Abstract

This article discusses the legal transformation of movable waqf in the context of current laws and regulations in Indonesia, particularly in the modern era. Waqf, which is commonly known in the form of land and fixed property, has experienced developments in terms of the objects that can be waqfed, including movable objects such as money, vehicles, and other equipment. This study outlines the changes in legal perspectives that have occurred in line with the development of regulations and policies related to the waqf of movable objects, including Law No. 41/2004 on Waqf, as well as its implementing regulations. In addition, the article also highlights the challenges and opportunities that arise in the implementation of movable waqf in Indonesia, as well as the role of religious institutions and the government in regulating and ensuring the sustainability of movable waqf. Hopefully, this article can provide a deeper understanding of the potential and legal implications of movable waqf in Indonesia's increasingly dynamic legal system. Keywords: Legal Transformation, Waqf Legislation, Contemporary Waqf, Utilization of Movable Assets

Abstract

Research on Hassan Hanafi's political thought focuses on three main aspects. First, the concept of "Leftist Islam," which emphasizes the struggle against social injustice toward the poor and the oppressed, while promoting the principle of equal rights and responsibilities for all citizens. Second, Occidentalism, which refers to a critical study of Western civilization from a comprehensive social perspective, including an analysis of its strengths and weaknesses. Third, the hermeneutical approach, which is a method of interpreting the Qur’an in a modern context. Hassan Hanafi's thought has received mixed responses from Muslim intellectuals some support his ideas, while many others offer critiques. Among the scholars who have examined his ideas are Fazlur Rahman, Mohammed Arkoun, and Nurcholish Madjid, while Kuntowijoyo is among his critics. Despite differing opinions, these do not necessarily diminish the value of Hassan Hanafi’s thought. Some of his ideas remain relevant as sources of inspiration for efforts to rebuild Islamic civilization. This relevance can also be evaluated from the perspective of the Qur’an.

Abstract

Abstract

The phenomenon of fundraising for various noble causes is widespread in society. However, the practice of fundraisers taking wages directly from collected donations raises legal questions. This article analyzes the legality of such practices using a normative legal research method (library study) from the perspective of Fiqh Muamalah. The research concludes that it is not permissible to take fundraiser compensation from the donation funds themselves. The principle of Fiqh Muamalah mandates that donation funds must be distributed entirely to the recipients (mustahik). Taking wages is considered to diminish the recipients' rights and potentially violate trust.Consequently, transparency and accountability in donation management are crucial. It is recommended that operational costs or fundraiser compensation be allocated from separate funding sources, or with the explicit consent of donors from the outset. This research provides understanding and guidance for individuals and philanthropic organizations. Keywords: Fundraising, Fundraiser Compensation, Fiqh Muamalah, Islamic Law
