Abstract

To have the status-of a well-known mark, a brand-requires a lot of effort and time, even after the brand has the status-of-a well-known-mark, more efforts are still needed to legally protect the well-known-marks. Trademark infringement is a problem that--has-been rampant and is highly avoided by trademark owner, especially well-known mark, because the consequences of trademark infringement can be detrimental to the well-known mark owners themselves. This-research uses-normative research-methods. The results-of the-study show-that legal remedies that can-be-taken by well-known-mark-owners are to file a claim for compensation and a lawsuit-for cancellation-or deletion-of a-mark to the Commercial-Court, but the owner-of a-well-known mark does not necessarily receive a refund of the value of the loss according to the loss. Abstract

Mortgage is one type of security right besides Mortgage, Pledge and Fiduciary. The guarantee right is intended to guarantee the debt of a debtor which gives the main right to a certain creditor, namely the holder of the guarantee right, to take precedence over other creditors if the debtor defaults. This study focuses on the mechanism for settling bad loans with mortgage guarantees and the execution procedure for mortgage guarantees in cases of default in debt agreements with mortgage guarantees. The problem approach in completing this research is by using the nature of the research in a descriptive analysis, namely by describing the analysis of the executorial power of mortgage rights in the event of bad credit (default) in the debt agreement submitted by the debtor in case Number 24 / Pdt.G / 2012 / PN.Pkl . Abstract

The establishment of the Bar Association by Act No. 18 of 2003 on Lawyers has raised a debate as to which organization is recognized by the law. The decision of the Constitutional Court No. 35/Law-XVI/2018 on the Organization of Lawyers is the result of the material examination request submitted by a number of lawyers. The research method used is Normative research. The results of the research indicate that Peradi is the only container of the lawyer profession has eight authorities. The existence of advocacy organizations outside the existing Peradi cannot be prohibited as an expression of freedom of association and assembly guaranteed by Article 28 and Article 28E paragraph (3) of the 1945 UUD. Only, the lawyer's organization is not authorized to exercise those eight powers as contained in the MK Decision No. 66/Law-VIII/2010 dated 27 June 2011. Therefore, any action by a lawyer's organization other than PERADI that appears to be exercising one of the eight (eight) powers of PERADI granted by the Law on Lawyers is an act against the law that is detrimental to PERADI as the sole party entitled to such authority. Abstract

The authority of a substitute notary in the issuance of copies and minutes of deeds for legal testimony in court and police investigations is an important issue in the legal field that requires in-depth understanding. This research aims to analyze the scope and limits of the authority of a substitute notary in the context of issuing these legal documents. The research method used is a literature study to collect information and data related to the authority of substitute notaries, as well as analyzing various regulations and related court decisions. The results of the analysis show that the authority of a substitute notary has clear limitations in the issuance of copies and minutes of deeds for legal purposes in court and police investigations. Factors such as statutory provisions, notary code of ethics, as well as court decisions are the main considerations in determining the authority of a substitute notary in certain situations. This research provides a better understanding of the role of substitute notaries in the broader legal context, as well as the relevant legal implications in notarial practice in Indonesia. Abstract

Perseroan perorangan (Persero) merupakan badan hukum yang keseluruhan modalnya dimiliki oleh satu orang pemilik. Dalam menjalankan usahanya, pendiri Persero berperan sebagai organ perseroan yang mengambil keputusan bisnis. Keputusan bisnis tersebut sering kali mengandung risiko dan ketidakpastian. Untuk melindungi pendiri Persero dari tanggung jawab pribadi atas keputusan bisnisnya, perlu diterapkan doktrin business judgement rule. Business judgement rule adalah doktrin yang memberikan perlindungan hukum bagi pengambil keputusan bisnis dalam suatu perseroan, asalkan keputusan tersebut diambil dengan itikad baik, berdasarkan informasi yang cukup, dan diyakini untuk kepentingan terbaik perseroan. Penerapan business judgement rule dalam Persero memiliki implikasi penting, antara lain: 1) memberikan keleluasaan bagi pendiri untuk mengambil keputusan bisnis berisiko; 2) membatasi tanggung jawab pribadi pendiri atas kerugian perseroan; 3) mendorong pendiri untuk bertindak lebih profesional dan berhati-hati dalam mengambil keputusan. Namun, penerapan business judgement rule juga perlu diimbangi dengan prinsip-prinsip tata kelola perusahaan yang baik, seperti transparansi, akuntabilitas, tanggung jawab, kemandirian, dan keadilan. Dengan demikian, perlindungan hukum bagi pendiri Persero dapat diwujudkan tanpa mengorbankan kepentingan pihak-pihak lain yang terkait dengan perseroan. Abstract

Abstract In civil law, collateral agreements such as cessie deeds are important instruments to protect the interests of the parties in legal transactions. However, when the security object in the cessie deed expires, questions arise about the legal standing of the cessie deed and the rights of the assignee. Fundamental questions include whether the transferred lien is still valid and whether the assignee is still entitled to pursue the lien. The legal implications of this situation are complex, depending on the terms of the cessie agreement and legal principles such as legal certainty and protection of interests. Courts may be faced with the difficult task of interpreting the law and reaching a fair decision. The impact extends to lenders, assignees and debtors, who must understand the legal implications to manage risk and safeguard their interests in cession transactions. Abstract

If an agreement does not fulfill one of these conditions, the agreement will be null and void, which means that from the beginning it is assumed that there has never been an agreement and there has never been an agreement. As a notary takes action as a public official, he must be prepared and based on applicable legal regulations. Carrying out and examining all evidence shown to the notary, and listening to information or statements from the parties/appearances must be used as basic material to be included in the deed. The ambiguity of the norms in the UUJN can be seen in Article 16 paragraph (1) letter a, which states the obligations of notaries, namely that in carrying out their position, notaries are obliged to act in a trustworthy, honest, thorough, independent, impartial manner and safeguard the interests of parties involved in legal actions. . The obligations of notaries above state that, in carrying out their obligations to make authentic deeds, they are obliged to act carefully, but do not provide an explanation of the meaning and examples of notaries' obligations to act carefully from this article. Such norm conditions are referred to as norm ambiguity. According to Pitlo, if the language or words in a statutory regulation are not clear, then the grammatical interpretation method is used, meaning capturing the meaning or text of the language in the law. The absence of any specific or general explanation in Article 16 paragraph (1) letter a UUJN, that the notary must act "carefully" in making the authentic deed, has resulted in practice giving rise to legal problems with different interpretations of the precautionary principle. Abstract

The law must always be responsive to the dynamics that exist in people's lives. Therefore, law, including in this case trial procedural law, needs to adapt to developments and changes in society so that the aim of simple, fast and low-cost justice can be realized. As is known, until now, the civil procedural law used in the civil justice system is still based on the procedural law inherited from the Dutch East Indies, namely the Herziene Inlandsch Reglement (HIR), which applies to Java and Madura, and the Reglement voor de Buitengewesten (RBG), which applies to outside Java and Madua. However, in reality, many of the procedural laws inherited from the Dutch East Indies need to be adjusted to current conditions, so changes need to be made. There is one thing that the Supreme Court can quickly do to respond to the legal dynamics that occur in society's lives if the procedural legal norms that are still in force are deemed no longer relevant or need to be refined, namely by issuing Supreme Court Regulation Number 7 of 2022 concerning Amendments to Supreme Court Regulation Number 1 of 2019 concerning Electronic Administration of Cases and Trials in Court, an internal regulation that can fill gaps in procedural law (evidence). This research is normative legal research, namely research that focuses on the application of rules or norms in practical methods. This kind of normative legal study is carried out by examining various formal legal rules such as laws, procedures, literature with theoretical concepts. The research results show that the validity of electronic evidence must meet the requirements both formally and materially as evidence that can be declared valid and used in court. The validity of electronic evidence that will be presented before the trial will determine the level of validity of the evidence in the evidence before the trial, so that the electronic evidence can be said to be valid and not doubt the judge at the trial in the process of handing down decisions against the litigants. Abstract

This paper discusses the important role of notary employees in fulfilling the public's need for authentic deeds in accordance with applicable legal provisions in Indonesia. Through an analysis of UUJN No. 2 of 2014, this paper highlights the rights and obligations of notary employees, particularly regarding the presence of witnesses in the process of making and reading authentic deeds. In this context, the instrumentair witness is the main focus, explaining its role in ensuring the validity of the authentic deed. In addition, this paper also outlines the responsibilities of instrumentair witnesses in the realm of liability, emphasizing that the notary remains the party responsible for the authentic deed. Thus, this paper provides an in-depth understanding of the roles and obligations of notary employees in the making of authentic deeds, as well as the relevance of legal protection for instrumentair witnesses in the context of notarial law in Indonesia. Abstract

In carrying out his position, a Notary can hold other positions, one of which is as an Auction Officer at the Notary's place of residence. The Big Indonesian Dictionary (KBBI) provides the definition of auction, namely sales in front of a large number of people led by an auction official. In an auction, of course, there is an auction limit value which is defined as the minimum value of the goods to be auctioned. Determining the auction limit value is carried out by a third party who is not the creditor.
