Abstract

Penelitian ini dilakukan dengan untuk mengidentifikasi dan menganalisis modus operandi yang dilakukan oleh pelaku Tindak Pidana Penipuan dalam Arisan Online lalu untuk mengidentifikasi dan menganalisis upaya hukum yang dapat dilakukan oleh Kepolisian Daerah Papua Barat agar para peserta yang belum mendaatkan gilaran Uang Arisan Online memperoleh uangnya kembali sesuai dengan nominal masing-masing. Dengan menggunakan metode penelitian yuridis normatif. Berdasarkan hal tersebut hasil penelitian menyatakan bahwa penipuan arisan online menggunakan media elektronik dan penipuan konvensional tidak melibatkan media elektronik. Terdapat dua peraturan perundang-undangan yang dapat digunakan dalam penipuan arisan online. Pasal 378 KUHP dan Pasal 28 ayat (1) juncto Pasal 45 A ayat (1) Undang-Undang No 19 Tahun 2016 tentang Perubahan Atas Undang-Undang No 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Kedua peraturan perundang-undangan tersebut memiliki karakteristik masing-masing dalam menjatuhkan pidana, sehingga Pasal 28 ayat (1) juncto Pasal 45 A ayat (1) Undang-Undang No 19 Tahun 2016 tentang Perubahan Atas Undang-Undang No 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik adalah yang paling tepat digunakan dalam kasus tindak pidana penipuan arisan online. Pelaku penipuan arisan online sangat jarang dipidana dalam tindak pidana pencucian uang, termasuk beberapa kasus di wilayah hukum Kepolisian Daerah Papua Barat yang menimbulkan kerugian hingga miliaran rupiah bagi ratusan masyarakat yang menjadi pesertanya. Adapun peraturan perundang-undangan yang dapat digunakan untuk kasus pencucian uang adalah Undang-Undang No 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Kata Kunci: Penipuan Arisan Online, Tindakan Pidana Arisan Online, Penanganan Penyidik Kepolisian Daerah Papua Barat Dalam Arisan Online.

Abstract

Di Indonesia penyelesaian kasus korupsi sangat terbantu sejak adanya justice collaborator. Hukum nasional yang menjadi pedoman bagi pengadilan adalah SEMA No. 4 Tahun 2011. Namun keberadaan SEMA tersebut tidak mengikat sebagaimana UndangUndang. Dalam hal ini terdapat pengaturan yang berbeda untuk setiap aparat penegak hukum dalam menentukan apakah seseorang dapat diberikan status sebagai justice collaborator. Dengan metode dan menggunakan pendekatan perundang-undangan dan pendekatan konseptual, penulis membahas standar hakim dalam menetapkan justice collaborator dalam perkara pidana korupsi. Hasil dari penelitian menunjukkan bahwa justice collaborator diatur dalam UU No. 7 Tahun 2006, UU No. 5 Tahun 2009, UU No. 31 Tahun 2014, dan SEMA No. 4 Tahun 2011. Oleh karena SEMA sifatnya mengikat ke dalam lingkungan peradilan, maka dikeluarkanlah Peraturan Bersama untuk menyelaraskan aparat penegak hukum dalam menangani perkara. Berdasarkan analisis putusan dalam pembahasan ini dapat diketahui bahwa tolak ukur hakim dalam menetapkan status justice collaborator hanya menggunakan SEMA No. 4 Tahun 2014.Kata Kunci: Perlindungan Hukum; Justice Collaborator; Tindak Pidana Korupsi

Abstract

This research discusses the form of legal protection for negotiating banks as intermediary banks and exporters for discounts on export bills using the Letter of Credit payment method. The problem that arises in this paper is that international trade has the potential for payment uncertainty if the importer and/or issuing bank does not provide collateral worth the L/C so that the beneficiary cannot cash the L/C as well as the changing money order discount policy from the central bank. The research method used in this research is a normative juridical research method. Based on the research results, it can be concluded that the legal strength of the implementation of Government Regulation Number 29 of 2017 concerning Methods of Payment for Goods and Methods of Delivery of Goods in Export and Import Activities regarding Uniform Customs and Practice for Documentary Credits (UCPDC) 600 for Negotiating Banks and Exporters still has many weaknesses and The international community tends to use UCPDC 600 because it is a source of international law originating from custom and binding legal force for issuing banks and importers. If default is limited to the sales contract before the importer requests an L/C to be issued to the issuing bank if this does not include a guarantee worth L /C. The obstacle is that not all import business actors are willing to provide guarantees worth the L/C but also the urgency of needing goods is very high. Abstract

Penelitian ini dilakukan dengan tujuan untuk mengidentifikasi dan menganaliis mekanisme ganti rugi atas tanah adat dalam pengadaan tanah untuk kepentingan umum, lalu untuk mengidentifikasi dan menganalisis upaya hukum masyarakat adat atas adanya ketidaksepakatan ganti rugi dalam pengadaan tanah untuk kepentingan umum di Kabupaten Manokwari Papua Barat. Dengan menggunakan metode penelitian yuridis normatif. Berdasarkan hal tersebut hasil penelitian menyatakan bahwa, pengaturan penyelenggaraan pengadaan tanah bagi pembangunan untuk kepentingan umum sebagai landasan hukum bagi penyelenggaraan pengadaan tanah supaya tidak terjadi kesewenang-wenangan dari pemerintah atau panitia pelaksana pengadaan tanah, misalnya dengan tidak memberikan atau hanya memberikan ganti kerugian yang tidak sesuai dengan kesepakatan antara kedua belah pihak. Pemberian ganti rugi dalam bentuk uang sejauh ini dianggap lebih mudah dalam penghitungan dan lebih efisien, karena masyarakat dapat mempergunakan sebagai modal utuk kehidupan yang lebih baik. Pasal 78 ayat (1) sampai dengan ayat (7) Peraturan Pemerintah Nomor 19 Tahun 2021 Tentang Penyelenggaraan dan Pengadaan Tanah Bagi Kepentingan Umum diharapkan dapat menjadi payung hukum. Abstract

Licensing is one form of administrative public service provided by the government to the community. To ensure the fulfillment of rights and legal certainty for the community in obtaining licensing services, the government, especially the regional government, has prepared service standards which are stated in the form of a Regional Head Decree or a Regional Apparatus Head Decree. However, the right to obtain licensing services can be limited if there is a court decision that has permanent legal force ordering the regional government not to provide licensing services to a person or legal entity. In order to protect the rights of women and children after divorce, the Surabaya City Government and the Surabaya City Religious Court have made an agreement containing a policy not to provide public services including licensing services to husbands who have not fulfilled their obligation to provide support based on a court decision issued by the Surabaya City Religious Court. The legal issue of concern is the validity of the contents of the Surabaya City Religious Court Decision considering that divorce cases are cases of the parties and the regional government is not a party to the case. Based on general legal principles, judges in deciding cases are prohibited from taking legal action without legal authority. In this case, the divorce dispute filed by the parties only discusses the resolution of the dispute that occurs between the parties. With the existence of the Surabaya City Religious Court Decision which has permanent legal force, the Surabaya City Government is bound not to provide licensing services. Government Regulation Number 18 of 2021 Article 97 concerning Management Rights, Land Rights, Apartment Units and Land Registration states that "Certificate of Ownership Rights, Compensation Certificate, Village Certificate and others of the same type which are intended as Certificate of Ownership Rights for land can only be used as a guide for land registration. However, on the other hand, if the certificate of ownership rights can only be used as a guide for land registration, various new problems will arise, therefore the author is interested in discussing the position of the certificate of ownership rights in the Manado State Administrative Court Decision Number: 25/G/2023/PTUN. MDO with the aim of knowing the Position of the Certificate of Ownership Rights as Proof of Ownership of Land Rights and Knowing and Analyzing the Position of the Certificate of Ownership Rights in the Manado State Administrative Court Decision Number: 25/G/2023/PTUN. MDO will then be examined by the author using a normative research method with a legal analysis approach or also called legal analysis, namely research conducted by analyzing applicable legal rules (Legal Research) so as to produce conclusions so as to produce conclusions In terms of the position of the evidence of the Dorneka Tawatua Land Ownership Certificate, it is valid and recognized as evidence, but proof of ownership of land rights based on the Land Ownership Certificate alone is not enough, but must also be proven by physical data and other legal data. Abstract

The evaluation of the Regional Spatial Plan (RTRW) by the Governor aims to ensure that spatial policies at the district/city level are not only in accordance with local interests, but also support the national development agenda and maintain balance between regions. Compliance with national policies means that every policy taken by the regional government must be in line with the laws and regulations set by the central government. In its implementation, the evaluation process often faces several obstacles. Problems arise, there are differences in interpretation of regulations between the central and regional governments, and resistance from district/city governments who feel that their authority is being intervened. There is a conflict of interest between the central government, provincial government and district/city government in the preparation of the RTRW. In this case, the Governor must be able to balance the interests of the various parties in carrying out his evaluation duties. So it is necessary to emphasize a strong basis in terms of the limitations of the Governor's authority as a Representative of the Central Government in evaluating the Regency/City Regional Regulation on the Regional Spatial Plan, and it is necessary to know the legal consequences of the Regency/City Regional Regulation on the Regional Spatial Plan that are not in accordance with the results of the Governor's evaluation as a representative of the Central Government. Abstract

Penetapan Lahan Pertanian Pangan Berkelanjutan (LP2B) merupakan salah satu strategi utama untuk menjaga keberlanjutan sektor pertanian dan mendukung ketahanan pangan nasional. Namun, dalam implementasinya, kebijakan ini menghadapi berbagai tantangan, khususnya dalam aspek transparansi. Penelitian ini bertujuan untuk mengkaji masalah hukum yang berkaitan dengan transparansi dalam penetapan LP2B serta implikasinya terhadap ketahanan pangan nasional. Dengan menggunakan pendekatan yuridis normatif, penelitian ini menganalisis kerangka hukum, praktik implementasi, dan dampak regulasi terhadap pengelolaan LP2B. Data diperoleh dari kajian dokumen, meliputi peraturan perundang-undangan, jurnal ilmiah, dan laporan resmi, yang dianalisis secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa meskipun regulasi LP2B, seperti Undang-Undang Nomor 41 Tahun 2009 dan Peraturan Pemerintah Nomor 1 Tahun 2011, telah memberikan landasan hukum yang kuat, pelaksanaannya di tingkat daerah masih menghadapi berbagai kelemahan. Kurangnya transparansi dalam proses penetapan LP2B, minimnya partisipasi masyarakat, dan adanya konflik kepentingan menjadi faktor utama yang menghambat efektivitas kebijakan ini. Selain itu, kasus alih fungsi lahan yang tidak sesuai dengan ketentuan hukum masih marak terjadi, yang berakibat pada berkurangnya luas lahan pertanian produktif. Kondisi ini mengancam keberlanjutan produksi pangan nasional dan memperburuk ketahanan pangan, terutama di tengah meningkatnya kebutuhan pangan akibat pertumbuhan penduduk. Penelitian ini merekomendasikan perlunya penguatan transparansi dalam penetapan LP2B melalui pelibatan masyarakat, pemanfaatan teknologi informasi untuk pengawasan, dan penegakan hukum yang lebih tegas terhadap pelanggaran. Selain itu, integrasi kebijakan LP2B dengan rencana pembangunan wilayah menjadi kunci untuk mengurangi konflik antara kebutuhan pembangunan dan perlindungan lahan pertanian. Abstract

ABSTRACT Progress in the field of information technology has progressed so quickly that it has affected every aspect of life. This information and communication technology makes a big contribution in making it easier to carry out activities such as communication, disseminating and searching for data, teaching processes and is used to support the effectiveness of an organization. This development also touches on legal issues which indirectly influence the process of administering justice in Indonesia. The Covid-19 pandemic has had a negative impact on all sectors and aspects of Indonesia, including the justice sector. Adaptations are made to adapt to existing conditions, one of which is E-Court which can be said to be a new legal product in the legal system in Indonesia whose implementation cannot yet be said to be optimal, but is required to adapt to the conditions of the country which is experiencing a health emergency due to Covid-19 pandemic, regarding this matter also in the implementation of settling civil cases in court via E-Court, whether it can realize the principles of simple, fast and low-cost justice. And in this case, to adapt to conditions following the Covid-19 pandemic, the government has updated the regulations regarding E-Court, namely Supreme Court Regulation Number 1 of 2019, updated with Supreme Court Regulation Number 7 of 2022 concerning Amendments to Supreme Court Regulation No. 1 of 2019 concerning Electronic Administration of Cases and Trials in Court. This PERMA was officially promulgated by the Chief Justice of the Republic of Indonesia on October 10 2022. There are several updates to the contents of the article, including a very contrasting one regarding electronic case administration services that can be used by other than registered users, but can also be used by other users. Other users are legal subjects other than registered users who are eligible to use SIP (Court Information System) with rights and obligations regulated by the Supreme Court. This research will look at the position of Perma Number 7 of 2022 which regulates the digitalization of civil justice through E-Court and legal protection for parties in civil justice through E-Court in accordance with Perma Number 7 of 2022, and is expected to be a contribution to knowledge for society.
