Abstract

Dalam hal penyelenggaraan pemilu 2024, KPU akan berpedoman dengan Putusan Mahkamah Konstitusi Nomor 87/PUU-XX/2022 Atas Pelaksanaan Pencalonan Legislatif Pada Pemilihan Umum Tahun 2024. Substansi dari peraturan tersebut adalah larangan mantan narapidana bandar narkoba, kejahatan seksual terhadap anak, dan korupsi untuk mencalonkan diri dalam kontestasi pemilu legislatif. Pencalonan mantan narapidana kasus korupsi tidak lepas dari peran partai politik dalam rekrutmen politik dan kaderisasi anggotanya. Tujuan penelitian ini adalah untuk mengetahui pandangan hukum progresif terhadap pencalegan mantan terpidana korupsi dan upaya dalam mengurangi dan mencegah kader-kader partai politik dalam kontestasi pilihan legislatif tahun 2024. Hasil penelitian menunjukkan, putusan MK Nomor No.87/PUU-XX/2022 ini menerapkan Judicial Activism, dapat dilihat dari penafsiran hukum dan memperlihatkan adanya keadilan bagi masyarakat, yang kemudian keputusannya Lembaga Yudisial dapat memutuskan peraturan perundang-undangan diatas sebagai peraturan perundang-undangan yang sedang di uji materiil. Komisi Pemilihan Umum demi menjaga profesionalitasnya sebagai lembaga pemilu yang mandiri tidak meloloskan bacaleg eks koruptor seperti yang telah ditetapkan melalui PKPU

Abstract

Penegakan hukum terhadap pelaku tindak pidana narkotika melalui restorative justice yang dilakukan anak merupakan amanat UUD 1945 dan Undang-Undang No 39 Tahun 1999 Tentang Hak Asasi Manusia, karena semua dihadapan hukum mempunyai hak yang sama dan anak masih punya masa depan yang panjang dan sebagai generasi penerus bangsa. Permasalahan dalam penelitian ini adalah bagaimana penegakan hukum terhadap pelaku tindak pidana narkotika melalui restorative justice yang dilakukan anak serta penanggulangannya di wilayah hukum Polres Teluk Bintuni, Apa hambatan dalam penegakan hukum terhadap pelaku tindak pidana narkotika melalui restorative justice yang dilakukan anak serta penanggulangannya di wilayah hukum Polres Teluk Bintuni, Solusi mengatasi hambatan dalam penegakan hukum terhadap pelaku tindak pidana narkotika melalui restorative justice yang dilakukan anak serta penanggulangannya di wilayah hukum Polres Teluk Bintuni Hasil penelitian ini adalah : Restorative Justice dan Diversi diberlakukan kepada anak yang telah berusia 12 (dua belas tahun) tetapi belum berumur 18 (delapan belas) tahun atau telah berumur 12 (dua belas) tahun meskipun pernah kawin tetapi belum berumur 18 (delpan belas) tahun, yang diduga melakukan tindak pidana. Proses diversi pada tingkat penyidikan dalam perkara anak, didasari adanya laporan dan pihak Penyidik membuat BAP, lalu Bapas melakukan Penelitian Masyarakat (Litmas) di lingkungan rumah pelaku, Bapas mengeluarkan surat rekomendasi untuk layak atau tidaknya proses diversi dan surat tersebut diserahkan kepada Penyidik, Penyidik melakukan pemanggilan kepada pihak-pihak yang terlibat untuk melakukan diversi, lalu hasil diversi dituangkan dalam bentuk surat yang hasil dari diversi tersebut selanjutnya diserahkan ke Pengadilan yang nantinya Pengadilan membuat surat penetapan bahwasanya diversi berhasil dilakukan. Hambatan yang ditemukan dalam proses diversi pada tingkat penyidikan dalam perkara anak, kurangnya waktu yang diberikan oleh Undang-undang bagi para penegak hukum untuk mengupayakan diversi, upaya ganti rugi mengalami hambatan dikarenakan terkadang kedua belah pihak dalam hal upaya ganti rugi tidak memenuhi kata sepakat, salah satu hambatan untuk pelaksanaan diversi adalah tidak mempunyai orang tua karena sebagian banyak permasalahan anak yang tersangkut masalah tindak pidana tidak mempunyai orang tua dan pihak kepolisian dan bapas kesulitan dalam melaksanakan diversi. Upaya mengatasi hambatan dalam penerapan prinsip Restorative Justice dalam Perkara Tindak Pidana dengan Pelaku Anak di bawah umur di wilayah hokum Polres Teluk Bintuni dalam mengatasi hambatan internal:Melakukan pertemuan terpisah (khusus) untuk mencapai kesepakatan, Menyusun rencana kerja dan memaksimalkan kinerja setiap penyidik dalam hal penanganan perkara anak. Upaya mengatasi hambatan dalam penerapan prinsip Restorative Justice dalam Perkara Tindak Pidana dengan Pelaku Anak di bawah umur di wilayah hokum Polres Teluk Bintuni dalam mengatasi hambatan eksternal : Mengoptimalkan sarana dan prasarana ; Menggunakan tenaga kesejahteraan sosial dalam proses diversi ; Menjalin komunikasi yang intensif dengan aparat penegak hukum yang lainnya ; Meningkatkan koordinasi dengan pembimbing kemasyarakatan ; Mengadakan sosialisasi tentang diversi di kalangan masyarakat dan Membuat kesepakatan mengenai pengawasan pelaksanaan hasil kesepakatan diversi. Abstract

The purpose of this research is to determine legal certainty and protection for the parties, as well as the validity of the rental agreement in the Semarang District Court decision Number 27/PDT.G/2016/PN.SMG and to find out whether the Directors of PT KAI Semarang committed unlawful acts based on the lease provisions. renting according to Article 1548 of the Civil Code. The method used in this research is the juridical problem approach. The data sources used are primary data sources and secondary data sources. Meanwhile, the data collection method is by means of literature study. Then the data analysis method used is the qualitative descriptive method. This aims to explain how research is carried out in order to obtain maximum results The research results show that the legal protection provided by PT Kereta Api Indonesia will only be given to the public or legal tenants of PT Kereta Api Indonesia's land. Based on Law Number 23 of 2007 concerning Railways, Article 86 clearly states that land which has been controlled by the Government, Regional Government or Business Entity in the context of developing railway infrastructure, is certified in accordance with the provisions of laws and regulations in the land sector. So PT. KAI is not said to have committed an unlawful act according to the provisions of the rental agreement, the object of which remains protection, because PT. Abstract

Article 27 paragraph (2) of the 1945 Constitution mandates the government to provide protection for labor and a decent livelihood for humanity. Today's rapid business development has an impact on the need for notaries as officials who make authentic deeds. This authentic deed will later become evidence with full legal force in court. The result of the increasing need for notaries is the increasing number of notaries and notary offices which then open up jobs as notary employees. When looking at the legal relationship between notaries and notary employees, the employer is the notary and the workers are notary employees, while the notary office is a company. For this reason, the existing rules in Law no. 24 of 2011 concerning the Social Security Organizing Agency also apply to notary offices. Normative juridical legal research methods, or research done by looking at the laws and regulations that apply or are applied to a specific problem with 2 (two) approaches, namely: statute approach and conceptual approach, are the research method used to address the legal issues raised in this study. Primary and secondary legal resources were the sources of research materials employed in this study. The deduction method, which is the process of conducting research based on general principles to explain particular events or from general theories to concrete facts, was the analysis approach employed in the compilation of data for this study. Abstract

A notary is an official who has the authority to make authentic deeds. The authentic deed itself functions as the most perfect piece of evidence in court, in the event of preservation of related rights and obligations. With the authority granted by law and the trust of the people served through legal traffic, it cannot be denied that in the process of transferring names, you will certainly receive a mandate from the applicant to keep the certificate of title to the land. In this research, the author analyzes the authority and responsibilities of Notaries in storing certificates of land rights lost due to theft. The type of research used is normative juridical or library research. The approach method is a statutory-regulatory approach, which means the approach is carried out by examining all laws and regulations related to the legal issue being handled. Basically, the notary himself does not have the authority to store land title certificates. This attitude is a form of neutral attitude that the notary has towards the parties to ensure legal certainty and protection. so that the notary indirectly assumes responsibility for storing land title certificates, including the obligation to safeguard the certificates, with the trust given by the parties. So that the Notary's form of responsibility must be carried out in accordance with the provisions of Article 1706 of the Civil Code (BW), which regulates that the Notary is also required to maintain and guard the certificate. The notary is obliged to compensate for damage or loss of land title certificates as reflected in Article 1694 of the Civil Code (BW). Thus, the notary's responsibility for land title certificates lost due to theft can be carried out in the form of compensation in the form of a replacement certificate. Abstract

ABSTRACT: The birth of the Agrarian Law of 1960 was the beginning of the implementation of positive laws on land in Indonesia. However, in the Agrarian Principles Law has not fully regulated the right of coastal and small islands, some people even say that the coastal boundary is not an object in UUPA. This polemic is increasing in line with the status of Indonesia which adopts as an archipelago country, so the coastline and also the small islands in Indonesia also need a clear arrangement. Since the enactment of Government Regulation No. 16 of 2004 on Land Settlement of coastal boundaries and small islands that are generally included in protected areas can be given Land Rights except in forest areas, this is further strengthened by Law Number 1 of 2014 and also detailed Regulation Minister of ATR / KBPN No.17 of 2016. Thus paying attention to the rules and also on the basis of legal certainty and utility, the layout of land in coastal and small island border areas can be given rights to land. Abstract

Micro, Small and Medium Enterprises are the pillars of the community's economy. In order to achieve stable and sustainable economic growth, it is necessary to support strong economic stability. Before the Job Creation Law was passed, which was later replaced by the Job Creation Perpu, there were still many obstacles and barriers faced by business actors, especially in micro and small businesses, including disharmonization of business licensing procedures for micro and small businesses between the law and its implementing regulations so that requires a lot of time and money. To deal with these conditions, government support is urgently needed, including in the form of establishing laws and regulations that favor micro and small businesses. With the ratification of Perpu Number 2 of 2022, which provides many conveniences for micro and small businesses and increases efficiency for business actors, it is hoped that it can become a guideline for micro and small businesses to further grow, develop and compete in the global and free market era. So as to balance the portion of large, medium, and especially micro and small businesses, while creating a fair business climate and fairness for MSMEs throughout Indonesia to a much greater extent. Abstract

Taxes are people's contributions to the state treasury based on law, so they can be imposed without receiving direct compensation. The main aim of taxes is to increase state income to improve people's welfare so that the function of tax criminal sanctions is a preventive tool so that perpetrators of tax crimes do not violate tax norms. However, in the implementation of tax collection there are always those who commit violations, such as in the case of land and building tax violations. In the law enforcement process, not everyone understands tax criminal sanctions and their legality. For this reason, this paper aims to describe the enforcement of tax criminal law sanctions and their legality. This paper uses a normative juridical method, namely through literature study with data sources in the form of statutory regulations, court decisions, as well as articles or other reading materials related to taxation with a qualitative descriptive approach and concludes the legality of enforcing tax criminal sanctions in accordance with the Law on General Provisions and Procedures. Abstract

This research discusses the position of fiduciary guarantees for replacement assets, which are replacement assets in the form of receivables in the name of credit agreements between banking institutions. The problem studied is that asset replacement is an intangible object but is allowed to become the object of fiduciary collateral which then has the potential to harm creditors as holders of preferential rights over replacement assets. The formulation of the problem given by the author is the position of banks as recipients of fiduciary guarantees for fiduciary collateral objects in the form of Asset Replacement and what are the preferential rights for banks as recipients of fiduciary guarantees for collateral objects in the form of Asset Replacement. The research method used is normative juridical using a statutory approach and a conceptual approach. The results of this research are that the object of fiduciary collateral is asset replacement, making the creditor who receives the fiduciary lose the pre-emptive right to take repayment of receivables through execution if the fiduciary is in default when it is not followed by a deed of transfer of receivables (cessie) and preferential rights or pre-emptive rights on the sale of the property which becomes The object of asset replacement for banks as creditors remains attached as long as it is bound by a deed of transfer of receivables (cessie) by first carrying out a review and/or research on the value and nature of the receivables as objects of collateral in the form of asset replacement.
