewpoints on the interaction between humans and artificial intelligence, to find an answer to the question of whether the digital revolution represents another, albeit radical, improvement in human life, one that may nevertheless displace humans from the pinnacle of evolution, or whether it constitutes something that is destined to replace humans altogether. The following methods were employed: logical analysis, observation, sociocultural analysis, synthesis, comparison, induction, forecasting, and generalisation. The results obtained indicate that three key problems in the interaction between humans and artificial intelligence have been identified. First, there is a declining human capacity to control digital technologies due to their revolutionary development. Second, there is an incorrect assessment of, or even a complete disregard for, the negative consequences of the total digitalisation of all spheres of life. Third, humans tend to overestimate their ability to control digital technologies based on artificial intelligence. In order to ensure further interaction between humans and the artificial intelligence they have created, the study proposes measures aimed at counteracting the criminalisation of artificial intelligence.

Abstract

The fundamental right to work in Indonesia is paradoxically undermined by pervasive no color blindness recruitments, often enforced via the Ishihara test. While this practice appears neutral, it constitutes indirect discrimination by disproportionately excluding competent individuals with partial colour blindness without any objective justification. This study aims to analyse the validity of the Ishihara test, arguing that it is a discriminatory tool that violates human rights. Using normative legal analysis and empirical case studies, the findings show that partial colour blindness is primarily a sensory limitation which rarely affects functional capabilities in most professions. Field data reveals a widespread misconception among employers that equates partial colour blindness with an inability to recognise hazards. Furthermore, many institutions enforce colour vision standards as an administrative hurdle without conducting job analyses relevant to the actual requirements of the role. The research concludes that the Ishihara test is widely misused as a definitive pass/fail determinant. This practice contravenes Law No. 13/2003 on Manpower regarding equal opportunity, and Law No. 8/2016 on Persons with Disabilities, which mandates the fulfilment of employment rights and reasonable adjustments. Automatic rejection without interactive dialogue constitutes a direct breach of legal obligations. This research advocates for an inclusive, fair, and dignified employment ecosystem in Indonesia.
