Abstract

According to Law No. 32 of 2004 supervise the regulation only accentuated the repressive supervision only. It differs by Law No. 5 of 1974, where in the Act oversight of the regulation there are two kinds, namely the supervision of preventive and repressive. These changes give rise to new problems, such as changing the shape of the embodiment of statutory supervision of the Central Government. Repressive supervision adopted Act No. 32 of 2004 can be seen in the establishment of laws that have been established and approved by the legislature can be directly applied without waiting for the ratification of the Central Government in advance, but to keep the area did not act contrary to the corridors of the Unitary State, then a provision stating that the legislation that has been passed (and has been in force) must be notified to the Government Pusat.Metode research conducted by the normative legal research methods.Parliament is no longer parallel notch and became a partner of the local government, but in the explanation of Law No. 32 of 2004 it is mentioned that the relationship between local government and parliament are working relationship and are equal in status to the partnership. Abstract

Legal certainty can be realized through good and clear in a law and its application will also clear. Legal certainty is also required in fiduciary. Act No. 42 of 1999 on Fiduciary is one of them as a guideline for transfer of fiduciary security object. Abdul Rozak initially accept objects of Wiliam Herudinata fiduciary underhand manner in which the recipient of fiduciary security object is PT. BII Finance Center. As a good faith Abdul Rozak convey to PT. BII Finance Center in writing about the transition under the arm, but the PT. BII Finance Center did not respond nor reject the installments paid by Abdul Rozak, on the other hand Wiliam Herudinata unknown. When installment was paid by PT. BII Finance refused to surrender fiduciary objects to Abdul Rozak. The top permasalahn Abdul Rozak filed suit in the District Court of Tangerang to register case number: 412 / Pdt.G / 2015 / PN.TNG. Judges on the lawsuit tersebuat the case in favor of Abdul Rozak with one of the legal considerations that Abdul Rozak have good faith and PT. BII Finan Center does not reject or endorse the transitional credit agreement with the fiduciary guarantee, it shall be rendered by the judges that Abdul Rozak is the only party entitled to take that object of the fiduciary guarantee.Keywords: Rule of Law, Fiduciary, Judicial Power

Abstract

In the general community, including members of Parliament and leaders other laws do not understand the difference of evidence and evidence, so to put something in order to group them as evidence based only on estimates or the unexpected, such as in Article 184 Criminal Procedure Code to enter user as evidence, so The concept also Prof.Dr.Indroharto enter the evidence and the judge's conviction as evidence. After knowing the difference of evidence with evidence will be able to determine what can be grouped as evidence. To determine the evidence is very important to know because the system proving that embrace the Indonesian criminal law is Wettelijk Negatief Stelsel ie at least two items of evidence and the judge assured.Keywords: Difference of evidence with evidence.

Abstract

All members of academia—lecturers and students—who are the front liners in developing science and technology should be sufficiently equipped with the know-how on intellectual property rights (IPR), not only the ones related to patent rights but also those related to industrial design rights. This knowledge is crucial in helping all academia members to grow respect for copyrights. Since it is the academia members who produce intellectual work, the lecturers at YARSI University should be educated on the matter. And, as preliminary measures, research to map this issue at YARSI University is necessary. This research is applied normative/empirical normative/empirical juridical, that is, it stresses on the secondary data in analyzing the principles in positive laws and in analyzing factors which are related to the research object,  and analyzing its implementation in promoting intellectual property rights among lecturers. The mapping findings of this research conducted at YARSI University with 50 full-time respondents suggest that: the majority (64%) comprehends the issue while 36% others don’t; most lecturers (66%) cannot differentiate copyright from patent right while the other 34% can; some (30%) of the respondents can categorize intellectual rights (trademark, design, PVT, trade secrets) while 70% others cannot; most lecturers (62%) are informed of plagiarism and its related laws while 38% others are not; 52% of the lecturers cannot differentiate such terms as creator, copyright, inventor, and invention while 48% others can; 96% of the respondents are not aware of automatic protection while 8% others are; 96% of the respondents are not informed of the object of copyright and its scope as described in the latest law (UU No.28 2014) while the other 4% are; 58% of the respondents are clueless on outright sale, royalty, and license while 42% others are not; 80% of the respondents know whether or not it is allowed to have a book copied for personal purposes while the other 20% don’t; it is a relief to learn that 86% of the respondents are aware of the importance of having an invention listed although 14% others are not; most lecturers (60%) cannot differentiate such terms as ‘listed’, ‘registered’, and ‘published’, while 40% others can; all respondents (100%) do not know anything about copyright-related offenses which can be filed to court. Some measures taken to promote awareness of intellectual property rights among lecturers at YARSI University are education on the issue and reward for it in the form of incentives for performing lecturers with scientific publications and registered patents. At YARSI University, it is Deputy Rector II ex-officio Research Head who has the authority and plays the role in motivating the lecturers to conduct research and to earn intellectual property rights.Keywords: lecturers’ knowledge on IPR, awareness of IPR, academia

Abstract

The law state concept which applied in Indonesia is the law system as heritage of Netherland which is growth in the Europe Continental is mention “Europe Continental Concept”, which is implementing base on “concordance principle” which is mentioned in the transition rule Article II of The Indonesia Constitution Year of 1945 (original text). Which declaring “all institutions of the state and regulation which is existing at the time is directly apply, during  been providing the new regulation yet base on this Constitution”. One of the other character of this law system in the Continental Europe Concept is the law  positivism or the law legism, which generally can be meaning that law identicallly  with the rule, outside the rule there is no law, to creating the certainty of law, the law absolutely be made by legislature institution, and be placed in the book of the rule (codification). The born of MPRS Decree No. XX/MPRS/1966 Subject to the hierarchy of the regulation, MPR Decree No. III/MPR/2000 Subject to the hierarchy of the regulation, Rule No. 10 Year of 2004 Subject to the Forming the Regulation, and Rule No. 12 Year of 2011 Subject to the Forming the Regulation. is meaning that Indonesia State belonging the on the rule and certainty of law. In the fact on practice still many society which not understanding yet each regulation which decided by the state, so that, often happened law violations which carry out by the society, but the society are not care as have been done. Such as for the time being happened the case of violation of the flag of the rule No. 24 Year of 2009 subject to the letters, flag and symbols of state. The conclution of this research that, the national law system of Indonesia, in the practically influenced by the concept of law positivism/legism from Continental Europe System.Key Words : Positivisme, konkordansi, legisme, certainty of law.

Abstract

The social media is existing in community recentely be phenomenoned because it is not existing before in our life. This existence became daily and premiere needs people but today it’s destroy for several aspects in human life, although it’s has been given for many advantages andhelpfull in many kinds of working in daily human life.This social media even the convensional media such as TV or an internet media are needful could not gave us several goodness it’s gave us too many kinds of ungoodness.  The contents of short massage for example, and there a lot of idea and many sentences in Facebook,  and What’s Up or WA and an Instagramare make a lot of people field unhappy after reading and communicating one each others in social media. Some times it has been laid but many kinds of intimidation between individuals and communities in our life.The problem is the era of globalization today in all over the world the convensional media and the internet media must be accepted and it’s imposible to rejected, and now the world is to be smalled and not belargedagain because an internet media and other kinds of media used. The other problem is the Indonesian people came from the several kinds of languanges, racials, cultures, and each others. Abstract

 Juvenile in conflict with the law according to Indonesian constitution number 12 years 2012 about Junenile Justice System are Children, which have riched 12 years old and under 18 years old suspected crime. Law enforcement for juvenile suspectible of negative impact cause by the judicial process, such as Stigma. Community has tend to “judge” that they are naughty children/ criminal and worthly to be dissociated from society, or even worthy imprisoned. Therefore, dissociate juvenile from judicial process (especially imprisoned) is more preferred. Deinstitutionalization for juvenile in conflict with the law is one of strategic policy for children best interest. Therefore, detention and imprisoned were the last attempt in consider of sociological and psychological impact. Best solution in juvenile case were diversion and restorative justice. Diversion according to Indonesian Constitution is diversion settlement of juvenile case from criminal justice  process to other. While, restorative justice is a process when every body/ side that involved are gathered to talk about the win win solution of the problem which best for nowadays and future interest. Correctional is a system and subsystem is every stages of criminal justice system, especially the criminal justice of juvenile. The stages began from pra adjudication, adjudication (by Bapas and LPAS) and post adjudication stage (by LPKA and Bapas). Balai Pemansyarakatan or we call it Bapas is a subsystem of correction which has role from beginning of criminal justice process. Its function is pra adjudication and adjudication stages were accompaniment, guiding, supervision of diversion criminal justice of juvenile and also restorative justice. In post adjudication stage, the principle of restorative justice is still needed with LPKA, Bapas and other are involved for the implementation.Keywords: Juvenile in conflict with the law, Diversion  Restorative justice, Correction

Abstract

Indonesia as a state law (state of law) adheres to the idea of equality before the law (equality before the law) to ensure that each person gets treatment and legal certainty are equal in their rights and obligations as subjects of law regardless of social status. In fact, the economic factor is often a differentiator for justice seekers and cause social jealousy. Based on Pancasila as the nation and the fundamental mandate of the 1945 state guarantees the right of every seeker of justice to obtain assurance hukum.Bagi people can not be provided legal aid program which is regulated in Law No. 16 Year 2016 on Legal Aid. Advocates have a strategic position and juridical rights in providing legal assistance for free of charge are regulated by law. As a legal Counsel, Advocate is obliged to comply with the provisions of article 22 of Law Number 18 Year 2003 concerning Advocates which requires Advocates to provide legal assistance for free of charge to the justice seekers who tidakk capable.Keywords: legal status, rights advocates, criminal case
