Abstract

Form of legal protection against the production of Gawai Replication in the form of preventive and repressive legal protection. The form of preventive legal protection in the form of legal protection for consumers is carried out at the time before the transaction occurs by providing consumer protection through the legislation that has been made. So that with the existence of these laws and regulations, consumers are expected to get protection before the transaction occurs, because there have been limitations and provisions that regulate transactions between consumers and businesses. Abstract

With the ease with which the permission of Foreign Workers (TKA) to enter Indonesia is expected to have a positive influence both for individuals, companies and for the country. The ease of permitting foreign workers can also be a way for investors to invest in Indonesia where investments made will be very profitable for the country. With the ease of Foreign workers permits, it is expected to be a trigger for the people of Indonesia to continue to develop and advance so as not to be left behind by the Foreign Workers and be able to develop companies in Indonesia more advanced so as not to make alternative foreign workers for company development. In relation to the competitiveness of companies, selected foreign workers must be able to develop the company so that they are able to compete in the world economy. Thus Indonesian workers and workers must be able to work together in producing new alternatives that can be developed in Indonesia, with the same welfare so as not to trigger discrimination between the two parties concerned. The government here has a very important role in everything, especially in the welfare of its people, here is done by opening up employment opportunities and guaranteeing all the welfare of its people by paying attention to the existing work by increasing the nominal salary in order to improve welfare for all levels of society especially people who are in the lowest layer.

Abstract

This study aims to find out how legal force and consequence of batikmark as protection of batik products in Indonesia. The problem raised is: How legal force of batikmark as protection of batik products in Indonesia?; and Howconsequence of batikmark as protection of batik products in Indonesia? This study includes qualitative research with normative legal research typology. Research data was collected throught literature study, documents, and interviews. Then all data collectedwritten descriptively and analyzed qualitatively.The results of this study show that batikmark as protection of batik products in Indonesia have legal force like constitution. But, batikmark implemented for batik entrepreneurs in Indonesia not effective yet. Proven by the small number of batikmark certificates given by Balai Kerajinan dan Batik until September 2012. Furthermore, whwn viewed from batik entrepreneurs, batikmark implemented not effective yet because no sanctions have been imposed if batik entrepreneurs have not implemented batikmark. Consequence of batikmark there are legal of implemented batikmark is batik products are given quality assurance, throuhgt batikmark can increase consumer trust because batik quality has certain criteria; and batikmark as a differentiator between Indonesian batik or foreign batik. This study recommends the improvement and renewal rule of law of batikmark; socializayion and introduction to batikmark forbatik entrepreneurs in Indonesia.

Abstract

Pengalihan lahan ke pembangunan berkelanjutan diarahkan pada perencanaan jangka panjang, berkelanjutan. Perencanaan pembangunan berkelanjutan memerlukan pendekatan simultan antara tiga dimensi utama pembangunan berkelanjutan: (1). Kelestarian lingkungan dapat terjadi jika dalam semua aktivitasnya, manusia tetap berpendapat bahwa pemanfaatan sumber daya alam masih berada di bawah daya dukung lingkungan dan limbah yang dihasilkan dari pemanfaatan sumber daya alam juga masih di bawah ambang batas. (2). Keberlanjutan pertumbuhan ekonomi dilakukan dengan mempertahankan modal (sumber daya alam) atau menjaga agar modal tidak turun saat modal digunakan. (3). Keberlanjutan sistem sosial yang menekankan aspek kualitas daripada aspek pertumbuhan kuantitas.

Abstract

The effectiveness and urgency of the use of foreign workers in Indonesia is very effective and urgent to meet the needs of skilled and professional workforce in certain fields that can not be occupied by local workers and as a step in accelerating the process of national and regional development by accelerating the transfer of knowledge and technology and increase foreign investment in the presence of foreign workers as supporting development in Indonesia, although in reality companies in Indonesia, whether foreign or national private companies, must use the Indonesian experts themselves. The purpose of regulating foreign workers if viewed from the aspect of labor law is basically to guarantee and provide decent employment opportunities for Indonesian citizens in various fields and levels. So that in hiring foreign workers in Indonesia must be done through strict mechanisms and procedures starting with the selection and licensing procedures to supervision

Abstract

Cases of Indonesian migrant workers who are not paid their pay or get pay that are not in accordance with the employment agreement still occur. BP3TKI Yogyakarta receives a complaint report from migrant workers who have returned to Indonesia related to unpaid wages. Therefore, a solution is needed to be able to give the right to wages for migrant workers. The purpose of this study was to analyze the implementation of legal protection for wages for Indonesian migrant workers in the Yogyakarta Special Region.The type of research used in this study is empirical juridical. The location of this research is in Yogyakarta Special Region. Data collection techniques in the form of interviews and document studies. Data analysis was carried out in a qualitative descriptive manner.The results of the study show that the fulfillment of the right to wages after migrant workers return to Indonesia has a problem in the settlement because the position of migrant workers has returned to Indonesia. Many cases occur only because Indonesian migrant workers, especially those from Yogyakarta Special Region, do not report to the BP3TKI Yogyakarta with the reason that they are reluctant to take care of and do not have confidence that their rights will be fulfilled. Cases of settlement of existing wages have been successfully resolved through mediation efforts between BP3TKI Yogyakarta and migrant workers / families of migrant workers and agents that channel migrant workers to work abroad. In addition to efforts through mediation, a method was also taken, namely with the BP3TKI Yogyakarta sending a letter of request for settlement assistance to the Indonesian Embassy. The Indonesian Embassy will mediate with the employer / company where the migrant worker works to fulfill the rights of the migrant worker who has returned to Indonesia.

Abstract

The government is a legal subject that has little or no role in the survival of society. In performing its duties to serve the community, not infrequently the government issued a State Administrative Decision which is intended for certain communities. With the government issuing this, certainly not forever it is in accordance with existing regulations. Sometimes, decisions issued by the government actually even give the impact on harm to ordinary people. Then, with the administrative court and Act No. 5 of 1986 on Peratun, at least there are facilities for the public to sue the government and ask to cancel the decision made by the government. Then in Year 2014 came the Law No. 30 of 2014 on Government Administration. In this Government Administration Act more or less supersedes the provisions contained in the Law of the Peratun. Especially in this Law which attracts attention is the expansion of object disputes. The object of the TUN dispute in this Act is different from its elements to the Law of the Peratun. One of these is a written stipulation that includes factual action. There is no explanation for the meaning of factual acts in this Administrative Administration Act. Therefore, further research is needed in this regard

Abstract

Pada penelitia ini, penulis mengangkat permasalahan Akibat Hukum Pendirian Lembaga Keuangan Mikro Oleh Badan Hukum Koperasi. Pilihan tema ini dilatar belakangi oleh adanya kegiatan usaha koperasi yang tidak hanya menghimpun dan menyalurkan dana milik anggotanya saja, melainkan juga masyarakat non anggota. Agar tidak menyalahi ketentuan Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian dan untuk menguatkan kedudukannya, koperasi mendirikan suatu Lembaga Keuangan Mikro (selanjutnya disebut LKM) sebagai suatu lembaga yang memiliki legalitas untuk mengelola dana anggota dan masyarakat. LKM yang didirikan oleh koperasi selanjutnya dinamakan Koperasi LKM. Penelitian skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian dan pembahasan, dapat ditarik kesimpulan bahwa pendirian LKM oleh badan hukum koperasi menimbulkan akibat hukum pada beberapa aspek dalam koperasi LKM, yaitu aspek kegiatan usaha, aspek permodalan, aspek kelembagaan, dan aspek pengawasan. Akibat hukum tersebut timbul karena adanya perbedaan pengaturan antara Koperasi dan LKM berdasarkan Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian dan Undang-Undang Nomor 1 Tahun 2013 tentang lembaga Keuangan Mikro.
