Abstract

 The purpose of this study was to find out about the implementation of remission of female prisoners in the Class II A Tangerang Women's Penitentiary and also to find out the obstacles to the implementation of remission against female prisoners in the Penitentiary. The method used in this study is normative and empirical legal research methods by collecting secondary data and primary data related to research problems. The results of the study indicate that remission is the right of prisoners to get a criminal reduction if during good coaching. Remission is the right of the prisoner if the person in question carries out acts such as doing services to the state and taking actions that are beneficial to the state or humanity, as well as committing acts that help the activities of the prison. There are several factors inhibiting remission in the Class II A Tangerang Women's Penitentiary, namely the difficulty of female inmates meeting the special requirements for the implementation of remission, which is paying fines and replacement money in accordance with court decisions.

Abstract

 Juvenile in conflict with the law according to Indonesian constitution number 12 years 2012 about Junenile Justice System are Children, which have riched 12 years old and under 18 years old suspected crime. Law enforcement for juvenile suspectible of negative impact cause by the judicial process, such as Stigma. Community has tend to “judge” that they are naughty children/ criminal and worthly to be dissociated from society, or even worthy imprisoned. Therefore, dissociate juvenile from judicial process (especially imprisoned) is more preferred. Deinstitutionalization for juvenile in conflict with the law is one of strategic policy for children best interest. Therefore, detention and imprisoned were the last attempt in consider of sociological and psychological impact. Best solution in juvenile case were diversion and restorative justice. Diversion according to Indonesian Constitution is diversion settlement of juvenile case from criminal justice  process to other. While, restorative justice is a process when every body/ side that involved are gathered to talk about the win win solution of the problem which best for nowadays and future interest. Correctional is a system and subsystem is every stages of criminal justice system, especially the criminal justice of juvenile. The stages began from pra adjudication, adjudication (by Bapas and LPAS) and post adjudication stage (by LPKA and Bapas). Balai Pemansyarakatan or we call it Bapas is a subsystem of correction which has role from beginning of criminal justice process. Its function is pra adjudication and adjudication stages were accompaniment, guiding, supervision of diversion criminal justice of juvenile and also restorative justice. In post adjudication stage, the principle of restorative justice is still needed with LPKA, Bapas and other are involved for the implementation.Keywords: Juvenile in conflict with the law, Diversion  Restorative justice, Correction

Abstract

The Super Maximum Scurity Penitentiary is a new Technical Implementation Unit in the ranks of prisons, which functions specifically to foster Terrorist prisoners or other high risk prisoners, the difference between this institution compared to other Correctional UPTs is that the security is very tight with one person and one prisoner cell. and the method of guidance provided to prisoners in Super Maximum Scurity (SMS) Lapas is different from other prison guidance. The issues raised in this researchare: How is the implementation of coaching terrorist prisoners in Super Maximum Security Prison based on Regulation of the Minister of Law and Human Rights No. 35 of 2018? And how is the development of terrorist inmates at Super Maximim Security Prison from a prison perspective? The theory used is by using coaching theory and descriptive qualitative research methods by direct interviews with officers of the Super Maximum Security (SMS) prison. Based on the results of the research, it is found that in the development of Terrorist inmates at the Super Maximum Security Prison, because in the implementation of the guidance, the difficulty of the prisoners' movement cannot be directly fostered by the officers having to regulate. Then coaching in terms of the goals of the correctional system can be reviewed because it is different from the goals of different systems, so it requires the best thinking and solutions so that coaching can be carried out in accordance with the objectives of the correctional system, namely prisoners are aware of mistakes, improve themselves and no longer commit acts that violate the law , are accepted by the community and can be active and productive in development and able to live their lives as good and responsible citizens.

Abstract

Setiap warga negara mempunyai hak guna menyampaikan ide maupun pandangan melalui demonstrasi. Walapun demonstrasi suatu kegiatan yang mendapatkan kekuatan secara hukum, namun tidak semua pihak melaksanakan demonstrasi dengan kesadaran hukum yang berlaku dalam negara Indonesia seperti demonstrasi yang berujung kerusuhan. Bagaimana klien pemasyarakatan kasus kerusuhan demonstrasi mahasiswa ditinjau dari pendekatan deindividuation. Bagaimana pembimbingan klien pemasyarakatan kasus kerusuhan demonstrasi mahasiswa. peneitian memakai penelitian hukum normatif dengan melihat gejala hukum di masyarakat. Pengambilan data melalui studi kepustakaan (library research). Sebab penelitian berfungsi memperoleh jawaban mengenai pertanyaan, pendapat dan tanggapan sesuai dengan sejumlah literatur yang digunakan. Hasil penulisan ini berkesimpulan bahwa kerusuhan dalam demonstrasi mahasiswa ditinjau dari pendekatan deindividuation berangapan bahwa kondisi dimana individu mahasiswa telah kehilangan kontrol atas dirinya sebab kelompok telah memiliki persepektif bahwa jika hanya melakukan aksi damai maka tuntutan tidak akan didengar. Klien pemasyarakatan kasus kerusuhan demonstrasi dipandang sebagai individu yang harus di ayomi dengan pemberian program pembinaan dan pembimbingan. Penulis menyarankan memberikan sosialisasi mengenai tata cara aksi demonstrasi sesuai peraturan yang berlaku terhadap mahasiswa, pemberian program pembimbingan kepribadian dengan bentuk bertaqwa kepada Tuhan Yang Maha Esa serta kesadaran hukum sebab sesuai dengan teori deindividuation, maka dengan pemberian program tersebut dapat memperkuat kualitas kontrol atas diri seseorang dan pemahaman lebih akan konsekuensi yang di terimakanya ketika melakukan perbuatan melanggar hukum meskipun menurut persepektif kelompoknya adalah benar.

Abstract

This study aims to develop a risk assessment tool for sexual violence recidivism in incarcerated individuals in Indonesia, considering both static and dynamic factors. Data analysis showed a strong positive correlation between recidivism and "Prior Sexual Offenses" (0.554) and the total static factor score (0.251). The frequency of sexual violence also moderately correlated with recidivism (0.232). Certain static factors had better predictive capabilities for identifying recidivism, while others showed lower predictive power. Regarding dynamic factors, the study found strong positive correlations with deviant sexual lifestyle (0.741) and sexual compulsivity (0.676), and weaker correlations with Interpersonal Aggression (0.505) and attitude towards criminal behavior (0.286). The total static and dynamic factor scores had a significantly positive and strong correlation (0.872), highlighting their importance in predicting recidivism. The AUC analysis indicated good predictive capabilities for recidivism in certain dynamic factors like interpersonal aggression and emotional self-control, while others had lower predictive abilities. Overall, the combined total score of static and dynamic factors yielded higher predictive capabilities (AUC=0.783). This research contributes to the development of an accurate risk assessment tool for sexual violence recidivism, aiding in identifying high-risk offenders and designing effective rehabilitation programs to prevent future recidivism.

Abstract

The implementation of the self-reliance coaching program at the Jakarta Class IIA Narcotics Prison in inmate work activities has the hope that the inmate has the skills and can open business opportunities so as not to repeat the criminal act and reduce the recidivism rate. The purpose of this study is to find out the role of fostering independence in efforts to reduce cases of recidivism. The authors used qualitative research methods in this study. The result of this study is that the development of independence in the Jakarta Class IIA Narcotics Prison has been running optimally so that it has a big role in reducing the rate of recidivist cases. Abstract

Terrorism crimes are an extraordinary crime where treatment and method require special strategic management. Strategic management for treatment the terrorist prisoners is one of the programs of the Directorate General of Correctional Affairs, Ministry of Law and Human Rights of the Republic of Indonesia, namely the management of human resources through the efforts of deradicalization for terrorist prisoners, especially in the Super Maximum Security of Correctional Institution. This research aims to provide strategic management for treatment the terrorist prisoners and the implementation of correctional institution' deradicalization programs for terrorist prisoners. This research was qualitative descriptive research. Data collection techniques using direct observation techniques in Focus Group Discussions, as well as in-depth interviews with the Head of Class 1 Correctional Institution of Batu Nusakambangan and terrorist prisoners as research objects. The results of this research indicate that the strategic management for treatment the terrorist prisoners was not completely relevant to the Regulation of the Minister of Law and Human Rights Number 35 of 2018 and the implementation for treatment the terrorist prisoners in Class 1 Correctional Institution of Batu Nusakambangan are still very limited. There were still constraints to implementing guidelines for special prisoners of terrorist in terms of socializing regulations, human resources, and infrastructure for special treatment for terrorist prisoners.

Abstract

Abstract This research is purposed to determine how corruption occurs and then what steps must be taken to eradicate corruption and also to determine the role of universities in reducing anti-corruption behavior. The research method used in writing this research is a normative legal research method by conducting studies through library research or document studies. The results showed that the ways in which corruption occurred were among others by embezzling the practice of making rules that benefited certain parties, marking up projects, reducing the volume of work both in quality and quantity. Subsequently also the way a person commits a crime of corruption can go through a process that was initially small-scale which continues until the person concerned holds a high position. The steps that must be taken in eradicating corruption are building the rule of law, creating tangible conditions in all regions, the existence of activists, creating anti-corruption education, building moral education as early as possible, providing intensive religious education. While the role of universities in reducing corrupt behavior is to make universities a driving force because higher education institutions have a very strategic position in instilling an anti-corruption mentality. Higher education has the power to fight for the values of honesty. "

Abstract

This study aims to analyze the influence of quality of work life on employee performance at the Class IIA Women's Prison in Bandar Lampung. In this era of digitalization could be increasing the competitive level and demands in organizations, it makes the transformation of human resources is crucial to ensure optimal employee performance and maximum achievement of organizational goals. This study used a descriptive quantitative approach with a cross-sectional survey design. Data were collected from 73 respondents obtained from the Krejcie and Morgan table, while data collection was carried out using simple random sampling techniques. The results of this study are the quality of work life has a positive and significant influence on employee performance at the Class IIA Women's Prison in Bandar Lampung. This study concludes that the quality of work life is an important factor affecting employee performance. Therefore, improving the quality of work life through various initiatives and programs can be an effective strategy to improve employee performance in a competitive and demanding work environment such as the Class IIA Women's Prison in Bandar Lampung. Abstract

This research aims to see the influence of transformational leadership on employee work engagement at the Class IIA Purwokerto Penitentiary. This research method uses quantitative methods with primary data obtained from 88 employees of the Purwokerto Class IIA Community Institution. There are a total of 32 statement items whose answers will then be processed into research results using SPSS. The results of the determination test analysis show that the influence of transformational leadership on employee work engagement is 37.4%. The hypothesis of this research concludes that there is an influence of transformational leadership on employee work engagement at the Class IIA Purwokerto Penitentiary.
